The State Fire Marshal adopted rules establishing a dispute resolution process, which became effective in December 2008. The rules establish a "panel of outside parties" to hear the appeal at the 5th step in the process. The State Fire Marshal Board is looking for volunteers who are willing to serve on dispute resolution panels as the A/E Executive Director. The Deputy Commissioner of Commerce & Insurance thinks panelists will be agents of the state and immune from lawsuits. The outside panel will be composed of 3 people: 1 each selected by the owner, the C&I Commissioner, and the Executive Director of the A/E Board. The A/E Board has requested the help of TSPE and ACEC to identify individuals from each area who would be willing to serve on panels. The A/E Board anticipates having someone from East or Middle TN sit on the panel for a dispute in West TN. Panel members will be paid $150 a day to serve on a panel. If you would like to read the complete rules which became effective in Dec 2008, go to: http://tn.gov/commerce/sfm/documents/rulemakingIFC.pdf Please contact JT Malasri at [email protected] if you would like more information and/or are interested.
