OnJuly30,2003 the City passed ordinances approving a First Amendment to DevelopmentAgreement 96-80nd amending Specific Plan 96-87nd Project Master Plan96-80InlightofthenatureoftheproposedVacationClubresortthatwilloccupythesite,omaketheprojectfinanciallyfeasible, ndbasedupontherequirementsoftheCodeofIndio, the applicant subsequently proposed a Transient Occupancy Tax (TOT)Agreementwiththe Cityofndio. TheAgreementasproposed and approvedinconceptbythisCouncilonJuly30,003providedforasharingoftheTOTrevenuetobegeneratedbytheproject.Exhibit A to this report contains the C i t y 'savorable financial analysis of thisAgreement. The City hereby represents andWorldMarkhereby acknowledges thatthe Code ofndio (the "Code")ets forthWorldMark's bl igationtopayTOTandanyapp l icab lesubsequentu sefeeeviedbyth eCityinplaceorinsteadofheTOT. TheProjectisa "Hotel"ndWorldMarkisanOperator"sdefinedinCodeSection34.6nd thereforesha l lbesubjecttotheCity'sUniformTransientO c c u p a nc y TaxOrdinance.
Wor ldMarkherebyundertakesandacceptsthatTOTpayments totheCityshallbedeterminedbymultiplyingtheRentasdefinedhereinattributabletoeachUnitoccupied duringanygivenreportingperiodbytheTOTratesetforthinh eCode.
