6. RULES & POLICIES

TUITION REFUND POLICY

1. If the institution receives tuition from the student, or a person onbehalf of the student, the institution will refund the student, or theperson who paid on behalf of the student, the tuition that was paid inrelation to the program in which the student is enrolled if:

a. the institution receives a notice of withdrawal from the student nolater than seven days after the effective contract date and beforethe contract start date;

b. the student, or the student’s parent or legal guardian, signs thestudent enrollment contract seven days or less before the contractstart date and the institution receives a notice of withdrawal fromthe student between the date the student, or the student’s parentor legal guardian, signed the student enrollment contract and thecontract start date; or

c. the student does not attend a work experience component and theinstitution does not provide all of the hours of instruction of thework experience component within 30 days of the contract enddate.

2. The institution will refund the tuition for the program and all relatedfees paid by the student or a person on behalf of the student enrolledin the program if the student is enrolled in the program without having met the admission requirements and did not misrepresent his or herknowledge or skills when applying for admission.

3. If a student does not attend any of the first 30% of the hours ofinstruction to be provided during the contract term, the institutionmay retain up to 50% of the tuition paid under the student enrollmentcontract unless the program is provided solely through distanceeducation.

4. Unless the program is provided solely through distance education, ifthe institution receives a notice of withdrawal from a student:

a. more than seven days after the effective contract date and

i. at least 30 days before the contract start date, the institution mayretain up to 10% of the tuition due under the student enrollmentcontract, to a maximum of $1,000;

ii. less than 30 days before the contract start date, the institutionmay retain up to 20% of the tuition due under the studentenrollment contract, to a maximum of $1,300.

b. after the contract start date

i. but before 11% of the hours of instruction to be provided duringthe contract term have been provided, the institution may retainup to 30% of the tuition due under the student enrollmentcontract;

ii. and after 10% but before 30% of the hours of instruction tobe provided during the contract term have been provided, theinstitution may retain up to 50% of the tuition due under thestudent enrollment contract.

5. Unless the program is provided solely through distance education, ifthe institution provides a notice of dismissal to a student and the datethe institution delivers the notice to the student is:

a. before 11% of the hours of instruction to be provided during thecontract term have been provided, the institution may retain up to30% of the tuition due under the student enrolment contract.

b. after 10% but before 30% of the hours of instruction to be providedduring the contract term have been provided, the institution mayretain up to 50% of the tuition due under the student enrolmentcontract.

6. If the institution provides the program solely through distanceeducation and the institution receives a student’s notice of withdrawalor the institution delivers a notice of dismissal to the student and:

a. the student has completed and received an evaluation of his orher performance for up to 30% of the hours of instruction to beprovided during the contract term, the institution may retain up to30% of the tuition due under the student enrolment contract, or

b. the student has completed and received an evaluation of his or herperformance for more than 30% but less than 50% of the program,the institution may retain up to 50% of the tuition due under thestudent enrolment contract.

7. The institution will refund fees charged for course materials paid forbut not received if the student provides a notice of withdrawal tothe institution or the institution provides a notice of dismissal to thestudent.

8. Refunds required under this policy will be paid to the student, or aperson who paid the tuition or fees on behalf of the student, within30 days:

a. of the date the institution receives a student’s notice of withdrawal,

b. of the date the institution provides a notice of dismissal to thestudent

c. of the date that the registrar provides notice to the institution thatthe institution is not complying with section 1(c) or 2 of this policy,or

d. after the first 30% of the hours of instruction if section 3 of thispolicy applies.

9. If an international student delivers a copy of a refusal of a study permitto the institution, sections 1(a), 1(b), 4, 7, and 8 of this policy apply asif the copy of the refusal were a notice of withdrawal, unless:

a. the international student requests an additional letter of acceptancefor the same program that was the subject of the refusal ofa study permit, or the program is provided solely throughdistance education.

To apply for a refund, a student must submit written notice of withdrawal to VanWest College.

REGISTRATION PROCEDURE

1. Please complete all sections and sign the application form.

2. Submit the completed application form and all required documentsby email at [email protected] or drop off in person.

3. A Letter of Acceptance will be issued upon receipt of tuition and otherfees.

4. Fees may be paid by cheque, money order, or wire transfer. Please put“Student’s Name” in the column of “Ordering Client”.

ACCOMMODATION PROCEDURE

Initial Booking• The recommended minimum booking duration for accommodation is 8 weeks unless the study duration is less than 8 weeks.• For minors (18 and under), accommodation must be booked for the entire duration of stay in case that custodianship is offered by VanWest

College.• For minors (18 and under), a guardian/adult companion is required to stay in the residence.

Any Changes in Duration including Extension/Shortening/Cancellation• In any early move-out or extension cases, fees will be refunded with a 4-week advance written notice to responsible student advisors or sales

managers.• In case that an initial accommodation booking duration is 4 weeks and students want to extend their stay after move-in, a written notice must be

submitted to responsible student advisors or sales managers no later than the Wednesday of the first week of their stay.

Cancellation before Move-in Date• If a student cancels residence within 4 weeks of the residence move-in date, he/she will be required to pay 100% of the first month’s residence

fees no matter what the reasons are.• If a student cancels a homestay placement within 4 weeks of the homestay move-in date, he/she will be required to pay 25% of the first month’s

homestay fees no matter what the reasons are.

Payment• Any extension payment must be received 4 weeks prior to the new extension start date.• In case of Kelowna accommodation extension payment, no cash payment is allowed.

MEDICAL INSURANCE

Students are required by law to have medical insurance while staying in British Columbia or traveling in Canada. Students who do not purchase their own medical insurance before leaving their home country must buy insurance on the day they arrive at VanWest College. Students are responsible for all medical costs incurred while they are in Canada. VanWest College is not responsible for any sickness, injury, loss or damage incurred on school premises or on school activities, tours, or in their Homestay.

AMENDMENTS TO THE STUDY PROGRAM AFTER THE START DATE - ESL PROGRAM ONLY

Students may apply for a reduction to their study hours after starting their program. Reductions may only be made from 30 lessons to 25 lessons programs; reductions from 25 lessons to 20 lessons are not permitted. When a change is made, the above refund policy applies.

VACATION & HOLIDAY POLICIES - ESL PROGRAM ONLY

Students may apply for a vacation from their study program. The number of vacation weeks depends on program length. Vacation time will be credited back to the student’s program; however, there will not be any cash refunds for vacation time.

Holidays and school closures are not credited back and students will not get refunds.

HOMESTAY CONTRACT1. If a student books a shorter homestay period than tuition period, and later decides to extend their homestay, an extension fee will apply. If they do not

give a minimum of 4 weeks advance notice of their plan to extend, VanWest cannot guarantee their host family will be available and relocation may be necessary. When their classes at VanWest finish, the student must move out of the homestay. All payment for homestay must be made through student advisors or sales managers. Direct payments to their host family are not allowed.

2. If a student has any questions or problems, or if they need to make a change, they must talk to student advisors or sales managers.

3. If a student wishes to leave their homestay early, they must tell student advisors or sales managers 4 weeks before they leave. If the student does not, they will have to pay for the following month even if they have moved out. Please note that checkout time is no later than 11:00 am on the move-out date.

4. The student will take part in the family’s daily life and should help when possible. The student must follow the house rules, for example, by keeping their room clean, helping to clean up after meals, following smoking rules, and so on. Students must notify their homestay family if they cannot be home for dinner or plan to be out late. Also, when making plans for the evening or weekend, students must tell their homestsay family where they will be and what time they will come home. It is very important to communicate clearly with their host family.

5. If a student breaks or damages any property of the host family, the student must pay for any repair or replacement of that property. VanWest will not be responsible for any lost, damaged or stolen property of the student or host family during the homestay period.

6. If a student cancels their homestay placement within 4 weeks of the homestay move-in date, he/she will be required to pay 25% of the first month’s homestay fees no matter what the reasons are.

7. If a student is caught with drugs at their homestay, they will be charged $500 and will be immediately kicked out of the homestay. In a homestay with no smoking policy, if a student is caught smoking, they will be charged $500 and will be immediately kicked out of the homestay.

STUDENT RESIDENCE CONTRACT1. Rooms are assigned based on availability for both new bookings and extensions. VanWest College reserves the right, without notice, to assign or

change roommates, to change accommodation assignments and/or to consolidate vacancies by requiring a student or other residents to move from one room to another. This may include requiring a student to move to a different residence area, floor, building or type of room. If this happens, the student is required to pay the residence fees stipulated for the new room.

2. $500 damage/security deposit will be held by VanWest College. It is fully refundable if there has been no damage caused by the student. Pre-authorization for the credit card for the damage deposit must be collected when submitting this form.

a. The refund of any portion of the deposit is conditioned as follows:

i. The student shall perform all obligations in this contract and the Residence Handbook whether the student takes occupancy or not;

ii. The student shall occupy the premises for the above agreed term;

iii. The student shall clean the unit and return it to VanWest College in its original move-in condition, allowing for reasonable wear and tear, upon the termination of this contract;

iv. The student shall return all keys to VanWest College.

3. If written cancellation is received 4 weeks prior to the move-in date, a full refund will be applied except the administration fee. If a student cancels residence within 4 weeks of the residence move-in date, they will be required to pay 100% of the first month’s residence fees no matter what the reasons are. If a student wants to cancel after moving in, a written cancellation must be received 4 weeks prior to the desired move-out date. A full refund of the room fee for the remaining period will be refunded.

4. Extension is possible depending on room availability but the same room is not guaranteed.

5. VanWest College may terminate this contract and cancel the right of occupancy if a student withdraws from the study program at VanWest College or violates the rules and regulations of this contract and Residence Handbook.

6. VanWest College is not responsible for property belonging to students or any of their guests which may be lost, stolen or damaged in any way, regardless of the cause, whether or not this may occur in their accommodation or on the residence property, including the storage facilities. VanWest College is not responsible for any injury, death, damage or loss whatsoever caused to students or their guests while in their room, common areas, the entire residence property, or while engaged in activities organized or sponsored by VanWest College.

7. If a student is caught smoking and/or with drugs at the residence, they will be charged $500 and will be immediately kicked out of the residence.

8. All residents of student accommodation must adhere to Residence Handbook.
