Demry motioned to approve bills. Seconded by Smith. All voted aye. Mark McGill spoke to the heard about the issues he sees with the City of Centerville's
extraterritorial zoning. He asked the board to vote at looking into county zoning this area‘ Waits stated
if county residents want it zoned he would like a petition stating so. Demry and Smith both stated they will take it into consideration. Members of the public also spoke about lack of representation if zoned
by the city. John Replogle from Superior Cable explained the security system they quoted for the County
Attorney’s Office. Demry motioned to proceed with Superior Cable installing the security system on the 3'“ Floor. Seconded by Smith. All voted aye.
Smith motioned to approve the liquor licenses for Honey Creek Resort State Park & Elliott’s
General Store. Seconded by Demry. All voted aye‘
Demry motioned to approve a Fireworks Permit for the Appanuose County Fair Board and hold
on the Viking Pyrotechnics application. Seconded by Smith. All voted aye.
Demry motioned to approve the Revised FY20 DOT Budget 81 Construction Program. Seconded

Demry motioned to approve amending the contract end date of the Interim County Engineer

County Engineer of Appanoose County, Iowa, be and is hereby designated, authorized, and empowered
on behalf of the Board of Supervisors of said County to execute the certification of completion of work and final acceptance thereof in accordance with plans and specifications in connection with all Farm-to-
Market and federal or state aid construction projects in this county effective April 22, 2019.

RESOLUTION NO 201940 WHEREAS, a request has been made wim the Appanoose County Board of Supervisors asking that action be taken to reclassify a section oppanoose County Secondary Roads from a Level A to a Level C,
described as follows: That portion of 455‘" Street which is currently classified as a Level A, beginning at the
intersection of 125‘“ Avenue heading west approximately 0.5 miles to where the public road ends. This
road is located in the west half of Section 33, 170M, R19W of Independence Township.
NOW THEREFORE BE IT RESOLVED that a hearing on the proposed reclassification will be held in the Board Room, Appanoose County Courthouse, 201 N 12‘", Centerville, IA 52544 at 9:20 AM on Monday,
May 20‘", 2019 in accordance with Iowa Code Chapter 306.

Brad Skinner, updated the board on Secondary Roads projects. HighwayJST east of Unionville
will require major patching. Sundown & Rathbun Lakes requested new signs. An agreement with Rathbun Lake needs to be updated. A third of FM rock has been hauled, The fuel pumps and possibly
the tanks will need replaced. They received 20 applications for the 3 openings that were listed in the
paper. Upcoming discussion/approval items: box culvert on 160‘” St, Right-ofway parcels, and DOT
paving approach proposal on 540‘" east of Highway 5.
Stephanie Koch, CD5 Coordinator, the next Governing Board meeting is the 14‘" here in the Boardroom 1:00 PM, She will be traveling to see how a peer run support house operates. The
children’s mental health bill was passed and signed by the governor. It requires the regions to develop a
plan by April.
Public comments: Waits spoke about the unfunded mandate to provide children’s mental health as well as the 2% cap placed on counties and cities propeny tax. Commercial property tax will be
backfilled through 2020. Bruce Buttel questioned which party controls the state government and stated people should not say nothing will change due to election turnover‘ Nichole Moore talked about the county starting to work on their comprehensive plan starting 7/1/19. The Board has cards detailing the meeting dates. Rusty Kirkland asked if the board has heard if (he ambulance is making any money yet. The board has not heard. There was further discussion on what is included in a comprehensive plan and
zoning.
Demry motioned to adjourn. Seconded by Smith. All voted aye.
The Board adjourned to meet at the call ofthe Auditor at 9:55 AM.

This Agreement, is entered into by and between the Iowa Department of Transportation, hereinafter designated the “DOT". and Appanaose County, Iowa, a Local Public Agency, hereafter designated the "LPA" in accordance with Iowa Code Chapters 28E, 306, 306A and 3134 as applicable:
The DOT proposes to establish or make improvements to Iowa 5 within Appanoose County, Iowa; and
The DOT and the LPA are willing to jointly participate in said project, in the manner hereinafter provided; and
This Agreement reflects the current concept of this project which is subject to modification by mutual agreement between the LPA and the DOT; and
Therefore, it is agreed as follows:

Project lnlormation
The DOT will design, let, and inspect construction of the following described project in accordance with me project plans and DOT standard specifications:
Hot Mix Asphalt (HMA) resurfacing with milling on Iowa 5 from County Road J4GIJ45 north to the north corporate limits of Centerviuev
Upon completion of construction, the LPA agrees to accept ownership and jurisdlcfion of the following referenced improvements. The LPA shall also assume responsibility for all future maintenance operations associated therewith. all at no additional expense or obligation to ma DOT:
Paved fi||els will be constructed at the following locations (see Exhibit A):
(a) County Road J45 (East side of Iowa 5)
Nine inch thick by 50 feet long paving of granular secondary road approaches beyond the 10 feet from the edge of the primary road pavement shall be 100% LPA cost based on the esfima‘ed quantities as shown on Exhibit B.
Project Costs
The LPA shall reimburse the DOT for its share of the project costs estimated at $16,900, as shown in Exhibit B. The amount paid by the LPA upon completion of construction and proper billing by the DOT will be determined by the actual quantities in place and the accepted bid at the contract letting.
The DOT will bear all costs except those allocated to the LPA under other terms of this Agreement.

Traffic Control
Iowa 5 through-traffic will be maintained during the construction.
If i becomes necessary to temporarily close LPA side roads during construction, the DOT will furnish and install the required barricades and signing for the closure at project cost and shall remove same upon completion of the project also at no expense or obligation to the LPA. The DOT will work in close cooperation with the LPA and the contractor to accommodate emergency services and local access across the project during construction. Any detours which may be necessary for project related LPA road closures will be the responsibility of the LPA all at no expense or obligation to the DOT.
If this project causes the temporary closure of a road during construction, the DOT shall meet with the LPA to determine whether said closure(s) will cause increased traffic on other LPA roads. The DOT and the LPA shall determine a plan. and the costs thereof, for the LPA to perform dust control on said LPA roads with increased traffic, should dust control become necessary. In that event. the LPA shall inform the DOT prior to pefiorming said dust control, The DOT shall reimburse the LPA for the cost of said dust control measures following the receipt of a bill for the agreed upon ooscs (see Iowa Code section 313.4 subsection 1b.).

The DOT will be responsible for the coordination of utility facility adjustments for the primary road project.
Construction 8. Maintenance
Upon completion of the project, no changes in the physical features thereof will be undertaken or permitted without the prior written approval of the DOT.
Future maintenance of the primary highway within the project area will be carried out ‘n accordance with the terms and conditions contained in Instructional Memorandum 1110.
General Provisions
1f the LPA has completed a Flood Insurance Study (FIS) for an area which is affeded by me proposed Primary Highway project and the FIS is modified. amended or revised in an area affected by the project after the date of this Agreement. the LPA shall promptly provide notice le modlfication, amendment or revision to the DOT‘ If the LPA does not have a deiailed Flood Insurance Study (FIS) foran area which is affected by the proposed Primary Highway project and me LPA does adopt an FIS in an area affected by the project after the date of this Agreement. the LPA shall promptly provide notice of the FIS to the DOT,

RESOLUTION FOR REDUCED LEVEL OF MAINTENANCE TO AREA SERVICE “C" ROAD
Appanoose County Resolution No. 2019-11
WHEREAS, Appanoose County desires to classify certain roads on the area service system in the County to provide for a minimal level of maintenance and access by means of a gate or barrier; and
WHEREAS, the County, after consultation with the County Engineer, has the authority to specify certain roads within the County as Area Service "C" roads pursuant to Iowa Code Section 309.57; and
WHEREAS, the only persons who \M'll have access rights to the roads shall be:

the owner, lessee. or person in lawful possession of any adjoining land, The agent or employee of the owner, lessee or person in lawful possession of any adjoining land. any peace officer, any magistrate. any public employee whose duty it is to supervise the use or perform maintenance of the road. any agent or employee of any utility located upon the road.
WHEREAS, the minimal level of maintenance will be as follows:

Blading. Blading or dragging will not be performed on a regular basis.
Snow and Ice Removal. Snow and ice will not be removed, nor will the road surface be sanded or salted on a regular basis.
Signing. Except for load limit posting for bridges, signing shall not be continued or provided. ALL AREA SERVICE LEVEL C ROADS SHALL BE IDENTIFIED WITH A SIGN AT ALL POINTS OF ACCESS TO WARN THE PUBLIC OF THE LOWER LEVEL OF MAINTENANCE.
Weeds Brush and Trees. Mowing or spraying weeds. cutting brush and tree removal will not be performed on a regular basis. Adequate sight distances will not be maintained.
Structures. Bridges and culverts may not be maintained to carry legal loads. Upon failure or loss, the replacement structure will be appropriate for the traffic thereon.
Road Surfacing. There will be no surfacing materials applied to Area Service Sys'tem C Roads on a regular basis.
