Under the pl'ovi ions of sub-sect'on (3) of Section 7 of the Multi State Co-operative Societies Act, 2002

hereas the Chief Promoter of Om Mekar Agro MuJti tate Co-operative Soci ty Limited, Ramesh Vaise Pati ,203/E, N'rupam Housing Society, No.OI, A urdi, Pune-411 035 (Maharashtra) had submitted a proposal for registration of the proposed society under the Multi

tate Cooperative Societies Act, 2002 (MSCS Act, 2002).

Whereas the following deficiencies were found in the application submitted by the Society:

1. Bank Certificate has not been enclosed with the appl ication. 2. In the membership Jist, the signatures appears to be signed by one person in many places. 3. The project report is not satisfactory. In the first year itself, it is proposed to generate profit

whj ich is highly impossible particu larly for agro societies. It appears that the same has been prepared not based on facts.

Whereas under the provisions of Section 7(3) of the MSCS Act, 2002 the Chief Promoter 29thvide notice of even number dated the April, 2015 was given an opportunity of personal

hearing on 30th April, 2015 to contest the deficiencies.

Authorised representative appeared for hearing. Deficiencies were explained to him. Since the existing proposal is having deficiencies as mentioned in the notice dt. 29.04.2015 the proposed Society in the name of Om Mekar Agro Multi State Co-operative Society Limited, Ramesh Vaise Patil, 203/E, Nirupam Housing Society, No.OI, Akurdi, Pune-411 035 (Maharashtra) does not meet the requirements of the provisions of the Multi State Co-operative Societies Act, 2002 and rules made thereunder and therefore cannot be considered for registration.

Accordingly, the proposal is. returned herewith in original. However, the society is. at liberty to submit a fresh proposal and the same shall be considered as per the provisions of MSCS Act. 2002 and MSCS Rules, 2002 made thereunder.

Whereas the Chief Promoter of Future Credit Multi-State Co-operative Society Ltd., H. No. 133, Mahavir Vihar, Kanjhawala, New Delhi-110 081 had submi\1ed a proposal foI'l' 'gisll'ation of the proposed s ciety under the Multi State Cooperative Socic\ics Act, 2002 (MSC Act 2002).

Whereas the following deficiencies were found in the application submitted by the Society:

1.Viability report has not been enclosed with the application.

2. Section 7 Certificates have not been enclosed with the application. 3. The area of operation is different in Form I and bye-law. The society has proposed its area of

operation in four states i.e. Uttar Pradesh, Bihar, Delhi & Rajasthan in form I and in bye-law it is mentioend as U,P., Bihar, Delhi & Jharkhand. As per Circular dated 26.3.2014, it has been decided that henceforth, the primary multi state cooperative societies shall be registered initially with only two contiguous states/UTs as area of operation.

4. Object no, (iii) relates to housing 5 Bye-laws are not numbered properly. 6. Point (c) of objects and functions relates to federal cooperative. 7. Bye-law no. 20{i) is vague. 8. Blank space has been left in many placess in bye-laws. Bye-laws enclosed with the proposal are

copies of model bye-laws. Necessary changes as per the features/objects of the proposed society are not incorporated in the bye-laws.

9. Members' lists are unsigned and not in prescribed format. 10. Following documents have been made mandatory for the proposed credit societies to submit

along with their proposal of registration:­A. No objection Certificate from the Registrar of Cooperative Societies of the States/U.T.

where the area of operation of the society extends. B. A certificate to the effect that the credential of the ~hief Promoter/Promoters members have

been verified by the Registrar of Cooperative Societies of the concemed States.

A he above documents are not available hence this is also being pointed out as a deficien cy.

Whereas under the provisions of Section 7(3) of the MSCS Act, 2002 the Chief Promoter vide notice of even number dated the 24th April, 2015 was given an oppol1unity of personal hearing on 30th

April, 2015 to contest the deficiencies.

Chief Promoter appeared for hearing. Since the eXlstlllg proposal is having deficiencies as mentioned in the I otice dt.24.04.20 15 and the same was not contested, the proposed Society in the name of Future Credit Multi-State Co-operative Society ltd., H. No. 133, Mahavir Vihar, Kanjhawala, New Delhi­110 081 does not meet the requirements of the provisions of the Multi State Co-operative Societies Act, 2002 and rules made thereunder and therefore cannot be considered for registration.

hereas the following deficiencies were found in the application submitted by the Society:

1. As per circular dated 26.3.2014, it has becn decided that henceforth, the primary multi state cooperative societies shall be registered initially with only two contiguous states/Uts as area of operation. Since Assam, Orissa and West Bengal are not contiguous states, this cannot be considered for registration.

2. The name of the society is misleading; it gives an impression as if it is an alJ India level society.

3. Soci ty has submitted photo copy of the Bank Certiflcate. 4. Scheme of viabil ity does not outline the fact that how the society will become a viable unit. 5. Provision of notice to defaulters has not been incorporated in bye-laws. 6. Bye-law no. 20(iii) relates to credit for which following documents have been

mandatory for the proposed credit societies to submit along with their proposal of registration : ­

A. No Objection Certificate from the Registrar of Cooperative Societies of the States/ .T. where the area of operation of the society extends.

B. A certificate to the effect that the credentials of the Chief Promoter/Promoters members have been verified by the Registrar of Cooperative Societies of the concerned States.

7. Bye-law no. 23 is not consistent with Rule 13 of the MSCS Act, 2002. 8. Bye-law no. 26(d) is vague. 9. Composition of Board is not depicted in bye-law no. 28(a). ] O. "ome of the important provisions ,like prohibition to hold office of President/Vice

Whereas under the provisions of Section 7(3) of the MSCS Act, 2002 the Chief Promoter vide notice of even number dated the 241h April, 2015 was given an opportunity of personal hearing on 30th April, 2015 to contest the deficiencies.

Whereas none appeared for hearing. Since the existing proposal is having deficiencies as mentioned in the notice dt.24.04.201 5 and the same was not contested, the proposed Society in the name of Hindustan Toursim Development Cooperative Society Ltd., 29 Sonkuchi, Bye Lane

Whereas under the provisions of Section 7(3) of the MSCS Act, 2002 the Chief Promoter vide notice fen number dated the 24th March, 2015 was given an opportunity for personal hearing on 31 st

March, 2015 to contest the deficiencies.

Whereas Chief Promoter appeared for hearing. He requested CRCS to give 30 days' time to submit the rectified documents/proposal. His plea was accepted. However rectified documents have not been submitted within the time period granted at the time of hearing. Since the existing proposal is having deficiencies as mentioned in the notice dt.24.03.20J 5 and the same was not contested, the proposed Society in the name of Apex Cooperative Credit Society Ltd., 1794, Sector-16-17, Hissar, Pin­125001 (liaryana) does not meet the requirements of the provisions of the Multi State Co-operative Societie Act, 2002 and rules made thereunder and therefore cannot be considered for registration.

Accordingly, the proposal is returned herewith in original. However, the society is at liberty to submit a fresh proposal and the same shall be considered as per the provisions of MSCS Act, 2002 and MSCS Rules, 2002 made ther under.

Subsequently, the Chief Promoter submitted the same in writing vide his letter dated 5th March, 2015.

Whereas this Office has received the fax dated 24-04-2015 whereby the Chief Promoter has requested that the time be extended till the end of May, 2015,

Whereas this Office had passed an order dated 25 th March, 2015' directing the society to submit the required documents by 27 th April, 2015 forenoon but the society has not submitted the required documents by the prescribed date, In view of the above, the application of the society cannot be considered for registration.

B. A certificate to the effect that the credentials of the Chief Promoter/Promoters members have been verified by the Registrar of Cooperative Societies of the concerned States.

6. In addition to the above deficiencies, the society has also submitted the documents relating to appointment of etmning Officer and nomination details for elections. This documents and the election process is required to

be initiated after registration not prior to it.

Whereas under the provisions of Section 7(3) of the MSCS Act, 2002 the Chief Promoter vide notice of 9U1even number dated the April, 2015 was given an opportunity of personal hearing on 27th April, 2015 to

contest the deficiencies.

Chief Promoter appeared for hearing. Since tbe existing proposal is baving deficiencies as mentioned in the notice dt.09.04.20 15 and the same was not contested, the proposed Society in the name of SJAL Agro Multi State Cooperative Society Ltd., #163-F, JMJ Arul Building, 2nd floor, Kalappaikaran Street, Balaji Nagar, Salcm-636016, Tamil Nadu does not meet the requirements of the provisions of the Multi State Co-operative Societies Act, 2002 and rules made tbereunder and therefore cannot be considered for registration.

Accordingly, the proposal is returned herewith in original. However, the society is at liberty to submit a fresh proposal and the same shall be considered as per the provisions of MSCS Act, 2002 and MSCS Rules, 2002 made thereunder.
