1. Introduction This report is a document produced by Cornwall Council’s Natural Resources Team. It relates to a site visit to monitor compliance with a planning permission and legal agreement for a minerals / waste site under relevant requirements of the Planning and Compulsory Purchase Act 2004. 1 Disclaimer It should be noted that apparent compliance with any condition at the time of a site monitoring visit by this Authority does not preclude the Authority from instigating enforcement action where any activity being undertaken is subsequently considered to be in breach of a condition or presents a risk of damage or disturbance to the environment or amenity. Any additional site monitoring visit required as a result of non-compliance with a planning condition may result in an additional site monitoring fee being levied. Traffic Lights For ease of reference the Authority has adopted a ‘traffic light’ system to illustrate the level of compliance with each requisite planning condition. The colour coding is based on the following criteria;

Green development was considered to be compliant with the relevant planning condition at the time of the site monitoring visit although some minor works may be required.

Amber development was not considered to be compliant with the condition at the time of the site monitoring visit and/or there are outstanding matters which remain to be resolved at this time by the Operator or this Authority. Any continued non-compliance or breach of this condition may result in the instigation of enforcement action.

Red development was not considered to be compliant with the condition at the time of the site monitoring visit. Furthermore it is considered that there is an urgent need to remedy this breach due to the potential risk and/or consequences to the environment or amenity. It is therefore concluded that steps should be undertaken without further delay to remedy this breach. Appropriate enforcement action is likely to be expedient should non-compliance with this condition continue.

3. Compliance with Planning Conditions NR/96/00015/MIN - PA91/IDO2 (K38/IDO) Determination of conditions – Approved on 21/01/1997 (as amended by Appeal M23/2/28 dated 23/11/1999).

Condition Number and Description Condition 1. Commencement

Extraction of minerals shall cease by 21st February 2042. Unless further planning permission has been granted for a continuation of the operations beyond this period, all the operations and uses hereby approved shall be discontinued on or before this date, all plant machinery and buildings no longer required shall be removed from site, and the land shall be reinstated in accordance with the further conditions below. Notes Following Visit This condition identifies that this permission will expire on 21st February 2042. Notwithstanding this however it is subject to a fifteen year periodic review under Section 96 of the Environment Act 1995. The next review is due following a fifteen year period from the Secretary of State’s Appeal M23/2/28 dated 23/11/1999, being by the 23rd November 2014.

Condition Number and Description Condition 2. Extent of Permission

(i) There shall be no stone extraction except within the area outlined in red on Drawing No. CQL 9601/TRE/002. (ii) Except as may otherwise be agreed with the MPA, surface tipping of overburden/quarry waste shall be confined to the portion of Area 3 hatched purple on the above-mentioned plan, in accordance with the provisions of condition no. 15.

(iii) There shall be no further tipping in Areas 1 and 2 as indicated on Drawing No. CQL 9601/TRE/002 nor any disturbance to the area hatched brown on Drawing No. TRE/001/96. Notes Following Visit (i) There are no mineral activities at the site and this has been the case for some time. From the 2005 aerial photograph on the front page of this report any previous extraction appears to have been retained within the area outlined red on drawing no CQL 9601/TRE/002. (ii) There are no mineral activities at the site and for this reason there are no tipping within Area 3.

(iii) There has been no further tipping in Areas 1 and 2 and the area hatched brown on drawing no. TRE/001/96 remains undisturbed.

Condition Number and Description Condition 3. Extent of Permission

The site shall not be worked below the 18 metre level AOD without the written permission of the MPA. There shall be no dewatering within the quarry until the Operators submit to and have approved by the MPA, in consultation with the Environment Agency, a scheme which provides for the protection of adjacent water interests. Notes Following Visit There are no mineral activities at the site at this time ands the quarry void remains flooded. For this reason it was not possible to determine the current depth of the void. Should the Operator wish to recommence developments then they should be aware that the quarry cannot be worked below the 18 metre level above ordnance datum without written consent from the Mineral Planning Authority. The condition also specifies that a scheme will need to be submitted prior to dewatering at the site. Condition Number and Description Condition 4. Development in Accordance with the Submitted Plans

No development shall be carried out other than in strict accordance with the submitted plans Drawing Nos. CQL 9601/TRE/002, TRE/001/96, and CQL 9601/TRE003, unless otherwise agreed with the MPA. Condition Number and Description Condition 5. Access and Highway Matters

Access to and from the site shall be obtained from the existing access point as shown on Drawing No. TRE/001/96. No other access shall be used by traffic entering or leaving the site. Notes Following Visit Access to and from the quarry is via the existing access point as shown on drawing no. TRE/001/96, although as developments have not been reactivated the access has been blocked off with boulders to prevent unauthorised vehicular access. There are no other accesses to the site.

Condition Number and Description Condition 6. Access and Highway Matters

No further development for the winning and working of minerals shall take place until a detailed scheme has been submitted to and approved in writing by the MPA specifying what measures the Operators shall employ to prevent the transfer of mud, dust, stones and other deleterious materials onto the public highway. This includes, where necessary the provision of wheel cleaning facilities the details of which shall be agreed with the MPA. The approved scheme shall be implemented and complied with at all times. Notes Following Visit The Operator should be aware that prior to the recommencement of the winning and working of minerals a scheme will need to be submitted to and then approved by the Mineral Planning Authority. The scheme will need to specify measures to prevent mud, dust, stones and other deleterious materials transferring to the public highway.

Condition Number and Description Condition 7. Access and Highway Matters

The site access shall be constructed and maintained in accordance with details to be agreed with the MPA in consultation with the Highways Authority. Such details shall include splays, sight lines and the surfacing of the access road to an appropriate standard, using concrete or bitmac.

Notes Following Visit Numerous conditions under this permission require schemes to be submitted and implemented prior to the recommencement of working at the site. As such it is considered that this condition should be interpreted in the same way. The Operator has therefore been informed that details of site access construction and maintenance (i.e. splays, sight lines, surfacing etc.) will need to be submitted to and agreed in writing by the MPA prior to the commencement of winning and working at the quarry.

Condition Number and Description Condition 8. Access and Highway Matters

All loaded lorries leaving the site shall be sheeted unless otherwise agreed in writing with the MPA.

Notes Following Visit No loaded lorries are anticipated to be leaving the site. However the Operator should be aware that should operations recommence then all loaded lorries leaving the site must be sheeted.

Condition Number and Description Condition 9. Hour of Operation

Except for routine plant maintenance and water pumping or as may otherwise be agreed in writing by the MPA, no quarry operations authorised or required under this permission shall be carried out except between the following times:- between 7.00 am and 7.00 pm Mondays to Fridays; and between 7.00 am and 1.00 pm on Saturdays Within these limits, blasting shall only take place between 09.00 am and 5.00 pm, Mondays to Fridays and between 10.00 am and noon on Saturdays. There shall be no quarrying operations on Sundays, Bank Holidays or National Holidays.

Notes Following Visit There are no mineral activities at the site and this has been the case for some time. On this basis this condition is considered non applicable at this time. However the Operator should be aware of the approved working hours for this area and that they differ slightly from the other extant permission (2/15/91/00040/F).

Condition Number and Description Condition 10. Noise and Dust (General)

All practicable means shall be employed by the Operators for preventing or minimising the emission of dust, smoke or fumes and the creation of noise and vibration and air over-pressure during the approved use of the site. The word practicable and the phrase practicable means in these conditions shall have the meaning assigned to them in Section 79(9) of the Environmental Protection Act 1990 as defined overleaf. The provisions of this condition include the installation and the maintenance of effective silencers on all plant and machinery, and these shall be maintained in accordance with the manufactures specifications at all times. Notes Following Visit There are no mineral activities at the site and this has been the case for some time. On this basis this condition is considered non applicable at this time. Should mineral operations recommence then the Operator should be aware of the requirements to minimise dust, smoke, fumes, noise and vibration by all practicable means.

Condition Number and Description Condition 11. Need for Prior Approval of a Detailed Noise Scheme

No further development for the winning and working of minerals shall take place until a detailed scheme has been submitted to and approved in writing by the MPA specifying: (a) the maximum permissible noise levels at the site boundaries or such locations as may be

approved by the MPA (including separate limits and maximum periods of operation in relation to soil stripping, formation of perimeter bunds/mounds and other temporary operations);

(b) noise monitoring and recording procedures to demonstrate compliance with conditions (c) noise suppression measures; (d) procedures to be adopted in the event of the maximum permitted noise levels being

exceeded. The approved scheme shall be implemented and complied with at all times.

Notes Following Visit The Operator is advised that a noise scheme would be required and will need to be submitted and approved prior to the commencement of winning and working at the site.

Condition Number and Description Condition 12. Need for Prior Approval of Detailed Dust Suppression Scheme

No further development for the winning and working of minerals shall take place until a detailed scheme has been submitted to and approved in writing by the MPA for the suppression of dust. The scheme shall include inter alia:- (a) the suppression of dust caused by the moving and storage of soil and overburden, stone

and other materials within the site: (b) the fitting of drilling rigs with efficient dust control measures; (c) dust suppression on haul roads; and (d) the provision of dust collection and storage facilities. (e) dust monitoring and recording procedures to demonstrate compliance with the conditions The approved scheme shall be implemented and complied with at all times.

Notes Following Visit The Operator is advised that a scheme for dust suppression will need to be submitted and approved prior to the commencement of winning and working at the site.

Condition Number and Description Condition 13. Plant and Machinery

Details of all plant and machinery (excluding quarry vehicles) to be sited and buildings to be erected shall be agreed in writing with the MPA prior to installation. Details shall include design, siting, dimensions, cladding/enclosure, noise and dust suppression measures. Notes Following Visit The site inspection revealed no plant, machinery or further buildings has been erected the site. The Operator should be aware that details would need to be approved by the Minerals Planning Authority prior to any installation.

Condition Number and Description Condition 14. Plant and Machinery

All lights and floodlights shall be screened so as not to cause a nuisance or annoyance to any occupied dwelling in the vicinity of the site. Notes Following Visit No lighting was identified during the visit.

Condition Number and Description Condition 15. Stockpiling of Materials/ Tipping of Quarry Waste

All stockpiling shall be confined to quarried areas of the site. Within 6 months from the day on which, in accordance with Section 22(2) 1991 Act, these conditions are finally determined, or such longer period as may be agreed in writing with the MPA, the Operators shall have submitted to and had approved by the MPA, a final contour plan for Area 3, as well as details of surface treatments/planting, and work shall be carried out in accordance with the approved scheme.

Notes Following Visit This condition was varied in writing by the Minerals Planning Authority as letter dated 16th July 2002. The Operator should note that a final contour plan for Area 3 as well as details of surface treatments/planting will need to be submitted to the Mineral Planning Authority prior to recommencement of winning and working operations at the quarry.

Condition Number and Description Condition 16. Blasting

Ground vibration from blasting shall not exceed a peak particle velocity of 8.5 mm per second at or near the foundations of any vibration sensitive building or residential premises in the vicinity of the site. The measurement to be the maximum of there mutually perpendicular directions taken at the ground surface. Unless otherwise agreed in writing with the MPA, the Operator shall self monitor all blasts, in accordance with a programme to be agreed in writing with the MPA, and release to the MPA all reading measured on request. There shall be no secondary blasting (or the use of non- explosive gas expanding rock breaking), except with the written agreement of the MPA].

Notes Following Visit There are no mineral activities at the site and this has been the case for some time. On this basis this condition is considered non applicable at this time. However should the Operator recommence blasting then they would need to submit a blast monitoring scheme to the Mineral Planning Authority for approval. This could be submitted in conjunction with the blasting scheme required in Condition 6 of permission 2/15/91/00040/F.

Condition Number and Description Condition 17. Drainage Matters

Any fuel, oil, lubricant and other potential pollutants shall be handled on the site in such a manner as to prevent pollution of any watercourse. For any liquid other than water this shall include storage in suitable tanks and containers which shall be housed in an area surrounded by bund walls of sufficient height and construction so as to contain 110% of the total contents of all containers and associated pipework. The floor and walls of the bunded area shall be impervious to both water and oil. Any pipes shall vent downwards within the enclosure formed by the bund. Notes Following Visit A visual inspection confirmed that there was no storage of potential pollutants on site.

Condition Number and Description Condition 18. Drainage Matters

All quarry washings and run-off from stripped or disturbed areas and quarry tracks shall be contained in settlement lagoons before discharge to any watercourses to remove solids. The design and location of any such lagoons shall be in accordance with details to be agreed in writing with the MPA in consultation with the Environment Agency and English Nature. Notes Following Visit The Operator should be aware of the necessity for appropriate measures to remove silt and/or other suspended material prior to discharge to a watercourse. Details of such measures would need to be agreed in writing by the Mineral Planning Authority.

Condition Number and Description Condition 19. Restoration of Vegetation

The existing trees, bushes and associated vegetation within the area hatched green on the approved plan Drawing No. CQL 9601/TRE/002 shall be retained and shall not be felled, lopped, topped or removed without the prior written consent of the MPA. There shall be no tipping or alternation of existing contours within 5 metres of any existing trees within the green-hatched area unless otherwise agreed. Any such vegetation removed without consent, dying, being severely damaged or becoming seriously diseased, shall, in planting season immediately following any such occurrences be replaced with trees or bushes of such size and species as may be specified by the MPA.

Notes Following Visit There has been no felling, lopping, topping or removal of trees, bushes and associated vegetation within the area hatched green on drawing no. CQL 9601/TRE/002. There is no evidence of tipping of alteration of contours within 5 metres of existing trees. No complaints have been received.

Condition Number and Description Condition 20. Restoration

There shall be no importation of waste to the site without the granting of further planning permission Notes Following Visit There is no evidence of waste having been imported on site. The stopping up of the entrance would further limit this action by preventing trespassing.

Condition Number and Description Condition 21. Restoration

Unless otherwise agreed in writing by the MPA, details of a site restoration scheme shall be submitted to and approved by the MPA within 6 months of the day on which, in accordance with Section 22(2) of the Planning and Compensation Act 1991, the permission has effect. The restoration of the site shall be carried out in accordance with the approved scheme. Notes Following Visit The requirements of this condition were varied by the Minerals Planning Authority as letter dated 16th July 2002. The variation now provides for the restoration scheme to be submitted within 6 months of the date of reactivation of the quarry. This scheme could also include provisions for the restoration requirements in Condition 11 of permission 2/15/91/00040/F.

Condition Number and Description Condition 22. Cessation

In the event of a cessation of winning and working of minerals prior to the completion of the approved working scheme, which in the opinion of the MPA constitutes a permanent cessation within the terms of paragraph 3 of Schedule 9 of the Town and Country Planning Act 1990, a revised scheme, to include details of reclamation and aftercare, shall be submitted in writing for approval to the MPA, within 12 months of the cessation of winning and working. The approved revised scheme shall be fully implemented within 2 years of the written approval unless otherwise agreed in writing with the MPA.

Notes Following Visit Records indicate that the quarry has not been worked since this permission was approved and as such the working scheme has not commenced.

Condition Number and Description Condition 23. Submission of Aftercare Schemes

Unless otherwise agreed in writing with the MPA:- (i) Within 6 months from the day on which, in accordance with Section 22(2) 1991 Act, these conditions are finally determined, or such longer period as may be agreed in writing with the MPA, aftercare schemes requiring such steps as may be necessary to bring the land to the agreed standard shall be submitted for written approval by the MPA, in consultation with English Nature. (ii) The submitted scheme shall specify the steps to be taken and the periods during which they are to be taken. Such steps shall be carried out for a maximum period of 5 years following the completion of the quarrying operations.

Notes Following Visit The requirements of this condition were varied by the Minerals Planning Authority as letter dated 16th July 2002. The variation now provides for the restoration scheme to be submitted within 6 months of the date of reactivation of the quarry. This scheme could also include provisions for the restoration requirements in Condition 11 of permission 2/15/91/00040/F.

3. Compliance with Planning Conditions

NR/90/00009/MIN -2/15/91/00040/F Amendment to quarry boundary to incorporate existing workings – Approved on 15/03/1991

Condition Number and Description Condition 1. Time Limit

This permission shall not be valid after 22nd February 2042. Unless further planning permission has been granted for a continuation of the operations beyond this period, all the operations and uses hereby approved shall be discontinued on or before this date, all plant, machinery and temporary buildings removed and the land reinstated in accordance with the further conditions below.

Notes Following Visit This condition identifies that this permission will expire on 22nd February 2042. Notwithstanding this however it is subject to a fifteen year periodic review under Section 96 of the Environment Act 1995. The next review should coincide with the review of the most substantive permission PA91/IDO2 (K38/IDO) Approved on 21 January 1997 as amended by Appeal M23/2/28 dated 23/11/1999, the next review being due by 23rd November 2014.

All operations and uses authorised by this permission shall be limited to the area shown outlined in red on the approved plan no. 981/00040/F/1 attached hereto. Notes Following Visit This permission provides for an amendment to the western boundary. The site hasn’t been worked for some time and the site visit and the 2005 aerial photograph indicate that developments were retained within the approved red line boundary shown on plan no. 981/00040/F/1.

Condition Number and Description Condition 3. Amenity Protection

The provisions of this condition include the installation of and maintenance of effective silencers on all plant and machinery. Notes Following Visit There are no mineral activities at the site and this has been the case for some time. On this basis this condition is considered non applicable at this time. Should mineral operations recommence then the Operator should be aware of the requirements to minimise dust, smoke, fumes, noise and vibration by all practicable means.

Condition Number and Description Condition 4. Working Hours of Operations

No operations authorised or required under this permission shall be carried out on the site except between the following times: between 8.00am and 6.00pm Mondays to Fridays between 8.00am and 1.00pm on Saturdays There shall be no working on Sundays, Bank Holidays or National Holidays. Notes Following Visit There are no mineral activities at the site and this has been the case for some time. On this basis this condition is considered non applicable at this time. However the Operator should be aware of the approved working hours for this area and that they differ slightly from the other extant permission (PA91/IDO2 (K38/IDO)).

Condition Number and Description Condition 5. Development Restrictions

Notwithstanding the provisions of the Town and Country Planning General Development Order, no plant, machinery or buildings shall be erected on the site without the prior written agreement of the Mineral Planning Authority (MPA). Notes Following Visit No further plant, machinery or buildings have been erected on site.

Condition Number and Description Condition 6. Blasting

No blasting shall take place on the site except in accordance with details to be agreed with the MPA to minimise ground and air vibrations. Notes Following Visit The Operator is advised that prior to any blasting recommencing on site a scheme will need to be submitted to and then approved by the Mineral Planning Authority. This scheme will need to be in accordance with Condition 16 of permission PA91/IDO2 (K38/IDO).

Condition Number and Description Condition 7. Water Matters

Prior to quarry dewatering or excavation below the water table a scheme shall be agreed with the County Planning Authority (CPA) in consultation with the NRA in order to protect adjacent groundwater supplies. Notes Following Visit The Operator is advised that prior to any dewatering or excavation below the water table a scheme will need to be submitted to and then approved by the Mineral Planning Authority. The scheme could be combined to cover Condition 3 of permission PA91/IDO2 (K38/IDO).

Condition Number and Description Condition 8. Stockpiling

There shall be no further extension of the quarry face at ground level, no stockpiling of rock or materials and no tipping of overburden or water on the application site, except those works necessary in accordance with the landscaping conditions 9 and 10. Notes Following Visit From a visual inspection of the site and aerial photograph it would appear that the face hasn’t been extended at ground level and no further stockpiling or tipping of rock, materials and overburden has taken place.

Condition Number and Description Condition 9. Landscaping

Within 6 months of the date of this permission the landscaping scheme indicated on the submitted drawings Plan no. 91/00040/F/2 and Section Sheet No. 91/00040/3, shall have been completed. This scheme shall be amended to ensure that the screen bund along the western boundary of the site achieves a height of 2 metres above the adjacent undisturbed natural ground level along its full length and this bund shall be continuous in order to link the northern and southern areas or overburden storage i.e. to run from A-B as shown on Plan no. 91/00040/F/2.

Notes Following Visit The site inspection confirms that a continuous bund, approximately 2 metres in height, has been achieved between the northern and southern areas of overburden storage indicated A-B on plan no. 91/00040/F/2.

Condition Number and Description Condition 10. Conservations

Within 3 months from the date of this permission a scheme shall be submitted to and agreed in writing by the MPA in consultation with the Nature Conservancy Council in connection with the treatment of the final surfaces of the landscaped feature to ensure a sympathetic vegetation cover.

Notes Following Visit This condition required the submission of a scheme to ensure the final surfaces of the landscaped feature had a sympathetic vegetation cover. There is no record of the submission of the scheme on file but the site inspection revealed that over a decade of dormancy has led to natural re-vegetation of features. At this stage no further action is required but should activities recommence at the sit then this condition will need to be re-addressed in order to protect the established re-growth. It is not considered expedient to enforce this non-compliance.

Condition Number and Description Condition 11. Cessation

On completion of all operations connected with the winning and working of minerals from the quarry a restoration scheme for the treatment of the site including all excavated areas, final quarry faces, quarry floors and waste dumps shall be agreed with the MPA to provide for an afteruse for amenity purposes. Such a scheme shall include details for the afteruse and maintenance of landscaping of a period of five years. Notes Following Visit As letter dated 16th July 2002 the Mineral Planning Authority agreed a variation to the submission of the restoration and aftercare schemes required in conditions 21 and 23 of the other extant permission PA91/IDO2 (K38/IDO). These conditions originally required the submission of the schemes within six months of the date of the decision notice but the Mineral Planning Authority agreed this could be varied so that the schemes could be submitted for approval within six months of the date of reactivation of Trevassack Quarry. It would seem reasonable that the same time frame was applied to this condition so that a combined scheme for the whole site would be submitted.

11. Summary Trevassack Quarry is located to the north west of Goonhilly Earth Station on the lizard peninsula. It is governed by the conditions in decision notice 2/15/91/00040/F dated 15th March 1991 and Decision Notice PA91/IDO2 (K38/IDO) dated 21st January 1997 (as amended by Appeal M23/2/28 dated 23/11/1999).

The quarry is believed to have remained dormant for almost 20 years, and in that time the main excavation has become flooded and nature has been left to re-vegetate the majority of the site. In order for the site to become operable again a number of schemes would need to be submitted to and approved by the Minerals Planning Authority.

As well as the requirement of schemes, the quarry is subject to a number of conditions. These have been discussed with the Operator, and they have been informed that as part of the Interim Development Order process, Trevassack Quarry’s permission is subject to a periodic review. The next review is due by 23rd November 2014.
