Unbelievably, summer is almost over and we are nearing the most important election possibly in the history of our nation. Regardless of what happens in the election and where your political heart lies, the next year will be perhaps the most important for the mortgage industry for the remainder of our careers. Why? We still have well over 100 regulations that will be drafted by the CFPB that will speak directly to mortgage banking issues. We are starting to see the details and proposals on these over the past few weeks and this will continue on right thru the January, 2013 — deadline established by Dodd-Frank. On behalf of the Texas Mortgage Bankers Association, the executive committee has been taking a very proactive stance on helping shape these regulations so as to minimize the unintended consequences to the industry. We have commented formally on the Qualified Mortgage (QM), Qualified Residential Mortgage Risk Retention (QRM), Servicing Standards and Servicing Compensation. We are in the process of preparing comments on the proposed TILA changes and Loan Officer Compensation. While not every regulation will impact all of us directly (i.e. the new servicing standards), each will impact all of us indirectly in some way. As a result, we must remain diligent about two things; 1) raising PAC funds to continue to impact the process as our next legislative session in Austin is starting to heat up. As I said back in May at the convention in San Antonio, just because we are having a good year in 2012, now is not the time for us to get complacent. Complacency in the face of this regulatory change would be disastrous in my opinion. While I’m certainly pleased that our member companies are both busy and profitable (perhaps more than many expected to be), we need to continue to focus on the developments in Austin and the regulatory developments in Washington; 2) staying involved and continuing the dialogue with our elected officials. They want to hear from you and understand how these regulations will impact your business and their constituents. Now, more than ever before, we need to do this on a consistent basis at both the state and national level. Having said this, I am optimistic about the future of our industry and our association. We are the strongest state association in the country in terms of both financial stability and membership. Let’s continue to build on this strength and help move the industry and the country in the right direction. I will be seeing many of you as I will travel around the state starting in September. I’d appreciate your thoughts and feedback on these issues or anything else the TMBA can improve upon. McFarlandFannie Mae, Executive Vice President and Chief Financial OfficerSusan is responsible for financial management across the enterprise, including financial reporting and accounting, and for ensuring the highest standards of financial integrity. She also plays a leading role in managing Fannie Mae’s relationships with government and regulatory entities, analysts, and banks. Ms. McFarland has more than 25 years of experience in consumer and retail financial services.

Michael YoungMortgage Bankers Association, ChairmanMichael W. Young, is also the Chairman of the Board of Cenlar FSB. An active MBA member for more than four decades, Young is a former member of MBA Board of Directors and currently sits on MBA’s Council on Ensuring Mortgage Liquidity, a task force of MBA members created to examine policy options and issue recommendations for the future of the secondary mortgage market.

Jim CarleyCFPB Chief ExaminerCarley joined the Bureau as Southeast Regional Director in October 2011 to lead supervision of bank and non-bank financial services firms across fifteen jurisdictions. Jim came to the Bureau from the Federal Housing Finance Agency, where he served as the Senior Associate Director for Examinations in the Division of FHLBank Regulation.

Lawrence Platt K&L Gates, Practice Area LeaderMr. Platt is one of the two Practice Area Leaders of the Financial Services Practice of K&L Gates and sits on the firm’s Management Committee. K&L Gates maintains one of the most prominent financial services practices in the United States, representing diversified financial services institutions and their affiliated service providers. Mr. Platt was named one of Washington’s Ten most Influential People on lending issues by Lending Intelligence Magazine.

Jared Woodfill and Geoff BergFOX NEWS Mr. Woodfill is Chairman of the Harris County Republican Party, having been re-elected five consecutive terms. He also served as vice-chairman for Senate District 17’s District Convention. He has been highlighted in numerous periodicals, radio, and television shows.

Geoff Berg is a partner at Berg & Androphy as a Civil Trial attorney and a former partner at Dow, Golub, Berg and Beverly LLP. Geoff is also a Talk Show Host at KPFT 90.1 FM covering the Houston metropolitan area featuring progressive talk. He was named a Texas Super Lawyer by Texas Monthly Magazine every year since 2004. Only 5% of Texas Lawyers earn this distinction.
