Signed: HIROHITO, Seal of the Emperor This thirtieth day of the fourth month of the twenty-sixth year of Showa (April 30, 1951) Prime Minister YOSHIDA Shigeru Cabinet Order No. 128 Cabinet Order for Exemption from Import Duty on Important Machinery In accordance with the provisions of paragraph 6 of the Supplementary Provisions of the Law for Partial Amendments to the Customs Tariff Law (Law No. 110 of 1951), the Cabinet estab- lishes this Cabinet Order. (Designation of Machines on Which Duty May be Exempted) Article 1. The machines, on which import duty may be exempted in accordance with the pro- visions of paragraph 6 of the Supplementary Provisions of the Law for Partial Amendments to the Customs Tariff Law shall be those com- plete with requirements mentioned in the re- spective items of the said paragraph and falling under one of the following items: (1) Articles (including those constituting im- portant parts of such articles) which are for use in one of the industries as enumerated in the left column of Annexed Table A of this Cabinet Order and are enumerated in the right column under respective items com- mon with the industries on the left side; (2) Articles which may be designated by the Minister of Finance, from among those as are enumerated in Annexed Table B of this Cabinet Order (including those constituting important parts of such articles) and are fo,r use in one of the following industries: Mining industry; Metal refining and processing industry; Machines manufacturing industry (includ- ing machines repairing industry) ; Electric appliances and apparatuses manu- facturing industry (including electric ap- pliances and apparatuses repairing in- dustry) ; Ship-building industry (including ship-re- pairing industry) ; Vehicles manufacturing industry (including vehicles repairing industry) ; Chemical industry; Rubber industry; Ceramic industry; Textile industry; Paper industry; Pulp industry; Milling industry; Dairy industry; Rail road transportation industry. (Import Procedure for Machines on Which Duty May be Exempted) Article 2. Any person, who intends to obtain the exemption from import duty on the article as provided for in the preceding Article, shall, when he files with the custom house the import declaration on such article, submit to the su- perintendent of customs a written application in duplicate setting forth therein the manu- facturer, place of manufacture, name, type, capacity, kind of the use, quantity, and value of such article, the kind of the enterprise for which such article, the kind of the enterprise for which such article is intended, the purpose and place of the employment, and the reason why such article is of a new type or of ahigh capacity and difficult to be manufactured in Japan, as well as stating whether or not the exemption from import duty has previously been obtained in accordance with the provisions of the preceding Article on those articles which are of the same kind as or of a similar kind to such article; in this case, if there is any article of the same or a similar kind, on which the exemption from import duty has previously been obtained, the written application shall be accompaniedwith a copy of theimport permit for such article. 2 The import declaration under the preceding paragraph, shall be executed in the name of the person who uses the article stated in such dec- laration. Duty on Important MachineryIn accordance with the provisions of paragraph

6 of the Supplementary Provisions of the Lawfor Partial Amendments to the Customs TariffLaw (Law No. 110 of 1951), the Cabinet estab-lishes this Cabinet Order.

(Designation of Machines on Which Duty Maybe Exempted)

Article 1. The machines, on which import dutymay be exempted in accordance with the pro-visions of paragraph 6 of the SupplementaryProvisions of the Law for Partial Amendmentsto the Customs Tariff Law shall be those com-plete with requirements mentioned in the re-spective items of the said paragraph and fallingunder one of the following items:(1) Articles (including those constituting im-

portant parts of such articles) which are foruse in one of the industries as enumeratedin the left column of Annexed Table A ofthis Cabinet Order and are enumerated inthe right column under respective items com-mon with the industries on the left side;

(2) Articles which may be designated by theMinister of Finance, from among those asare enumerated in Annexed Table B of thisCabinet Order (including those constitutingimportant parts of such articles) and are fo,ruse in one of the following industries:

Mining industry;Metal refining and processing industry;Machines manufacturing industry (includ-

ing machines repairing industry) ;Electric appliances and apparatuses manu-

facturing industry (including electric ap-pliances and apparatuses repairing in-dustry) ;

Ship-building industry (including ship-re-pairing industry) ;

Vehicles manufacturing industry (includingvehicles repairing industry) ;

Chemical industry;Rubber industry;Ceramic industry;Textile industry;Paper industry;Pulp industry;Milling industry;Dairy industry;Rail road transportation industry.

(Import Procedure for Machines on WhichDuty May be Exempted)

Article 2. Any person, who intends to obtain theexemption from import duty on the article asprovided for in the preceding Article, shall,when he files with the custom house the importdeclaration on such article, submit to the su-perintendent of customs a written application induplicate setting forth therein the manu-facturer, place of manufacture, name, type,capacity, kind of the use, quantity, and valueof such article, the kind of the enterprise forwhich such article, the kind of the enterprisefor which such article is intended, the purposeand place of the employment, and the reasonwhy such article is of a new type or of ahighcapacity and difficult to be manufactured inJapan, as well as stating whether or not theexemption from import duty has previouslybeen obtained in accordance with the provisionsof the preceding Article on those articles whichare of the same kind as or of a similar kindto such article; in this case, if there is anyarticle of the same or a similar kind, on whichthe exemption from import duty has previouslybeen obtained, the written application shall beaccompaniedwith a copy of theimport permitfor such article.

for which such article has been exempted fromimport duty, or to change the place of employ-ment of such article, he shall notify the super-intendent of customs, having jurisdiction overthe place of importation of such article, to thateffect.(Matters to be Recorded in the Book concern-

ing Duty-exempt Machines)Article 4. Any person who has obtained the ex-

emption from duty on the article as providedfor in Article 1, shall keep a book for each
