    Short recital of the ease

    The Goa Dock Labour Union (hereinafter called the Union) representing the Workmen of Barge Repair Workshop at Corrtalim, Vlide their letter No. 512/VMJSVWS/72 dated l1.:2tth Au-gust, 1972, along with the enclosure demanded from the Management certain benefits, such as, Additional/VaTiable Dearness allowance, Medical Benefits, Washing Allowance, shoes, etc. for the workmen employed at the above workshop.

    The Management contended that as the workmen were (' already covered by a Memorandum of Settlement signed between the Management and the workmen on 16th March, 1971, expressed their tuability to concede to any of the above demands. The Management further stated that the

    position can only be reviewed after the expiry of the said settlement. The Union repeatedly approached the Mana-gement for their reconsideration in the light of similar set-tlement signed with M/s. V. S. Dempo & Co. Pvt. Ltd., Barge Repair Workshop at Vaddem. To this, the Manage-ment contended that there is no comparison between the two establishments as they are already paying to their workmen higher wages than those existing in the workshop of M/s. V. S. Dempo and other comparable workshops. As the. parties failed to reach a settlement, the workmen went on strike with effect from 14th November, 1972. After the strike, the matter was admitted in conCiliation and after series of discussions before the Labour Commissioner the parties adjourned again for mutual discussion on 14th De-cembel', 1972. On 15th December, 1972 the parties again met and finally agreed to the folloWling:-

    Terms of Sef;t!emen,t

    1. The workmen agreed to resume duty forth i. e. from the general shift on 21st December, 1972.

    2. It is agreed further between the Management and the Union that the parties would sign a separate settle-ment for referring the above dispute for the arbi-' tration under Section lOA of the Industrial Disputes Act, 1947. This arbitration agreement will also be signed simultaneously with this Memorandum of agreement and the parties agree to forward the copies of the same for registration and further action.

    3. The Management agree to withdraw the termination letters issued, if any, to those workmoo who have completed more than 6 months service without a break of not more than 10 days.

    4. In case the agreed arbitrator, Advocate Shri Pandu-rong Mulgaocar declines to be an arbitrator to this dispute, the parties shall choose by mutual agreement any person from the arbitration panel maintained by the Government of Goa, Daman and Diu (Arbitra-tion Council). In the case of disagreement between the parties in the selection of an arbitrator, one from such panel shall be chosen by lots.

    5. The Management agree to advance an amount equi-valent to 1~ month's wages (gross wages) to each workman who were on the rolls of the Company on the previous day of the strike 1. e. on 13th November, 1972 and who did not report for worl{ with effect from 13th November, 1972. It is agreed between the parties that the said advance shall be deducted and/or adjusted against the benefits, if any, arising out of the said arbitration award, in full and/or recovered from their wages in Six equal monthly instalments within six months from the date on which the arbitration award referred to in Clause (4) above comes into force.

    6. The casual and temporay workmen who put in more than 90 days continuous service and/or were on the rolls of the Management on 13th November, 1972 and who did not report for work wUth effect from 13th· November, 1972, shall .also be paid an advance equivalent to 15 days wages. The said advance shall be recoverable either from the benefits, if any arising out of the said arbitration award and/or legal dues payable to them.

    7. It is agreed by the Management that the period of absence during stI'li'ke, i. e. from 13th November, 1972 to 15th December, 1972 shaH be treated as on leave provided that the workmen have to their credit earned leave/privilege leave to that extent. In case the workmen have no earned/privilege leave or no sufficient earned/privilege leave to their credit such absence shall be treated as leave without pay.
