Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.

As of 2014/10/14, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.

Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located.

As of 2014/10/14, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.

As of 2014/10/14, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.

I do not hold and have not held and my employer TERRAPROBE INC.does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessmentor risk assessment upon which this record of site condition is based

The following document presents the Updated Phase Two Conceptual Site Model for the property

The Phase I ESA report covered the current Phase Two Property (Part 25) as well as the surrounding

Bridgepoint Lands. A summary of the report is provided below.

The Phase One Property was partially developed at the time of the 2008 investigation. Part 25 was occupied by two small buildings occupied by medical offices/charities associated with the Bridgepoint Health Hospital. The other parcels of land included in the investigation were occupied by the Bridgepoint Health building, the Old Don Jail, and the New Don Jail.

No fuel storage tanks, waste disposal sites, or other similar items of potential environmental concern were identified directly on Part 25. A possible UST (vent pipes) was noted at the east side of the Don Jail building, about 50 m north of the current Phase One Property.

Golder Associates noted that other subsurface investigations had been conducted at the Property by Pinchin Environmental Limited. The results of those older investigations indicated that fill was present at Part 25. Samples of the fill were reported to contain elevated levels of arsenic, barium, lead and zinc, but no exceedances of the applicable MOE limits were found at that time. No other evidence of potential environmental impact (i.e. staining, odours, etc.) to the soil was noted.

Various fuel spill occurrences were recorded by the MOE at the Old Don Jail Building (550 Gerrard Street East; just north of the Phase One Property).

A number of properties surrounding the Bridgepoint/Don Jail lands were occupied by tenants which included dry cleaning operations, garages, gasoline service stations, and machine shops.

A Phase II Environmental Site Assessment (ESA) was recommended.

In this report, Part 25 was designated as “Parcel 4A”. The other Parcels (P1 to P3) studied are now designated as Parts 6, 9, 19, 21 and 27 on the current survey plan for the Bridgepoint lands.

Fourteen (14) exploratory boreholes were drilled across the entire study area, with four monitoring wells installed upon completion of drilling. Three boreholes were drilled directly in Part 25. One ground water monitoring well was installed in Part 25.

At every borehole, a zone of earth fill was encountered (from 0.2 m to 2.7 m below ground level). The fill was described as “sand to sandy silt, trace clay, occasional gravel, traces of brick’. No odours or staining were identified in the soil samples obtained during drilling.

Native sandy silt soil was encountered beneath the fill. Bedrock was not encountered during drilling. Ground water was not observed in the boreholes during drilling.

Soil samples were analysed for metals, VOCs, and PAHs. The report indicated that all parameters tested were below the MOE Standards at that time. It is noted that all of the soil samples also meet the current (2011) MOE Table 3 Standards.

Groundwater samples were obtained from the monitoring wells installed in each Part. The report indicated no groundwater exceedances were encountered for the parameters (VOCs, metals and PAHs) for which samples were analysed. It is noted that the ground water sample results also meet the current (2011) MOE Table 3 Standards.

The ground water flow direction was determined to be from the northeast to the southwest.

A Phase One Environmental Site Assessment was recently completed for the Phase Two Property by

Terraprobe. The Phase One ESA included this Phase Two Property plus two other land parcels at the

Bridgepoint Health site. The Phase One ESA findings are presented in a report entitled “Phase One

Environmental Site Assessment, Parts 25, 26 and 27, Plan 66R-24227, Part of Lot 15, Concession 1 FTB,

City of Toronto, Ontario”, issued March 24, 2014 (Updated February 19, 2015).

The PCA locations are provided on Figure 1.

During the completion of previous subsurface investigations at the site by Golder Associates, the ground

water flow direction was determined to be from the northeast towards the southwest. For this reason, the

PCAs which were located downgradient (south) of Part 25 (PCAs 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 29

and 36) were not carried forward as APECs.

The Phase One ESA identified the following Areas of Potential Environmental Concern (APEC) on the

Phase Two Property:

APEC 1 is a result of the fuel storage tanks, historical waste generators and historical spill which were located to the north and northeast of the Phase One Property. The APEC includes PCAs 2 to 4, PCA 8, PCA 38, and PCA 47, and includes the entire Phase One Property. The Contaminants of Concern (CoCs) for this APEC are PHCs, VOCs and BTEX. The media potentially impacted are soil and ground water.

APEC 2 is a result of the fill materials (PCA 1) located on the Property based on previous investigations. The APEC includes the entire Property. The Contaminants of Concern (CoCs) are metals, select inorganics and PAHs. The media potentially impacted are soil and ground water.

Based on the findings of the Phase One ESA, a Phase Two ESA was recommended.

2.3 Subsurface Structures and Utilities

Underground utilities are not present on the Property, but they are located along Jack Layton Way to the

north. Based upon this, it is possible that any potentially contaminated ground water could migrate

horizontally along the utilities onto or off the Property.

The site is covered by earth and grass. As such, infiltration of storm water from the ground surface would

occur when a precipitation event occurs. This could cause the downward migration of possible

contaminates.

3.0 PHYSICAL SETTING OF THE PHASE TWO PROPERTY

3.1 Site Stratigraphy

Pavement Structure

The ground surface of the Phase Two Property was covered with grass and topsoil.

Earth Fill

All of the boreholes encountered a surficial layer of earth fill, which had a thickness of 0.3 to 1.5 metres.

The fill consisted of silty sand or sandy silt with some gravel. No visual or olfactory evidence of potential

environmental impact to the fill was noted.

Native Soil

A layer of native soils consisting of silt, trace sand extending to the maximum depth of investigation (5.2

mbgs) was encountered at all borehole locations. Refer to enclosed borehole logs for stratigraphy details.

Bedrock

Bedrock was not encountered during this investigation.

3.2 Approximate Depth to Water Table

Ground water elevations are presented on the following table. Based upon the ground water elevations,

there appears to be one aquifer present on the property. The aquifer is an unconfined aquifer in the native

soil. The ground water flow direction in the aquifer is relatively flat and flowing in a northerly direction.

3.3 Site Hydrogeological Characteristics

According to Freeze and Cherry (1979), the typical hydraulic conductivity of the strata investigated at the

Property are:

Earth Fill (Silty Sand) 10-4 m/s to 10-6 m/s

Native Soil (Silt, trace sand) 10-7 m/s to 10-9 m/s

Bedrock (Georgian Bay Formation) 10-4 m/s to 10-8 m/s

The horizontal hydraulic gradient is calculated using the following equation:

i = Δh/Δs

Where,

i = horizontal hydraulic gradient;

Δh (m) = ground water elevation difference; and,

Δs (m) = separation distance.

Based on the available information, horizontal hydraulic gradient of shallow ground water flow is

estimated at 0.02 in a southerly direction.

It is noted that vertical hydraulic gradients were not evaluated for the Property as a second water bearing

unit was not encountered at the depths investigated at the Property.

Contaminants of Potential Concern were not present at concentrations above the applicable site condition

standards in the aquifer investigated.

3.4 Approximate Depth to Bedrock

The depth to bedrock was inferred from Ontario Geological Survey mapping completed in the area. The

mapping indicated that the bedrock is of the Georgian Bay Formation, and should be encountered at an

elevation of about 70 masl.

3.5 Section 41 or 43.1

Section 41 of the regulation (Environmentally Sensitive Areas) does not apply to the Phase Two Property.

Section 43.1 of the regulation (shallow soil property or water body) does not apply to the Property.

3.6 Soils Placed On, In or Under the Phase Two Property

No soils have been imported or placed on, in or under the Phase Two Property since the Phase One ESA

was completed in 2014.

The site will be redeveloped as a public park for the City of Toronto. No new buildings are to be

constructed.

4.0 CONTAMINATION IN OR UNDER THE PHASE TWO PROPERTY

4.1 Applicable Site Condition Standard

The applicable soil and ground water Standards for the Property were determined to be those in Table 3 of

the April 15, 2011 Ontario Ministry of Environment (MOE) “Soil, Ground Water and Sediment

Standards for use under part XV.1 of the Environmental Protection Act” for

Residential/Institutional/Parkland property use in a non-potable ground water condition for coarse

textured soil (Table 3 RPI Standards).

These are considered to be the applicable Standards for the following reasons:

The Property is to be conveyed to the City of Toronto for redevelopment as a public park.

Soil at the Property was assumed to be coarse-textured for the purposes of this work.

The Property is not within 30 m of a surface water body, or adjacent to any natural areas.

Bedrock across the Property is found at depths of greater than 2 m.

The Property is located in an area of the City of Toronto that is serviced by municipal piped water. The City of Toronto derives its potable water from Lake Ontario.

The soil pH was between 6-9 for surficial soils, and between 5-11 for subsurface soils.

4.2 Media Investigated

Based upon the Potentially Contaminating Activities (PCAs) identified in the Phase One ESA for the

Property, it was decided that investigation was required for:

4.4 Areas Where Contaminants are Present

The Phase Two ESA used the Table 3 RPI Standards for the soil and ground water as found in the “Soil,

Ground Water and Sediment Standards for Use Under Part XV.1 of the Environmental Protection Act”

(April 2011).

APEC-1 Off-site: Properties occupied by fuel storage tanks, etc.

Soil samples from Boreholes 1, 2 and 3 found no exceedances of the MOE Table 3 Standards for

the Contaminants of Potential Concern (PHC + BTEX and VOCs).

No exceedances were found in the ground water samples collected from Monitoring Wells MW1,

MW2 and MW3.

It is concluded based on the soil and ground water sampling that there are no Contaminants of Potential

Concern present about the Table 3 Standards in this APEC.

APEC-2 On-Site: Imported Fill Soils Located Across Property.

The fill soil sample from BH1 found one exceedance of the MOE Table 3 Standards for lead. No

exceedances of the Table 3 Standards were found in the other fill soil samples from the site.

No exceedances of the MOE Table 3 Standards were found in the native soil or the ground water.

After the above-noted exceedance was found, approximately 4.5 cubic meters of fill soil was

excavated and removed from the Property in the vicinity of the exceedance. Confirmatory soil

samples were obtained after the soil was removed and were submitted for laboratory analysis. No

exceedances of the MOE Table 3 Standards were found in the confirmatory samples.

It is concluded based upon the soil sampling conducted as part of the current investigation that (after the

soil removal activities) there are now no Contaminants of Potential Concern above the MOE Table 3

Standards at this APEC location, but formerly one contaminant was present (lead).

4.5 Contaminants Associated with Each Area

The Phase Two ESA used the Table 3 RPI Standards for the soil and ground water as found in the “Soil,

Ground Water and Sediment Standards for Use Under Part XV.1 of the Environmental Protection Act”

(April 2011).

Contaminants of Concern were not identified in the ground water above the applicable criteria during the

investigation.

No Contaminants of Potential Concern were identified in the native soil above the applicable Site

Condition Standards.

One contaminant (lead) was identified in the fill soil at APEC #2 during the Phase Two ESA

investigation. The fill soil at that location extended to a maximum depth of 0.3 m below the existing

ground surface. The fill soil at the exceedance location was excavated and removed. Confirmation soil

samples were obtained after the soil was removed and were submitted for laboratory analysis. No

exceedances of the MOE Standards were found in the confirmatory samples.

4.6 Medium in Which Contaminants are Associated

Earth fill, native soils and ground water were investigated as part of the Phase Two ESA. No

Contaminants of Concern were identified above the applicable Site Condition Standards in the native soil

or the ground water during the investigation.

One contaminant was found in the near-surface fill soils. The fill soils were therefore a medium with

which contaminants were associated. The fill soil with the exceedance was subsequently removed from

the Property.

4.7 Information Known about Each Contaminated Area

One Contaminant of Potential Concern was identified in the fill soil at APEC #2, specifically at the

location of Borehole #1. The fill was likely placed at the Property during site development activities. The

fill soil was removed and subsequent soil sampling confirmed that the contaminants are no longer present.

No Contaminants of Potential Concern were identified in the native soil or the ground water in this

APEC.

No other contaminated areas were identified on the Property.

4.8 Distribution of Contaminant

The lead exceedance was found in the fill soil at Borehole #1, at a depth of about 0.3 mbgl. At Borehole

1, the fill soil extended to a depth of about 0.3 m. During remediation, the soil at this location was

excavated to a depth of about 0.5 m and removed from the Property.

4.9 Reasons for Discharge of Contaminant

The contaminant that was found at the Property was identified in the fill which was likely associated

with historical site development activities.

4.10 Migration of Contaminant

It is not expected that the identified contaminant (lead) would migrate.

4.11 Climatic or Meteorological Influences on Migration

The Property was covered by a soft cap (grass). Climatic or meteorological influence on migration of

potential contamination on the Property could occur. Since no Contaminants of Potential Concern are

currently present in the soil and ground water, there is no possibility of future migration of contaminants.

4.12 Soil Vapour Intrusion into Buildings

No Contaminants of Potential Concern were identified in the soil and ground water upon completion of

the investigation, with the exception of the previously identified metals exceedance in the fill soil. Metal

parameters are not contaminants which migrate by soil vapour intrusion. As such there is no possibility

for soil vapour intrusion of contaminants into future buildings.

4.13 Relevant Construction Features of Buildings

No volatile Contaminants of Concern have been identified on the Property. Therefore, it is not expected

that building construction features would affect the distribution and transport of Contaminants of

Concern.

4.14 Building HVAC

No volatile Contaminants of Concern have been identified on the Property. Therefore, it is not expected

that any building HVAC systems would affect the distribution and transport of Contaminants of Concern.

4.15 Subsurface Structures and Utilities

Underground utilities are not present on the Property, but are located in the roadway located directly to

the north. Based upon this, it is possible that any potentially contaminated ground water could migrate

horizontally along the utilities onto or off the Property.

5.0 POTENTIAL EXPOSURE PATHWAYS AND RECEPTORS

5.1 Description of All Components

Following is the list of all risk based components of the potential exposure pathways and receptors. These

components are used in this section as well as the graphical representation of the pathways and receptors

presented on Figure 8.

Please note Figure 8 is a graphical representation of potential pathways and receptors and does not have a

scale or orientation which can be related to the Phase Two Property.

GW1 – Ground water for drinking water purposes

GW2 – Ground water for protection from movement to indoor air

GW3 – Ground water for protection of aquatic life

S1 – Soil for protection of a residential receptor from direct contact with surface soil

S2 – Soil for protection from direct soil contact for a lower frequency and intensity exposure than

residential surface soil, such as commercial or industrial scenarios

S3 – Soil for direct soil contact for a low-frequency, high-intensity, human health exposure scenario
