A. Background

The Code of Conduct on the Safety and Security of Radioactive Sources1 (hereinafter referred to as the “Code”) was endorsed by the International Atomic Energy Agency (IAEA) General Conference in resolution GC(47)/RES/7.B. Since then, 127 States have made policy statements regarding their implementation of the Code in line with resolutions GC(47)/RES/7.B and GC(48)/RES/10.D.2 The

supplementary Guidance on the Import and Export of Radioactive Sources3 (hereinafter referred to as the “Guidance”) was initially endorsed by the General Conference in resolution GC(48)/RES/10.D. It was revised and endorsed by the General Conference in resolution GC(55)/RES/9. To date, 98 States have notified the Director General of their intention to act, as appropriate, in a harmonized manner in accordance with the Guidance. Moreover, 132 States have nominated a Point of Contact to facilitate the exchange of information on the import and export of radioactive sources.

In September 2006, the IAEA Board of Governors endorsed a proposal for a process for the sharing of information on States’ implementation of the Code and its associated Guidance, as set out in Annex 2 to IAEA document GOV/2006/40-GC(50)/3.4 In its resolution GC(50)/RES/10, the General Conference also recognized the value of information exchange on national approaches to controlling radioactive sources and took note of the Board’s endorsement of the proposal. In its resolutions GC(58)/RES/10 and GC(59)/RES/9, the General Conference requested the Secretariat to continue to foster information exchange on implementation of the Code and its associated Guidance.

It is in the above-mentioned context that the Secretariat is organizing this open-ended meeting of technical and legal experts from States.

B. Objectives

The main objective of the meeting is to promote a wide exchange of information on national implementation of the Code and the Guidance.

Noting the non-binding nature of the Code and the Guidance, and the voluntary nature of the process, such an exchange of information will:

(a) Assist States in their national implementation of the Code and Guidance, by enabling them to learn from the experiences of others and to evaluate their own progress on implementation of the Code and Guidance;

(b) Increase the knowledge of States concerning the capability of other States to manage Category 1 and 2 sources in a manner consistent with the provisions of the Code in order to facilitate the application of the import and export provisions of the Code and of the Guidance;

(c) Enhance the IAEA Secretariat’s awareness of the implementation of the Code and Guidance, which will assist the Secretariat in the planning of the IAEA’s activities under its Regular Budget and technical cooperation programmes; and

(d) Invite and encourage more States to implement (and make a political commitment to) the Code and Guidance.

C. Target Audience

The meeting is primarily intended for legal and technical experts from States involved in the safe and secure management of radioactive sources, and in the national implementation of the Code and the Guidance. States are invited to nominate one or two participants for this meeting. Member States are strongly encouraged to identify suitable women participants.

Participants wishing to present national papers to share their experiences are encouraged to provide these to the Secretariat four weeks in advance of the meeting to facilitate their circulation. Unless participants indicate otherwise, the papers will be made available to other nominated participants in advance of the meeting. Participants who do not wish to submit papers in advance, but still wish to give a presentation at the meeting, are kindly requested to notify the Secretariat of their intention to do so in advance. Participants may choose to discuss any relevant issues in their papers, including but not limited to the range of topics addressed in Annex 2 to IAEA document GOV/2006/40-GC(50)/3 (link provided in footnote 4 above).

A draft document entitled Guidelines Regarding National Papers on the Implementation of the Code of Conduct on the Safety and Security of Radioactive Sources and Its Associated Guidance on the Import and Export of Radioactive Sources is being circulated to Member States for their consideration through a separate note verbale. These draft guidelines will be discussed during the open-ended meeting.

D. Working Language

The meeting will be held in English.

E. Application Procedure

Nominations should be submitted using the attached Nomination Form. Completed forms should be endorsed by the competent national authority (e.g. Ministry of Foreign Affairs, Permanent Mission to the IAEA, or National Regulatory Body), and returned through the established official channels. They must be received by the IAEA not later than 15 February 2016. Nominations received after that date or applications sent directly by individuals or by private institutions cannot be considered.

Prospective participants intending to submit a national paper, to give a presentation and/or to apply for funding should indicate this at the same time as they submit their nomination.

Nominating governments will be informed in due course of the names of the selected candidates.

F. Expenditure

The IAEA has limited funds at its disposal to help meet the cost of attendance of certain participants. Such assistance may be offered upon specific request to one or two participants per country provided

that, in the IAEA’s view, the participant(s) on whose behalf assistance is requested will make an important contribution to the meeting, including through the submission of a national paper and a presentation. The application for financial support should be made at the time of nominating the participant(s).

G. Visas

Participants who require a visa to enter Austria should submit the necessary application to the nearest diplomatic or consular representative of Austria at least four weeks before they travel to Austria. Since Austria is a Schengen State, persons requiring a visa will have to apply for a Schengen visa. In States where Austria has no diplomatic mission visas can be obtained from the consular authority of a Schengen Partner State representing Austria in the country in question.

H. Local Arrangements

The meeting will be held at the IAEA’s Headquarters in Vienna, Austria, specifically in Room B/M1 of the M Building at the Vienna International Centre (VIC), and will start at 9.30 a.m. on Monday, 30 May 2016, and end in the afternoon of Friday, 3 June 2016.

Participants are kindly requested to be at Checkpoint 1/Gate 1 of the VIC at least an hour before the meeting starts to allow adequate time for photo badges to be issued. Participants should bring some form of personal identification, such as a national passport, in order to identify themselves to the security officers at Checkpoint 1/Gate 1.

IAEA Guidance on the Import and Export

of Radioactive Sources

List of Points of Contact The ‘Code of Conduct on the Safety and Security of Radioactive Sources’ (the Code), in paragraphs 23-29, contains guidance concerning the import and export of Category 1 and 2 radioactive sources. In this connection, IAEA Member States developed the non-legally binding ‘Guidance on the Import and Export of Radioactive Sources’ (the Guidance) to provide supplementary guidance on the implementation of those provisions of the Code. Paragraph 4 of the Import/Export Guidance states “Each State should nominate a point of contact, which could be a persons or a position, for the purpose of facilitating the export and/or import of radioactive sources in accordance with the Code and this Guidance. If more than one point of contact is designated by a State, the State should indicate which point of contact should be contacted under which circumstances. States should provide the details of these points of contact to the IAEA.” Additions and amendments to this list of national contact points should be sent to IAEA through the normal official channels, marked for the attention of Hilaire Mansoux (contact details are given below).
