As such, the SoEE relates to the impacts of the development on the natural, built and social environments.

Re: Proposed residence at 12 Green Lane

Visual Privacy

The proposal consists of the following;

- The construction of a 2 storey dwelling.

The living areas and balcony at the rear and to the northern side of the proposal are higher than 1.5m above natural ground level at the boundary on the north. The proposal consists of a covered balcony orientated to take advantage of the views through the developed tree tops through to the North West and over West Orange. So as to NOT impede on the visual privacy of the house at 10 Green lane the balcony does not start until behind the principal area of Private open space. This ensures the view corridor is orientated to the North West as depicted in the site plan Drawing Number 18-109 -- 05 in the application set.

Further adding to this separation is the distance the existing house at 10 Green Lane is setback from the boundary. As shown from the detail survey the balcony is more than 20m from the principal area of private open space.

As shown in the image below, looking from the open space of the dwelling at 10 Green Lane to the south, the presence of large developed trees and landscaping features ensures the neighbouring dwelling remains private.

Dear Nigel,

I am writing to you as a consulting arborist on behalf of my client, Mr Tim Bassmann of Bassmann Drafting Services, regarding an application to remove 2 trees from a development site at 12 Green Lane, Orange.

Orange City Council has approved the subdivision of this property (DA 413484) and a house is planned for construction in the southern section of the block. The block was part of an established garden including a remnant Eucalyptus viminalis and numerous plantings of trees and shrubs.

Access to the block is yet to be established and is limited by terrain and existing vegetation. A site visit by Tim in your company concluded that the most viable option was to build a driveway on the southernmost side of the top of the block. Access at this point would involve building a driveway over raised and compacted fill, held in place by a retaining wall.

This driveway would be constructed one metre from the base of a large Eucalyptus, involving a severe change in soil level on one side of the tree. Such a change in soil level would see the root system starved of oxygen and almost certain deterioration of the root system on one hemisphere of the tree. This would lead to an irreversible decline in tree vigour and vitality

The effects of soil level changes to tree health and stability include the following:

• Cutting off the oxygen supply and preventing gas exchange between soil and air • Disruption of the normal flow of water, creating either excessive soil moisture or deprivation

of water • Loss of nutrient stratum in the soil preventing the tree from absorbing essential nutrients

and water. • Compaction leading to loss of vital oxygen spaces in the soil • Decay and dieback of the root system • Overall decline of tree health and a significant increase in the risk of tree failure

In addition, a 600 mm deep trench for the retaining wall for the driveway would be dug just one metre from the base of this tree. This translates as a serious incursion into the Structural Root Zone (SRZ) of the tree and probable destabilisation due to root severance.

The Eucalyptus (treel) is thought to be a remnant Ribbon Gum due to its size. The tree has a DBH of 1000mm and a height approaching 35 metres. This is a significant tree in stature and appears to in reasonably good health. The tree is not without some structural defects which is to be expected given its age. The tree is one of the largest growing in the immediate vicinity of standard residential density housing and if whole tree failure was to occur then property damage would be likely.

Tree 2 is the second tree to be impacted on by development on this block and is a 12-metre-tall Cupressus nootkatensis, Nootka Cedar or Alaska Cedar with a DBH of 430mm. This tree is growing within the building envelope and whilst the tree is valued, it is too big to be transplanted and must therefore be removed.

The owners of the block have expressed a desire to retain as many trees as possible and keep the charm of the block with its established garden. They have also expressed reluctance to remove any trees but are pragmatic in their approach to the entire development process.

About this report

Residential energy ratings address the quality of the building fabric i.e. walls. windows, floors and roof/ceilings. Ratings do not cover the energy or water efficiency of appliances including heating and cooling, hot water, dishwashers. ovens. fridges, TVs etc. or solar panel or water tank requirements. A NatHERS House Energy Rating is a comprehensive dynamic computer modelling evaluation of the floorplans, elevations and specifications to predict an energy load of a home. Not all of us use our homes in the same way, so ratings are generated using standard assumptions. This means homes can be compared across the country.

The actual energy consumption of your home may vary significantly from the predicted energy load figures in the report depending on issues such as the size of your household and your personal preferences, e.g. in terms of heating or cooling.

While the figures are an indicative guide to energy use, they can be used as a reliable guide for comparative purposes between different house designs and for demonstrating that the design meets the required regulatory compliance.

Homes that are energy efficient use less energy. are warmer in winter, cooler in summer and cost less to run. The higher the star rating the more energy efficient.

Schedule of BASIX commitments

The commitments set out below regulate how the proposed development is to be carried out. It is a condition of any development consent granted, or complying development certificate issued, for the proposed development, that BASIX commitments be complied with.
