A BILL To regulate the importation, manufacture, possession, sale

or transfer of assault weapons, and for other purposes.

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Assault Weapons Ban 4

of 2018’’. 5

SEC. 2. DEFINITIONS. 6

(a) IN GENERAL.—Section 921(a) of title 18, United 7

States Code, is amended—8

(1) by inserting after paragraph (29) the fol-1

lowing: 2

‘‘(30) The term ‘semiautomatic pistol’ means any re-3

peating pistol that—4

‘‘(A) utilizes a portion of the energy of a firing 5

cartridge to extract the fired cartridge case and 6

chamber the next round; and 7

‘‘(B) requires a separate pull of the trigger to 8

fire each cartridge. 9

‘‘(31) The term ‘semiautomatic shotgun’ means any 10

repeating shotgun that—11



chamber the next round; and 14


fire each cartridge.’’; and 16

(2) by adding at the end the following: 17

‘‘(36) The term ‘semiautomatic assault weapon’ 18

means any of the following, regardless of country of manu-19

facture or caliber of ammunition accepted: 20

‘‘(A) A semiautomatic rifle that has the capac-21

ity to accept a detachable magazine and any 1 of the 22

following: 23

‘‘(i) A pistol grip. 24

‘‘(ii) A forward grip. 25

‘‘(iii) A folding, telescoping, or detachable 1

stock. 2

‘‘(iv) A grenade launcher or rocket launch-3

er. 4

‘‘(v) A barrel shroud. 5

‘‘(vi) A threaded barrel. 6

‘‘(B) A semiautomatic rifle that has a fixed 7

magazine with the capacity to accept more than 10 8

rounds, except for an attached tubular device de-9

signed to accept, and capable of operating only with, 10

.22 caliber rimfire ammunition. 11

‘‘(C) Any part, combination of parts, compo-12

nent, device, attachment, or accessory that is de-13

signed or functions to accelerate the rate of fire of 14

a semiautomatic rifle but not convert the semiauto-15

matic rifle into a machinegun. 16

‘‘(D) A semiautomatic pistol that has the ca-17

pacity to accept a detachable magazine and any 1 of 18

the following: 19

‘‘(i) A threaded barrel. 20

‘‘(ii) A second pistol grip. 21

‘‘(iii) A barrel shroud. 22

‘‘(iv) The capacity to accept a detachable 23

magazine at some location outside of the pistol 24

grip. 25

‘‘(v) A semiautomatic version of an auto-1

matic firearm. 2

‘‘(E) A semiautomatic pistol with a fixed maga-3

zine that has the capacity to accept more than 10 4

rounds. 5

‘‘(F) A semiautomatic shotgun that has any 1 6

of the following: 7

‘‘(i) A folding, telescoping, or detachable 8

stock. 9

‘‘(ii) A pistol grip. 10

‘‘(iii) A fixed magazine with the capacity to 11

accept more than 5 rounds. 12

‘‘(iv) The ability to accept a detachable 13

magazine. 14

‘‘(v) A forward grip. 15

‘‘(vi) A grenade launcher or rocket launch-16

er. 17

‘‘(G) Any shotgun with a revolving cylinder. 18

‘‘(H) All of the following rifles, copies, dupli-19

cates, variants, or altered facsimiles with the capa-20

bility of any such weapon thereof: 21

‘‘(i) All AK types, including the following: 22

‘‘(I) AK, AK47, AK47S, AK–74, 23

AKM, AKS, ARM, MAK90, MISR, 24

NHM90, NHM91, Rock River Arms LAR–25

‘‘(K) All belt-fed semiautomatic firearms, in-1

firearm described in subparagraphs (A) through (K) 4

can be assembled. 5

‘‘(M) The frame or receiver of a rifle or shot-6

gun described in subparagraph (A), (B), (C), (F), 7

(G), (H), (J), or (K). 8

‘‘(37) The term ‘large capacity ammunition feeding 9

device’—10

‘‘(A) means a magazine, belt, drum, feed strip, 11

or similar device, including any such device joined or 12

coupled with another in any manner, that has an 13

overall capacity of, or that can be readily restored, 14

changed, or converted to accept, more than 10 15

rounds of ammunition; and 16

‘‘(B) does not include an attached tubular de-17

vice designed to accept, and capable of operating 18

only with, .22 caliber rimfire ammunition.’’. 19

(b) RELATED DEFINITIONS.—Section 921(a) of title 20

18, United States Code, as amended by this Act, is 21

amended by adding at the end the following: 22

‘‘(38) The term ‘barrel shroud’—23

‘‘(A) means a shroud that is attached to, or 24

partially or completely encircles, the barrel of a fire-25

arm so that the shroud protects the user of the fire-1

arm from heat generated by the barrel; and 2

‘‘(B) does not include—3

‘‘(i) a slide that partially or completely en-4

closes the barrel; or 5

‘‘(ii) an extension of the stock along the 6

bottom of the barrel which does not encircle or 7

substantially encircle the barrel. 8

‘‘(39) The term ‘detachable magazine’ means an am-9

munition feeding device that can be removed from a fire-10

arm without disassembly of the firearm action. 11

‘‘(40) The term ‘fixed magazine’ means an ammuni-12

tion feeding device that is permanently fixed to the firearm 13

in such a manner that it cannot be removed without dis-14

assembly of the firearm. 15

‘‘(41) The term ‘folding, telescoping, or detachable 16

stock’ means a stock that folds, telescopes, detaches or 17

otherwise operates to reduce the length, size, or any other 18

dimension, or otherwise enhances the concealability, of a 19

firearm. 20

‘‘(42) The term ‘forward grip’ means a grip located 21

forward of the trigger that functions as a pistol grip. 22

‘‘(43) The term ‘rocket’ means any simple or complex 23

tubelike device containing combustibles that on being ig-24

nited liberate gases whose action propels the tube through 25

the air and has a propellant charge of not more than 4 1

ounces. 2

‘‘(44) The term ‘grenade launcher or rocket launcher’ 3

means an attachment for use on a firearm that is designed 4

to propel a grenade, rocket, or other similar destructive 5

device. 6

‘‘(45) The term ‘permanently inoperable’ means a 7

firearm which is incapable of discharging a shot by means 8

of an explosive and incapable of being readily restored to 9

a firing condition. 10

‘‘(46) The term ‘pistol grip’ means a grip, a thumb-11

hole stock, or any other characteristic that can function 12

as a grip. 13

‘‘(47) The term ‘threaded barrel’ means a feature or 14

characteristic that is designed in such a manner to allow 15

for the attachment of a device such as a firearm silencer 16

or a flash suppressor. 17

‘‘(48) The term ‘qualified law enforcement officer’ 18

has the meaning given the term in section 926B. 19

‘‘(49) The term ‘grandfathered semiautomatic as-20

sault weapon’ means any semiautomatic assault weapon 21

the importation, possession, sale, or transfer of which 22

would be unlawful under section 922(v) but for the excep-23

tion under paragraph (2) of such section. 24

‘‘(50) The term ‘belt-fed semiautomatic firearm’ 1

means any repeating firearm that—2



chamber the next round; 5


fire each cartridge; and 7

‘‘(C) has the capacity to accept a belt ammuni-8

tion feeding device.’’. 9

SEC. 3. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE 10

CAPACITY AMMUNITION FEEDING DEVICES. 11

(a) IN GENERAL.—Section 922 of title 18, United 12

States Code, is amended—13

(1) by inserting after subsection (u) the fol-14

lowing: 15

‘‘(v)(1) It shall be unlawful for a person to import, 16

sell, manufacture, transfer, or possess, in or affecting 17

interstate or foreign commerce, a semiautomatic assault 18

weapon. 19

‘‘(2) Paragraph (1) shall not apply to the possession, 20

sale, or transfer of any semiautomatic assault weapon oth-21

erwise lawfully possessed under Federal law on the date 22

of enactment of the Assault Weapons Ban of 2018. 23

‘‘(3) Paragraph (1) shall not apply to any firearm 24

that—25

‘‘(A) is manually operated by bolt, pump, lever, 1

or slide action; 2

‘‘(B) has been rendered permanently inoperable; 3

or 4

‘‘(C) is an antique firearm, as defined in section 5

921 of this title. 6

‘‘(4) Paragraph (1) shall not apply to—7

‘‘(A) the importation for, manufacture for, sale 8

to, transfer to, or possession by the United States 9

or a department or agency of the United States or 10

a State or a department, agency, or political subdivi-11

sion of a State, or a sale or transfer to or possession 12

by a qualified law enforcement officer employed by 13

the United States or a department or agency of the 14

United States or a State or a department, agency, 15

or political subdivision of a State, for purposes of 16

law enforcement (whether on or off duty), or a sale 17

or transfer to or possession by a campus law en-18

forcement officer for purposes of law enforcement 19

(whether on or off duty); 20

‘‘(B) the importation for, or sale or transfer to 21

a licensee under title I of the Atomic Energy Act of 22

1954 for purposes of establishing and maintaining 23

an on-site physical protection system and security 24

organization required by Federal law, or possession 25

by an employee or contractor of such licensee on-site 1

for such purposes or off-site for purposes of licensee-2

authorized training or transportation of nuclear ma-3

terials; 4

‘‘(C) the possession, by an individual who is re-5

tired in good standing from service with a law en-6

forcement agency and is not otherwise prohibited 7

from receiving a firearm, of a semiautomatic assault 8

weapon—9

‘‘(i) sold or transferred to the individual by 10

the agency upon such retirement; or 11

‘‘(ii) that the individual purchased, or oth-12

erwise obtained, for official use before such re-13

tirement; 14

‘‘(D) the importation, sale, manufacture, trans-15

fer, or possession of a semiautomatic assault weapon 16

by a licensed manufacturer or licensed importer for 17

the purposes of testing or experimentation author-18

ized by the Attorney General; or 19

‘‘(E) the importation, sale, manufacture, trans-20

fer, or possession of a firearm specified in Appendix 21

A to this section, as such firearm was manufactured 22

on the date of introduction of the Assault Weapons 23

Ban of 2018. 24

‘‘(5) For purposes of paragraph (4)(A), the term 1

‘campus law enforcement officer’ means an individual who 2

is—3

‘‘(A) employed by a private institution of higher 4

education that is eligible for funding under title IV 5

of the Higher Education Act of 1965 (20 U.S.C. 6

1070 et seq.); 7

‘‘(B) responsible for the prevention or investiga-8

tion of crime involving injury to persons or property, 9

including apprehension or detention of persons for 10

such crimes; 11

‘‘(C) authorized by Federal, State, or local law 12

to carry a firearm, execute search warrants, and 13

make arrests; and 14

‘‘(D) recognized, commissioned, or certified by 15

a government entity as a law enforcement officer. 16

‘‘(6) The Attorney General shall establish and main-17

tain, in a timely manner, a record of the make, model, 18

and, if available, date of manufacture of any semiauto-19

matic assault weapon which the Attorney General is made 20

aware has been used in relation to a crime under Federal 21

or State law, and the nature and circumstances of the 22

crime involved, including the outcome of relevant criminal 23

investigations and proceedings. The Attorney General 24

shall annually submit a copy of the record established 25

under this paragraph to the Congress and make the record 1

available to the general public. 2

‘‘(w)(1) It shall be unlawful for a person to import, 3

sell, manufacture, transfer, or possess, in or affecting 4

interstate or foreign commerce, a large capacity ammuni-5

tion feeding device. 6

‘‘(2) Paragraph (1) shall not apply to the possession 7

of any large capacity ammunition feeding device otherwise 8

lawfully possessed on or before the date of enactment of 9

the Assault Weapons Ban of 2018. 10

‘‘(3) Paragraph (1) shall not apply to—11

‘‘(A) the importation for, manufacture for, sale 12

to, transfer to, or possession by the United States 13

or a department or agency of the United States or 14

a State or a department, agency, or political subdivi-15

sion of a State, or a sale or transfer to or possession 16

by a qualified law enforcement officer employed by 17

the United States or a department or agency of the 18

United States or a State or a department, agency, 19

or political subdivision of a State for purposes of law 20

enforcement (whether on or off duty), or a sale or 21

transfer to or possession by a campus law enforce-22

ment officer for purposes of law enforcement (wheth-23

er on or off duty); 24

‘‘(B) the importation for, or sale or transfer to 1

a licensee under title I of the Atomic Energy Act of 2

1954 for purposes of establishing and maintaining 3

an on-site physical protection system and security 4

organization required by Federal law, or possession 5

by an employee or contractor of such licensee on-site 6

for such purposes or off-site for purposes of licensee-7

authorized training or transportation of nuclear ma-8

terials; 9

‘‘(C) the possession, by an individual who is re-10

tired in good standing from service with a law en-11

forcement agency and is not otherwise prohibited 12

from receiving ammunition, of a large capacity am-13

munition feeding device—14

‘‘(i) sold or transferred to the individual by 15

the agency upon such retirement; or 16

‘‘(ii) that the individual purchased, or oth-17

erwise obtained, for official use before such re-18

tirement; or 19

‘‘(D) the importation, sale, manufacture, trans-20

fer, or possession of any large capacity ammunition 21

feeding device by a licensed manufacturer or licensed 22

importer for the purposes of testing or experimen-23

tation authorized by the Attorney General. 24

‘‘(4) For purposes of paragraph (3)(A), the term 1

‘campus law enforcement officer’ means an individual who 2

is—3

‘‘(A) employed by a private institution of higher 4

education that is eligible for funding under title IV 5

of the Higher Education Act of 1965 (20 U.S.C. 6

1070 et seq.); 7

‘‘(B) responsible for the prevention or investiga-8

tion of crime involving injury to persons or property, 9

including apprehension or detention of persons for 10

such crimes; 11

‘‘(C) authorized by Federal, State, or local law 12

to carry a firearm, execute search warrants, and 13

make arrests; and 14

‘‘(D) recognized, commissioned, or certified by 15

a government entity as a law enforcement officer.’’; 16

and 17

(2) by adding at the end the following: 18

‘‘(aa) SECURE STORAGE OR SAFETY DEVICE RE-19

QUIREMENT FOR GRANDFATHERED SEMIAUTOMATIC AS-20

SAULT WEAPONS.—It shall be unlawful for any person, 21

other than a licensed importer, licensed manufacturer, or 22

licensed dealer, to store or keep under the dominion or 23

control of that person any grandfathered semiautomatic 24

assault weapon that the person knows, or has reasonable 25

cause to believe, will be accessible to an individual prohib-1

ited from receiving or possessing a firearm under sub-2

section (g), (n), or (x), or any provision of State law, un-3

less the grandfathered semiautomatic assault weapon is—4

‘‘(1) carried on the person, or within such close 5

proximity that the person can readily retrieve and 6

use the grandfathered semiautomatic assault weapon 7

as if the grandfathered semiautomatic assault weap-8

on were carried on the person; or 9

‘‘(2) locked by a secure gun storage or safety 10

device that the prohibited individual has no ability to 11

access.’’. 12

(b) IDENTIFICATION MARKINGS FOR SEMIAUTO-13

MATIC ASSAULT WEAPONS.—Section 923(i) of title 18, 14

United States Code, is amended by adding at the end the 15

following: ‘‘The serial number of any semiautomatic as-16

sault weapon manufactured after the date of enactment 17

of the Assault Weapons Ban of 2018 shall clearly show 18

the date on which the weapon was manufactured or made, 19

legibly and conspicuously engraved or cast on the weapon, 20

and such other identification as the Attorney General shall 21

by regulations prescribe.’’. 22

(c) IDENTIFICATION MARKINGS FOR LARGE CAPAC-23

ITY AMMUNITION FEEDING DEVICES.—Section 923(i) of 24

title 18, United States Code, as amended by this Act, is 25

amended by adding at the end the following: ‘‘A large ca-1

pacity ammunition feeding device manufactured after the 2

date of enactment of the Assault Weapons Ban of 2018 3

shall be identified by a serial number and the date on 4

which the device was manufactured or made, legibly and 5

conspicuously engraved or cast on the device, and such 6

other identification as the Attorney General shall by regu-7

lations prescribe.’’. 8

(d) SEIZURE AND FORFEITURE OF LARGE CAPACITY 9

AMMUNITION FEEDING DEVICES.—Subsection (d) of sec-10

tion 924 of title 18, United States Code, is amended—11

(1) in paragraph (1)—12

(A) by inserting ‘‘or large capacity ammu-13

nition feeding device’’ after ‘‘firearm or ammu-14

nition’’ each time it appears; 15

(B) by inserting ‘‘or large capacity ammu-16

nition feeding device’’ after ‘‘firearms or ammu-17

nition’’ each time it appears; and 18

(C) by striking ‘‘or (k)’’ and inserting 19

‘‘(k), (r), (v), or (w)’’; 20

is amended by striking ‘‘or (q) of section 922’’ and insert-8

ing ‘‘(q), (r), (v), (w), or (aa) of section 922’’. 9

SEC. 5. BACKGROUND CHECKS FOR TRANSFERS OF GRAND-10

FATHERED SEMIAUTOMATIC ASSAULT WEAP-11

ONS. 12

(a) IN GENERAL.—Section 922 of title 18, United 13

States Code, as amended by this Act, is amended—14

(1) by repealing subsection (s); 15

(2) by redesignating subsection (t) as sub-16

section (s); 17

(3) in subsection (s), as redesignated—18

(A) in paragraph (3)(C)(ii), by striking 19

‘‘(as defined in subsection (s)(8))’’; and 20

(B) by adding at the end the following: 21

‘‘(7) In this subsection, the term ‘chief law en-22

forcement officer’ means the chief of police, the 23

sheriff, or an equivalent officer or the designee of 24

any such individual.’’; and 25

(4) by inserting after subsection (s), as redesig-1

nated, the following: 2

‘‘(t)(1) Beginning on the date that is 90 days after 3

the date of enactment of the Assault Weapons Ban of 4

2018, it shall be unlawful for any person who is not li-5

censed under this chapter to transfer a grandfathered 6

semiautomatic assault weapon to any other person who is 7

not licensed under this chapter, unless a licensed importer, 8

licensed manufacturer, or licensed dealer has first taken 9

custody of the grandfathered semiautomatic assault weap-10

on for the purpose of complying with subsection (s). Upon 11

taking custody of the grandfathered semiautomatic assault 12

weapon, the licensee shall comply with all requirements of 13

this chapter as if the licensee were transferring the grand-14

fathered semiautomatic assault weapon from the licensee’s 15

inventory to the unlicensed transferee. 16

‘‘(2) Paragraph (1) shall not apply to a temporary 17

transfer of possession for the purpose of participating in 18

target shooting in a licensed target facility or established 19

range if—20

‘‘(A) the grandfathered semiautomatic assault 21

weapon is, at all times, kept within the premises of 22

the target facility or range; and 23

ited from possessing or receiving a grandfathered 2

semiautomatic assault weapon. 3

‘‘(3) For purposes of this subsection, the term ‘trans-4

fer’—5

‘‘(A) shall include a sale, gift, or loan; and 6

‘‘(B) does not include temporary custody of the 7

grandfathered semiautomatic assault weapon for 8

purposes of examination or evaluation by a prospec-9

tive transferee. 10

‘‘(4)(A) Notwithstanding any other provision of this 11

chapter, the Attorney General may implement this sub-12

section with regulations. 13

‘‘(B) Regulations promulgated under this para-14

graph—15

‘‘(i) shall include a provision setting a max-16

imum fee that may be charged by licensees for serv-17

ices provided in accordance with paragraph (1); and 18

‘‘(ii) shall not include any provision imposing 19

recordkeeping requirements on any unlicensed trans-20

feror or requiring licensees to facilitate transfers in 21

accordance with paragraph (1).’’. 22

(b) TECHNICAL AND CONFORMING AMENDMENTS.—23

(1) SECTION 922.—Section 922(y)(2) of title 24

18, United States Code, is amended, in the matter 25

preceding subparagraph (A), by striking ‘‘, 1

(g)(5)(B), and (s)(3)(B)(v)(II)’’ and inserting ‘‘and 2

(g)(5)(B)’’. 3

(2) SECTION 925A.—Section 925A of title 18, 4

United States Code, is amended, in the matter pre-5

ceding paragraph (1), by striking ‘‘subsection (s) or 6

(t) of section 922’’ and inserting ‘‘section 922(s)’’. 7

(c) EFFECTIVE DATE.—The amendments made by 8

this section shall take effect 90 days after the date of en-9

actment of this Act. 10

SEC. 6. NOTIFICATION TO LAW ENFORCEMENT AGENCIES 11

OF PROHIBITED PURCHASE OR ATTEMPTED 12

PURCHASE OF A FIREARM. 13

(a) IN GENERAL.—Title I of the NICS Improvement 14

Amendments Act of 2007 (34 U.S.C. 40911–40916) is 15

‘‘(a) IN GENERAL.—In the case of a background 21

check conducted by the National Instant Criminal Back-22

ground Check System pursuant to the request of a li-23

censed importer, licensed manufacturer, or licensed dealer 24

of firearms (as such terms are defined in section 921 of 25

title 18, United States Code), which background check de-1

termines that the receipt of a grandfathered semiauto-2

matic assault weapon (as defined in section 921(a)(49) of 3

title 18, United States Code) by a person would violate 4

subsection (g) or (n) of section 922 of title 18, United 5

States Code, the System shall notify the law enforcement 6

agencies described in subsection (b), including in a case 7

where such a determination is made after 14 business days 8

have elapsed since the licensee contacted the System. 9

‘‘(b) LAW ENFORCEMENT AGENCIES DESCRIBED.—10

The law enforcement agencies described in this subsection 11

are the law enforcement agencies that have jurisdiction 12

over the location from which the licensee contacted the 13

System and the law enforcement agencies that have juris-14

diction over the location of the residence of the person for 15

which the background check was conducted, as follows: 16

‘‘(1) The field office of the Federal Bureau of 17

Investigation. 18

‘‘(2) The local law enforcement agency. 19

‘‘(3) The State law enforcement agency.’’. 20

(b) CLERICAL AMENDMENT.—Section 1(b) of such 21

Act (34 U.S.C. ch. 409, front matter) is amended by in-22

serting after the item relating to section 106 the following:23

‘‘107. Notification to law enforcement agencies of prohibited purchase or at-

tempted purchase of a firearm’’.

Section 501(a)(1) of the Omnibus Crime Control and 5

Safe Streets Act of 1968 (42 U.S.C. 3751(a)(1)) is 6


‘‘(H) Compensation for surrendered semi-8

automatic assault weapons and large capacity 9

ammunition feeding devices, as those terms are 10

defined in section 921 of title 18, United States 11

Code, under buy-back programs for semiauto-12

matic assault weapons and large capacity am-13

munition feeding devices.’’. 14

SEC. 8. SEVERABILITY. 15

If any provision of this Act, an amendment made by 16

this Act, or the application of such provision or amend-17

ment to any person or circumstance is held to be unconsti-18

tutional, the remainder of this Act, the amendments made 19

by this Act, and the application of such provision or 20

amendment to any person or circumstance shall not be af-21

fected thereby.22
