Overview of Commissioner’s List of Reading Instruments The Commissioner’s List of Reading Instruments is a comprehensive list of reading diagnostic instruments from Prekindergarten through Grade 8. School districts and open-enrollment charter schools may refer to the list to ensure they are selecting instruments that are based on scientific research that is valid and reliable and measures the appropriate set of reading skills. In accordance with the Texas Education Code (TEC) §28.006(b), the commissioner of education shall adopt a list of reading instruments that school districts may use to diagnose student reading development and comprehension. Reading instruments placed on the list must be based on scientific research, evaluate individual student reading progress, and be used to identify students at risk for dyslexia or other reading difficulties. The list of reading instruments adopted under the TEC, §28.006(b), must also provide for diagnosing the reading development and comprehension of students participating in a program under the TEC, Chapter 29, Subchapter B (Bilingual Education and Special Language Programs). Texas Education Code (TEC) §28.006. Reading Diagnosis (a) The commissioner shall develop recommendations for school districts for: (1) administering reading instruments to diagnose student reading development and comprehension; (2) training educators in administering the reading instruments; (3) applying the results of the reading instruments to the instructional program. (b) The commissioner shall adopt a list of reading instruments that a school district may use to diagnose student reading development and comprehension. A district-level committee established under Subchapter F, Chapter 11, may adopt a list of reading instruments for use in the district in addition to the reading instruments on the commissioner’s list. Each reading instrument adopted by the commissioner or a district-level committee must be based on scientific research concerning reading skills development and reading comprehension. A list of instruments adopted under this subsection must provide for diagnosing the reading development and comprehension of students participating in a program under Subchapter B, Chapter 29. (c) Each school district shall administer, at the kindergarten and first and second grade levels, a reading instrument on the list adopted by the commissioner or by the district-level committee. Chapter 101. Assessment Subchapter FF. Commissioner's Rules Concerning Diagnostic Assessment §101.6001. Texas Middle School Diagnostic Reading Assessment.

(a) Each school district shall administer during the first six weeks of the school year the diagnostic reading instrument specified in subsection (c) of this section to each student in Grade 7 whose performance on the Grade 6 Texas Assessment of Knowledge and Skills (TAKS) or TAKS-Accommodated in reading did not meet the passing standard. The admission, review, and dismissal committee for each student who was administered the TAKS-Modified in reading may determine if the diagnostic assessment is appropriate for use with that student.

(b) A student in Grade 7 who does not have a score for the statewide reading assessment in Grade 6 may be given an equivalent comprehension assessment. If that student does not meet the passing standard, then the student must be administered the diagnostic reading assessment specified in subsection (c) of this section.

(c) A school district must use the Texas Middle School Fluency Assessment and/or an alternate diagnostic reading instrument approved by the Texas Education Agency (TEA). A district must submit to the TEA an alternate diagnostic reading instrument for approval if it meets the criteria in subsection (d) of this section.

(d) An alternate diagnostic reading instrument must:

(1) be based on published scientific research in reading;

(2) be age and grade-level appropriate, valid, and reliable;

(3) identify specific skill difficulties in word analysis, fluency, and comprehension; and

(4) assist the teacher in making individualized instructional decisions based on the assessment results.

(e) A school district shall provide additional reading instruction and intervention to each student in Grade 7 who did not meet the passing standard on the Grade 6 state assessment in reading as appropriate to improve the student's reading skills in the areas of need identified by the diagnostic reading assessment.

Source: The provisions of this §101.6001 adopted to be effective October 14, 2008, 33 TexReg 8500. For the Grade 7 reading diagnostic instrument, school districts and open-enrollment charter schools have the option to use the state-owned Texas Middle School Fluency Assessment (TMSFA). The TMSFA and training on how to administer and interpret results of the instrument are provided through the regional education service centers at no cost to school districts and open-enrollment charter schools. The TMSFA also provides reading instruments for Grades 6 and 8. If school districts or open-enrollment charter schools opt to use a Grade 7 reading instrument other than the TMSFA, they must cover the full cost of the instrument.
