ALIEN PROPERTY CUSTODIAN RECORDS OF TRENT TRUST CO., LTD.

Introduction

Following the United States declaration of war against Gennany, the Office of Alien Property Custodian was established by Executive Order 2927-A on October 12, 1917 under authority of the Trading with the Enemy Act, October 6, 1917. The Custodian was to assume control and dispose of enemy-owned property in the United States and its possessions. In 1918, the Alien Property Custodian, A. Mitchell Palmer, appointed Trent Trust Company Limited (Trent Trust) as depository, agent, bailee, and attorney in fact of money or other property of enemies or allies of enemies. Ownership of enemy property was transferred from businesses and individuals such as H. Hackfeld and Company, Limited, and the Estate of Otto Ernst Isenberg to the Trust between 1918 and 1924. Richard H. Trent, President of Trent Trust Company was appointed proxy for the Alien Property Custodian, with full power of substitution in stockholders meetings of H. Hackfeld Company and J.F. Hackfeld Company. The Alien Property Custodian Records of Trent Trust were transferred to the Hawaii State Archives in 1964.

Agency History

Trent Trust was established in 1907 by Richard H. Trent, Cecil Brown, Irwin Beadle, C.H. Cooke, and James Lyle to do business as a trust company which recorded and prepared abstracts of land titles; perfonned as surety executors, administrators, guardians and trustees; acted as auditors, accountants, actuaries and brokers; purchased, took on lease, exchanged, hired, acquired or held lands; purchased, took over, or undertook whole or part of a business; raised or borrowed money and secured the payment of money raised or borrowed either by charge of mortgage or deed of trust; made, drew, accepted, endorsed and or executed negotiable instruments; exercised the power and privilege of making and entering into contracts; and received for investment deposits of money and loaned the same on mortgage and or collaterals and collected and accounted for dividends, profits and income arising from such acts and services.

As depository, agent, bailee, and attorney in fact of money or other property of enemies or allies of enemies in the Territory of Hawaii, Trent Trust had the power to collect the income from income-bearing securities of enemy individuals or businesses and to collect any principal which might be owing to any enemy individuals or businesses which had been reported. The Trust was authorized to make leases, not exceeding one year, except with the consent of the Custodian. The Trust was authorized to pay any taxes or administration expenses on any of the enemy property, but was prohibited from investing any funds belonging to an enemy which came into its hands, and from bringing any suit or selling any property whatsoever except by a specific authorization of the Alien Property Custodian.

The following is a chronology of events beginning with Trent Trust's appointment as depository for the Alien Property Custodian and ending with the trust's dissolution:

1918 Alien Property Custodian appoints Trent Trust Co., Ltd. as depository for seized enemy property in the Territory of Hawaii. Enemy properties are seized and deposited in Trent Trust. To preserve the business ofH. Hackfeld some stocks are sold to minimize German control of the corporation and board of directors who are Gennan are replaced by Americans. The Alien Property Custodian does not approve and the transfer is reversed.

1918-1924 Ownership of property, mainly stocks, is transferred from H. Hackfeld Company; J. F. Hackfeld Company; Estate of Otto Ernst Isenberg; and the J.C. Glade, Clara Glade, Paul Isenberg, and H.H. Pflueger Trusts to Trent Trust. Trent Trust obtains controlling interest in H. Hackfeld Company. All H. Hackfeld Company stock is sold to American Factors and proceeds are distributed to stockholders.

1924 J.F. Hackfeld claims to be an American citizen and is fully reimbursed of the proceeds of the sale of the J. F. Hackfeld Limited stock. Stockholders file simultaneous suits against Trent Trust in Honolulu for selling H. Hackfeld stock too cheaply.

1928 The War Claims Act authorizes return of eighty percent of properties seized and expropriation of the remaining balance.

1929

1931

Suits against Trent Trust are consolidated and one suit is filed in San Francisco for all shareholders of H. Hackfeld Company.

Richard Trent resigns and ownership of Trent Trust is transferred to Cooke Trust Company. Trent Trust continues to exist because it is involved in litigation with shareholders and heirs to the seized properties who claim that the shares were sold too cheaply to competing businesses. The Internal Revenue Service tries to collect taxes from the Trust.

]935 U.S. Court of Appeals upholds the sale of$7.5 million assets ofH. Hackfeld to American Factors.

1936 U.S. Government files suit against Estate of J.F. Hackfeld after discovering that he was not an American citizen.

1942 The U.S. Supreme Court rules in favor of the U.S. Government and Estate of J.F. Hackfeld is required to pay back the difference between what an American citizen would have received from the Alien Property Custodian through the liquidation of J.F. Hackfe]d stocks, and what a German national would have received through the War Claims Act. Trent Trust sustains losses as Alien Property Custodian depository and tries to recoup from the U.S. Government.

1955 Cooke Trust is appointed receiver for Trent Trust under Equity No. 3248 in the First Judicial Circuit, Territory of Hawaii. Fees to the attorneys hired by Trent Trust left the trust with no assets.

1974 Trent Trust is dissolved on February 6.

German successes in business in Hawaii prior to World War I and the court cases which decided how much those businesses were worth.

Note: Articles attacking the Americanism of certain officers ofH. Hackfeld and Company, Limited were submitted to the newspapers by Richard Trent under the pen name "Dixie Doolittle"from 1917 to 1918. These articles were eventually used in court cases to prove that there was a conspiracy to force the sale of H. Hackfeld and Company.
