1.0 EXECUTIVE SUMMARY

The Concessionaire has started the construction of balance works of the project. The works of balance service roads in Bahadurgarh Bypass are being carried out including some other works such as fixation of sign boards, etc. The works of fixation of bearings and launching of steel girders in the track span of ROB at Ch. 86+177 have been completed by the Concessionaire. Presently, the works of erection of intermediate cross girders and cross bracing are being carried out by the Concessionaire. The Concessionaire has been requested to also carry out works related to safety and maintenance of project highway including to take actions to prevent encroachment of NHAI land. The progress of works need to be expedited by the Concessionaire to complete the project without any more further delays. The project can be completed within a period of 3-4 months if the Concessionaire executes the works with proper planning and by providing adequate resources.

1.2 CONCESSIONAIRE’S WORK PROGRAMME:

The Concessionaire had committed during meeting held at RO Office, Chandigarh on 16th January 2015 under the Chairmanship of Mr. B. S. Singla, CGM (T), that the balance works including ROB at Ch. 86+177 will be completed by 31st March 2015. The Concessionaire has been asked to submit the work programme to complete the entire project. The Concessionaire has also been asked to the expedite the completion of the balance works of entire project from Km. 29+650 to Km. 85+372 such as balance service road, slip roads, truck lay byes, road signages & safety appurtenances, road markings, balance works of structures, balance toll plaza works, highway lighting works, MBCB, drainage works, bus bays, ROB at Rohtak bypass to make the Rohtak bypass operational. The Concessionaire had also been advised to submit the consolidated case for extension of time of project at the earliest but the same has not been received up till now.

1.3 HANDING OVER OF SITE:

Land in the total length of the project has been handed over.

1.7 QUALITY CONTROL:

The fixation of bearings for ROB at Ch. 86+177 (in track span) has been completed by the Concessionaire. These works were checked by Railway Authorities as well as by the representatives of Independent Engineer and PIU-NHAI/Rohtak. The service road works were also inspected regularly by the representatives of the Independent Engineer and necessary directions to ensure the proper levels and for quality of materials were issued to the Concessionaire and subsequently follow ups are being made at site to ensure compliance of these observations.

1.8 MAINTENANCE OF PROJECT HIGHWAY:

1.8.1 Status of Maintenance: The works have been started by the Concessionaire, however, the maintenance and repair is yet

to be carried out by the Concessionaire.

1.8.2 Maintenance measures required to be taken by the Concessionaire:

Following Maintenance measures are still required to be taken by the Concessionaire.

i. The slip roads at every grade separators & VUPs require extensive repairs.

ii. Proper drainage measures are required to be taken at slip roads & in the stretch where water is accumulated on account of reverse slope.

iii. Rain cuts at two three places up to Km 85+000 are require to be attended on priority basis.

iv. Restoration of pavement affected due to rain cuts in Rohtak Bypass at the approaches of

(a) Minor Bridge at Ch. 88+393 (both sides)

(b) VUP at Ch. 91+131 (both sides)

v. Restoration of pavement due to rain cuts in scattered reaches from Ch. 86+700 to Ch. 93+140.

vi. Slope protection work is yet to be taken up where height of embankment is more than 3.0m. particularly at the approaches of structures.

vii. The repair of strip seal expansion joints of various locations. The list of damaged strip seal expansion joints has been forwarded already to the Concessionaire.

viii. Rectification of defects noted in the structures and for which the list of the same has already been submitted to the Concessionaire.

ix. The sealing of gaps in the RCC crash barrier panels at the grade separator at Ch. 33+445, Ch. 35+643, Ch. 38+440, Ch. 40+107, etc.

1.9 SAFETY MEASURES:

The Concessionaire must address required safety measures by deploying safety teams to look after

the work of safety measures on the project highway. The cleaning of chocked/non-functioning pipe &

box culverts is required to be carried out by the Concessionaire for which immediate efforts are

required to be made by the Concessionaire. The main points of concern are as follows.

(a) Unauthorized median cuts:

Existing Illegal cuts in median indicated in previous reports have not been closed and as such

present status remains same as given below:

(i) Km 31+500 (Sector – 9)

(ii) Km 50+950 (Rohad Village)

(iii) Km 52+190 (Near Toll plaza diversion)

(iv) Km 69+540

(v) Km 77+800 (Petrol Pump)

(vi) Km 83+450

(vii) Km 85+100

The above mentioned median cuts are on the stretch which has been opened to traffic (i.e. from

Ch. 29+650 to Ch. 85+372). These median openings are required to be closed immediately to

avoid accidents. Similar action in the further stretch from Km 85+372 to Km. 93+140 should also

be taken accordingly.

(b) Fixing of Road Signs

Since the stretch from Km. 29.650 to Km. 85.372 has been opened to traffic so it has become

very necessary to fix the sign boards particularly at the junctions. Following are the junctions

which need immediate attention of the Concessionaire:

(i) Junction at Km. 68+400

(ii) VUP at Km. 69+600

(iii) Clover leaf at Km. 76+076

(iv) VUP at Km. 79+207

(v) Grade Separator at Km. 85+372

(c) Black Spots

Though the project highway has been constructed as per required specification & design but the

following spots except the illegal cuts are still existing at present which may also prove as

accident prone areas in future in the absence of further improvement .

(i) At grade junction at Km 35+350

Junction has been developed but the provision of a CUP of 4.5 m height will minimize the

accidents in view of height of embankment at this location.

(ii) At grade junction at Km 36+500

Provision of VUP at this location in place of at grade junction will bring the complete safety in

view of Bahadurgarh-Badli traffic and close vicinity of village Nayagaon.

(iii) At grade junction at Km 56+600

Provision of VUP is required at this location in place of at grade junction to make this junction completely safe in view of Sampla-Beri cross road at curvature of MCW and nearby adjacent Tehsil building Rest house and Girls College.

(d) Recommendations of Independent Engineer which have not been acted upon by the Concessionaire:

The Construction of balance works has been taken up by the Concessionaire but the following observations made by the IE are yet to be complied with by the Concessionaire.

(i) Shifting of electric lines crossing project highway on bamboos erected in median and shoulder areas in the stretches from Km. 67+500 to Km. 67+875 (median), Km. 68+100 to Km. 68+350 (RHS), Km. 89+720 to Km. 90+150 (RHS).

(ii) Protection of slopes at the approaches of structures on Rohtak Bypass and high embankment stretches.

(iii) Protection of site from encroachment, etc is required to be addressed as per clause 10.5 of the agreement. The Concessionaire has been directed several times through written and verbal directions however concrete steps are required to be taken by the Concessionaire in this regard.

(iv) Land plan which is a basic record to be maintained has not been submitted by the Concessionaire despite of asking him so many times.

1.10 FORCE MAJEURE EVENT DURING THE MONTH:

None

1.11 ISSUE OF DELAYED COMPLETION:

The cure period notice was issued to the Concessionaire by the NHAI vide letter No.

NHAI/RO/CHD/11011/PD-RTK/DLH-RTK/NH-10/2232, dated 12th December 2013 in view of various

issues of slow progress to complete the works timely and failure on the part of the Concessionaire

towards other issues such as safety, maintenance & protection of site from encroachment, etc. The

Concessionaire vide their letter No. WHHPPL/NHAI/2014/102/HN002/CMO/D/230, dated 06th February

2014 has given detailed reply on the cure period notice and assured that they will complete the work

and as such no further action was taken.

1.12 ISSUES OF CONCERN:

(i.) ROB at Km 86+177

The factors contributing to the delay in this ROB and status of work are described in detail as

below.

a) The launching of girders and deck slab casting in the obligatory span of ROB at Ch. 86+177

could not be carried out due to dispute in which Railway were demanding 30% capitalized

cost as maintenance charges before approval of traffic block. The Concessionaire refused

to deposit the capitalized maintenances cost to Railway because the maintenance has to be

carried out by the Concessionaire as per Concession Agreement. This issue was resolved

on 20th September 2013 after intervention of MORTH and NHAI. The Railway Authority

confirmed on 17th February 2014 for depositing of only supervision charges on the

capitalized cost of maintenance of this ROB.

b) The Railway Department asked the Concessionaire on 3rd September 2013 to comply the

observations regarding quality of steel girders for the track span before getting the traffic

block for execution of launching of steel girders and the compliance of these observations

could not be made by the Concessionaire in time. The Railway Department again asked on

14th December 2013 to comply with the observations regarding quality of fabrication of

girders and concrete, proper stacking of girders, etc.

The Concessionaire submitted on 23rd December 2013 that the observations on quality of

concrete shall be complied by 31st December 2013. Regarding additional butt welds, the

Concessionaire pointed out that the butt welding is permitted for joining two plates as per

codal provisions of IRS Welded Bridge and IRC: 24-2001.The Concessionaire has also

informed that they had to do butt welding because of non-availability of 12.5m plate lengths

at the time of fabrication and the appropriate NDT testing was performed and inspection

clearance for obligatory Span was taken from the concerned representative of NW Railway.

c) The Railway Department further intimated on 8th January 2014 that none of the items of

inspection note sent vide their letter dated 5th September 2013 has been complied during

last 4 months. Regarding butt welding of girders, it was pointed out by the Railway that the

Concessionaire has provided additional butt weld in the web plate using shorter plates

which is not as per approved drawing and therefore, the plea of the Concessionaire for non-

availability of longer plates is not acceptable. The NWR asked that the Concessionaire

should be directed to fabricate the end portion of these girders as per approved drawings

and to submit the programme of fabrication of girders. The Railway also asked to submit the

QAP and WPSS for fabrication of girders as well as for bearings. Subsequently, this issue

was resolved during meetings held with Railway Authorities at NWR Jaipur.

d) The Railway Authority further asked the Concessionaire on 18th September 2014 to provide

and install the bearings before issuance of traffic block. The Concessionaire procured the

bearings on 20th November 2014 but the installation of the same is yet to be done by the

Concessionaire.

e) The Concessionaire had submitted the traffic working order including activity schedule of inspection & fixation of bearings on 22nd November 2014 for processing and sanctioning of the case for issuance of traffic block for launching girders in obligatory span of said ROB and the same was forwarded to North Western Railway by the Project Director on 25 th November 2014.

f) The North Western Railway on 16th December 2014 has again informed that the bearings have not been fixed at site although bearings were received almost one month back. The Railway has further once again intimated that the fixing of bearing and all other prerequisite like arranging of cranes, securing arrangement for cross frame etc. are must before processing the papers for sanction of Traffic Working Order and the bearings are to be fixed under supervision of the Railway Officials.

g) The period of CRS sanction was up to 31st January 2015 and the Concessionaire could not complete the fixation of bearings to get the traffic block from Railways to launch the steel girders within available period of CRS sanction up to 31st January 2015. The Project Director has requested the Railway Authorities to further extend the CRS extension up to 30th April 2015 which has been accorded by the Railway.

h) Status of work:

The fixation of bearings in track span has been completed by the Concessionaire in block

period from 21st March 2015 to 25th March 2015 and presently the work of erection of

intermediate cross girder & bracing is being carried out by the Concessionaire.

(ii.) Compliance of Railway observations on ROBs at Ch. 71+580, Ch. 59+868 and Ch.

70+002:

The Concessionaire has yet to complete the balance works of these ROBs which are

requested to be carried out to comply with the observations raised by the Railway Department

for these ROBs. The Railway Department has further pointed out that these works have not

been completed by the Concessionaire yet. The Concessionaire has again been reminded to

complete the works and to submit the completion plan.

(iii.) Elevated Corridor for Metro Rail

The initial stretch of length 1.4 Km from Chainage 29+650 (start of the project) to Chainage

31+050 (start of Bahadurgarh Bypass) has been taken up by the DMRC for construction of

Elevated Corridor for Metro Rail. The stretch is having heavy traffic conditions and therefore

remains congested due to undergoing construction of Metro line. The NHAI, DMRC, HUDA,

Concessionaire are deciding to construct an underpass at junction at Ch. 31+050 to decongest

the traffic and also a four party agreement is being prepared for DMRC, NHAI, Concessionaire

& HUDA departments for this issue. The Draft agreement for this has being prepared and

being finalized by NHAI with DMRC/HUDA departments.

2.0 PROJECT DETAILS

2.1 PROJECT BACKGROUND

The Ministry of Road Transport and Highways (MORT&H), Govt. of India has decided to take up the

development of various National Highway Corridors where the traffic intensity has increased significantly

thereby necessitating capacity fragmentation for safe and efficient movement of traffic. National Highway

No.10, (NH-10) is part of North – South Corridor. The Ministry of Road Transport and Highways

(MOSRT&H) has entrusted to the National Highways Authority of India (NHAI) the development,

maintenance and management of the National Highway No.10 including section from Km. 29.700 to Km.

87.000. The NHAI had resolved to augment the existing road from Km 29.700 to Km 87.000 on the

Bahadurgarh- Rohtak in the State of Haryana by 4/6 laning on Build, Operate and Transfer (BOT) Basis.

The Project starts at Delhi / Haryana border at Ch. 29.650 and ends at Ch. 93.140 (design chainage). The total length of the project including the two (2) Bypasses is 63.49km.

For the realization of the above-mentioned project, a Concession Agreement between the NHAI and M/s. West Haryana Highways Project Pvt. Ltd. was signed on 6th November 2007.

The commencement date of the project is 3rd May 2008 with total project duration of 24 months. The project completion date is 2nd May 2010.

Intercontinental Consultants and Technocrats (ICT) Pvt. Ltd. has been appointed as the Independent Engineer for the project. An Independent Consultancy Contract was signed on 17 th January 2008 between the NHAI and ICT.

The Project involves the widening and strengthening of existing 2-lane dual carriageway into 6-lane divided carriageway from start of project at design Ch.29+650 to the beginning of Bahadurgarh Bypass at Ch.31+050 with a length of 1.40 km, new construction of 4-lane Bahadurgarh Bypass from Ch.30+050 to Ch. 44+400; eccentric widening of the existing 2-lane to 6-lane divided carriageway from Ch.44+400 to Ch. 68+400, new construction of 4-lane Rohtak Bypass from Ch. 68+400 to Ch. 93+140 which skips to urban center of Rohtak; 2 Major Bridges;9 Minor Bridges; 64 nos. Slab/Box Culverts; 5 Nos. Grade Separators/Interchanges; 4Nos. Vehicular Underpasses; 67 Nos. Pipe Culverts; and Project Facilities such as Toll Plaza, Roadside Furniture, Street lighting, Pedestrian Facilities, Landscaping and Tree Plantation, Rest areas, Truck lay-Bys, Bus-Bays and Bus Shelters, cattle Crossings, Development of Site for Wayside Amentias, Traffic Aid Posts, Medical Aid Posts, Vehicle Rescue Posts, Telecom System and Highway Traffic Management system.

4.0 ROLE OF INDEPENDENT ENGINEER

4.1 Design Review Stage

Undertake a detailed review of Drawings to be furnished by the

Concessionaire along with supporting data including the geo-technical and

hydrological investigations; characteristics of materials from borrow areas

and query sites, topographical surveys and traffic surveys.

Review any modified Drawings or supporting documents sent to it by the

Concessionaire.

Review the detailed design, construction methodology, quality assurance

procedures and the procurement, engineering and construction time

schedule sent to it by the Concessionaire.

Review and make comment on the EPC Contract or any other contract for

construction, operation and maintenance of the Project Highway.

4.2 Construction Stage

Review and make comment in respect of the Drawings, Documents and

Safety Report received by the Independent Consultant during the

Construction Period.

Review Monthly Progress Report furnished by the Concessionaire and

send comments thereon to the authority and Concessionaire.

Inspect the Construction Works and the Project Highway once every

month, and make out a report of such inspection (the “Inspection

Report”) setting forth an overview of the status, progress, quality and

safety of construction, including work methodology adopted, the materials

used and the sources.

Require the Concessionaire to carry out tests on sample basis to be

specified by the Independent Engineer in accordance with Good Industry

Practice for quality assurance. The Independent Engineer shall issue

necessary directions to the Concessionaire for ensuring that the tests are

conducted in a fair and efficient manner, and shall monitor and review

the results thereof.

Undertake review of the progress of constructions and identify potential

delays, of any.

To make recommendation to the Authority for the suspension of

Construction Works if the Concessionaire fails to make adequate

arrangements for the safety of the workers and Users in the zone of

construction.

Issue a Completion Certificate or Provisional Certificates, as the case

may be.

Make a fair and reasonable assessment of the costs of providing

information, works and services and certify the reasonableness of such

costs for payment by the Authority to the Concessionaire.

Aid and advise the Concessionaire in preparing the Maintenance Manual.

4.3 Operation and Maintenance Stage:

Review and make comments in respect of the Designs, Documents and safety

report.

Review the Maintenance Program furnished by the Concessionaire and send

comments to the authority and the Concessionaire.

Review the monthly status report furnished by the Concessionaire and send

comments to the authority and the Concessionaire.

Inspect the Project Highway once every month and make an O & M Inspection

Report.

Examine the request of Concessionaire for closure of any Lane (s) of the

carriageway for undertaking maintenance/repair works thereof.

Monitor and review the curing of defects and deficiencies by the Concessionaire.

Review and send comments on modifications that the Concessionaire proposes to

make on the Project Highway,

Undertake traffic sampling, as and where required by the Authority.

10.0 MAINTENANCE OF EXISTING ROAD:

10.1 Status of Maintenance:

The maintenance and repair work have been completed by the Concessionaire in most of stretches up to Km. 85+000. Some repair of rain cuts beyond Km. 85+000 still remains to be attended on Rohtak Bypass.

10.2 Maintenance measures required to be taken by the Concessionaire:

No maintenance measures were taken by the Concessionaire during the month and status is as follows:

I. Restoration of pavement affected due to rain cuts in Rohtak Bypass at the approaches of

(a) Minor Bridge at Ch. 88+393 (both sides)

(b) VUP at Ch. 91+131 (both sides)

II. Restoration of pavement due to rain cuts in scattered reaches from Ch. 86+700 to Ch. 93+140.

III. Slope protection work is yet to be taken up where height of embankment is more than 3.0m. particularly at the approaches of structures.

IV. The repair of strip seal expansion joints of various locations. The list of damaged strip seal expansion joints has been forwarded already to the Concessionaire.

V. Rectification of defects noted in the structures and for which the list of the same has already been submitted to the Concessionaire.

VI. The sealing of gaps in the RCC crash barrier panels at the grade separator at Ch. 33+445, Ch. 35+643, Ch. 38+440, Ch. 40+107, etc.

VII. Lot of bushes/wild growth have come up in the median & slopes of embankment obstructing the movement of traffic which are required to be attended by Concessionaire.

11.0 SAFETY MEASURES:

The Concessionaire must address required safety measures by deploying safety teams to look after the

work of safety measures on the project highway. The cleaning of chocked/non-functioning pipe & box

culverts is required to be carried out by the Concessionaire for which immediate efforts are required to

be made by the Concessionaire. The main points of concern are as follows.

(a) Unauthorized median cuts:

Existing Illegal cuts in median indicated in previous reports have not been closed and as such

present status remains same as given below:

(i) Km 31+500 (Sector – 9)

(ii) Km 50+950 (Rohad Village)

(iii) Km 52+190 (Near Toll plaza diversion)

(iv) Km 69+540

(v) Km 77+800 (Petrol Pump)

(vi) Km 83+450

(vii) Km 85+100

The above mentioned median cuts are on the stretch which has been opened to traffic (i.e. from

Ch. 29+650 to Ch. 85+372). These median openings are required to be closed immediately to

avoid accidents. Similar action in the further stretch from Km 85+372 to Km. 93+140 should also

be taken accordingly.

The illegal cut at CH. 50+950 has become an accidental spot. It should be either closed or this

crossing be developed as at grade junction.

(b) Fixing of Road Signs

Since the stretch from Km. 29.650 to Km. 85.372 has been opened to traffic so it has become very

necessary to fix the sign boards particularly at the junctions. Following are the junctions which

need immediate attention of the Concessionaire:

(i) Junction at Km. 68+400

(ii) VUP at Km. 69+600

(iii) Clover leaf at Km. 76+076

(iv) VUP at Km. 79+207

(v) Grade Separator at Km. 85+372

However work of fixing of sign boards has been completely stopped for the last six months.

Concessionaire should take up the work and fix sign boards which are essential for safety of road

users.

(c) Black Spots

Though the project highway has been constructed as per required specification & design but the

following spots except the illegal cuts are still existing at present which may also prove as

accident prone areas in future in the absence of further improvement .

(i) At grade junction at Km 35+350

Junction has been developed but the provision of a CUP of 4.5 m height will minimize the

accidents in view of height of embankment at this location.

(ii) At grade junction at Km 36+500

Provision of VUP at this location in place of at grade junction will bring the complete safety in

view of Bahadurgarh-Badli traffic and close vicinity of village Nayagaon.

(iii) At grade junction at Km 56+600

Provision of VUP is required at this location in place of at grade junction to make this junction completely safe in view of Sampla-Beri cross road at curvature of MCW and nearby adjacent Tehsil building Rest house and Girls College.

(d) Recommendations of Independent Engineer which have not been acted upon by the Concessionaire:

The Construction of balance works has been taken up by the Concessionaire but the following

observations made by the IE are yet to be complied with by the Concessionaire.

i. Shifting of electric lines crossing project highway on bamboos erected in median and shoulder areas in the stretches from Km. 67+500 to Km. 67+875 (median), Km. 68+100 to Km. 68+350 (RHS), Km. 89+720 to Km. 90+150 (RHS).

ii. Protection of slopes at the approaches of structures on Rohtak Bypass and high embankment stretches.

iii. Protection of site from encroachment, etc is required to be addressed as per clause 10.5 of the agreement. The Concessionaire has been directed several times through written and verbal directions however concrete steps are required to be taken by the Concessionaire in this regard.

iv. Land plan which is a basic record to be maintained has not been submitted by the Concessionaire despite of asking him so many times.

v. The Concessionaire should develop a dedicated team for monitoring the safety works as well as for protection of site which has been neglected completely by Concessionaire.

13.0 QUALITY REVIEW REPORT:

13.1 QUALITY ASSURANCE/MATERIALS TESTING REPORT:

The site inspection were carried out diligently and regularly by the representations of the Independent

Engineer and written/verbal directions were given to the Concessionaire regarding quality of workmanships,

rectification of non-conformities noted in some works as per issued NCRs, safety of project highway,

documentation of activities, etc. The directions issued on the activities which transpired during the reporting

month are as following.

(i) The Concessionaire was advised to take proper measures immediately in order to drain out the water on permanent basis to avoid any inconvenience to road users at grade separator at Km 33+400. The Concessionaire was further advised to take proper drainage measures in such a way that the water in drained out in shortest period of time after occurrence of rains in order to avoid the damage to the road crust. It was admonished that the road already damaged be repaired immediately particularly the repair of damaged slip roads at grade separators.

(ii) The Concessionaire was advised to use locally available sandy soil (tibba sand) materials in service road works and for balance earth works of the Project Highway to ensure good quality of earth works.

(iii) The Concessionaire was requested to take action for the compliance of safety observations at the earliest and submit the compliance report to this office accordingly.

(iv) The Concessionaire was advised to take actions for the safety of workers and of completed works because some discrepancies were noted during site inspection in the removal of shuttering materials/bars in superstructure of the non-track span of ROB at Ch. 86+177 (Rohtak-Bhiwani Line).

(v) The Concessionaire was advised to rectify the discrepancies in service road works to ensure that the FRL levels are not lowered at any location.

(vi) The Concessionaire was advised to take up the rectification work of trenches made at the slip roads at VUP at Km 79+207 and to report the compliance at the earliest for further submission of compliance report to the Project Director.

(vii) The Concessionaire was once again reminded to take action against illegal access/encroachments by serving the time bound notice to the encroachers for vacating the ROW.

(viii) The Concessionaire was requested to take immediate action to improve the quality of materials & workmanship of on going works.
