Page 4 Carers (Scotland) Act Now in Force
This outlines the key legal duties as detailed in the Carers (Scotland) Act 2016. It does not at this stage address where Ministers may make provisions through regulations and guidance.
The Carers (Scotland) Act 2016
Your Rights - What to expect
Many carers are unaware of their rights and entitlements, therefore missing out on the financial, practical and emotional support available to
them. This is an important new piece of legislation that was passed by the Scottish Parliament on 4th February 2016.
It extends the rights of adult and young carers in Scotland, placing a duty on local authorities to provide every carer with a carer support plan
and to provide support based on the Carer’s identified needs which meet the local eligibility criteria, if, the carer’s needs cannot be met by
services provided for the cared for person or through other supports.
Understanding the Act and using your rights to access the services and supports available to you from the wide range of public bodies and
local third sector organisations will help you to manage your caring role
The Local Authority now has:
A duty to prepare an Adult Carer Support Plan (ACSP)
A duty to prepare a Young Carer Statement (YCS)
A duty to set local eligibility criteria
A duty to involve Carers in carer services
A duty to provide support
A duty to provide a local Carer Strategy
The Local Authority must provide information and advice in particular about:
Carer’s rights
Income maximisation
Education and training
Advocacy
Health and wellbeing (including counselling)
Bereavement support services
Emergency and future care planning
This piece of legislation enhances the rights of Carers, although there are many additional acts that affect Carers such as :
Legislation affecting carers
The following legislation established a carers right to an assessment in their own right, a duty on local authorities to take into account carers’
views when putting together a community care package and a duty on NHS boards to produce Carer Information Strategies:
Carers (Recognition and Services) Act 1995 Community Care and Health (Scotland) Act 2002
Equalities Act 2010
This act began on 1st October 2010 and brought new legislation to protect carers from direct discrimination or harassment because of their
caring responsibilities. The Government Equalities Office (GEO) has produced a series of guides
including ‘Equality Act 2010: What do I need to know as a Carer?’
For more information call the Equality Advisory Support Service (EASS)
on 0808 800 0082 or visit www.equalityadvisoryservice.com
Everyone has the right to be treated fairly, legislation protects you from discrimination.
The Patient Rights (Scotland) Act 2011
It aims to improve patients’ experiences of using health services and to support people to become more involved in their health and health
care. Included in the Act was the establishment of a Patient Advice and Support Service (PASS). This service provides free, accessible and
confidential information, advice and support to patients, their carers and families about NHS healthcare.
For more information visit: www.nhsinform.scot/ care-support-and-rights GP Contracts are changing, this may make a difference when
you make a visit to see your GP
Work and Families Act 2006.
Carers in employment now have statutory rights to help them manage their work and caring responsibilities.
It gives carers of adults the right to request flexible working, building on the existing rights which were introduced in April 2003 for parents of
a disabled child under 18.
The Self-Directed Support (Scotland) Act
This Act became law in 2014. It introduced a new power for local authorities to support carers through a choice of 4
funding options. For more details see: www.selfdirectedsupport scotland.org.uk.
The Carers Charter - What to expect
Section 36 of the Carers Act requires Scottish Ministers to set out the rights of Carers in or under the act. The Carers’
charter explores those rights.
The Act requires the local authority to have local information and advice for Carers. One aspect of information that must be provided are Carers’ rights. The Act came into effect on 1 April 2018, it extends and enhances the rights of Carers in Scotland to help improve their health and wellbeing, so that they can continue to care, if they so wish, and have a life alongside caring. In the context of the Act, the care provision must not be under a contract or as a volunteer, it must be unpaid. Your cared for person must need support but not only (where they are under 18) because of their age.
Are you a Carer?
You are a Carer if you provide (or intend to provide) care for another person. You can be caring for any number of hours, it does not need to
be regular or substantial.
You may be a parent, a partner, a son or a daughter, a sister or brother or friend to someone who needs support as a result of their illness
(physical or mental illness and substance misuse), condition or disability. If you provide them with help and support to manage their life – you
are also a Carer.
Young Carers - Are under the age of 18 or over 18 but still attending school
Adult Carers - Are aged 18 and over and not attending school
Kinship Carers - Are looking after a child in place of the parents and meet the meaning of “Carer” not caring simply because of
child's age
Your rights under the Act:
Adult Carers have a right to an: Adult Carer Support Plan
The responsible local authority must offer an Adult Carer Support Plan to anyone they identify as an Adult Carer. They must prepare an Adult
Carer Support Plan for anyone who accepts this offer. They must also prepare an Adult Carer Support Plan for anyone who meets the
definition of an Adult Carer if that person requests one.
Young Carers have a right to a: Young Carers Statement
The responsible authority must offer a Young Carer Statement to anyone they identify as a Young Carer. They must prepare a Young Carer
Statement for anyone who accepts this offer. They must also prepare a Young Carer Statement for anyone who meets the definition of
Young Carer if the Young Carer requests one.
Support comes in many forms from many organisations: Right to support to meet any ‘eligible needs’
The responsible local authority must provide support to any Carer who has identified needs (which meet local eligibility criteria) that cannot
be met through support provided to the person being cared for, or through general local services.
Steps to involve Carers and carer representatives in planning and evaluation:
The right to be involved in services
The responsible local authority must involve Carers in planning their local carer services and when assessing Carers support needs.
They must consider Carers views when assessing their cared for persons needs and additionally when preparing and reviewing short
breaks statements.
Carers are informed, heard and their views considered before discharge:
The right to be involved in the hospital discharge process of the cared for person
Each health board must ensure that, before a cared for person is discharged from hospital, it involves Carers in the
discharge of the cared-for person.
