2. VEHICLE REGISTRATION2.1 General Information2.1.0 Studentsmay register their vehicle via the online parking

ID purchasing system located on MyStateOnline. Faculty and employeesmay register their vehicle via the onlineparking ID purchasing system located on InsideState. Online purchasing will be available until the date specified online, afterwhich walk-up purchase will be available at the Cashiers Office,SAD 136 Monday through Friday 9 am to 5 pm.

2.1.1 Mopeds are not required to have a parking ID. For safety reasons,mopeds will not be driven on the sidewalks. Mopeds may be parkedin the bike racks located throughout the campus. Mopeds arerequired to observe the rules of the road. Bicycle Regulations are published separately.

2.1.2 All students, faculty, career service employees, and volunteers whomaintain a headquarters on the campus and who operate one or more motor vehicles in areas under the control of the University must:

2.1.2.1 Obtain a parking ID and must register their vehicle(s) via onlineparking ID purchasing or with the Cashiers Office, SAD 136.

2.1.2.2 Properly affix the vehicle identification marker to vehicles andmotorcycles as instructed on the parking ID after removing allexpired parking IDs, or

2.1.2.3 Properly display hanging parking IDs from the rearview mirror of the vehicle.

2.1.3 Vehicles must be registered each year. A registrant does not acquirethe status of a visitor during vacation and between semesters.

2.1.4 The parking ID is not valid without proper validation sticker for the current academic year.

2.1.5 State vehicles parking in a lot must purchase a parking ID for that lot.2.1.6 Trailer Parking. Cargo trailers brought on campus are to be parked

in the remote parking lot and are required to have a parking ID.

2.2 Registration Procedure2.2.1 Faculty and Employee Registration. Faculty and other employees

register vehicles via online parking ID purchasing or with theCashiers Office, SAD 136.

2.2.2 Student Vehicle Registration. At registration every student who operates a motor vehicle on campus must be registered with theCashiers Office, SAD 136 or via online parking ID purchasing. Theparking ID must be displayed by the first Friday after registration.Each student with a motor vehicle, which is to be operated in theUniversity area, will be issued a vehicle parking ID marker.

2.2.3 Those who leave the University should return their parking ID to the Cashiers Office to prevent unlawful use of the parking ID. Refunds will be available according to the parking refund policy, see section 3.4.

2.2.4 All parking IDs shall be purchased at prices as set forth in section3.3 of these rules and regulations.

2.3 Change in Classification and Lost or Stolen Parking IDs2.3.1 If an individual’s classification changes, as it pertains to these rules

and regulations his/her vehicle must be re-registered immediatelywith the Cashiers Office. The old parking ID shall be re-validatedwith new appropriate parking classifications.

2.3.2 Permanently attached parking IDs are not transferable. If a motor vehicle is sold or transferred, the parking ID for that vehicleor its remnants must be returned to the Cashiers Office before a replacement parking ID will be issued. Liability for fines remainswith the original registrant until the parking ID is returned to theCashiers Office.

2.3.3 Hanging parking IDs are transferable from one vehicle to anotherregardless of ownership. Tickets and resulting fines are assessedagainst the owner of the parking ID.

2.3.4 Lost or stolen parking IDs are the responsibility of the registered ownerand should be reported to the Cashiers Office immediately. Since stolenparking IDs could still be used in the parking system, only properly reporting it can guarantee unwanted future financial liability for fines.Owners/operators needing to replace a lost or stolen parking ID will beissued a two-week temporary parking ID. If the lost or stolen parkingID is not located within the two weeks, the owner shall be required topurchase a replacement parking ID as defined in 3.3. In case of fire,motor vehicle accident, or similar occurrences (excluding theft or loss),

the parking ID may be replaced free of charge upon presentation of apolice report documenting the loss. Protect your parking ID and othervaluables by locking your vehicle.

2.4 Parking ID Enforcement: August 1–May 21Reserved/Commuter/All Class:Enforced 2 am-4 pm, NO PARKING 2 am-5 am

LOTS 16 AND 17 MUST BE CLEARED BY 4 PM ON GAME DAYS.Remote/Residence Hall/Residence Hall Reserved: Enforced 24 hrs/day

2.5 Falsification and Misuse2.5.1 Falsification or misrepresentation of information in the application

for a parking ID or in the appeal of a violation may subject theoffender to revocation of driving and parking privileges on allUniversity-owned, leased, and supervised property and streets.

2.5.2 Any person who obtains or attempts to obtain a vehicle parking ID with intent to defraud may be subject to revocation of drivingand parking privileges on all University-owned, leased andsupervised property and streets, and may be charged criminally in addition to University action.

3. CLASSIFICATION OF PARKING IDs & FEES 3.1 Types of Vehicle Parking IDs Issued

19 Residence Hall. Issued to residents in residence halls and marriedstudent housing. All vehicles bearing an 19 parking ID may park in any lot designed as 19 parking, All Class or Remote parking.

5 Residence Hall Reserved. Issued to residents in residence halls whohave purchased a Reserved parking ID for the reserved lot 5. Personswith a reserved lot 5 parking ID may only park in lot 5 which isreserved for them, All Class or Remote lots. If reserved lot 5 is full, callthe SDSU Police and they will direct you where to park temporarily.

C Commuter. Issued to students, faculty, and staff who commute tocampus. Vehicles bearing a C parking ID may park in lots designatedfor C parking, All Class parking, or Remote parking areas only.

D Residence Hall Directors.Vehicles bearing a D parking ID may parkin the specific reserved space provided in the assigned lot or in anydesignated C parking, All Class or Remote parking areas.

H Handicapped. To be issued to permanently handicapped staff and students needing handicapped parking. In order to purchase an H parking ID, an individual must already have registered thevehicle with the County Treasurer and State DMV and possess a Handicapped Placard.

MC Motorcycle.Motorcycles bearing this parking ID may park only inthe designated MC parking spots located throughout the campusand around residence halls. These parking areas are not availableduring winter months.

GK Gold Key. An application for the Gold Key parking ID must becompleted at the Cashier’s Office. Guidelines for the application are:a.May be issued to individuals who have provided a service to theUniversity and have retired. Current, full time or part timeemployees are not eligible.

b.May be issued to members of the Campanile Society orDistinguished University Benefactors.

c.May be issued to individuals who have made noteworthycontributions to the Society.

d. GK parking privileges are only intended for use by those specified,not other individuals such as family and friends. Approval of theapplication for the Gold Key parking ID must be made by a Dean,Vice President, or President of SDSU. If approved, the Gold Keyparking ID holder may park in any general parking area oncampus in all classes except D or Reserved lots. Retired individualsare no longer eligible for Gold Key Status if they are rehired by theuniversity.

X Reserved. To be issued to faculty, staff, or students who havepurchased a Reserved parking ID for the reserved lot of their choice.Persons with a Reserved parking ID may only park in the specific lotsreserved for them,All Class or Remote lots. If your reserved lot is full,call the SDSU PD and they will direct you where to park temporarily.Reserved parking ID holders will have first priority for renewing

Welcome Visitors1. Stop In. If you are visiting the SDSU campus, we can

make parking arrangements for you. Stop at the University

Police Department (SDSU PD) in the Sorenson Center, call

688-5117, email [email protected] or visit us online

at http://parkinginfo.sdstate.edu.

2.Free Visitor Parking. Visitors can park for free with

a valid visitor parking ID. Visitor parking IDs are issued free

by the Admissions Office (Administration Building, Room 200),

Info Exchange (University Student Union) or the SDSU PD and

are valid for one business day only, as indicated on the ID.

Visitors may park in visitor lots, visitor stalls or any parking lot

that is not designated as reserved, and may use Handicapped

parking spaces with a valid county- or state-issued Handicapped

placard. Visitor parking IDs must be completely filled out and will

not be issued to individuals working for the University (full or part

time), or students enrolled in courses.

3.Parking Ticket. If you are a visitor and you are issued a

parking ticket for having No Marker, please sign the ticket and

drop it off at any department main office or mail it to the SDSU

PD so the ticket can be cleared. Visitor status does not apply tostudents, faculty, employees, or volunteers on campus for the

purpose of conducting business.4.Bicycle Regulations. SDSU has a campus-wide Bicycle

Regulations program. Details are available at SDSU PD.

Parking & Traffic Regulations1. INTRODUCTION1.1 General Information1.1.1 Enforcement. The SDSU Police Department is responsible for the

enforcement and administration of the regulations. PURCHASE OF PARKING ID. The Cashiers office is responsible for the sale,administration and distribution of parking decals/ID’s.

1.1.1.1 These regulations are in effect throughout the year. Specificrestrictions regarding parking and vehicular access may apply and are included herein.

1.1.1.2 All parking areas are identified by signage or on the enclosed map.1.1.1.3 During emergencies or special situations, it may be necessary to

temporarily suspend or otherwise modify these regulations. In timesof such emergencies or special situations, directions will be given by theSDSU PD and/or the Office of the President. If time permits, signagewill be installed and public service announcements will be made.

1.1.2 Disabled Vehicles. Assistance may be obtained by calling the SDSU PD at 688-5117 or for emergencies call 111 (campus phone)or 688-6805. If the disabled motor vehicle impedes the flow oftraffic or creates a hazard, police may have the vehicle towed.

1.1.3 Abandoned Vehicles.Vehicles abandoned on University propertywill be removed and impounded at the owner operators’ expense.Any vehicle apparently abandoned for more than seven (7) days willbe considered to be in dead storage. Such vehicles may be towed awayat the owner’s expense as described in paragraph 4.4.9. Also see 1.1.4.

1.1.4 Vehicle Storage. Storage of vehicles is not permitted on campus. See 1.1.3.

1.1.5 Liability for Damage. The University assumes no liability for damageto any vehicle, or for any injury to the operator, the occupant(s), or anyother person.

1.1.6 Accidents.Vehicle-related accidents that occur on campus must bereported to the SDSU PD immediately. It is recommended that theaccident be reported before the vehicles are moved.

1.1.7 Comments. Submit comments in writing to: Chairperson, Parkingand Traffic Committee, University Police Department, Box 520,Brookings, SD 57007-3505.

1.1.8 Procedural Additions. In addition to published rules and regulations,rules of a procedural nature having limited effect may apply, dealingwith media parking IDs, contractor parking, etc.

1.1.9 The use of a vehicle on campus is a privilege, not a right. Violation of thisprivilege is prejudicial to the common interests of all members of SouthDakota State University. Violations may lead to the loss of the privilege.

1.2 Definitions1.2.1 Motor or Motorized Vehicles. Every motorized device in, upon, or

by which any person or property is, or may be transported, or drawnupon any University controlled street.

1.2.2 Visitors. Invited and uninvited guests of the University, its departments,or members of its community.

1.2.3 Owner/Operator. The person (or legal entity) in whose name a motor vehicle is registered, or in whose name a parking ID isregistered with the University; or in the case in which a motorvehicle is not registered with the University, the person (or legalentity) named as the registered owner under Federal or State Law.

1.2.4 Enforcement. The SDSU PD is charged with the enforcement oftraffic regulations on University-owned or leased properties. TheSDSU PD is located in the Sorenson Center at the corner of HarveyDunn and Medary Avenue, and is open 24 hours per day. Call 688-5117 or for emergencies call 111 (campus phone) or 688-6805.

1.2.5 Parked Vehicle. A motor vehicle that is stationary, except whenprogress is temporarily impeded by the other traffic or signage.Vehicles stopped or standing, other than when so temporarily impeded, shall be considered parked.

1.3 AuthorityThese regulations are formulated by South Dakota State Universityunder policy guidelines recommended by the Parking and TrafficCommittee as liaison to the President of South Dakota StateUniversity and the South Dakota Board of Regents and are in general consonance with policy guidelines set forth by these bodies.2 3

vehicle to unnecessarily turn abruptly or sway, shall be guilty of the misdemeanor of exhibition driving.

4.5.2 Careless Driving–$90. Any person who drives a vehicle carelesslyand without due caution, at a speed or in a manner so as toendanger any person or property, not amounting to reckless driving on University-owned, leased and supervised property andstreets shall be guilty of the misdemeanor of careless driving.

4.5.3 Reckless Driving–$120. Any person who drives a vehicle carelesslyand heedlessly in disregard of the rights or safety of others, orwithout due caution and circumspection, and at a speed or in amanner so as to endanger or be likely to endanger any person orproperty, shall be guilty of the misdemeanor of reckless driving.

4.5.4 Other Moving Violations. Affronts to the University Driving Codeor violations of state traffic laws or city traffic ordinances notspecifically mentioned above fall into the category of Other MovingViolations. Specific examples include, but are not limited to, drivingthrough a barricade or driving on grass or sidewalks. Fine for thisgeneral violation is $24 or as prescribed by the appropriate court.

4.5.5 Stop Sign Violation–$50.All vehicles are required to come to acomplete stop at all stop signs.

5. PAYMENT OF VIOLATION FEES & APPEALS5.1 Payments of Violation Fees For a University Ticket5.1.1 All payments of fines shall be made within 96 hours after the date

of issuance for each violation, excluding Saturdays, Sundays, andschool holidays. Payment of fines and/or submissions of appealsmay be made at the SDSU PD. Appeals must be filed within 96hours of the date and time of issuance of the ticket.

5.1.2 Failure to pay a violation fee or submit an appeal within 96 hoursafter the date of issuance, excluding Saturdays, Sundays, and schoolholidays will result in action as defined in 5.3.

5.1.3 Unless an appeal is initiated, a $3 late fee will be added to eachcitation 96 hours after issuance, excluding Saturdays, Sundays, and school holidays.

5.1.4 If payment for a citation is not received within five (5) school daysafter the last day of registration, a processing fee of $5 will be added toeach citation and the fine may be collected through the University’saccounting system. For students, see 5.3.1.2. For employees see 5.3.1.3.

5.2 Appeals5.2.1 Individuals who feel that an injustice has been committed by the

issuance of a citation may appeal their University violation. Appealsmust state concisely, but fully, the grounds on which the appeal is based.

5.2.2 An appeal must be submitted at the SDSU police department or bye-mail within 96 hours, excluding Saturdays, Sundays and schoolholidays after the issuance of the citation for the appeal to beconsidered valid. An appeal request form can be found online athttp://parkinginfo.sdstate.edu. Links and complete instructions for filing an appeal are available through MyStateOnline (Students)and InsideState (Faculty and employee).

5.2.3 Individuals who appeal citations may appear personally before theAppeals Committee. Each appellant shall be given the date and timeon which to appear before the Appeals Committee. If appellantcannot appear on the date given, they may reschedule once withinthe semester. If the appellant cannot appear any of the scheduledappeal dates, a written appeal must be received by the SDSU PDprior to the start of business on the day of the Appeals Committee.If the appellant fails to appear personally or submit a written appealwithin the semester in which the citation was issued, the appeal shallautomatically be denied and the appeallant shall be so notified and berequired to pay the fine for the action. If your appeal is denied, youwill be charged a filing fee of $10.

5.2.4 The decision to grant or deny a citation is final.5.2.5 A violation fee which has been appealed and denied by the Appeals

Committee must be paid within seven (7) working days of denial,excluding Saturdays, Sundays, and school holidays.

5.3 Collection of Violation Fees5.3.1 Failure to pay violation fees after written notice results in the

following action:

5.3.1.1 Transcripts of students shall not be released until all requiredviolation fees are paid in full.

5.3.1.2 Unpaid student parking violation citations will be applied to thestudent’s account periodically throughout the semester. It is the sole responsibility of those with unpaid fines to provide payment of parking violations either at the SDSU PD or by student fees. The offices of UPD and Cashiers will assist in verifying that all citationshave been accounted for. Neither the SDSU PD nor the Cashiers office is responsible for costs incurred as a result of the vehicle being towed. (See section 4.4.10)

5.3.1.3 Failure of any employee to pay violation fees in the prescribed timeperiod is an infraction of SDSU administrative rules. In the case of terminating personnel (voluntary or involuntary, includingretirement), the deduction will be taken from the last pay check.

6. MISCELLANEOUS6.1 Multiple Ownerships6.1.1 In case of multiple ownership and operation, a vehicle identification

marker will be issued in the name of one individual only, and he/sheshall be responsible for the motor vehicle. That individual shall bethe one with University affiliation as an employee or student.

6.1.2 Ownership Liability. The person in whose name the vehicle isregistered or if the vehicle is not properly registered, the person whohas legal possession of the vehicle shall, be held liable for all violationsattached to the vehicle and is subject to any and all fees or disciplinaryaction resulting from the violation.

6.1.3 An employee or student who acquires a different motor vehicle afterthe regular University registration period shall register his/her vehiclewith the Cashiers Office.

6.1.4 Faculty and employees may not purchase C, X or D parking IDs for vehicles used primarily by their student spouses or children.

6.2 Pedestrians shall at all times have the right of way on all University-owned, leased and supervised property, and streets.

7. THE PARKING AND TRAFFIC COMMITTEE7.1 Membership and Quorum7.1.1 The Committee shall consist of three (3) faculty members appointed

by the President, three (3) career service employees selected by theCareer Service Advisory Committee and approved by the President,two (2) administrative personnel appointed by the President, and five (2) students appointed by the Students’ Association, (2) StudentRHA and (1) Student from the Grad College. Seven members shallconstitute a quorum. All actions of the Committee shall be presentedto the President for approval, and the President alone shall have thefinal decision on all recommendations.

7.2 Objectives7.2.1 To provide maximum parking area in the best interest of the

University, consistent with the natural beauties of the campus.7.2.2 To allocate equitable parking to those in need of convenient

transportation among faculty, employees, and students.7.2.3 To maintain lawful traffic movement with a minimum

amount of disturbance and proper protection for pedestrians.7.2.4 To ensure access for emergency vehicles.

7.3 Duties7.3.1 Designate parking areas and establish parking and traffic rules,

penalties, and fees.7.3.2 The Committee, or subcommittee, thereof, shall review and rule

--on all appeals and shall determine additional penalties to beimposed in cases of repeated or flagrant violations.

7.3.3 Duly authorized representatives of the Committee shall enforce the regulations and collect the fees.

7.3.4 Recommended fees shall be as established and described herein.

7.4 Amen dmentsAn amendment to the current Parking and Traffic Regulations shall be considered in force after being published in the SDSUCollegian or University “InsideState” and “MyState.” Please checkhttp://parkinginfo.sdstate.edu for the most current version.

R Remote. To be issued to any student, employee, or faculty. Vehicles bearing a Remote parking ID may park only in a parking lot designated for Remote parking.

3.2 Temporary Parking IDs3.2.1 Any individual who is being paid to work on the campus as an

employee of SDSU on a temporary basis must purchase a temporaryparking ID in order to park on campus. Temporary parking IDs areissued by classification as described in Section 3 of these rules andregulations. Temporary parking passes available at Cashiers Office.

3.2.2 Temporary parking IDs will not exceed 30 days.3.2.3 Temporary parking IDs will not be issued in Reserved lots except

as described in 3.2.4.3.2.4 A temporary Handicapped parking ID may be issued upon

demonstration of need and/or statement from a practitioner of medicine for a period as determined by the practitioner. If additional time is needed, the parking ID may be renewed. Vehicles may park in any legal handicapped stall.

3.4 Parking ID RefundsTo obtain a refund, the individual must return their decal to theCashier’s Office. Total Separation from the University must occur for an individual to apply for and receive a parking ID refund. TotalSeparation is defined as an individual that no longer has status as astudent, staff or faculty member at SDSU or is no longer an employeeof an independent business operation performing services on SDSUproperty. The amount of the refund will be according to the refundschedule. Refund policy and schedule available at Cashiers Office.

4. VIOLATIONS AND FEES4.1 Areas of Violation4.1.1 The motor vehicle laws of the State of South Dakota, common sense,

and driving courtesy shall be adhered to by all those who operate avehicle or bicycle on University—owned, leased, and supervisedproperty and streets.

4.1.2 It is the responsibility of the motor vehicle operator to legally operateor park the motor vehicle. Lack of a parking space is not considereda valid excuse for parking illegally.

4.2 Multiple Tickets The issuance of a ticket for a violation does not preclude the issuanceof additional tickets for the same or similar violations on the sameday or subsequent days.

4.3 Determination of Violation Fees University traffic violation fees are established by the Parking andTraffic Committee.

4.4 Parking ViolationsParking or traffic signs need not be displayed for a citation to be issued.

4.4.1 No Parking violations. The following actions constitute a NoParking Violation and shall be accompanied by a Traffic ViolationFee as listed below.Vehicles parked in the following manner may be towed at owner’s expense. See 4.4.9.

4.4.1.1 Parked in a No Parking area–$50.

4.4.1.2 Obstruction, partial or complete, of any crosswalk or sidewalk–$50.4.4.1.3 Fire hydrant/fire lane–$75. Parking within 15 feet of a fire hydrant

or parked in a fire lane. 4.4.1.4 Loading zone–$50. Parking in any loading zone, except when

loading or unloading the vehicle.4.4.1.5 In front of a movable barricade–$50.4.4.1.6 Double parked–$50.4.4.1.7 Parallel or diagonally parked in the wrong direction

(i.e., the wrong side of the street)–$50.4.4.1.8 Backed into a stall on a street–$50.4.4.1.9 Improper parking–$50. Parking outside a marked stall

(taking up two parking places, parked across boundary lines, etc.).4.4.1.10 Unauthorized parking–$100. A vehicle parked in any area other

than sanctioned streets or parking lots. 4.4.1.11 Obstructing traffic/outside of a marked parking boundary–$50.4.4.1.12 Emergency snow removal–$25. Any lot which has been declared as

an emergency snow removal lot.4.4.2 No parking ID–$50. Any vehicle parked on campus by an employee

or student or for the benefit of an employee or student must beregistered and have the appropriate parking ID properly displayed.

4.4.3 Improper parking ID–$50. Parking in a designated area other thana Reserved lot without a corresponding parking ID.

4.4.4 Improper display–$25. Failure to display parking ID according todirections on or accompanying the parking ID.

4.4.5 Fake/altered parking ID. The owner of the vehicle will be charged$200 for having a fake or altered parking ID and will be required topurchase an official SDSU Parking ID. The vehicle may also be towedat the owner’s expense, and the owner may be charged criminally inaddition to University action. See 2.5.

4.4.6 Unauthorized parking in a Reserved lot–$50. The vehicle may alsobe towed at the vehicle owner’s expense in order to free the spaceoccupied by the unauthorized vehicle. See 4.4.9.

4.4.7 Overtime parking–$25. Exceeding the limit for parking in an areadesignated with a maximum time limit.

4.4.8 Handicapped stalls –$200. To facilitate handicapped faculty, staff,students, and visitors, SDSU has installed numerous handicappedparking stalls. Any unauthorized vehicle will be ticketed and may be towed at owner’s/operator’s expense.

4.4.9 Towing. If a motor vehicle owner/operator is in violation and thevehicle is towed, all costs associated with the fine, towing and storageshall be the responsibility of the vehicle owner/operator and thevehicle will not be released until the owner/operator pays alldelinquent fines to UPD. Towing charges paid in cash to thecontracted towing company.

4.4.10 Outstanding fines.Operators of motor vehicles with outstandingfines of $100 or more may have their vehicles towed and impoundedat the owner’s/operator’s expense. The vehicle will not be releaseduntil the owner/operator pays all delinquent fines to UPD. Towingcharges are the responsibility of the vehicle owner/operator and are to be paid to the towing company per their specific payment policy.SDSU and/or UPD have no involvement in payment policies adoptedby private towing contractors.

4.4.11 Extended holiday parking. To facilitate cleanup and snow removal ofparking lots during extended holidays, i.e., Thanksgiving, Christmas,Spring Break, (holidays extending four (4) or more days), all vehiclesleft on campus during these periods, must be parked in the Remote(R) parking lot. Vehicles in any other area during these times may be ticketed and towed.

4.5 Moving ViolationsMoving violations, unless otherwise indicated, will be the same asthe city or state rate for the violation. Upon conflicts, it will be at the discretion of the officer.

4.5.1 Exhibition Driving–$60. Any person who drives a vehicle onUniversity-owned, leased, and supervised property and streets in such a manner that creates or causes unnecessary engine noise,tire squealing, or skidding or sliding as a result of rapid accelerationor stopping, or that simulates a temporary race, or that causes the
