ACCEPTANCE OF TENDER

Council may decide not to accept the highest or any tender it receives. Council will accept the tenders most advantageous to it having regard to sound contracting principles and the overall value outcome achieved. Section 228 (7) of the Local Government Regulations 2012 relating to changes to tenders may be applied. Payment to be made in accordance with the terms of the signed Contract for Houses and Residential Land prepared on acceptance of the tender. Price tenderer is to be on a lump sum basis.

CONTRACT TERMS

The Buyer accepts to buy the property on an “As Is, Where Is” basis and has relied upon their own investigations and judgement in assessing: (i) The condition of the property; (ii) The encumbrances on the title (with the exception of any mortgage, writ or caveat which must be released at completion); (iii) The requirements of any local authority; And hereby waives any right they may have under the Contract or otherwise to terminate or claim compensation from the Seller ordinarily under any other standard conditions herein.

Settlement shall be 30 days from date of Contract.

TENDER SUBMISSION

Tenders must be submitted by 8am 11 June 2021 using Part 3 - Respondent’s submission form provided. Tenders may only be lodged via email to [email protected] noting the tender number in the subject line or hand delivery, ensuring the tender number is easily identifiable, to a physical tender box at one of the council offices located at:

(a) 65 Egerton Street Emerald; or

(b) 10 Mackenzie Street Blackwater; or

(c) 4 Conran Street, Capella; or

(d) 12 William Street, Duaringa; or

(e) 29 Eclipse Street, Springsure.
