In the matter of Dorothy Partch, an incapable person the

undersigned Petionner hereby objects to the appointment of State of

Connecticut/Department of Social Services as Conservator, based on the

following:

1. That Marjory Partch has been designated as the Conservator;

2. That there has been no full evidentiary hearing under 45a-651to

determine whether a family member is more properly suited to be a

conservator;

1. That the Petitioner has filed a Motion to recuse the Norwalk

Probate Judge.

2 . That the Petitioner has filed a Motion to Subsitute herself as

Successor Conservator

3. That no evidentiary Hearing has been held regarding the

appropriateness of afamily member i.e. Marjorie Partch

4 . That the Motion to Recuse must be heard first and then a full

evidentiary hearing must be held to determine the appropriateness of

Marjorie Partch

Judge of the Probate Court of Norwalk recuse himself from the Motion to

Substitute Executor based on the following:

1. That the Probate Judge has clearly indicated his position regarding

the appointment of Marjorie Partch, the daughter of Dorothy Partch,

as a possible Conservator; and

2 .. The Petionner believes that in order to receive an impartial fairhearing, this matter be transferred and heard by another Judge.
