NEGATIVE BRAINS IN SANCHAR BHAVAN
The 14 storey skyscraper Sanchar Bhavan in New Delhi has manychambers. A bureaucrat sitting in one of such chambers was soimpudent to state that he puts all requests on pension revisionof BSNL/MTNL retirees in dustbin. He gets huge salary, as revisedwith 7th CPC fitment benefits, to do so.
On 24-8-2014, we submitted a memorandum to 7th CPC. Thechairman of CPC, Justice (Retd.) Mr. A K Mathur, stated that wehad a prima facie. In March 2015 Ms. Meena Agarwal, Secretaryto 7th CPC informed us that CPC sought views of DoT on thatmemorandum. Though the letter from CPC reached SancharBhavan on 5-1-2015, the ‘big baboos’ kept it in the dustbin for 8months. We pointed it out to the then Secretary, Telecom Mr.R. K, Garg on 4-8-2015. Thereafter the dustbin baboos sent theviews of DoT to CPC on 16-8-2015. But, the time limit was overand hence the ‘views’ went to the dustbin of CPC office. Now,these baboos of Sanchar Bhavan, who killed the matter, ask:“Where is recommendation from CPC on your pensionrevision?” They get huge salary to ask such dumb questions.
AUAB rightly demanded delinking pension revision from payrevision in BSNL. During discussion on 3-12-2018, the ‘bigbaboos’ in DoT informed the Minister that they had already takenup the matter of delinking with DoP&PW. So the Minister assuredthat it would be expedited. But the ‘wisemen’ in Sanchar Bhavanchambers deliberately sent a half cooked stuff to DoP&PWexpecting a negative reply from DoP&PW. Now, DoP&PW hassent the File back to DoT asking to resubmit it with concreteproposal how the pension would be revised after delinking.Officers in DoP&PW say that they have not rejected the proposalbut the ‘big baboos’ in Sanchar Bhavan say that it is ‘virtuallyrejected’. They misguided the Minister. They try to misguideall. They will get huge salary for it.
We hope that Smt. Aruna Sundararajan, an efficient IAS Officer,and the Minister will understand what is being cooked in SancharBhavan chambers and come to the rescue of BSNL retirees whotoiled and developed Indian Telecom infrastructure that gave aprofit of Rs 10,000 Crore per year to the BSNL. Such people donot deserve the humiliation after retirement.
Remember: One day the green leaves will also fall.

CWC meeting:In fact, we have no member atKanyakumari. But we held ourCWC meeting there. Our PresidentCom. PSR took the responsibilityto make arrangements and trav-elled from his home in Trivandrumto Kanyakumari (about 90 KMs)several times for it. Com. Chellaiah(DS Nagercoil) and 15 comradesof our Nagercoil SSA Unit renderedall help to PSR. Thus, the CWCbecame very successful. Accom-modation was super. Food alsowas good. Our comrades couldwatch the gorgeous sunrise fromVivekananda Kendra itself. Timeavailable was utilized for seriousdebates on organizational matterand main issues. Com. G NHariharan Nair, the CS of DOT-BSNL Pensioners Association,Kerala, (a constituent of CBMPA )greeted the meeting.
Some CWC members could notattend the Kanyakumari meetingfor personal reasons. Com. DG,our senior Vice President thoughstarted from his house developedsome uneasiness before reachingrailway station in Chennai. Imme-diately he was taken to hospital forcheck up. It was due to suddenshoot up of blood sugar. He is nowconvalescing in his house. We feltbadly his absence in the debate.Comrades A Sugumaran, H SPrasad, A Sudhakara Rao, Jagdir
Singh and S R Dutta also couldnot attend CWC as also Circle Sec-retaries of Chhatisgarh, Haryana,Jharkhand, Kolkata TF and UPWest.
POST CARD CAMPAIGNBased on the feedback from CircleSecretaries it is assessed thatmore than 35400 post cards weresent to the PM by our comrades.Adding the number from CBMPAconstituents, it is more than 45000.I profusely congratulate all ourcomrades for enthusiastic andprompt response to the call.
Decisions/ResolutionsImportant decisions taken by CWCare given in Page 6 of this issueand hence not repeated here.CWC adopted few resolutions as: a) Demand the Minister forCommunication to honour his as-surance given to AUAB that pen-sion revision would be delinkedfrom pay revision in BSNL. b) Demand the DoT to resub-mit the File on delinking toDoP&PW with concrete proposalon pension revision as required byDoP&PW, without further delay. c) Release sufficient funds toclear all pending bills and pay infull the quarterly allowance underBSNLMRS. d) DoT should pay the premiumto CGHS, as one time measure, sothat the pensioners can migratefrom MRS to CGHS. Since many of the pensionersare residing in areas not coveredby CGHS at present, CGHSWelness Centres should beopened in all remaining districtsheadquarters in the country.
e) Augment staff in CCA officesto launch the CPMS effectively andwithin the time frame. f) Start Pension Adalat at thenational level for sorting out issuesrelated to BSNL pension. g) Thanking the Bangalore TDUnit of NFTE-BSNL for providingthe space free, to function our CHQoffice.
SECRETARIATMajor problem in convening CWCis in getting train tickets on shortnotice. Therefore, CWC decidedto constitute a CHQ Secretariatwith the following 12 comrades, tomeet occasionally and to take col-lective decisions:

The Central Working Committee ofAIBSNLPWA met in Kanyakumari on 13th and14th February 2019 without any formalinauguration or any Open Session; to save timefor discussing very seriously certain issues andorganizational task to march ahead to the newheights. We met in CWC to review our workduring the last nine and a half years. We met toassess if we had done justice to our solemndeclaration made on 20th August 2009launching this organization that “we shall workto protect and safeguard the interest of entireBSNL pensioners in the country, without anypolitical, regional, communal or cadre bias andthat we shall work unitedly irrespective of theorganizations with which we had associationwhile we were in service.” It was a clearconscious statement.
We had launched this organization because; In 2006, the 6th CPC was appointed. Therewas nobody to raise our problem before the CPC.In 2008 September, the Government issuedorders implementing 6th CPC report on pensionrevision. But, BSNL pensioners did not get anybenefit. There was none to plead for us then. In 2008 February, 50% IDA was merged in PSU,but it was not given to pensioners. BSNL staffunions naturally fought for employees, nobodytalked about pensioners. On 26-11-2008, theDPE issued order on pay revision for PSUExecutives. On 5-3-2009, BSNL endorsed thatorder. But retired executives were not given anybenefit. In 2009 itself negotiations werecommenced on wage revision for the Non-Executives in BSNL. None raised the demandfor pension revision in BSNL at that time.
WE LAUNCHED AIBSNLPWA ON 20-8-2009 ANDSTARTED OUR STRUGGLES.
We achieved Pension Revision on 15-3-2011,first instant in Central PSUs. On 8-7-2011,the new order for full Pension on completion of10 years was got extended to BSNL retirees.Simultaneously we achieved pension @ 50% ofLast Pay Drawn for BSNL retirees also. Therewas nobody else to raise these demands. Wedemanded and achieved two family pensions forEx Servicemen re-employed in BSNL. MRSwas first denied to spouses of pensioners. Westruggled and got it. BSNL agreed to allot StaffQuarters to pensioners on our demand. Weachieved concession on BSNL Broadbandconnections to pensioners. The new ordergranting family pension to unmarried daughters/divorced daughters etc. without any age limitwas got extended to BSNL also. Favourableorder on deferred option cases is yet anotherachievement of AIBSNLPWA. When servingstaff got the benefit of 78.2% IDA in pay revisionin June 2013, ‘leaders’ kept mum when DoTdeleted the sentence regarding pensioners in theagreement. We had to struggle for about threeyears to get it. The prticular Clause in Rule37A on sharing the pension liability between theGovernment and BSNL was annulled becauseof conscious demand AIBSNLPWA placed andstruggled for.
These are undeniable facts, notwithstandingthe false claims by some people who neverthought of these issues. Formation ofAIBSNLPWA was a historic requirement.Struggles launched by this organization andthe victory are unique and spectacular..
We started the journey in 2009 with ZEROmembership. Today, we have more than 42000Life members and more than 25,000 annualmembers on role.

We have created a history. We move further tocreate new history. Formation of CBMPA, anumbrella organization of all associations ofBSNL/MTNL retirees in November 2018 isanother great leap in our journey. We shallstrengthen CBMPA and we shall march aheadshoulder to shoulder with all the right thinkingorganizations of BSNL/MTNL retirees.
AT KANYAKUMARIThe meeting was held in Vivekannda Kendra,Kanyakumari. Com. Ramankutty, assisted byCom. A Chellaiah (DS Nagercoil) and a team of14 comrades from Nagercoil SSA unit made allarrangements for boarding and lodging in theVivekananda Kendra compound itself whichwas appreciated by all who attended the meeting.Some of the CHQ office-bearers and CircleSecretaries could not attend it due to illness.Com. DG developed some health problem onhis way from his house in Chennai to Railwaystation. He had to be admitted in hospital.Similarly Comrades A Sugumaran (VP), ASudhakara Rao (VP), H S Prasad (AGS), JagdirSingh (AGS), S R Dutta (OS), B P S Chouhan(CS CGT), J S Malik (CS HR), R N Singh (CSJKD), Murshid Ali (CS Kolkata TF) andGautam Kailash (CS UPW) also could reach dueto personal reasons.
CWC meeting paid rich tributes to Shri H NAnanthkumar, former minister, Com. GeorgeFernandez, Com.. P C Moitra and others.
IMPORTANT DECISIONSCWC declared full support and solidarity tothe serving staff and their unions in theirefforts to get a reasonable and decent wagerevision. CWC called upon branches to extendall possible help and support whereverpossible.
Based on information received throughwhatsapp, CWC felt that the AUAB may be
forced to make some understanding for payrevision with 0% or 5% fitment and such anunderstanding between BSNL company andthe staff unions in no way is binding onpension revision which is an entirely differentissue to be decided by the Department ofTelecom. Hence, we shall continue vigorouslyour efforts to get pension revision with CPCfitment benefits. No benefit shall come to usautomatically or as Grace.
CWC authorized the CHQ Secretariat to takeappropriate action at the appropriate time torealize our just demand for pension revision.Though it is time consuming and costly, legalremedy can also be considered as the lastresort.
CWC called upon branches to approach MPsand enlist their support to our efforts anddemand. Efforts may be made to submit thememorandum on our demand to the PrimeMinister whenever he visits different placesduring election campaign.
CWC directed the CHQ to hold a NationalConvention of BSNL/MTNL pensioners inNew Delhi in consultation with CBMPAconstituents. Efforts should be made to ensureparticipation of leaders of all central tradeunions in the Convention.
CWC expressed its anger and anguish overthe most negative and recalcitrant attitudeof bureaucrats in DoT explicitly expressed bynot submitting concrete proposal on pensionrevision as required by the Department ofPension & Pensioners Welfare.

for New Retirees of BSNLo Interim Process till onboarding of BSNL:The current practice of manual filling ofphysical forms by retiree and submitting toBSNL offices will continue which, the HoO(BSNL) will forward to the CCA along withthe form 7 and other papers for processingthrough Sampann. This will eventually bereplaced with online filling of forms by theretirees once the HoO (BSNL) initiates onlineprocessing and forwarding of cases to CCAoffices.

Timely Updates and tracking: Pensionerswill get updates regarding the progress of thecase via Mail and SMS once the pension caseis captured on Sampann.
Digital ePPO: Once the pension issanctioned, the digitally signed PPO andAuthority for Payment of Death-cum-retirement Gratuity will be generated andmade available in the Dashboard of thePensioner for printing if required.
Handing over of PPO: A hard copy of thePPO shall be sent by Post to the pensioner.This will replace the earlier Embossed sealPPO. The payment will be disbursed to themandated Bank account.
There will be no requirement to come to theCCA in person to collect the PPO, unlike theearlier system where pensioners wereexpected to visit the Bank to collect the PPOand receive the first pension in person.
Regular and Timely Payment: Thecalculation of monthly pension, Arrears, TDSetc. will be processed by the CCA offices. Tobe informed about the latest status,Pensioners can check their monthly statementin their account at dotpension.gov.in or theSampann website.
Income Tax: Pensioners are to submit thesavings declaration through Post to the CCAoffices. The concerned CCA will dispatch theForm 16 by post to the pensioner’s declaredaddress.
Grievance Redressal: In case a pensionerhas any query, grievance etc. the same canbe registered and tracked by the pensionervia CPMS website/mobile app. Alternately the
Pensioner can always call the nationalHelpline or mail his grievances/query [email protected].
for DOT/BSNL Pensioners whosepension is processed by the CPPCs/banksand HPO/Post offices
There will be no changes for the TelecomPensioners drawing pension from Banks/Post offices and they will continue in thecurrent system till orders for migration isissued.
Proper intimation and assistance: Theexisting pensioners will be migrated to thenew system in the new financial year followedby announcements and proper intimations.
Digital Profile: Once migration is done incoordination with the banks, their profile willbe created on CPMS.Least disruption: Even after migration, thepayment will continue to be made in the sameBank account as was done in earlier system.
Regular and timely payment: Thecalculation of monthly pension, Arrears, TDSwill be processed by the concerned CCAoffice. Pensioners can check the monthlyledger on the Dashboard as well.

Broadly there are two schools of thought:1. Pension Revision will be carried outgiving effect from 1.1.2017, following WageRevision as per 3rd PRC2. Pension Revision should be delinkedfrom Wage Revision as thedisbursing authority for pension is different fromthat for wages and thereby, pension revision willbe carried out as per CPC but on ID pay scales,date of effect being 1.1.2017.
UNITED FORUM OF MTNL UNIONS ANDASSOCIATIONS, DELHI belongs to the 2nd
category. Why? Let me explain:-
Those who advocate for 1st category pensionrevision pin their justifications broadly on thefollowing points:-(1) Pension Revision as per 3rd PRC followingWage Revision will be comparatively easier toachieve.(2) This will keep the pensioners close to theworking employees as the interest of both groupsso far as revision of wage/pension is concerned,will rest on one common fulcrum.(3) It will be loss for both employees andpensioners if we invite CDA pay scales and CDAllowance in the process because CDA payscales are normally less than IDA pay scales andCD Allowances are normally granted afterinterval of 6 months unlike IDA for whichinterval is 3 months.(4) They are dismayed when they apprehend thatif the hard-earned IDA pay scales are sacrificed,the fruits of consistent struggles to achieve IDAscales at the time of absorption will go waste.(5) They refer the issue of MTNL pensionsstating that Government agreed to take theresponsibility /liability of MTNL pension
DEBATE ON PENSION REVISION IN BSNL/MTNLWrite-up by Senior leader Com. M K Bagchi
(combined services) only when their pension iscalculated on the basis of equivalent BSNL payscales.
My comments:(1) It is not difficult to comprehend that ifpension revision depends on pay revision as perPRC, there is no certainty whether pensionrevision will at all be carried out. Pay Revisionas per PRC is subjected to a number of obnoxiousclauses. There are fair amount of chances thatpay revision may not take place. If at all payrevision takes place, there remains the question:to what extent the pay will be revised. Thuspension revision following pay revision as perPRC is not secured and not uniform.(2) When I say so, I don’t underestimate thestrength of the unions and associations. We mustbe pragmatic enough to understand that allconstraints cannot be done away with fully (andalways) with the fighting strength of the unions.There are other factors involved.(3) Due to this uncertainty, even DOT feels(subjected to be approval of nodal ministries/departments) pension revision should bedelinked from pay revision. DOT feels, payrevision is uncertain under certain situation, butpension revision cannot be resisted for long. Forpay revision, MTNL/BSNL will have to pay fromtheir earnings, but pension & pension revisionis the liability of DOT/Govt.(4) Then there is a contention that CPC isonly for CG employees and CG pensioners whoare linked to CDA pay scales and not for thosewho are on ID pay scales or retired from ID payscales. This statement is only partially truebecause a number of our pensionary claims ofID pensioners are settled on the basis ofrecommendations of CPC and for this, we neednot sacrifice either ID pay scales or IDA. Only

the issue of pension revision is left. Had weoverwhelmed ourselves with such poorconvictions at the time of absorption, we couldnot have achieved pension from DOT/Governmental civil estimates.(5) If CPC is for CD pensioners’ pensionrevision, then what is there for the pensionrevision of ID pensioners? Fact is that neitherthe CPC Report nor the orders issued thereon byDepartment of Pension & Pensioners Welfaretalks of CDA pensioners or IDA pensioners. Allthe orders issued by DoP&PW implementing theCPC recomm-endations from time to time statethat they are applicable to all Pensioners andfamily Pensioners covered under CCS (Pension)Rule, 1972. BSNL/MTNL pensioners arecovered under the said rule. PRC does not dealwith pension revision in that sense. So wedemand: let there be CPC guidelines to applyfor ID pension like ours.(6) Then there is a fear that if we press forCPC, then pension wi l l be cal culated onequivalent CD pay scales. Just to bring home thisfear, the example of MTNL pension is wronglypointed out stating that MTNL pension iscalculated on BSNL pay scales. The statementis, at the least, confusing. MTNL pensioners arenow getting pension from DOT and that too onMTNL pay scales. Com. V A N Namboodirishould know this as I thankfully acknowledgethat he was closely associated with us in thatstruggle and made valuable contributions. MTNLpays to DOT only pension contribution onMTNL’s ID pay scale as BSNL pays the sameon its own ID pay scale. Beyond that MTNL doesnot (or, not in a position to) pay.(7) I consciously avoid bringing MTNLmatter into discussion at this stage to avoidavoidable confusions in this debate. BecauseDOT’s present proposal for delinking is only forBSNL. Why to bring MTNL matters at thisstage?(8) It is no body’s contention to plead forCD pay scale & CD allowances. We should notplay this as a ghost in the dark room. Ghost can
be tackled appropriately when confronted inactuality.(9) One important aspect of CGHSentitlement of BSNL/MTNL pensioners is beinglost sight of. Initially the entitlement of CGHSfor BSNL/MTNL pensioners was denied on theground that they are ID pensioners. ButGovernment had to concede the fact that BSNL/MTNL pensioners draw the pension from thesame civil estimates as the CD pensioners do.Thus BSNL/MTNL pensioners are madeentitled to CGHS benefits as CD pensioners.Please note that BSNL/MTNL employees are notentitled for this, as their wages are not paid fromcivil estimates of Govt. of India. The amount ofone time contributions for life time CGHSbenefits of BSNL/MTNL pensioners werecalculated keeping their ID pay scales intoaccount. This may be a good pointer in thedirection of ID pensioners to get pay revision asper CPC even though pension contributionscalculated ID pay scales.(10) Then on the question of “easilyachievable”, some feel that pension revisionfollowing PRC can be achieved easily. If so, whyit is not possibly done so during last 2 years.Moreover, we want easy solution or permanentsolution?(11) My point is why to burden ourselves byanticipating what Govt. may say or may not?Why to take the side of Govt. to plead what arethe problems on Govt side? Let us leave those tothe Govt. at this stage. Let us concentrate on whatshould be our DEMAND that, on achievement,will solve our problem fully and once for all. Ifour pension revision is a knotty issue, who isresponsible for this? We need not be apologeticor unduly defensive to put up our r ightDEMAND.
LET US JOIN AS ONE PEOPLE WITHONE VOICE AND ON SAMEJUSTIFICATIONS. FALL OUT? WESHALL SEE TO IT AS AND WHEN ITAPPEARS.

If someone pays Rs 1000 to the branch and becomes a LifeMember of the Association, the branch remits only Rs 200 of it as CHQ Quota. WithRs 200 once received we cannot supply the Patrika to such Life members for theirlife time. If anyone wants to get the Patrika for life time, another Rs 1000 has to bepaid. Entire amount of that Rs. 1000 (Patrika subscription) should be sent to CHQas branch has no expenditure on the journal.
From January, 2019 onwards the Life time subscription is Rs 1000 per copy and forAnnual Subscription it is Rs. 100 per copy. Please enroll Life subscribers as far aspossible. Kanyakumari CWC considered some options like reducing pages byavoiding printing lists of Life Members, avoiding the colour pages etc. But someCWC members did not favour such options.
I prepare most of the matter appearing in this Patrika. I type all the items. I read theproof - first one, second and third one also. Then, after making the page layout andconverting into pdf format I send it as email to the printing press at Chennai. As such,I need not read it again. But, I know well that I need not be the Editor all the time.Even after relieving myself from the post I must read it. So I became a Life Subscriberpaying the required amount. One copy comes to me by post from Chennai. Normally,speed post reaches the very next day. Ordinary mail takes 4 or 5 days. But my copy oflast issue of the Patrika posted in Chennai RMS office on 7th January 2019 reached meat Trivandrum on 30th January 2019. This is the postal service. As Journals are unreg-istered articles there is no record and nobody responds to any complaint. This is ageneral complaint with regard to all journals and periodicals using Indiapost. ON RETIRAL BENEFITS AS PER CPC CEPORTTO THOSE WHO RETIRED ON 31-12-2015
The Apex Court, in S.Banerjee Vs UoI, AIR 1990SC 295, ruled “it has to be said that thepetitioner had retire d on January 1, 1986and not on December 31,1985. In thecircumstances, the petitioner comes within thepurview of paragraph 17.3 of therecommendations of the Pay Commission”.This judgement has attained finality and thusholds the field today. Even though UoIrepresented by Secretary, DoP&PW argued thatthe Apex Court judgement is applicable only tothose who voluntarily retired on 1st January andnot for those who retired on 31st December onsuperannuation, Hon. High Courts of Kerala,Andhra & Karnataka did not accept thataruguments but gave relief to the petitioners. InUoI & Ors Vs P.S.R. Kumar Sinha & Anr(2006(2) ALT 354:2006(3) ALD 57 Hon AndhraHigh Court stated in para 6.17 “When theemployee has retired on the last date of themonth, his date of retirement has to be treatedas 1st date of succeeding month”.
Very recently CAT, Principal Bench New Delhiin OA No. 571/2017 gave a judgement whichwas pronounced on 17/04/2018 sanctioned reliefto the petitioner Shri G.C.Yadav who retired onsuperannuation on 31/12/2015 and whose dateof birth was 1/1/1956 and directed therespondents to fix the retiral benefits of theapplicant in accordance with the 7 th CPCrecommendations which have been implementedvide OM & resolution dated 4/8/2016 in respectof pensioners retiring on or after 1/1/2016.
It has become the law of the land. So, pleasedon’t force the pensioners to resort toprolonged litigation. It is nothing but wastageof time of honourable courts and unnecessaryexpenditure to the exchequer. We request you,sir, to issue a general order for getting theretiral benefits, particularly gratuity ceiling,of 7th CPC recommendations for those whoretired on 31/12/2015, including BSNL IDApensioners.

ON SWITCHING OVER TO CGHS
We called on you, madam, on 20-11-2018evening to discuss about the inordinate delayin making payment to pensioners underBSNLMRS. You were kind enough to explainthe financial difficulties faced by BSNL andnobody is lending a helping hand You advisedus to tell the pensioners to switch over to CGHS.When we pointed out that CGHS facility isavailable only in 26 cities and not everywhereyou suggested that at least in those cities 26cities let the pensioners get the medical facil-ity. Then we pointed out that most of the pen-
sioners are not in a position to make one-timelumpsum payment to CGHS and wait for reim-bursement from BSNL.
We suggested that BSNL can make one timelumpsum payment directly to CGHS. If that sug-gestion is accepted then we can request the pen-sioners to switch over to CGHS in those 26 cit-ies. The financial burden of BSNL on MRS wouldalso drastically reduce. Hope BSNL would takea positive decision in this regard sooner than later.
