    Statement of FactsBased on our personal k.nowledge from media reports and personal conversations, it appearsthat Representat ive Patterson has engaged in a pattern of conduct that may be considereddomestic violence. Mr. Patterson's gir lfrlend has f iled a protective order against him allegingcertain acts, which If true, would constitute domestic Violence, Including causing physical injuryand mental anguish. These recent events appear to be part of a pattern of inappropriateconduct, including previous allegations by Mr. Patterson's ex-wife who obtained a n order ofprotection against him,

    Violations of LawsThe Ethics Committee is empowered 10 investigate claims of disorderly conduct, Ariz. Const.art. 4, pat. 1, 11, violat ions of state or federal laws, such as the provisions proscribingdomestic violence, conduct violaUng the public trust or adversely reflecting upon the House, andunethical or unprofessional conduct, such as def ined in AR.S, 32-1901.01.

    Supporting DocumentsAttached to this Complaint is a copy of an article from the Tucson Citizen, which includes a 'photograph of the order of protect ion signed by Mr. Patterson's gir lf riend, an article from theTucson Weekly, a s well as copies of orders of protection issued against Mr. Patterson on behalfof his ex-wife.Based on the foregoing, I request that the Ethics Committee immediately convene andinvestlqats the alleged unethical conduct of Mr. Patterson.

    The Rep. Daniel Patterson sideshow reconvenes at the Capitol this week, as Patterson,a TUcson Democrat, put out word Monday that he's been cleared of accusations that heassaulted his former girlfriend.Georgette Escobar recanted in a Facebook post on Sunday>- just one day before shewas due in court to be arraigned on drug charges stemming from an arrest she hasclaimed was orchestrated by Patterson."I always said truth would prevail," Patterson wrote on Facebook, in response toEscobar's retraction. "This personal matter is tough on us & our families. Time to heal."Time, actually, to get to the bottom of what the heck is going on here.The House Ethics Committee meets Wednesday to hear the results of its investigationon Patterson. His ex-wife has filed a new order of protection against him, telling me thatshe's afraid for their s-year-cld daughter,Meanwhile, Tucson City Attorney Baird Greene says he has no plans to drop thecharges and Senate Minority Leader Chad Campbell is sticking by his call for Pattersonto resign.

A Tucson police report quotes witnesses as saying they saw Patterson"backhand" Escobar, but no one was arrested.Patterson, who now faces four misdemeanor domest ic-violence charges, has said hedid nothing wrong -- that in fact he was the one who called police because she was theaggressor. Escobar, he says, has mental issues and a criminal history involving drugs,theft and domestic violence.Two weeks after the Feb. 24 altercation, Escobar was arrested in Quartzsite andcharged with possession of methamphetamine. Because she Was in jail, she was unableto attend a Tucson hearing on her restraining order, which was quashed.On Sunday night, she suddenly recanted."Daniel Patterson never hit or committed domest ic violence against me," she wrote. "Inever needed an order of protection against him. I'm sorry. I disagree with the ethicscomplaint. investigation and charges against him. He should be found innocent."Escobar didn't return calls on Monday.If you're wondering what's going on here, you're not alone. While some women do lieabout abuse, people who work with domestic-violence victims tell me they often recant.Rep. Katie Hobbs, D-Phoenix, who has long worked with Sojourner Center, says shehas no plans to withdraw her ethics complaint against Patterson. The complaint , shesays, was based upon a pattern of behavior, including verbal altercat ions at the Capitolthat have fallen just short of blows."I believe she was abused," Hobbs said of Escobar. "I've talked to her on the phone. I'veheard her stor ies and I've also interacted with Daniel on many occasions and witnessedhis behavior. I don't think that two women in a row would lie about him being abusive."Patterson's ex-wife, Jeneiene Schaffer says she recently filed a new order of protectionbecause she's afraid for her daughter's safety. Schaffer says Patterson began abusingher when she was eight months pregnant."He hit me twice a week and 80 percent of that time it was in front of (our daughter),"she said. "Not only did he hit me, he did exactly the same thing he did to Georgette. Herwould push me out the door, push me out the gate and Iwould have (our daughter) withme."Patterson is adamant that both women lied. He calls Schaffer'S allegations "old news"and says she's now using the court system to keep his daughter from him. He said that he was speaking with hisattorney and pointed towards the re~ turned my attention in that direction and 1aw II female standingnear IIvehicle parked inside the fenced . to come towards me, she was cooperative, and I escorted herout of the yard. The woman was She tol d me that she had a court order and that shewanted to get her dog.After I walked closed and secured the open gate leading intohis yard. Communications re-contacted who communications that upon instructions from hisattorney he would not speak with officers at scene. Officers did not attempt nor were invited back into the fencedyard at 1040 S Railroad. .. ., .. >

    lfurtherescortcd_to her vehicle that was parked on 4th Avenue behind the Railroad address. She saidthat she hada copy of the court order. _ showed me a copy of the court order. The court order was to be served.on stated that she would leave but just wanted her dog. The order was not served and . ? didnot gel her dog. The dog was in the rear of 1040 S Railroad behind the secure gate.

    1 spoke wilh the witness, Jesus Garcia. Garcia said that he heard yelling in the back of his house. He said hecame outside and.spoke with Faskerlhim to hel her et her dog from the fenced yard at 1040 SRailroad. When Garcia told he could not help her, iiIisaid that she would just get some, "C4 andblow the neighborhood up".     Benjamin staled that the female began yelling for the male not to takeher dogawayfromber (aGerman Shepard), because she needed the dog. He also said that the male wasyelling.Benjamin staled that the male got the back door of the car open and began removing the dog fromthe car. The female approached the male to attempt to prevent this from happening. but the malesubject "backhanded" the female in the face with his hand.

    Benjamin staled that the male hit th e female in the face with what appeared to be an open hand, andthat the strike was hard enough (0.knock the female to the ground.Benjamin said that at this point. his c o- worker Rudy Rios was pulling up to the scene in a vehicle.and he used Rudy's cell phone to call911. H e said the female was screaming for someone to call91 1 and help her.Benjamin said that the female got up from the ground and began slapping at the male. who was stilltrying toget the dog out of the car, Benjamin said he thought that this was more of an attempt to get

    . the dog away from the male, who was trying to lake the dog away from th e scene, rather than anattempt to injure the male .

    .Benjamin then said that th e male was able to gel the dog away from thefem ale and took it to aresidence a short distance away. Benjamin saw the male put the dog away in a yard, then the malereturned to the scene .

    . . Detective Vaughan and I then made contact with Rudy Rios, who is a witness in this case. He is also ..!111 employee of the City of Tucson Parks and Recreatlon Department. His assigned work station inSanta Rita Park.

    We conducted IIrecorded interview with Rudy in my'assigned work vehicle. T h e following is aparaphrasing.of what hesaid; refer [0the recording for exact details .

    . R udy stated.he was working in Santa Rita park with Benjamin on the 241hof February. 2012. Hepulled his work vehicle up onto the road bordering the:park to find Rudy speaking with an upsetfemale in the north western portion of the park.

    Rudy said that Benjamin informed rum that the female had been assaulted, and asked him to call911. Rudy stated that the women was screaming for help, and was.standing next loa whitelexusSUV. The women told Rudy that there was a argument over a dog, which she needed for therapyreasons

    . R udy saw a male subject with a VW vehicle parked behind the white S1JV. The male returned hisvehicle into hi s fenced yard, Olen approached Rud y. R ud y stated he thought th e male approachedhim since the male saw and heard him calling 91 1. Rudy gave a similar description of the male andfemale subject than w hat w as given by Benjamin.Rudy stated t ha t th e male said "1don't want any problems" an d that the female had hit him. Rudytold the male that several people in the park, including him a nd Benjam i n, had witnessed an act ofdomestic violence and the police needed to be called.Rudy advised me that several homeless people in the park witnessed the incident and also asked himand Benjamin to call911. Rudy advised that there are two homeless male subjects witnesses theincident. Rud y sta ted that a t this point, th e male subject returned to his fenced residential yard andlocked the gate. He took the dog with him when he did this.Rudy identified the same incident location as Benjamin. the intersection of Railroad and 21",The female subject also told Rudy that the male subject ha d taken her medication from her. and thatshe had th e dog trained as a special therapy dog for her.Rudy stated that there nrc homeless people who frequent the park who witnessed the incident. Thesepeople told Rudy that the male "pulled" the female from the vehicle,hit her, and knock her to theground. He gave Detective Vaughan and I a description of some of the homeless people who mayhave witnessed theIncident,Rudy stated he does not know the male or the female subject. and that he has had no contact withthem either before or after this incident.
