    BOARD RESOLUTION NO. 60Series of 2011

    Adopting Revised Procedure in the Conduct of Interview ofNew Authorized Managing Officer (AMO)

    All new AMOs, AMOs of firms upgrading for category “B” and above, all foreign AMOs,and AMOs whose qualification cannot be fully determined by their submitted documents,will be interviewed by the Board on or before their respective applications are deliberatedby the Board.

    Interviews may be conducted by a panel of all three board members or by an individualmember.

    Interviews may be conducted in the PCAB Office in Makati or in Visayas and Mindanao.

    All interviews are conducted by appointment. Interviewees will be notified thru email, faxor any other expedient means and in turn should confirm their attendance.

    Specific time will be allotted to each interviewee and they are advised to come on timeotherwise, their slots are forfeited and will be re ‐scheduled

    Failure to appear in the scheduled interview may cause the disapproval of the application.

    Adopting a Revised Procedure in the Processing ofLicense Renewal Applications starting CFY 2011‐2012

    Ten (10) working day maximum processing time (in compliance to Citizen’s Charter)

    Upfront payment of renewal fees

    Provisions by applicants of self ‐addressed self stamped or pre ‐paid courier’s envelopestogether with renewal applications for delivery of signed licenses to the official address of

    contractors. (to reduce the cost of doing business)Initial evaluation of networth and STE compliance requirements together with pre ‐screening.

    Post audit and post verification of documents submitted once every three (3) years.Role of ROG:

    Immediate sending via e ‐mail of General Information Sheet (PCAB Form No. 102), Balance

    Sheet, and List of STEs (PCAB Form No. 204) for early processing of license at PCAB office.

    Timely transmittal of Applications and Attachments to PCAB ( 2 to 3 days from receipt)

    Safety Seminar for New Proprietors/AMOs and Licensees Applyingfor Upgrading of License Category

    To require the following Proprietors or AMOs of:

    1. New license applicants;2. Applicants for change of AMO; and3. Applicants upgrading for license category, regardless of whether the proprietor or

    AMO has served in such a capacity prior to the application.

    to submit on or before 30 June 2011 proof of completion of the 40 ‐hour ConstructionSafety and Health Course for Site Safety Officers (COSH) conducted by a DOLEaccredited safety course provider.

    Non‐compliance with the COSH shall be a bar to the renewal of the license until compliance.

    Failure to comply within two (2) contracting fiscal years after June 30, 2011, the license shallbe delisted.

    Prescribing Comprehensive Written Examination for New AMOsand Licensees Applying for Upgrading of License Category

    To prescribe a comprehensive and responsive written examination to screen new AMOs andAMOs of applicants for upgrading of license category with a pool of at least five hundred(500) questions and complete answers to be made available to all license applicants as partof the education process.

    The written examination shall consist of at least fifty (50) questions taken from the pool at

    random.The passing score shall be thirty ‐five (35) correct answers out of fifty (50) questions.

    There will be fifteen (15) mandatory questions on building, safety & health, tax and labor

    laws that have to be correctly answered by an examinee to pass.The written examination is meant to eventually phase out the oral examination/interviewpresently given to same license applicants.

    The comprehensive and responsive written examination shall be formulated jointly by withPhilippine Domestic Construction Board and the Construction Manpower DevelopmentFoundation by the Board .

    To require the passage of the written examination by all proprietors or

    nominated AMOs as prerequisite to the filing of new license applicationsstarting July 31, 2011.

    a) Building lawsb) Safety and Health, Lien lawsc) Tax lawsd) Republic Act 4566 and Presidential Decree No. 1746e) Adherence to the regulatory requirements of the Social Security Act, Phil Health

    Insurance Corp. and Pag ‐ibig Fundf) Contractor’s Code of Ethics

    Accreditation of Contractors’ Associations and Professional Organizationsto Assist the Public Assistance Desk (PAD) of PCAB

    Qualifications of contractors’ associations and professional organizations to be accredited byPCAB to provide advisory services to contractors and set up their “public assistance desk”

    The contractor’s association or professional organization is duly registered entity and inexistence for not less than five (5) years.

    A contractor’s association has a membership of not less than 20 licensed contractors andaffiliate/chapter of a national constructors’ association duly recognized/accredited by theConstruction Industry Authority of the Philippines (CIAP).

    Activities to be undertaken by the contractors’ associations and professional organizations:

    Pre‐screening and evaluation of all types of applications

    Follow‐up of pending applications

    Verification of documents submitted by contractor ‐applicants

    Reporting of unlicensed contractors to PCAB

    Other functions as the Board may assign

    BOARD RESOLUTION NO. 270

    Granting of Additional Credit Points to ISO Certified ConstructionContractors as an Incentive

    PCAB shall grant ISO certified contractors a total of one hundred fifty (150) additionalcredit points for categorization purposes broken down as follows:

    •ISO 14001:2004 ‐ 50 points

    •OSHAS 18001:2007 ‐ 50

    •ISO 9001:2008 ‐ 50

    BOARD RESOLUTION NO. 273

    Ordering Moratorium on Acceptance and Processing of Applications forNew Regular License of Cooperatives

    A moratorium on the acceptance and processing of applications for regular licensecooperatives was ordered by the Board in view of the following:

    Philippine Cooperative Code of 2008 has no specific provision authorizingcooperative to undertake construction contracting per se;

    RA 9520 enumerated different types of cooperative but only the agrarian reformcooperatives are given privilege to undertake construction but with a very limitedscope.

    RA 9520 enumerated three (3) other activities (Electric, Housing, and WaterService) which obliquely refer to construction but with the limitation to serve onlythe household members or regular members of the specific cooperative.

    RA 9520 warrants only the grant of a special license for specific purposes.

    Available for all contractors with projects undertakenwithout a license

    No exam, no interview

    No audited financial statement, just a bank certificationwith an amount of P45,000 within one month fromfiling of application

    License issued within 10 working days

    Note: AMO and CoSH seminars will be required only by June 2012
