Subject: - Proposal for diversion of 0.983 ha of forest land for establishment of BOPShyampara under District Forest Officer, South

In pursuance to the Final approval issued by the State Government vide letterNo.F.6-1069/FC/fOr-lS/28848-55 dated 26.11.2016 and also to comply with the order of theHon'ble National Green Tribunal vide letter dated 24.07.2013, I am directed to state that after dueconsideration the State Govt. approves handing over of 0.9$3 ha of forest land for establishmentof BOP Shyampara under District Forest Officer, South in the State of Tripura with thefollowing conditions::-

The legal status of the land shall remain unchanged.I

Compensatory Afforestation shall be done by the Forest Department over identifieddegraded forest land over 1.966 ha identified in degraded forest land at CS plotNo.2218/P in Kh. No.4/46 in Mouja Betaga R.F under District Forest Officer, South

with the State Forest Department.Ill. Permanent demarcation of forest land proposed for diversion shall be done on the ground at

project cost before handing over the forest land to the User Agency.IV. State Govt. not to hand over the land without demarcation & erection of pillars.v. The forest land shall not be used for any purpose other than that specified in the proposal.VI. The User Agency shall not expand its occupation or use surrounding forest/ forest land in

any manner otherwise expressed in this clearance.VII. Land so diverted shall revert back to the Forest Department in case it is not needed for the

above use after due restoration to its 'original status (as far as possible and to the satisfactionof state Forest Deptt.). I

VIII. The User Agency shall take all possible precautions & care all the time not to impactadversely the surrounding forests and forest land by their actions/ activities.

IX. The project should not involve felling of more than fifty trees per ha. Correspondingpermissible limit of maximum number if trees to be felled for the forest area diverted, shallbe in proportion to the extent of the diverted area.

x. The User Agency will undertake comprehensive soil and water conservation measures atthe Project cost.

Xl. Whcr~eL_possible and technically feasible, the user agency shall undertakeAfforestation measures along the road within the area diverted under this approval, inconsultation with the State Forest Department.

XII. No damage to the tlora and fauna area shall be caused.XIII. The proposal will be implemented under the overall supervision of the concerned District

Forest Officer.

XIV. In case of any violation of the stipulated conditions immediate action is to be taken bythe Forest Deptt. as per Ministry'S letter No.S-S/86/FC dated 07.12.1999 and letter

No.2-1-S1I2004/~ONE/v 01~II13181-02 dated 28.12.2006.iO"'

xv. The permission granted by the State Govt. shall be subject to the monitoring by theconcerned Regional Office of the Ministry of Environment, Forest & Climate Change.

XVI. The layout plan shall not be changed without prior approval of the Central Government.XVll. All other ciearances I NOCs under different rules/lregulations / local laws and under

Forest dwellers under Scheduled Tribes and Other Traditional Forest Dwellers(Recognition of Forest Right) Act, 2006 as required vide MoEF, New Delhi guideline

No.1 1-911998-FC(PT) dated 03.08.2009 shall be complied with.

xviii. The earlier Final approval order No.F.6-641/FCIFor-06/25454-61 dated 12.10.2012issued by the State Govt. for diversion of 0.983 ha of forest land against the saidproposal may be treated as cancel as the part of the land is beyond Indo-Bangla Border

fencing.XIX. Any other conditions as may be found appropriate in future for the betterment of

environment & wildlife, may be imposed by North Eastern Regional Office, MoEF & CC,Shillong. '

xx. The District Forest Officer, South and the Sub-Divisional Forest Officer, Sabroom shallmonitor of the conditions stipulated above, and violation of any of the conditions, 'ifnoticed should be immediately reported to the Nodal Officer, FCA, Tripura.

2. The copies of the Forest Clearances ano this order should be submitted to the' all head oflocal bodies, Panchayats and Municipal bodies etc. for wide publicity,

3. The District Forest Officer, South is also requested to submit the monitoring report time totime to the Nodal Officer, FCA after fulfillment of all conditions,

4. The handing over and taking certificate is to be submitted to the Nodal Officer, FCA alongwith GPS reading and polygon over the diverted land. ~
