FRIENDS,The Mortgage Bankers Association continues to be among the most sophisticated and effective
trade associations in Washington, DC and that is in no small part because of your continued
support of MORPAC, MBA’s political action committee.
With the year more than half over, I am proud to announce that due to your support, 2015 has so
far been MORPAC’s biggest year yet. With that in mind, I am pleased to present the 2015 MORPAC
Mid-Year Report.
This year alone we have raised over $500,000 in individual donations, out-pacing this time last
cycle by nearly 9%. Together we have managed to add over 200 new MORPAC contributors, and
our average contribution has increased by over $100 over last year’s figure.
We continue to make great strides to increase our grassroots reach as well. The Mortgage Action
Alliance (MAA) currently enjoys nearly 10,000 active members and under the leadership of MAA
Chairman Fowler Williams, we are on pace to hit 12,500 by year’s end.
As a show of gratitude to our dedicated contributors, this report lists all of the individuals and
companies who have been a part of our 2015 campaign. In addition, you’ll find itemized information
about the goals our political programs have been able to achieve thus far, and a comprehensive
summary of the legislative and political priorities MBA’s advocacy team has been working to
achieve at this point in 2015.
I hope that you will make note of the great steps we are taking with our political action committee
on our industry’s behalf. None of this is possible without your involvement in MORPAC, and your
continued support is imperative to our success. Together, we will make this 2015–2016 fundraising
cycle the best in MBA history. I appreciate and thank you for your dedication to MBA, MORPAC
and our collective public policy goals.

LEGISLATIVE AND POLITICAL UPDATE
As we mark the fifth anniversary of the Dodd-Frank Act,
it is clear how dramatically the implementation of the
landmark law has impacted the industry, and how difficult
the politics surrounding any potential corrections will
continue to be over the near term. MBA remains engaged
on a broad set of issues and possible opportunities as
lawmakers work their way towards the Fall — and the
budget / appropriations / debt limit discussions that will
color the remaining first session of the 114th Congress.
Regulatory Relief LegislationAs was widely expected, the Senate Banking Committee
(“SBC”) held a contentious late May markup of Chairman
Richard Shelby’s (R-AL) financial regulatory reform leg-
islation, S.1484, the Financial Regulatory Improvement
Act, with the bill approved along strict party-lines (12–10
committee vote). The legislation contains a number of
MBA priorities on issues ranging from GSE transition
steps to QM lending standards, FHFA’s FHLB membership
rule, TRID, Basel III and its impact on mortgage servicing
rights, and preferred SAFE Act amendments (language
identical to H.R. 2121).
During the markup, SBC Democrats offered a narrower,
substitute version led by Ranking Member Sherrod Brown
(D-OH), which failed to pass. In the coming weeks, we
expect quiet negotiations between junior SBC Republicans
and moderate SBC Democrats (regarding the bill’s more
controversial provisions) to continue. Such a bipartisan
consensus will need to be reached for any regulatory
relief package to reach the Senate floor — or for any of
the bill’s key provisions to be considered for inclusion
in “must-pass” vehicles later this year.
SAFE Act AmendmentsFollowing the House introduction of H.R. 2121 in late
April, the SAFE Transitional Licensing Act — which
would provide a temporary license for loan originators
between federally-insured depositories and non-depos-
itories, as well as transitioning across state lines — we
have seen a growing bipartisan number of lawmakers
indicate support for the bill. Led by Representative
Steve Stivers (R-OH), fellow House Financial Services
committee (“HFSC”) members Terri Sewell (D-AL),
Lynn Westmoreland (R-GA), Joyce Beatty (D-OH), Luke
Messer (R-IN), Kyrsten Sinema (D-AZ), and Ed Perlmutter
(D-CO) were all original cosponsors. Since April, strong
progress has been made through the bipartisan addition
of 29 more cosponsors. MBA is continuing its dialogue
with the Conference of State Banking Supervisors in
an effort to reach consensus with the group in order to
convince the House leadership to move the bill through
the HFSC and to the House floor later this year.
GSE ReformWe continue to believe that neither SBC Chairman Shelby
nor HFSC Chairman Jeb Hensarling (R-TX) will choose
to dedicate the significant amount of political capital (or
time needed to build a policy consensus) necessary to
advance an issue as complicated as GSE reform this year
— or this Congress. Nonetheless, several comprehensive
reform proposals offered during the last Congress have
reemerged. In the House, Reps. John Delaney (D-MD),
John Carney (D-DE) and Jim Himes (D-CT) reintroduced
their proposal (H.R. 1491, the Partnership to Strengthen
Homeownership Act), which utilizes Ginnie Mae an a guar-
antor and to regulate the conventional market. Senator
Johnny Isakson (R-GA) reintroduced his proposal, S. 495,
the Mortgage Finance Act, which winds down the GSEs
through orderly receivership and creates a new facility
to guarantee securitizations of QRM mortgages.

Chairman Hensarling has made recent public statements
that he is open to discussions with the White House and
Treasury officials to reach possible consensus on more
limited GSE transition steps. MBA-supported provisions
to prohibit the sale of GSE preferred shares, prevent the
use of GSE guarantee fees (g-fees) for non-housing-re-
lated purposes, direct the FHFA Director to finalize a
Common Securitization Platform by a time certain, and
require the FHFA Director to direct the GSEs to engage
in mandatory first loss risk sharing transactions were all
included in Title VII of the Shelby regulatory relief package.
THUD AppropriationsIn early June, the Fiscal Year (“FY”) 2016 Transportation,
Housing and Urban Development (“THUD”) funding bill
(H.R. 2577) passed the full House by a vote of 216–210.
At MBA’s urging, HUD’s request to receive authority to
fund a portion of FHA’s administrative costs through an
up-to 4 bps lender fee assessment was not included in
the bill. We were also pleased that the measure again
excluded a HUD proposal that would have allowed state
Housing Finance Agencies expanded access to Ginnie
Mae multifamily loan securitization in the context of
FHA’s Section 542(c) and Section 542(b) programs, and
maintained a prohibition on federal funds being used to
facilitate eminent domain seizures of performing FHA
and Ginnie Mae mortgage loans. Significantly, the bill also
contained an adequate level of commitment authority
($30B) for FHA’s multifamily and health care programs.
In late June, the full Senate Appropriations Committee
considered and reported its alternative version of the FY16
THUD bill by a bipartisan 20-10 vote. The bill mirrored its
House counterpart with respect to the aforementioned
MBA priorities, and included report language regarding
the FHA administrative fee that directly acknowledges
MBA’s lobbying efforts, as follows:
“The Committee is disappointed that the budget request
proposing a new fee to offset administrative costs is the
same [HUD] language as in fiscal year 2015. Numerous
concerns were raised by stakeholders in reaction to
the 2015 request, yet the 2016 budget request fails to
address those concerns. As such, the Committee does
not include authority for HUD to charge a fee to provide
additional funds to address FHA’s administrative costs…
Finally, the Committee encourages FHA and its partners
to work together to address these challenges.”
Additionally, the Senate bill detailed specific concerns
about proposed changes to the Project Capital Needs
Assessment (PCNA) requirements for multifamily lend-
ers. Within the bill, HUD has been directed to report to
the House and Senate Appropriations Committees as to
the “merits of continuing” HUD’s recommended PCNA
changes. In particular, the report from HUD would include
a review of changes to the initial reserve calculations and
replacement reserve calculations, and a recommenda-
tion on whether a clearer definition of intrusive testing
requirements would “benefit HUD and lenders without
creating additional risk.”
The Senate THUD bill will likely not receive floor consider-
ation, but instead be rolled into eventual House / Senate
discussions surrounding a Continuing Resolution and / or
a year-end omnibus spending measure designed to fund
the entire federal government.

Tax Reform / ExtendersIn late July, the Senate Finance Committee released the
reports from its five working groups addressing various
aspects of comprehensive tax reform. While the Individual
Income Tax Working Group held stakeholder briefings
on homeownership incentives in the tax code (MBA
participated in one of these briefings), the group chose
to focus solely on Charitable Giving, Higher Education
and Tax Administration issues in its final report.
Additionally, the Community Development and
Infrastructure Working Group’s jurisdiction included
coverage of the LIHTC and tax-exempt bonds, including
Housing Bonds. The Working Group’s report includes
descriptions of the LIHTC and Bond programs, but,
importantly, does not offer options or recommendations
for changes to them. While it remains highly unlikely
that Congress will undertake comprehensive tax reform
before the 2016 general election, the working group
reports could serve as the foundation for any reform
efforts in future years.
House Ways and Means Committee Chairman Paul Ryan
(R-WI) recently reported that Congress should move
quickly on tax extenders in order to avoid the end-of-year
rush that left Congress renewing expired tax cuts for just
a few weeks at the end of last year. House Democrats
remain opposed to efforts to make extenders permanent,
arguing that the revenue losses must be offset. House
Republicans are opposed to raising taxes in other areas
to pay for extenders.
At this writing, the Senate Finance Committee has com-
pleted a markup of a two-year package of extenders.
As in past years, the two-year package (tax years 2015
and 2016) includes an exclusion from taxable income for
mortgage debt that is canceled or forgiven, the continued
deductibility of mortgage insurance premiums, and an
extension of provisions related to Low Income Housing
Tax Credit allocations. MBA will lobby to insure these
extender priorities are included in whatever the House
and Senate may ultimately reconcile and send to the
President’s desk.
Housing-Related “Pay-fors”At the end of July, the President signed into law a three
month funding extension of the Highway Trust Fund that,
thanks in part to MBA lobbying efforts and pressure from
the Mortgage Action Alliance, did not include a contro-
versial provision which would have funded transportation
spending by extending a previous temporary increase in
Fannie Mae’s and Freddie Mac’s guarantee fees (g-fees).
Unfortunately, despite MBA’s efforts, the Senate did pass
a long-term extension that contained this provision and
would fund spending for the next three years by extending
the previous increase in g-fees by four years. The House

will work to craft its own version of a long-term highway
reauthorization and negotiate with Senate leaders on a
compromise bill by the end of October — when the three
month extension would expire.
MBA has continued to lobby both the House and the
Senate to ensure that any final long-term extension does
not contain a g-fee increase extension or any other hous-
ing-related “revenue grabs.”
Flood InsuranceSenate Banking Committee members Dean Heller (R-NV)
and Jon Tester (D-MT) and House Financial Services
Committee members Dennis Ross (R-FL) and Patrick
Murphy (D-FL) introduced the Flood Insurance Market
Parity and Modernization Act in July. Having supported
such efforts in the past, MBA sent letters of support
for the House (H.R. 2901) and Senate bills (S. 1679)
at the request of the authors. The legislation provides
additional access to an expanded set of flood insurance
coverage options by providing incentives to accelerate
the development of a private flood insurance market
(with consumer protections overseen by state insurance
regulators).
Disparate ImpactIn late June, the U.S. Supreme Court handed down its
ruling in the case of Texas Department of Housing and
Community Affairs v. Inclusive Communities Project, Inc.
The court held in a 5–4 decision that disparate impact
claims can be brought under the Fair Housing Act. On the
legislative front, during debate on the THUD appropria-
tions bill, the House passed a floor amendment offered
by Representative Scott Garrett (R-NJ) that would block
the agency’s disparate impact rule. As we’ve done the
last two years, MBA led a joint trade letter in support
of the amendment, which passed by a largely partisan
vote of 231 to 195. The House also passed another MBA-
supported Garrett amendment that would prevent the
Justice Department from using disparate impact as the
basis of litigation. The Garrett language has traditionally
faced stiff opposition from the Senate (expected again).
High Volatility Commercial Real Estate ExposuresMBA, in conjunction with allied trades, has been lobbying
targeted congressional offices to discuss concerns about
the Basel III treatment of high volatility commercial real
estate exposures (HVCRE). HVCRE loan status requires
a higher capital charge for acquisition, development and
construction (ADC) loans that, among other things, have
a loan-to-value ratio of greater than 80 percent and less
than 15 percent equity contribution by the borrower. MBA
is concerned that tight restrictions placed on ADC loans
could result in the unwarranted higher capital treatment
for many ADC loans, which could negatively impact bank
ADC lending decisions.
MBA has also raised strong concerns with the Federal
Reserve, Comptroller of the Currency, and the Federal
Deposit Insurance Corporation and is seeking guidance
from these agencies that would provide greater flexibility
for the structuring of ADC loans to avoid HVCRE status.
This is part of a broader strategy to raise the issue directly
with Members of Congress in hopes that they will also
weigh in with regulators.

Single-Family FHA Legislative ReformsIn the House, HFSC Chair Hensarling and other commit-
tee Republicans continue to take an aggressive stance
with HUD Secretary Castro, having been highly critical
of the agency and calling for major reforms to its sig-
nature programs (including FHA) in hearings held thus
far this year. Despite the heavy criticism, we continue
to believe there is little chance that either Hensarling
or SBC Chairman Shelby will seek to advance “PATH
Act”-style reforms (or even more measured changes)
in Congress this year.
QM “Points and Fees”MBA’s efforts to provide lenders greater flexibility to fit
loans under the QM definition’s strict three percent cap
on points and fees (e.g., changes to escrow calculations
and affiliated title company exclusions) again cleared an
initial hurdle when H.R. 685, once again championed by
HFSC member Bill Huizenga (R-MI), passed the House in
mid-April by a bipartisan vote of 286–140. In the Senate,
SBC Chairman Shelby’s committee-passed regulatory
relief bill also contains modified language that would
exclude escrow for future insurance payments from the
computation of points and fees.
