    1. Introduction

    1.1 Purpose

    PR-1171 Part II, referenced in document GU-140, C9 HSE Specification Minimum Requirements, is a key

    document designed to assist and enable Contractor to carry out Company prescribed HSE activities in the manner

    and at the level required by Company. Of particular importance is the detail given for the preparation of

    Contractor Contract Specific HSE Management Plan section 2.6

    It is mandatory that in any contract the HSE requirements of PR-1171 Part II are fulfilled by Contractor. PR-1171

    Part II shall be given to Contractor to enable them to satisfy the requirements detailed below, in addition to all

    other contractual requirements.

    1.2 Distribution/Target Audience

    This Procedure is a mandatory requirement for Contractor. PR-1171part II contains HSE instructions for

    Contractor. Distribution of this document is controlled by the Document Custodian.

    2. Contract HSE Management Procedure

    2.1 Scope

    This Procedure applies to all contracts tendered by Company regardless of size and value.

    Throughout this document, “shall” means that an activity or requirement is mandatory.

    2.2 Definition

    Contractor shall adhere to PR-1171 Part II in the preparation and use of documents to meet the HSE

    requirements of both the Tender documentation and the Post-Award HSE management requirements of a

    Contract. Other mandatory contractual requirements not given in this document remain obligatory on

    Contractor.

    2.3 Deliverables

    2.3.1 Retention of document information

    Records shall be maintained to document the implementation of the requirements of this Procedure. A company

    Activity checklist is available in PR-1171 Part I. Other information is available in the web site stated below:

    Contractor shall:

    Provide the following deliverables, as stated in Contract Document C-9 HSE Specification – Minimum Requirements.

    1. Contract HSE Management Plan, (refer to paragraph 2.6.2 - Appendix7) that details the arrangements

    explaining how Contractor will manage HSE risks throughout the duration of the contract.

    2. As part of the Tender submittal, and as part of the HSE Plan, Contractor shall perform a Hazards and Effects

    Management Process (HEMP). The HEMP, following the format in appendix 6, shall be used to detail how

    Contractor will manage the HSE exposures related to the contract C4 Scope of work and the resources that

    will be allocated for control. Both the detailed information on the proposed HSE management and the HEMP

    will be included in document C9 HSE Specification - Minimum Requirements. Section 2.6 of this document

    provides further detail on the necessary information for Tender submission.

    3. Appointment of HSE Key Personnel, including HSE Advisers (refer to paragraph 2.7.2)

    4. Provide any further documentation deemed necessary

    Company staff: Any non-compliance with PR-1171 Part II shall be notified, investigated and reported as per

    document CP-122, HSE Management System Manual.

    Contractor: Any non-compliance with PR-1171 Part II shall be reported in writing to the Contract Holder.

    2.4 Responsibilities

    Contractor shall ensure they have a copy of PR-1171 Part II, ensuring that the requirements of PR-1171 Part II

    are adhered to within the scope of a Contract. (C4) In the event that circumstances prevent compliance with PR-

    1171 Part II, Contractor shall seek formal step-out approval (CP-122, HSE Management System Manual).

    Contractor shall:

    Be responsible for ensuring that activities undertaken within the C4 scope of their contracts are managed in

    accordance with the requirements of PR-1171 Part II, and all other obligations arising from related contract

    documentation.

    Ensure all required approvals are sought from Company and recorded in writing and retained for the duration for

    the contract

    Be responsible for all HSE compliance, regardless of whether the relevant activities are delivered directly by

    Contractor or by a Subcontractor

    2.5 Performance Requirements

    No contract specific activities in Company concession area or at Site may be commenced until Company has

    issued a HSE Commencement Certificate approved by MSE1 (refer Appendix 1). In the event Company permits

    mobilisation activities, the activity should be covered by a Commencement Certificate stating the scope of

    permitted work. Once Company is satisfied that all the pre-commencement steps are complete then a

    Commencement Certificate approved by MSE1 for the whole scope will be issued.

    In the event that there is a significant change in the activity e.g. new Sub Contractor, Company shall direct the

    start of the new scope under the issue of a Commencement Certificate approved by MSE1 for that discreet part.

    In this way the measure of HSE is formally monitored.

    2.6 Contractor HSE Management Plan

    2.6.1 Preamble

    This entire Section 2.6 of PR-1171 Part II provides basic assistance to Contractor in the development and

    application of HSE Management Plans. The Contract HSE Management Plan is a mandatory document and shall

    be specific to each individual contract scope (C4); it shall reflect the nature of the work to be performed and the

    specific hazards presented by the work activities and the respective controls to mitigate the risk including roles

    and responsibilities.

    MSE1 shall use this information when evaluating the suitability and adequacy of Contractor’s HSE Management

    Plan.

    As part of the tendering process, Contractor is obliged to conduct a Hazards and Effects Management Process

    (HEMP) which shall be used to develop the information required for document C9 HSE Specification – Minimum

    Requirements:

    Contractor shall:

    Detail all HSE exposures identified, including those advised by Company in C9 HSE Specification – Minimum

    Requirements, and detail how these risks will be controlled, mitigated and managed to ALARP1.

    Details provided shall fully describe the manpower, equipment and broad details of Contractor HSE policies, rules,

    procedures, standards, guidelines and specifications together with applicable HSE requirements imposed by

    legislation that will be applied to the management of HSE risk for the Contract (See B below).

    Contractor shall:

    Fully describe the key manpower (HSE critical positions) that will be applied to the HSE management of the

    Contract, including names, qualifications and experience. Copies of each individual’s CV will be included in the

    Tender documentation for C9 HSE Specification – Minimum Requirements.

    Contractor shall:

    Cover all Contract Phases from mobilization through execution, demobilization and site restoration.

    2.6.2 Contract-Specific HSE Management Plan

    Contractor shall:

    a) following the Contract Award, kick-off Meeting and on site HSE Workshop, revise its original HEMP and from

    that develop the Contract-Specific HSE Management Plan

    b) describe how the HSE Management Plan will apply its established, generic programs to manage its activities

    in the specific contract

    c) identify the contract-specific work activities it will perform and the anticipated HSE hazards associated with

    the work

    d) clearly describe its plan (controls) for minimizing the potential effects of these anticipated hazards. The

    plan shall identify specific deliverables, targets, performance measures, monitoring programs, etc. Where

    possible, responsibilities and accountabilities should be clearly defined and assigned

    e) submit the completed HSE Management Plan together with the HEMP to the Contract Holder for approval

    by MSE1

    f) obtain formal approval from the Contract Holder in writing for any proposed deviations from or

    amendments to its HSE Management Plan.

    The approved HSE Management Plan shall become part of the contract documents and be legally binding.

    The HSE Management Plan should contain only measurable, quantifiable, contract-specific actions that will be

    taken during the duration of the contract.

    2.6.2.1. Leadership and Commitment

    Contractor shall:

    Provide a list of Contractor senior management and describe their typical participation in HSE activities related

    to contracts (meetings, inspections, audits, site visits, performance reviews etc.).

    Contractor, as part of the plan must submit an organisation chart that clearly details the actual Contractor

    organisation structure from the top management to the site staff. The organisation chart must clearly identify

    the HSE personnel and identify the Key personnel, as stated in the contract, as well as identify the Level 1 and

    Level 2 HSE critical staff. The written detail of HSE roles and responsibilities must then match the organisation

    chart. It is important that Contractor ensures that all organisation staff are identified and listed in the HSE Roles

    and Responsibilities section of the written part of the document.

    Contractor is to submit at the end of the section, a table to detail which senior managers in the organisation,

    will support HSE management activities and when and where. The HSE plan will then require an agreed

    monitoring plan as well as an annual calendar of HSE activities approval to be sought from Contract Holder.

    The elements of the leadership may be combined in the section 2.6.2.3 below.

    2.6.2.2. Policy and Strategic Objectives

    Contractor shall:

    Provide an authorised copy of the HSE Policy. Contractor HSE Policy shall be produced in an easy to read

    format in the working languages of staff and the workforce, endorsed and dated by Contractor most senior

    executive, and communicated to all employees and other relevant parties. Contractor Policy should align with

    the Policy requirements of OHSAS 18001:2007

    The policy should be reviewed annually to reflect any changes. The review should be recorded as part of

    Contractor HSE quality system e.g.

    HSE Manager with CEO Policy Review Annually Head Office

    2.6.2.3. Organization, Responsibilities, Resources, Standards and Documents

    The HSE Plan must identify the HSE staff. It must detail the numbers of HSE staff (advisors), their positions in

    the organisation, their locations stated in the C4 Scope of Work and their lines of reporting.

    Contractor to develop the monitoring plan. The company as well as Contractor will have specific inspections and

    audits planned and it is prudent to align the plans to avoid duplication of effort. Nonetheless, it is incumbent on

    Contractor to ensure that measures stated in the HSE plan or indeed the HEMP are identified to be included and

    managed in the monitoring programme.

    Contractor must be specific in the plan to detail HOW HSE activities will be organised. As an example if they are

    to hold ‘Gate’ meetings instead of, or as well as Tool Box meetings this should be explained. Company prefers

    Craft group meetings e.g. welders as this ensures smaller groups and more interaction with the workers.

    Contractor must provide a sample of the agenda sheets designed to be used in particularly site meetings.

    Contractor shall:

    a) Prepare a contract-specific organization chart showing personnel responsible for the implementation of

    HSE targets and objectives.

    b) Provide the number of competent HSE Advisers to be employed full time on the Contract, describe their

    roles, responsibilities and deployment (see section 2.7.2)

    c) Provide CVs and qualifications for contract HSE Advisers. (see section 2.7.3)

    d) Describe a typical schedule for contract specific HSE meetings to review and communicate HSE issues to all

    levels of the contract-specific organization and between Company and Contractor including (as

    appropriate):

    Company/Contractor HSE meetings (refer HSE Monitoring Plan/Program, Appendix 2);

    Contractor HSE meetings;

    Craft specific HSE meetings; (Preferred)

    Town hall meetings

    e) Provide typical Terms of Reference for contract specific HSE meetings.

    f) Provide a statement indicating the typical involvement of HSE support functions within Contractor

    organisation (if applicable) in:

    preparing and monitoring departmental action plans;

    Contractor must record a sample Action Tracking Register approval to be sought from the Contract Holder.

    Formulating HSE rules;

    Inspections and audits;

    Contractor must submit a schedule of the intended inspections and audits. Inspections must be detailed to

    cover all the aspects of the activities for example workshops. (Inspection check lists) Audits must be specified

    to include significant risks identified in the HEMP process. An example of this would be an audit of PR-1708 and

    1709 Mechanical Lifting.

    Developing promotional/incentives material;

    Contractor must state what HSE promotional material and incentive programmes will be adopted to promote

    HSE in the organisation. Although the Company may provide some materials it is expected that Contractor will

    drive the HSE aspects of this.

    Training;

    Contractor must submit a training programme in line with the contract requirements of C9 HSE Specification -

    Minimum Requirements and the SP-1157 required training attached. It must include additional details of any in

    house training or third party training which supports the competence of any staff included in the contract

    organisation. See also Appendix 3

    Road Safety;

    Contractor must submit Details of how they will manage the requirements of SP-2000 and SP-2001. Detail e.g.

    how will commuting be managed to assure, as far as reasonably practicable, that employees will not use private

    transport. Detail e.g. who in the organisation is competent to ensure that any loads being transported to site

    are secure and meet the SP-2001 criteria?

    Sub-contractor assessment;

    Contractor must submit a sample of the Sub Contractor HSE Contract Risk Assessment process sheets that will

    be used and recorded as part of the HSE plan for the specific contract. The details of this should be available in

    the contract submission (T3 HSE Questionnaire) and Company may refer to this during an audit to ensure what

    was committed is actually applied. Suggest that this forms a part of an appendix to support the statement on

    managing sub Contractor.

    Health risk assessment, performance monitoring and surveillance;

    Contractor must detail how it will manage Health and Welfare through the duration of the contract. Company will

    refer to the Control Measures stated in the HEMP process and submitted as part of the HSE plan. It is expected

    that Contractor will detail all HRA documents as part of the HEMP controls and as appropriate to the activities.

    Company will strictly apply the requirements of C9 and therefore Contractor must have at least knowledge of the

    requirements e.g., SP-1231 Occupational health, SP-1230 Medical Examination, Treatment and Facilities (Fitness

    to Work) and SP-1232 Public Health

    Environmental monitoring;

    Contractor must detail how it will manage Environmental issues through the length of the contract. Company will

    refer to the Control Measures stated in the HEMP process and submitted as part of the HSE plan. It is expected

    that Contractor will detail all Environmental documents as part of the HEMP controls and as appropriate to the

    activities. Company will apply strictly the requirements of C9 and therefore Contractor must have at least

    knowledge of the requirements e.g., SP-1009 Waste Management

    Incident Investigation.

    Contractor must detail how it will manage Incident Investigations. All investigations must be managed and led by

    Contractor. Company will strictly apply the requirements of C9 and therefore Contractor must have at least

    knowledge of the requirements e.g., PR-1418 and GU612 unless otherwise stated. Ideally Contractor should

    submit a typical Incident investigation Presentation model and lesson learned model sheet as part of the HSE

    plan.

    g) Allocate sufficient competent resources at all levels to effectively manage HSE.

    Contractor shall submit an organisation chart as stated in 2.6.2.3 above. Contractor must state how it will meet

    the minimum requirements of C9 and at the same time manage the resources to match the stated control

    measures within the HSE plan (HEMP).

    h) Ensure that all employees (including sub-Contractor) are competent to perform their work tasks, that relevant

    HSE training is provided, and that HSE requirements are incorporated into competency assessment and

    assurance programs. Contractor must identify Level 1 and Level 2 critical HSE positions in their organisation

    and that of their sub Contractor and ensure personnel are HSE competent to deliver the activity in a safe

    manner.

    Contractor shall explain in detail how the HSE Competence is managed in house for their staff as well as how

    they measure the competence of the sub Contractor? Contractor is to detail how competence assessment of

    Contractor employees are conducted. Details of whom in the organisation is qualified to conduct the HSE

    Competence assessments for individuals and competent to assess the sub Contractor are also to be included.

    Ideally Contractor will support the detail with a copy of the assessment forms used for HSE competence

    assessments. See Section 2.7

    i) Ensure that all employees (including sub-Contractor) are competently supervised.

    j) Provide a matrix describing required training for contract activities (including refresher training) and maintain

    detailed training records of staff employed on the contract.

    k) Submit a draft HSE training plan and schedule for approval by the Company Contract Holder.

    In line with 2.6.2.3 above Contractor must submit a training programme and training schedule in line with the

    contract requirements of C9 HSE Specification – Minimum Requirements and the SP-1157 required training.

    It must include additional details of any in house training which supports the competence of any staff included in

    the contract organisation.

    Contractor shall:

    Confirm mandatory and compulsory training requirements for contract activities.

    Required training might include, but shall not be limited to:

    HSE induction-orientation;

    Job procedures (e.g. Permit to work, gas testing, fire fighting, working at height, lifting operations,

    confined space);

    Road safety;

    Health (e.g. first aid (AHA), use of PPE);

    Incident investigation and reporting;

    Auditing;

    Environmental protection/awareness;

    Supervisory training; specialized training as necessary; on the job training;

    Emergency planning.

    2.6.2.4. Hazards and Effects Management Process (HEMP)

    Contractor shall:

    Provide a register of anticipated contract-specific hazards and effects identified by the detailed HEMP.

    Contractor is to submit the HEMP (risk assessment) to contract holder for approval by MSE1, and to be aligned

    with Company expectations in Appendix 6 attached.

    From the assessment of hazards, identify risk reduction measures to control and recover, including:

    Work methods and work site procedures

    Emergency response plans

    Exposure reduction methods

    2.6.2.5. Planning and Procedures

    Contractor shall:

    Establish, implement, maintain and retain document information which complies with ISO 9001:2015

    requirements.

    The organization shall maintain “documented information 2 ” for the following four activities over and above the

    operational processes:

    7.5 Documented information

    7.5.3 Control of documented information (including retention)

    9.2 Internal audit

    8.7 Control of nonconforming outputs

    10.2 Nonconformity and corrective action

    (Above reference numbering relate to ISO 9001:2015)

    Contractor shall:

    Provide contract-specific HSE objectives and targets.

    Produce a schedule of contract-specific and most credible emergency response drills.

    Provide a list of contract-specific work procedures and other procedures to address high hazard work (HSE

    hazardous activities identified in the HEMP).

    Contractor must submit a list of procedures, specifications and guidelines that it intends to use for contract

    management. Contractor is mandated to follow, as a minimum, the Company C9 HSE documents procedures

    must be formerly stated in the required list. The list must personify the stated documents in the HSE plan HEMP.

    Contractor shall:

    Provide a list identifying sub-Contractor to be employed in the execution of the contract.

    Identify potential emergency scenarios that might arise during the contract execution phase and procedures

    typically used in such scenarios.

    Contractor must submit a list of the most credible scenarios relevant to the contract scope and to include full

    cognizance of the locations. In addition Contractor to submit a plan which states when the scenarios will be

    practiced which in turn must be in line with the phase of the contract or project e.g. Commissioning phase leads

    to H2S practice?

    Examples include:

    Road traffic accident;

    Fire;

    H2S evacuation;

    Working at height, rescue form height;

    Radiation leak;

    Man lost;

    Storm;

    Well Blow-out;

    Medevac; Critical illness; Sever Skin Burn;

    2.6.2.6. Implementation, Monitoring and Corrective Action

    Contractor shall:

    List the typical communication techniques used to make contract personnel aware of HSE issues. Examples

    include:

    Leadership walkabouts

    Meetings (refer paragraph 2.6.5)

    Notice boards (indicate locations)

    Newsletters (indicate frequency of issue)

    Contractor shall:

    List critical items for HSE inspection. Equipment to include (typically):

    Contractor must explain how all the contract/project equipment will be recorded for site checks, third party inspection

    etc. Contractor to submit, as part of the HSE plan, details of the inspection schedule for the equipment. Ideally this

    will be available electronically and part of a reporting system e.g. MAXIMO

    Rotating equipment

    Excavation equipment

    Scaffolding

    Contractor shall:

    Prepare an inspection schedule for the above, indicating category of item to be inspected e.g. pressure

    equipment, the frequency of inspection, responsible person and the location of the inspection.

    Using the template in Appendix 4, report monthly HSE information to the Company for approval by the Contract

    Holder.

    Nominate and identify the person in the organisation chart responsible for preparing the monthly HSE report.

    Ensure that the responsibility is listed in the HSE plan i.e. Roles and responsibilities.

    Prepare a program for monitoring contract-specific HSE data, describing what will be measured, where the

    measurement will occur, the frequency of measurement, who will perform the measurement and the method

    used to take the measurement.

    Contractor must submit an example sheet to show how the HSE data will be managed by Contractor. In

    addition the roles and responsibilities must state who in the organisation is responsible for HSE records as well

    as reviewing the data.

    2.6.2.7. Audit

    Contractor shall:

    Provide a contract-specific matrix showing the schedule for HSE audits and inspections. Appendix 2 might be of

    assistance to Contractor.

    Contractor shall:

    Provide third party auditor training for key staff assigned the responsibility for internal auditing of the HSE

    management system and associated processes.

    In line with 2.6.2.3 above Contractor must submit details of who will conduct audits, when and where they

    will be conducted. It is important that Contractor states what audits will be conducted as stated earlier in

    2.6.2.3. The phase or activity level of the Contract or Project should drive the most appropriate audit e.g.

    working at height Audit scaffold SP-1257.

    2.6.2.8. Review

    Contractor shall:

    2.7 Competence Assurance (refer 2.6.2.3)

    Contractor shall:

    Provide HSE Competent personnel. Contractor staff employed (including Sub Contractor staff), particularly in

    positions where they have a significant influence over the safety aspects of an activity, must be HSE competent.

    HSE Qualifications shall be verified by Contractor.

    Contractor shall:

    Have an established Competence Assurance framework that includes:

    a specification criteria for assessment i.e. expectations in terms of awareness knowledge and

    2.7.1. Contractor HSE Key Personnel

    Contractor shall:

    Propose the appointment of the HSE Key Personnel given in tender document for Contract Holder review and

    approval. Individuals to fill the positions of Contractor HSE Adviser(s), Contractor Representative(s) and

    Contractor Site Representative(s) shall be classified as HSE Key Personnel under the contract.

    HSE Advisers shall not be responsible for line management and supervision; the role of HSE Advisers shall be

    facilitatory/advisory in nature. Line management and supervision shall be responsible for implementation and

    assurance of HSE controls in the work place.

    Contractor shall:

    Define the role and responsibilities of the HSE Advisers in the HSE Management Plan as well as the roles and

    responsibilities for all HSE critical positions

    2.7.2. Requirements for HSE Advisers

    Contractor shall:

    Provide HSE Adviser(s) as described in this section that, at a minimum, satisfy the requirements of the

    ‘Occupational Health & Industrial Safety Precautions’, Sultanate of Oman, Ministry of Social Affairs and Labour,

    Decision No. 286/2008.

    Company may consider additional HSE advisors over and above the legal requirements. The minimum number

    of HSE Advisors required by Company will be as specified in the tender Requirements (C-04 and T-3). The

    absolute minimum will be one HSE Adviser for each geographical area in which the contract is operating

    (Geographical area is defined as a Company operating area e.g. Bahja, Marmul, Harweel, Yibal, NIMR,

    Lekhwair, Fahud, Qarn Alam etc.)

    The total number of HSE Adviser(s) required by the Contract will be stated in the tender document. The

    decision will be based on HSE exposures presented by the specific contract activities and the overall HSE risk.

    Contractor Management shall, at all times, throughout the duration of the contract, maintain the required

    number of professionally qualified HSE Advisers as per the contract. Where the contract is based on a JV

    Contractor shall:

    Ensure that the HSE management system of the JV on which the banding was done is retained for the duration

    of the contract.

    2.7.3. Minimum Competence for Professional HSE Advisers

    Professional HSE Advisers shall have a minimum of five years work experience, of which at least two years shall

    have been in the role of an HSE Adviser. Work experience must be related to the activities to be carried out

    under the terms of the contract.

    HSE Adviser shall, as a minimum, be a holder of the (NEBTOGS) NEBOSH International Tech. Certificate in Oil

    and Gas Operational Safety course or (NEBHSC) NEBOSH International Certificate in Occupational Safety &

    Health course or (NEBHSD) Level 6 NEBOSH Diploma in Occupational Safety & Health course and a member of

    an independent internationally recognized Professional Institution per the list below:

    I. IOSH: Member of the Institute of Occupational Safety and Health.

    II. DIPSM: Diploma in Safety Management, or Member of International Institute of Risk and Safety

    Management.

    III. RSP: Registered Safety Professional.

    IV. Other per Approved List held by Company CFDH for HSE (MSE1)

    HSE Advisers shall be COMPETENT in specific relevant safety management principles and techniques as

    required by the scope of work and have a working knowledge of the legal and contractual health, safety and

    environmental requirements that must be met. They must have the ability to communicate effectively at all

    levels of Contractor organization including written and Spoken English. HSE staff will be interviewed by

    Company HSE staff against the industry competence model.

    K: Knowledge, an employee is considered at awareness PLUS level which requires the individual to demonstrate ability to

    interpret and evaluate information and advice from expert in an area of expertise

    A: Awareness, an employee has a good knowledge of what is involved in the area of expertise and its relevance to the

    business.

    In Addition:

    Contractor shall:

    Confirm in the tender document C9 HSE Specification - Minimum Requirements that they will provide HSE

    Advisers that satisfy the minimum competence requirements.

    An HSE Adviser holding higher qualifications not currently recognized by Company, might be exempted from

    some of the above requirements subject to review by Contract Holder and CFDH for HSE (MSE1) .

    Contractor HSE Advisers shall be qualified in accordance with either of the following requirements:

    2.7.4. HSE Adviser seconded from Line Management

    Line Managers who are seconded to HSE might be acceptable as HSE Advisers provided that the proposed

    individuals have a minimum of three years experience on Company contracts at site supervisory level and been

    in a HSE critical Position. Work experience must be related to the activities to be carried out under the terms of

    the contract. In all cases the competence level required for the post will be the overriding factor see table

    above.

    Proposed individuals who do not satisfy the criteria of three years experience on Company contracts at site

    supervisory level shall be subject to review and approval by Company CFDH for HSE (MSE) to determine

    acceptability to Company.

    2.8 Site Restoration (Upon completion of the Work or Services)

    Contractor shall:

    Satisfactorily restore the site, including any areas of Company concession area and any premises thereon, used

    by Contractor to perform the Work or Services as per the requirements of SP-1012 Specification for Land

    Management. (Upon completion of the restoration of the Site)

    Contractor shall:

    Apply for certification of such restoration. Company shall certify satisfactory completion by the issuance of a Site

    Restoration Certificate (refer Appendix 5).

    A copy of the certificate must be sent to the MSE2 section in Company for record.

    2.9 HSE Penalties and Defaults

    Company Contract Representative/Site Representative(s) shall apply HSE penalties and defaults on Contractor,

    as allowed in the Contract (C5), for unauthorized deviation(s) from Contractor HSE Management Plan and C9

    HSE Specification – Minimum Requirements. The Contract Manager is to be advised in writing of all Penalties

    and Defaults being imposed.

    HSE Penalties and Defaults shall be determined by the Contract Holder and may include Contract Performance

    Reports detailing unauthorized deviations as well as from inspections and audit findings.

    2.10 Behavioural Safety and Assurance

    2.10.1 Behaviour and Assurance

    Contractor shall:

    Fully implement a Behaviour Based Safety Programme (BBS) The model shall be of an international standard

    and/or approved subject matter expert.

    2.10.2 Life Saving Rules

    Life Saving Rules (LSRs) refer GU140 (C9) Article 9 - 9.3. In addition to the chosen behavioural programme

    Contractor shall:

    Fully implement the Company Life Saving Rules.

    The Life Saving Rules set out clear and simple “dos” and “don’ts” covering activities with the highest potential

    safety risk. They help to make sure that rules are acknowledged, followed and people are protected. We are

    determined to save lives.

    Contractor MUST adopt and ensure that the rules are embedded in their company.

    There are serious consequences associated with breaking a Life Saving Rule.

    If a rule-breaker is aware of the Life Saving Rule or required procedure through training, experience or

    communication, and did not comply, the maximum appropriate disciplinary action will be applied: up to and

    including termination of employment for employees; or removal from site and disqualification from future

    Company work for employees of Contractor or sub-Contractor.

    2.10.3 Letter of Assurance

    Contractor Chief Executive Officer (CEO) shall submit a HSE Letter of Assurance (LoA) every year before 1st

    March to Company. The LoA is a confirmation from the CEO, with or without qualifications, that the current

    implementation status and integrity of Contractor HSE management system meets the Contract HSE

    requirements. Only one LoA per Contractor is required covering all contracts with Company that are operational

    on 1st January of that year. Company will issue the format and submission details for the LoA annually.
