  • 1. Commencement / Application Whole of the Punjab

    2. It shall apply to :- (i) Govt. Employees.

    (ii) Corporation Employees.

    (iii) Retired Employees of Govt and Corporation.

  • DEFINITIONS

    ACCUSED A person against whom action is

    initiated.

    CHIEF MINISTER(Punjab)

    COMPETENT AUTHORITY

    Chief Minister or Any officer or Authority

    Authorize by the Chief Minister to exercise the powers of competent authority.

    Two or more employees proceeded against jointly,

    Competent authority of Senior most employee in all accused.

  • APPELLATE AUTHORITY

    Authority next above the Competent to which an appeal lies against the order of the Competent authority.

    CHARGES

    Allegations framed against the accused.

    INQUIRY OFFICER / INQUIRY COMMITTEE

    An officer / Two or more officers appointed by the Competent Authority

  • CORPOTATION Organization or institution set up, established,

    owned, managed or controlled by the Govt, by or under any law. OR

    A body or organization in which the Govt has a Controlling share or Interest and includes the Chairman and the Chief executive.

    EMPLOYEE Means a person in the employment of a Corporation,

    Corporate body, Autonomous body, authority, statutory body or any other organization or Institution established by Govt. or in which the Govt. has a controlling share or interest.

  • GROUNDS FOR PROCEEDINGS

    Inefficiency.

    Guilty of misconduct.

    Guilty of corruption.

    Engaged in subversives activities or guilty of disclosure of official secrets.

  • PENALTIES MINOR PENALTIES (i) Censure

    (ii) Withholding of increments for a specific period.

    Maximum 5 years.

    (iii) Fine Not exceed basic pay of one month.

    (iv) Reduction to a lower stage / stages. Maximum

    5 years.

    (v) Withholding for promotion for a specific period

    Maximum 5 years.

  • MAJOR PENALTIES (i) Recovery of Pay, Pension or Any other amount

    payable to the accused.

    (ii) Reduction to a lower post and pay scale

    for specific period Maximum 5 years.

    (iii) Forfeiture of past service for a specific period

    Maximum 5 years

    (iv) Compulsory retirement.

    (v) Removal from service.

    (vi) Dismissal from service.

  • PENALTIES AFTER RETIREMENT

    (i) Withholding of pension or any part.

    (ii) Recovery from pension or any other amount

    Payable to the accused.

  • INITIATION OF PROCEEDINGOn the basis of

    Own knowledge

    Information placed before it.

    It shall either

    (a)Proceeding against accused Show cause notice

    No opportunity of show cause or Personal hearing

    Where Competent authority is satisfied

    In the interest of security of Pakistan.

    Employee Convicted of the charges of corruption

    Employee Involved in subversive activities.

    (b)Hold an inquiry by appointing an enquiry officer/enquiry committee.

  • SUSPENSION An employee may be placed under suspension

    For a period of 90 days if in the opinion of the competent authority, suspension is necessary.

    If not extended within 30 days of the expiry of initial period of Suspension employees reinstated.

  • PROCEDURE FOLLOWED BY THE COMPETENT AUTHORITY

    APPOINTMENT OF AN INQUIRY OFFICER / AN INQUIRY COMMITTEE SENIOR RANK TO THE ACCUSED

    Grounds for proceedings charges. Appointment of DR.

    Direction to the accused to submit written defense to the enquiry officer or enquiry committee within 7 days.

    Record of the case shall be communicated to the enquiry officer.

  • PROCEDURE FOLLOWED BY ENQUIRY OFFICER / ENQUIRY COMMITTEE

    On receipt of reply of the accused inquire into the charges, examine documentary evidence, witnesses cross-examination

    Accused fails to furnish his/her reply (ex-partee)

    Accused absence himself /herself deemed to have hampered unless medical leave is sanctioned on the recommendation of a medical board.

    Submit inquiry report clear cut findings along with specific recommendation within 60 days.

    In case inquiry not completed within 60 days seek extension for specific period for reason to be recorded in writing.
