 HIGHLIGHTS   OF   GENERAL  BUDGET - 2016-17

- Budget contains insignificant benefit forindividual serving as well retired/seniorcitizens.

- No change in income tax slabs or tax rates.

- Increase in surcharge from 12% to 15% onindividuals, HUFs with income exceeding ̀1cr.

- Income-tax rebate for resident individualswith total income not exceeding ` 5 lakh enhanced from ` 2,000 to ̀ 5,000.

- Additional deduction of ̀ 50,000 in respectof interest payable on home loan taken byan  Individual during 2016-17.This deductionis available to a person not owing a houseproperty and cost of house also does notexceed ̀ 50 lakh and loan does not exceed` 35 lakh.

- Period within which the construction oracquisition of a self-occupied house propertyis to completed for claiming deduction ofinterest on housing loan increased from 3years to 5 years reckoned from the year inwhich is taken - permissible deduction limitremains unchanged at ̀ 2,00,000.

- Arrears of rent received will deemed to beincome from house property. Deduction at30% of the amount so received is allowed.

- Exemption limit for employer’s contributionto superannuation enhanced to ̀ 1,50,000per annum from existing ̀ 1,00,000.

- Exemption on withdrawal of accumulatedinterest from EPF reduced from 100% to40% to the extent it relates to contributionsmade by the employee after April1, 2016.This concerns other than excludedemployees.

- 40% of the amount withdrawn from the NewPension Scheme(NPS) on retirement willbe tax exempt. As on date, entirewithdrawal is being taxed. This is to bring

parity between NPS and superannuationfunds. In nutshell, this will increase theoverall tax liability of the  Individua. Amountsreceived by a nominee from NPS on deathof the taxpayer would be exempt fromtax.(Govt is likely to revisit this proposal asvarious unions of the Karamcharis &employees have expressed resentments).Contributions upto March,2016 wouldcontinue to enjoy all tax benefits.[. Furtherclarifications are awaited on tax treatmentof withdrawals from PPF - an optionalpopular savings scheme mostly taken bypensioners and senior citizens . Hope afavourable view is taken by the Govt.]

- Deduction limit for rent paid by an individualwho neither have a house & nor entitled toHRA from employer  raised to ̀ 60,000 from` 24,000.

- Gains under Sovereign Gold Bonds Scheme2015 are exempt from tax with provision ofindexation benefit on transfer of the GoldBonds.(This, it is felt, will give incentive for investing in Gold Bonds instead of physicalpossession of gold). 

- Individual to be charged a tax of 10% on thedividend received in excess of ̀ 10 lakh asagainst present provision where dividendreceived by an individual is exempt from taxas dividend distribution tax (DDT) is alreadypaid by the company/corporate.

- No higher rate of TDS to NRIs due tounavailability of PAN subject to fulfilment ofother conditions.

- Introducing e-assessment & doing awaywith present system of physical verificationduring tax hearing.

- Reducing time-limit for filing of belatedreturns to anytime before the end of theAssessment year or completion ofassessment , whichever is earlier.

- Advance payment schdule amended forindividuals  as: a) 15% of tax payable

by June 15, b) 45% of tax payableby September 15, c) 75% of tax payableby December15 & d) 100% of tax payableby March 15. ( This will increase complianceburden ). 

- Income declaration scheme - Immunity hasbeen granted from further scrutiny in cases where the taxpayer declares domesticundisclosed income and pays 45% thereof( 30% of tax , surcharge of 7.5% and penalty7.5%. Window is available between June 1,2016 and September 30,2016 for suchdeclarations and availing the option with twomonths of The declaration. Declared wouldnot come for scrutiny under IT Act or theWealth Tax Act. Scheme also providesimmunity from prosecution.

- Krishika Kalyan Cess @ 0.5% on value ofany or all taxable services  effective fromJune, 2016. This will raise the service taxto 15% from present 14.5%.

- House built under recognised govt schemesmeasuring upto 60 sqm exempted from service tax.

- Infrastructure Cess @ 1% to 4% introducedon motor vehicles depending on the variantof the vehicle & type of fuel used.

- Basic excise duty on branded ready madegarments having retail price of ̀ 1,000/- or more increased from 2 to 12.5% frompresent nil. Excise Duty of 1% increasedon jewellery.

- Clean Energy Cess on coal,lignite etcrenamed as ‘Clean Environment Cess’increased  from ̀ 200 per ton ̀ 400 per ton.

- ` 2,000 cr scheme ‘Ujjwala’ to provide LPGconnections to 1.5 cr women from BPLfamilies.

- Setting up of 3000 ‘Jan Aushadhi’ storesfor dispensing generic medicines. Thesestores will import duty free Dialysisequipments.

- Health-care insurance scheme proposed for1/3rd of population (BPL) families .

- Pensions including OROP  and salary togovtemployees puts Govt on a tight string. Addl provision for civil pensioners to meetrecommendations of 7th CPC is at ̀ 32,070cr in 2016-17 against ` 27,285 cr in 2015-16 giving an increase of 17.5% which fallsshort of requirements.

- Statutory status to Aadhar. --- a centre ofJAM (Jandhan, Aadhar & Mobile). Hon'bleFinance Minister Arun Jaitley in his budgetspeech said to make the uniqueidentification number the foundation fordelivering social security programmes of thegovt. Aadhar scheme is currently underchallenge from civil rights groups in theSupreme Court. Aadhar is finding itscriticism due to lack of legal backing.

- Government has concentrated onagriculture sector, irrigation projects,organicfarming schemes, Gram Sadak Yojna,strengthening of MANREGA, Swatch BharatMission, roads, Infra projects, more benchesof SEBI Appellate Tribunal, banksrehabilitation, additional benches forIncome Tax Tribunals.

- lowering of corporate income tax rate forcompanies with turnover less than ?5 cr to29% +surcharge+Cess.

- It is unfortunate that the govt has almostignored the middle class especially thePENSIONRS/SENIOR CITIZENS who onlypay tax very honestly,religiously andethically bound citizens.Hike in the rate ofindirect tax is bound to effect this class ofcitizens whose past savings - a source forlivelihood in the evenings of their lives getsautomatically reduced due to erosion in thevalue of money. Finance Minister has notdone justice to this group of citizens. Thisgroup is not only a toothless silentspectator but also a helpless sufferer. Wish

FAMILY PENSION IS THE RIGHTTHE OF WIFE AND NOT THEDISCRETION OF HUSBAND

To wipe the tears from the face of anindividual, one needs dynamic Organisationcoupled with strong will. Without these, it isdifficult nay impossible to set right the wrongdecisions of Administration. The undersignedin his capacity as Secy General  of SECRailway Association had various experiences.Some of these are quoted below:1. Sh Soma Sakharam, an ex-Gangman  who

retired on 30.04.1998 had been deniedpension on grounds of not completing not10 years of Qualifying service at the time ofretirement. The matter was takenup in thePension Adalat where the service sheet ofthe pensioner under reference was checkedby u/s who found that 50% of his casualservice in CPC scale had not been countedby the administration. Same got re-examined and found that the pensioner  u/rhas over 12 years of qualifying service Andthus entitled Pension/Family pension. 

2. Sh Khemchand Brijlal, Gangman soughtvoluntary retirement from 22.12.1981 & laterexpired  on 11.01.1984. He too was notsanctioned pension for reason of not havingput in 20 years of qualifying service. The

officials kept on arguing that acceedingto  the request of pensioner to grant/sanction pension without 20 years ofqualifying service is incorrect  and as suchthe orders of voluntary retirement werecancelled and his death treated as deathduring service. 

3. Smt Shanti Bai  Yadav when approachedthe bank for sanction of family pension afterthe death of her husband was told that nofamily pension is sanctioned in the PPOand also no joint photograph with herhusband is available in the PPO. Aftersubmission of various declaration anddocuments proving that the claimant is alegally married wife, a PPO was issued inher favour for family pension. 

4.  Sh Leeladhar Gangadhar, ex-Tech, afterretirement got pension . Suddenly he wasfound missing. His wife Smt Mirabai lodgedan FIR. Later on approaching the bank forfamily pension, she was informed that thereis no family pension in her favour in the PPOand hence cannot be paid any familypension. Matter was taken to the PensionAdalat and after prolonged battle it wasproved that she is the legally married wifeof the pensioner Leeladhar whowent missing. A correction to the PPO wasissued and the claimant is now getting familypension.

5. Sh Chandan Mahagoo, Gangman retired on31.03.1998. He had two wives and none ofthe two found mention in the  PPO givingentitlement of family pension to any of thewives. On the expiry of the pensionerthe first wife represented for sanctionof family pension but the claim was rejectedand case closed.The matter was thentakenup afresh and administrative authoritiesconvinced with citation of existing rules onthe subject. The Ministry of Pensions andRly Board’ orders stipulate that the first wifeis entitled to,family pension and after herdeath, children of second wife are entitledto the benefits of family pension. This ruleis in force since 2013 and there is nochange since then. All the five cases listed above force the u/s

the Hon'ble Finance Minister revisits thepoints ignored such as extra interests onsavings, pensions be net of income tax,raising exemption limit of income tax bothfor senior citizens & citizens above 80 yearsold. He may also like to address theEmpowered Committee of Secretariesheaded by Cabinet Secretary P K Sinhaexamining the report of 7th Central PayCommission to give full consideration to thedemands of the pensioners which would notonly benefit the pensioners alone but seniorcitizens in general too. Sincere attemptsbe made to make Budget 2016-17 'PEOPLE FRIENDLY' instead of 'PEOPLEUNFRIENDLY'.

We seek your benign intervention in thefollowing matter of injustice with a section ofPre-2006 Central Government Pensioners:1. Sixth Pay Commission recommended for

“Modified Parity” between Pre-2006 & post-2006 Pensioners. Its Recommendationswere accepted by the Cabinet vide Resolutiondated 29-8-08 cited above, which inter-aliaprovided that “The fixation (of Pension)………. will be subject to the provisionthat the revised pension, in no case,shall be lower than 50% of the sum ofthe minimum of the pay in the pay bandand the grade pay thereon

to feel that the officials handling these casesnot only need proper understanding of the rulesand regulations but middle level supervisoryofficers too are not discharging their dutiessincerely to help the affected  parties. Furtherit  emphasises the need for on-job refreshertraining through workshops whereat besidesofficials handling such matters, the lower levelwhose literacy level is low, also need toeducated on benefits they are entitled to.Checking of service records in between andservice verification  is equally essential to bein line with Prime Minister shri “Narendra Modi’s dictum of Minimum Govt andMaximum Governace”  and corruption freeadministration.

2. Later on, DOP&PW made changes in theabove said orders (vide Para 5 of OM dated11-2-09 cited above) & inter-alia laid downthe condition that “benefit of up-gradation ofposts subsequent to their retirement wouldnot be admissible to the pre-2006pensioners in this regard.”

3. The above said condition changed the verynature and content of the decision of theCabinet notified vide Gazette Notificationdated 29-8-2008 as the said Resolution didnot provide for it.

4. DOP&PW’s OM dated 11-2-09 has sincebeen quashed by the CAT New Delhi videOA 655/2010 directed for fixation of Pensionas per Resolution dated 29-8-2008.

5. All SLPs of the Government in this regard,against the judgements of the CAT and HighCourts, had been conclusively been rejectedby the Apex Court vide its judgement dated17-3-15.

5. a) DOP&PW vide OM dated 28-1-2013ordered for Revision of Pension of Pre-20006Pensioners to 50% of minimum of the Payin the Pay Band plus Grade Pay of theCorresponding to Pre-revised scale w.e.f.24-9-2012 whereas the decision of theCabinet on 24-9-2012.

b) This order was modified and implementedw.e.f. 1-1-2006 vide DOP&PW OM dated30-7-15 - as per Orders of the SupremeCourt on 17-3-2015.

6. The order dated 30-7-15 only partiallyimplemented the orders of the Courts andthe orders are yet to be issued in respect ofrevision of Pension as per pay scales ofmerged/upgraded posts.

7. DOP&PW OM No. 38/77-A/09- P&PW(A)Pt. of 5.3.2015 (para 2) says “Hon’ CAT/PBin orders dt. 1.11.2011 directed that the pastpensioners may be granted w.e.f.1.1.2006 revised pension with ref. to FitmentTable for the Post, as adopted for payfixation of serving employees.”

8. Delhi High Court in W.P.(C) 8012/2013 hadheld that “policy decision of the Governmentin the OM dated September 01, 2008 to fixpension for all category of pensioners didnot classify post of pre January 01, 2006retirees and all were entitled to pension asper a common formula”

9. All the above said judgements have beenconclusively upheld by the Supreme Court.

10.It is, therefore, requested that Pre-2006Pensioners be given the benefit of upgradedPay Band and Grade Pay of the post fromwhich they retired so that, minimum pensionbe not lower than 50% of the pay in therevised pay band plus the grade paycorresponding to the post from which thepensioner retired.

2. Now, in the implementation of thejudgment of the Hon’ble Supreme Court on this

issue in Civil Appeal no. 10640- 46/2013 in thecase of KC BAJAJ & Others v/s Union Of INDIA,Govt. of India, Min of Personal, PublicGrievances and Pension and P.W, vide itsOffice Memo. No: 38/31/11-P &PW (A) (Vol.IV) dated 18-02-2015, has issued orders to allministries/deptts. That in the c/o Pre-1996 &Pre2006 Retired medical officers, NPA @ 25%shall be added to the minimum of the revisedscale of Pay as on 1.1.1996 & 1.1.2006corresponding to the Pre-revised pay scale fromwhich the Med. Offr. has retired in cases wherethe consolidated Pension/ F.P is stepped upto 50%/30% respectively of the minimum of therevised scale of Pay/Pay+GP in the 5th & 6thPay commissions respectively.

3. In view of the above action plan of G.O.I.itIs requested that Govt. of Haryana should alsotake similar steps and issue orders to thePension disbursing authorities to revise Pensionof Pre-1996 & Pre-2006 retired doctors ofHaryana considering NPA as PAY whenpension is stepped up to 50% of the minimumof the Pay/Pay+GP in the revised scales ofPay in the 5th & 6th Pay Commissionscorresponding to the scale from which the M.O.has retired w.e.f 1.1.1996 & 1.1.2006respectively i.e. 50% of minimum of Pay(Pay+NPA) w.e.f 1.1.1996 & 50% of Pay(Pay+GP+NPA)w.e.f.1.1.2006 of correspondingscales.

7th Pay Commission Latest News – Finance Ministry has published this 7th PayCommission meeting minutes held with themembers of staff side held on 19.02.2016Minutes of the Meeting of Joint Secretary (IC)with the Members of the Staff-Side of theStanding Committee (National Council-JCM)held on 19.02.2016. A Meeting was held underthe chairmanship of Joint Secretary(Implementation Cell), Department ofExpenditure, Ministry of Finance, with theMembers of the Staff Side of the StandingCommittee (National Council-JCM) on19.2.2016 to discuss the issues raised by theNational Joint Council of Action (NJCA) {JointConsultative Machinery (JCM)} in their letter No.NJC/2015/7th CPC dt. 10.12.2015, addressedto the Cabinet Secretary, regarding their Charterof Demands on the recommendations of the 7th

Central Pay Commission. The Secretary, Staff-Side of the Standing Committee (NationalCouncil- JCM), who is the convener of the NJCA,along with other office bearers attended themeeting. The list of the participants from theStaff-Side is attached at Annexure.

2. Welcoming the members of the Staff-Side, JS(IC) mentioned that the meeting hasbeen convened to enable the Staff-Side to bringout their concerns on the recommendations ofthe 7th CPC in the light of the Charter ofDemands made by them in the foresaid letterof NJCA so that same could be examined inthe Implementation Cell and submitted forconsideration of the Empowered Committee ofSecretaries. He informed the office bearers thatbefore arriving at a decision, the ECoS wouldalso hold separate discussions with the StaffSide.

3. Commencing the discussions from theSide of the Members of the Staff-Side,Secretary, Staff-Side, Standing Committee

(National Council-JCM), explained thatthey have already placed their Charter ofDemands as per the letter of NJCA dated10.12.2015. He mentioned that the reasonsbased on which these demands havebeen made have also been explained therein.He, however, highlighted that the Staff-Side isnot at all happy with the recommendations ofthe 7th CPC and, in fact, no section of theemployees is satisfied, as the Commission hasrecommended a minimal pay increase ascompared to the previous Pay Commissions.He mentioned that the Staff-Side does notagree with the minimum pay of Rs. 18000 andthe reason as to why the methodology adoptedby the 7th CPC to arrive at this figure is notcorrect has been explained in their letter dated10.12.2015. He stated that Staff-Side demandsenhancement of the minimum pay to Rs. 26000and the reasons in support of this have beengiven in their aforesaid letter. He further statedthat an amicable and mutually negotiatedsettlement of these demands is necessary asnon-acceptance would further causeresentment in the employees. He informed thatStaff-Side has already made their stand clearto go on strike from 11th April, 2016 if theirdemands are not considered and no amicablesettlement happens.

4. Thereafter, the other members of theStaff-Side also expressed their arguments foracceptance of these demands and all of thememphasised that the minimum pay needs tobe revised. Consequently, the fitment multipleof 2.57 would also need commensurate change.The leader of the Staff-Side explained that theoffice bearers who were present in the meetingrepresent various sections of CentralGovernment employees including railways,defence civilians, postal employees etc., thenumber of which is around Rs. 32 lakhs.

5. The Staff-Side brought out their concernson all the 26 demands included in the Charterof Demands and all the points brought out by

them in the letter of the NJAC dt. 10.12.2015were reiterated. However, following issues insupport of their demands were highlighted :-

(i) Minimum Pay needs to be revised to Rs.26000 p.m. and the minimum pay of Rs. 18000p.m. as recommended by 7th CPC is notacceptable. This would require upward revisionin the fitment multiple of 2.57 and change inthe Pay Matrix. It was argued that if the 10%of the pay for NPS contribution and therecommended increase in the CGEIScontribution are taken into account, there wouldbe a drop in the take-home salary of theemployees at the minimum pay of Rs.18000.

(ii) Central Government employees need tobe excluded from the National Pension Scheme(NPS), which has been a long pending demandof the Staff Side. The Staff-Side stated that thePension Fund which has been created underNPS to generate annuity for employees, wouldnot ensure reasonable pension. Rather it is quitelikely that it may generate negative returnsbecause of the dismal performance of thefinancial market to which the fund is invested,leaving the employees without any reasonablesocial security benefit.

(iii) The 7th CPC has recommended abolitionof 52 allowances without properly appreciatingthe justification of these allowances. Theexample of break-down allowance in case ofRailway employees was given, stating that thisallowances is given so that the concernedemployees take up the necessary follow upaction in the case of breakdown on an urgentbasis and therefore its withdrawal is not justifiedin operational interests of Railways.

(iv) The withdrawal of advances, especiallyLTC, TA, Medical, National Calamity Advance,was not justified. It was argued that theseadvances are recovered from the employeesand, therefore, the same should be retained.

(v) In regard to enhancement of contributionunder Group Insurance Scheme, it was argued

Sub: Comments of the Ministries/Departments on Recommendationsof 7th Central Pay Commission-Request to Expedite-regarding.

All the Ministries/Departments, vide theD.O.No.1-4/2015-EIII.A dated 21.11.2015 fromJoint Secretary (Pers), Department ofExpenditure were requested to formulate theirviews/comments on the issues and the posts/services under them with reference to therecommendations of the 7th Central PayCommission and forward it to the Departmentof Expenditure within a period of three weeks.

2. The action involved on part of theadministrative Ministries/Departments was alsodiscussed, in detail, in the meeting with theNodal Officers on 02.02.2016 and all the NodalOfficers were requested to furnish theircomments in the ‘prescribed proforma’circulated in the meeting, along with softcopy to the ‘[email protected] within twoweeks i.e. by 17.02.2016. The responsesreceived so far are not satisfactory andcomments of the most the Ministries/Departments are still awaited.

3. The Implementation Cell which is workingas the secretariat of the Empowered Committeeof Secretaries (E-CoS) has been asked to

that increase in the contribution from theemployees was not justified and if the same isto be raised, the Government should bear theinsurance premium.

(vi) The post of LDC should be upgraded toUDC and as part of delayering, Grade Pays ofRs. 1900, Rs. 2400 and Rs. 4600 should beabolished and merged with the next higherGrades.

(vii) The rate of increment needs to be raisedfrom 3% to 5% because pay is revised in theCentral Government after 10 years. It wasmentioned that in the PSUs the pay is revisedafter 5 years and the rate of increment is alsohigher.

(viii) Two increments in the feeder post maybe granted as promotion benefit. (ix) Fixedmedical allowance for pensioners who are notcovered by CGHS and REHS needs to beincreased from Rs. 500 p.m. to Rs. 2000 p.m.

(x) The recommendation regarding grant ofonly 80% of salary for the second year of ChildCare Leave need not be accepted and theexisting provisions may be retained

(xi) It was also demanded that though theD/o Expenditure has sought the comments ofthe Ministries/Department on the issuespertaining to them after consulting the StaffAssociations, administrative Departments arenot inviting the Staff associations fordiscussions.

6. After detailed explanation by the Staff-Side on all the demands included in the Charterof Demands, JS(IC), while concluding thediscussions, assured the Staff-Side that theconcerns and demands made by them wouldbe placed before the Empowered Committeeof Secretaries for consideration after examiningthe same in the light of the recommendationsof the Commission. He also mentioned that incases where the comments of theadministrative Ministries/ Departments wouldbe necessary, e.g., the case of break-down

allowance pertaining to Ministry of Railways,the same would be considered before the issuesare placed before the E-CoS. As regards theissue raised that the administrativeDepartments are not inviting staff associationsfor discussions, JS(IC) mentioned that theDepartments have to formulate the viewskeeping in view the representations made bythe Staff Associations.

Sub: - Restoration of 1/3rd commutedportion of pension in respect ofGovernment servants who haddrawn lumpsum payment onabsorption in Central Public SectorUnder takings / Central AutonomousBodies — Stepping up of notional fullpension w.e.f. 01.01.2006 for thepurpose of Dearness relief andadditional pension for oldpensioners.

Orders for revision of 1/3 rd restored pensionof absorbees, who had drawn lumpsumpayment on absorption, were issued vide thisDepartment O.M. of even number dated15.9.2008 as amended/ modified vide OM No.4/30/2010-P&PW(D) dated 11.07.2013. As perthese memorandums, the full pension of theabsorbees was notionally revised w.e.f.01.01.2006 in accordance with the instructionscontained in this Department O.M. No.38/37/08-P&PW(A) dated 01.09.2008. The paymentof DR and additional pension to old pensionersis regulated on the basis of the notional fullpension.

2. Instructions were issued vide thisDepartment’s OM No.38/37/08-P&PW(A)dated 28.01.2013 for stepping up of the pension

furnish considered views of the Ministries/Departments on the recommendations of the7th CPC.

4. In view of the above, the comments ofthe Ministries/Departments may be furnishedto the Implementation Cell. Department ofExpenditure, immediately.

This may be treated as most urgent.

3. Instructions have now been issued videthis Department’s OM No 38/37/08- P&PW(A)dated 30.07.2015 for revision of pension/ familypension of all pre-2006 pensioners/ familypensioners in accordance with thisDepartment’s OM dated 28.01.2013 with effectfrom 01.01.2006 instead of 24.09.2012.Accordingly, the notional full pension ofabsorbee pensioners would also be revised inaccordance with the instructions contained inaforesaid OM dated 30.07.2015 w.e.f.01.01.2006 instead of 24.09.2012 and dearnessrelief and additional pension for old pensionerswould be admissible on such revised notionalfull pension.

4. This issues with the concurrence ofMinistry of Finance, Department of Expenditurevide their I.D. No. 1(5)/EV/2012 dated18.01.2016.

According to government figures, the nextinline in this pension segment is the defenceministry, which is far behind with 42,000pensioners. Facing a cash squeeze and abulging pension bill, the Railways havelaunched a first-of-its-kind exercise to physicallyverify whether all its retired employees, agedbetween 80 and 100 years, are still alive.Starting this month, hundreds of “WelfareInspectors” have been fanning out to track downeach of the 2.86 lakh former employees in thisage group, who form 20 percent of the Railways’total pensioner population of 13,75,483 and drawa combined pension of at least Rs 8,000 crore.The inspectors, all railway employees, havebeen asked to visit the houses of all pensionersin this age bracket, obtain their signatures and,if possible, that of their neighbours aswitnesses to certify that the beneficiary is alive.

“Legally, every pensioner is supposed toprovide physical proof of life to banks every yearto continue drawing pension. The system worksfine. But looking at the huge numbers andconsidering the age group in question, we justwant to rule out the possibility of any irregularitythere,” a senior Railway Board official told

Sanctioning Authority during their lifetime andafter the death of his/her parents, family pensionis claimed by a handicapped child, in this casewhether the family pension will be admissibleif he/she;

(a) Produces a medical certificate issuedafter death of his/her parents.

(b) Produces a medical certificate issued before the death of his/her parents butthe same is not as per rules.

2. It had been clarified previously, videO.M.No.1/2/09-P&PW(E), dated 30thDecember, 2009 that non-intimation ofphysical/mental handicap does not make aperson ineligible for family pension.

3. A disability certificate issued after thedeath of the employee/Pensioner or his/herspouse for a disability which existed before theirdeath may be accepted by the appointingauthority if he is a satisfied that (i) it rendershim or her unable to earn a living (ii) he/shewas suffering from that disability on the crucialdate, i.e., on the date of death of pensioners/employee or his spouse, whichever was later.

4. If a disability certificate has been obtainedfor a permanent disability previously, there isno requirement of obtaining a disabilitycertificate afresh as has already been madeclear in rule 54 (6) and this department’sO.M.No.1/18/01-P&PW(E)(Vol.II), dated 30thSeptember, 2014 and 5th November 2015.

5. It is also clarified that the criteria fordisabled siblings is same as above.

3. Banks may be advised to stress that whilethis activity is totally voluntary on the part ofpensioners, and the Life certificate can besubmitted by a pensioner in any branch of thepension disbursing bank in the month ofNovember every year through the conventionalmethods also there are possible benefits ofavailing the Digital Life Certificate (DLC)methodology to the pensioner and it is his/herchoice to make use of this facility.

4. Banks may further ensure that there isto be no discrimination against thosepensioners who do not submit their DLC digitallythrough the Jeevan Pramaan facility. In terms of Board’s letter cited underreference, Family Identity Cards (FICs) are tobe issued to retiring/retired railway employeesand the Widows of railway employees with lifetime validity.

2. The issue of simplification of FICs,presently in the form of a booklet, wasconsidered and with the approval of Board, ithas been decided that individual FICs shouldbe issued to the retiring/retired railway officialsand the Widows of railway employees in theform of computer printed and laminated cardson the model enclosed as Annexure - I. As it isstipulated in the Pass Rules that the RailwayAdministration should issue FIC, for the firsttime simplified FICs may be issued free of cost.However, issue of duplicate FICs should be onreceipt of a written request, accompanied by acopy of FIR filed on loss of the card andpayment @ ̀ 25/- per card.

3. The Railways should commence issueof individual FICs within 2 months from the dateof issue of these instructions. It has also beendecided that in order to avoid any rush, FICs inthe booklet form issued till March 2015 with 7years validity may be replaced free of cost withindividual FICs as and when they become duefor renewal. However, if any retired officialrequests for individual FICs in lieu of old FICbefore the expiry of validity, such requests maynot be denied and individual FICs should beissued free of cost treating it as renewal. Incase of officials who retired after April 2015 andgot an FIC with life time validity, they may beallowed to get it replaced with individual FICs,free of cost, as per their convenience. FICs inthe booklet form will, however, continue as avalid identity proof for travel on PRCP till itsreplacement with individual FICs in due courseso that pensioners do not face any problemwhile travelling. Individual FICs for travel onWidow Passes may also be issued on thesame model.

4. The following instructions issued vide

Board’s letter of even no. dated 04.06.2003would continue to be in force:-

(i) The identity card should be carried by thespouse/dependent children during journeyand produced on demand by the TicketChecking Staff.

(ii) The FICs, will be issued by the office fromwhere the employees retired.

(iii) In case of retired employees/Widowsdrawing Post-retirement ComplimentaryPass/Widow Pass from an office other thanthe office where the original FIC was issued,the renewal of the FIC shall be done by theauthority who is issuing the pass to theapplicant. For the purpose of renewal, theapplicant shall submit the old FIC based onwhich renewal will be done.

(iv)Any addition in the FIC shall be done onlyby the office who issued the FIC for the firsttime. Renewing authorities shall have nopower to carry out any addition in FIC.However, deletion of eligible member in FICon account of death, marriage of daughteretc. may be allowed on request.

5. Aadhaar No. if available may be incorporatedin the FICs as indicated in the format.Necessary action may be taken by theRailways accordingly.

6. This issues with the concurrence of theFinance Directorate of the Ministry ofRailways.

The undersigned is directed to refer to thisDepartment’s OM No.18/26/2011-Estt (Pay-I)dated 6th February, 2014 wherein certaininstructions have been issued to deal with theissue of recovery of wrongful / excess paymentsmade to Government servants in view of thelaw declared by Courts, particularly, in the caseof Chandi Prasad Uniyal And Ors. vs. State ofUttarakhand And ors., 2012 AIR SCW 4 742,(2012) 8 SCC 417. Para 3(iv) of the OM inter-alia provides that recovery should be made in

all cases of overpayment barring few exceptionsof extreme hardships.

2. The issue has subsequently come up forconsideration before the Hon’ble Supreme Courtin the case of State of Punjab & Ors vs RafiqMasih (White Washer) etc in CA No.1152 7of 2014 (Arising out of SLP(C) No.11684 of2012) wherein Hon’ble Court on 18.12.2014decided a bunch of cases in which monetarybenefits were given to employees in excess oftheir entitlement due to unintentional mistakescommitted by the concerned competentauthorities, in determining the emolumentspayable to them, and the employees were notguilty of furnishing any incorrect information /misrepresentation fraud, which had led theconcerned competent authorities to commit themistake of making the higher payment to theemployees. The employees were as innocentas their employers in the wrongfiil determinationof their inflated emoluments. The Hon’bleSupreme Court in its judgment dated 18thDecember, 2014 ibid has, inter-alia, observedas under : “7. Having examined a number ofjudgments rendered by this Court, we are ofthe view, that orders passed by the employerseeking recovery of monetary benefits wronglyextended to employees, can only be interferedwith, in cases where such recovery would resultin a hardship of a nature, which would faroutweigh, the equitable balance of theemployer’s right to recover. In other words,interference would be called for, only in suchcases where, it would be iniquitous to recoverthe payment made. In order to ascertain theparameters of the above consideration, and thetest to be applied, reference needs to be madeto situations when this Court exemptedemployees from such recovery, even inexercise of its jurisdiction under Article 142 ofthe Constitution of India. Repeated exercise ofsuch power, “for doing complete justice in anycause would establish that the recovery beingeffected was iniquitous, and therefore, arbitrary.

And accordingly, the interference at the handsof this Court.”

“10. In view of the afore-stated constitutionalmandate, equity and good conscience, in thematter of livelihood of the people of this country,has to be the basis of all governmental actions.An action of the State, ordering a recovery froman employee, would be in order, so long as itis not rendered iniquitous to the extent, thatthe action of recovery would be more unfair,more wrongful, more improper, and moreunwarranted, than the corresponding right ofthe employer, to recover the amount. Or in otherwords, till such time as the recovery would havea harsh and arbitrary effect on the employee, itwould be permissible in law. Orders passed ingiven situations repeatedly, even in exercise ofthe power vested in this Court under Article 142of the Constitution of India, will disclose theparameters of the realm of an action of recovery(of an excess amount paid to an employee)which would breach the obligations of the State,to citizens of this country, and render the actionarbitrary, and therefore, violative of the mandatecontained in Article 14 of the Constitution ofIndia.” 

3. The issue that was required to beadjudicated by the Hon’ble Supreme Court waswhether all the private respondents, againstwhom an order-of recovery (of the excessamount) has been made, should be exemptedin law, from the reimbursement of the same tothe employer. For the applicability of the instantorder, and the conclusions recorded by themthereinafter, the ingredients depicted in paras2& 3 of the judgment areessentially indispensable. 

4. The Hon’ble Supreme Court whileobserving that it is not possible to postulateall situations of hardship which would governemployees on the issue of recovery,where payments have mistakenly been madeby the employer, in excess of their entitlementhas summarized the following few situations,

Sub: One Rank One Pension to theDefence Forces personnel.

The undersigned is directed to refer thisMinistry’s letter No. 12(1)/2014/D (Pen/Policy)¬Part- II dated 7th November, 2015notifying One Rank One Pension (OROP)scheme for Defence Forces personnel. Salientfeatures of the scheme have been mentionedat Para 3 & 4 of above said letter with theprovision that the benefit of the scheme shallbe implemented from 1.7.2014 to all pre-1.7.2014 pensioners. Para 6 of the letterprovides that detailed instructions relating toimplementation of OROP along with tablesindicating revised pension for each rank andeach category, shall be issued separately forupdation of pension and payment of arrearsby Pension Disbursing Agencies concerned.

2. The undersigned is directed to say thatin order to quicken the process of revision ofpension/ family pension, total 101 pensiontables indicating rates of pension/familypension under OROP scheme notified vide thisMinistry’s order dated 7th Nov, 2015, areappended to this order. The appended tablesindicate revised rates of Retiring/Service/Special/ Disability/ Invalid/ Liberalizeddisability/War Injury Pension includingdisability/war injury element and ordinary/special/ liberalized family pension ofCommissioned Officers, HonoraryCommissioned Officers, jC0s/ORs and Non-Combatants (Enrolled) of Army, Navy, Air

wherein recoveries by the employers wouldbe impermissible in law:-

(i) Recovery from employees belonging to Class-III and Class-IV service (or Group ‘C’ andGroup ‘D’ service).

(ii)Recovery from retired employees, oremployees who are due to retire within oneyear, of the order of recovery.

(iii) Recovery from employees, when the excesspayment has been made for a period inexcess of five years, before the order ofrecovery is issued.

(iv) Recovery in cases where an employee haswrongfully been required to discharge dutiesof a higher post, and has been paidaccordingly, even though he should haverightfully been required to work against aninferior post.

(v) In any other case, where the Court arrives atthe conclusion, that recovery if made fromthe employee, would be iniquitous or harshor arbitrary to such an extent, as would faroutweigh the equitable balance of theemployer’s right to recover.

5. The matter has, consequently, beenexamined in consultation with the Departmentof Expenditure and the Department of LegalAffairs. The Ministries / Departments are advisedto deal with the issue of wrongful / excesspayments made to Government servants inaccordance with above decision of the Hon’bleSupreme Court in CA No.11527 of 2014 (arisingout of SLP (C) No.11684 of 2012) in State ofPunjab and others etc vs Rafiq Masih (WhiteWasher) etc. However, wherever the waiver ofrecovery in the above-mentioned situations isconsidered, the same may be allowed withthe express approval of Department ofExpenditure in terms of this Department’sOM No.18/26/2011-Estt (Pay-I) dated 6thFebruary, 2014. 

6. In so far as persons serving in the IndianAudit and Accounts Department are concerned,

these orders are issued with the concurrenceof the Comptroller and Auditor General of India.

Force, Defence Security Corps & TerritorialArmy retired/discharged/invalided out fromservice/died in service or after retirement. Theexisting pension of all pre- 1.7.2014 pensioners/family pensioners shall be enhanced withreference to applicable table for the rank (andgroup in case of JCOs/ORs) in which pensionwith reference to the actual qualifying serviceas shown in Column-I of the tables subject tomaximum term of engagement for each rankas applicable from time to time. The rate ofpension of pensioners/ family pensionersdrawing pension more than the rate of revisedpension/ family pension indicated in annexedtables, shall remain unchanged.

3. The undersigned is also directed toconvey that full pension of PSU absorbees whohad opted for 100% commutation of pension,shall also be revised under this order withreference to revised pension of the rankdetermined for regular category of pensioners.However, there shall be no change in restoredamount of pension already notified byrespective PSAs in their case.

APPLICABILITY

4. The provisions of this letter shall beapplicable to all pensioners/family pensionerswho had been retired/discharged/ invalided outfrom service/died in service or after retirementin the rank of Commissioned Officers, honorarycommissioned officers, KO s/ORs and Non-Combatants (Enrolled) of Army, Navy, AirForce, Defence Security Corps, Territorial Army& Ex-State Forces and are in receipt of pension/family pension as on 1.7.2014.

4.1 The provisions of this order, however,do not apply to UK/HKSRA/KCIO pensioners,Pakistan & Burma Army pensioners, Reservistpensioners and pensioners in receipt of Ex-gratia payments.

Methodology For Implementation :

5. All Pension Disbursing Agencies (PDAs)handling disbursement of pension to Defence

ensioners are hereby authorized to carry outrevision of Retiring/Service/ Special/Disability/Invalid/Liberalized disability/War Injury Pensionincluding disability/war injury element andordinary/special/liberalized family pension of allpre- 1.7.2014 pensioners drawing pension ason 1.7.2014 in terms of these orders withapplicable rates of dearness relief without callingfor any applications from the pensioners andwithout any further authorization from thePension Sanctioning Authorities concerned.

6. Where the revised pension as on 1.7.2014worked out in terms of these orders, happensto be less than the existing pension/ familypension as on 1.7.2014, the pension shall notbe revised to the disadvantage of the pensioner.

7. Arrears on account of revision of pensionfrom 1. 7 .2014 till date of its implementationshall be paid by the Pension DisbursingAgencies in four equal half yearly installments.However, all the family pensioners includingthose in receipt of Special/Liberalized familypension and all Gallantry award winners shallbe paid arrears in one installment.

8. The initial Pension Payment Order (PPO)or its Corrigendum PPO (Corr PPO) indicatesrank,group and qualifying service for which theindividual has been pensioned. This informationis available with Pension Disbursing Agenciesas they have revised pension of all suchpensioners in the recent past in terms ofGovernment orders issued for implementationof recommendations of Sixth CPC, CSC-2009& CSC-2012. In case, however, any informationregarding qualifying service, rank, group etc.,is not available with Pension DisbursingAgencies, such cases may be referred toPension Sanctioning Authority concerned onthe proforma enclosed as Annexure-A. ThePension Sanctioning Authorities concerned willprovide the requisite information from theavailable records within 15 days of the receiptof request from the Pension DisbursingAgencies.

9. In case of any doubt relating to revisionof pension in terms of this order, pensiondisbursing agencies may immediately take upthe matter with nodal officers of respective PSAsdetails of which shall be notified by Pr.CDA(P)Allahabad in their implementation instructions.

10. The OROP shall be basic pension from1.7.2014 and therefore, additional pension asapplicable to the old age pensioners/ familypensioners on attaining the relevant age (80years and above) shall also be enhanced bythe PDAs from 1.7.2014 or the date from whichthe pensioner attains the age of 80 years ormore, whichever is later.

Payment of Life Time Arrears (LTA) :

11. If a pensioner to whom the benefitaccrues under the provisions of this letter hasdied/dies before receiving the payment ofarrears, the Life Time Arrears of pension (LT A)shall be paid in the following manner: –

a) If the claimant is already in receipt ofFamily Pension or happens to be the person inwhose favour Family Pension already standsnotified and the awardees has not becomeineligible for any reason, the LTA under theprovisions of this letter should be paid to sucha claimant by the PDA on their own.

b) If the claimant has already received LTAin the past in respect of the deceased to whomthe benefit would have accrued, the LTA underthe provisions of this letter should also be paidto such a claimant by the PDA on their own.

c) If the claimant is a person other than theone mentioned at 11(a) & 11(b) above, paymentof LTA shall be made to the legal heir/heirs asper extant Government orders.

12. The following elements shall continueto be paid as separate elements in addition tothe pension revised under these orders-

i) Monetary allowance attached to gallantryawards viz. Param Vir Chakra, AshokChakra etc.

ii) Constant Attendance Allowance, whereadmissible.

iii) Dearness relief as sanctioned by theGovernment from time to time.

Miscellaneous Instructions :

13. No arrears on account of revision ofpension/family pension shall be admissible forthe period prior to 1.7.2014.

14. No commutation of pension shall beadmissible on revised/additional amount ofpension accruing as a result of revision ofpension under these orders. However, theexisting amount of pension, if any, that hasbeen commuted will continue to be deductedfrom the revised pension.

15. As a result of these orders, there will beno change in the amount of gratuity alreadydetermined and paid with reference to the rulesin force at the time of discharge/invalidment/death.

16. Any overpayment of pension coming tothe notice or under process of recovery shallbe adjusted in full by the Pension DisbursingAgencies against arrears becoming due onrevision of pension on the basis of these orders.

Metodology For Reporting :

17. An intimation regarding disbursementof revised pension shall be furnished by thePension Disbursing Agencies to the Office ofthe Pr. CDA(P) Allahabad in the formatprescribed as Annexure¬B to this letter in thefollowing month in which revision takes place.PDAs shall also ensure that an intimationregarding revision of pension is invariablyconveyed to the pensioners concerned for theirinformation irrespective of the fact the same isbeneficial to them or not. The Public SectorBanks who are disbursing defence pensionthrough Central Pension Processing Centres(CPPC), the progress report shall be furnishedby the CPPC of the bank directly to the officeof the PCDA (Pensions) Allahabad throughelectronic scrolls.

18. All other terms and conditions whichare not affected by this order shall remainunchanged.

NFIR was represented byShri Guman Singh, President, Dr M.Raghavaiah, General Secretary, Shri R.P.Bhatnagar, Working President and Shri K.S.Murthy, Vice President.

Dr Raghavaiah stated that the Govt Sidecomprising of Secretaries from variousministries and Chairman Railway Board heardto the detailed 26 charter of demands by NJCAleaders. The leaders also explained the peculiarworking conditions on Railways explaining thenumber of deaths in the course of working ofIndian Railwaymen. The leaders highlighted theinjustice done with regard to Minimum Pay,Multiplying Factor etc., The leaders made theintentions clear to Shri P.K. Sinha, CabinetSecretary that in the event of No SatisfactoryNegotiated Settlement all the CentralGovernment Employees will go on Strike from11th April 2016 as already decided.

After listening to the points raised by NJCAleaders, Mr Sinha suggested some more timeto explain the issues in detail to the CabinetCommittee. However, the talks wereinconclusive.

Further course of action will be discussedby NJCA on 02nd March 2016. ThePreparations of Strike should continue.

Indian Railways – PaperlessUnreserved and Platform Tickets… 

With a view to cut down queues at countersat Railway stations and to facilitate convenientbooking of tickets by passengers, IndianRailways have introduced the facility ofpaperless unreserved tickets through mobilephone over suburban sections of Central,Western, Southern, Northern (New Delhi-Palwal section), Eastern and South CentralRailways. Further, a pilot project of booking ofplatform tickets through mobile phones has alsobeen introduced on some stations of theseZonal Railways.

Leveraging new technologies to facilitatepassengers is a continuous and ongoingprocess. This information was given by theMinister of State for Railways Shri Manoj Sinhain a written reply to a question in Rajya Sabhaon 26.02.2016 (Friday).

Timely disposal of PublicGrievances – Q & A in Rajya Sabha…

As per the guidelines issued by theDepartment of Administrative Reforms andPublic Grievances, a grievance is required tobe redressed within a period of two months. Incase, it is not possible an interim reply withreasons for delay is required to be provided.However, due to federal structure of governance,each State can also create its own grievanceredress mechanism prescribing differenttimelines for redress of public grievances. Thegrievances received in the nodal Departments/offices of Central Government which pertain toState Governments are forwarded to them forappropriate action.

This was stated by the Minister of State forPersonnel, Public Grievances and Pensionsand Minister of State in Prime Minister’s officeDr. Jitendra Singh in written reply to a questionby Shri Md. Nadimul Haque in the Rajya Sabha.

Guidelines for Nomination ofRepresentatives in SCOVA

The Standing Committee of VoluntaryAgencies (SCOVA) is a forum for holdingconsultation with the stakeholders, i.e., thepensioners through their Associations andvarious Ministries/Departments of theGovernment of India, to get feedback onimplementation of pension related policies, todiscuss and critically examine the policyinitiatives and to mobilise voluntary efforts tosupplement Government action.

A mechanism has been put in place fornomination of a Standing Group comprising of5 Associations and a Rotating Groupcomprising of 10 Associations through aResolution issued from time to time. As perthe existing mechanism the Standing Groupserves for 3 terms of 2 years each or till thepleasure of the Chairman of SCOVA whicheveris earlier and Rotating Group serves for 1 termof 2 years and is eligible for re-nomination forone more term. These Associations representvarious categories of Central Governmentpensioners from various Regions/States.

The last reconstitution of SCOVA was donevide Ministry of Personnel, Public Grievancesand Pensions, Department of Pension andPensioners’ Welfare’s Resolution No. 42/08/2013-P&PW(G) dtd.25.08.2015. This wasstated by the Minister of State for Personnel,Public Grievances and Pensions and Ministerof State in Prime Minister’s office Dr. JitendraSingh in written reply to a question by ShriMahendra Singh Mahra in the Rajya Sabhatoday.

We dispose off Review Application (RA)165/2015 in OA 2165/2011 and RA 172/2015in OA 1165/2011 together as the prayer madeis the same.

2. This Tribunal had disposed of three OAsnamely OA 1165/2011, OA 2165/2011 andOA 246/2012 vide order dated 21.04.2015.These were disposed of together on theunderstanding that all the OAs dealt withthe same issue.

3. Through these RAs, the applicants havepointed out that while one part of their prayerhas been answered in our order dated21.04.2015, the order is silent on anotherpart. It is stated that in OA 1165/2011, therelief sought was basically to count thequalifying service for earning full pension as20 years for those who retired/ deemed tohave retired from Central Governmentservices on or before 31.12.2005 and werealive on that day at par with post-1.01.2006retirees. In our order, we had allowed this

prayer in para 13. 7 RA 165/2015 with RA172/2015

It is pointed out that in OA 2165/2011, theapplicants in para 8.6 of the relief clausehave prayed as follows: “8.6 The applicantspray that the U.O.I. be directed that thebenefits of due pension as per the qualifyingservice of 20 years/ 10 years for grant of fullpension with effect from 01.01.2006 be givenwithin three months of the judgment alongwith interest from the dates when thepayments were originally due.”

In our order dated 21.04.2015, while prayerfor earning full pension on 20 years of servicewas allowed, no order had been passedregarding 10 years of qualifying service inaccordance with rule 49 (2) of CCS(Pension) Rules, which relates tosuperannuation whereas 20 years’ clauserelates to voluntary retirement. Learnedcounsel for the applicants has made out acase that this is an error apparent on theface of record and we may rectify the same.

6. Shri Rajesh Katyal, learned counsel for therespondents has raised four objections,namely,

(i) since the applicants had not made a prayerin OA 1165/2011 regarding 10 year clause,they cannot raise it now in an RA as this isbeyond the scope of RA; (ii) in OA 655/2010decided on 1.11.2011, the applicants whowere pre-2006 retirees, claimed pension atpar with post-2006 retirees. This Tribunalhad rejected the prayer for grant of fullpension on 8 RA 165/2015 with RA 172/2015 completion of 20 years of service atpar with post-2006 retirees and, therefore,in view of this order, their claim cannot beconsidered; (iii) the respondents have fileda Writ in the Hon’ble High Court and,therefore, the matter being subjudice, thejudgment of the High Court should beawaited before passing any order in RAs;

and (iv) In view of Section 11, ExplanationV of the Code of Civil Procedure, 1908, incase an order or judgment is silent on oneof the prayers, then it should be presumedthat that prayer has been rejected.Therefore, since there was no directionregarding 10 year clause, it should bedeemed to have been rejected.

7. We have heard the learned counsel for theparties and gone through the pleadingsavailable on record.

8. We have examined the law as expoundedby the Hon’ble Supreme Court in thefollowing two cases: (i) Kamlesh Verma Vs.Mayawati and others, (2013) 8 SCC 320 (ii)State of West Bengal and others Vs. KamalSengupta and another, (2008) 2 SCC (L&S)735. 9 RA 165/2015 with RA 172/2015

9. While the contention of the learned counselfor the respondents is that in OA 1165/2011,the prayer regarding 10 year clause was notthere, it was indeed included in para 8.6 ofOA 2165/2011. However, we had disposedof all the three OAs under the impressionthat they deal with the same legal issuei.e. whether a distinction can be madebetween pre and post- 1.01.2006 retirees.This legal principle had been decided thatno distinction can be made but in thespecific relief clause, only reference wasmade to 20 years clause and not the 10years clasue. In our opinion, in view of thelaw expounded by the Hon’ble SupremeCourt as quoted above, this clearly is wellwithin the scope of review as the relief soughtwas primarily on the question of governmentinstructions distinguishing benefits beinggranted to pre and post-2006 retirees beingviolative of law laid down by the Hon’bleSupreme Court. This would be clear frompara 8.1 of the relief clause in OA 2165/2011, which is as follows: “8.1 Quashingthe impugned clarification/ modification

given in Govt. of India, Ministry of Personnel,Public Grievances and Pensions, Dept. ofPensioners Welfare Office memorandumF.No.38/37/08-P&PW (A) dt. 03 Oct. 2008(Annex. A-1) to para 4.2 of the Officememorandum F.No.38/37/08-P&PW (A) dt.1.09.2008 (Annex. A-4) as violative of lawlaid down by the Supreme Court anddirecting that the qualifying service forearning full pension shall be same for pre2006 and post 1.01.2006 retirees/pensioners.” Similarly, para 8.1 of the reliefclause in OA 1165/2011 also refers to samegovernment instructions being violative of thelaw laid down by the Hon’ble Supreme Court.We had, therefore, 10 RA 165/2015 with RA172/2015 examined this issue in depth inour order dated 21.04.2015 and come to theconclusion that in view of the law laid downby the Hon’ble Supreme Court in D.S.Nakara Vs. Union of India, 1983 SCC (L&S)145, V. Kasturi Vs. Managing Director, StateBank of India, Bombay and another, (1998)8 SCC 30, T.S. Thiruvengadam Vs.Secretary to Government of India, Ministryof Finance, Department of Expenditure, NewDelhi and others, (1993) 2 SCC 174 andorder of the Full Bench of this Tribunal inOA 937/2010 decided along with OA 2101/2010, no distinction can be made betweenpre and post- 2006 retirees. The prayer inthe OA was, therefore, allowed.

10. The error that has crept in is that while wehave specifically mentioned about thequalifying service for earning full pension tobe treated as 20 years also for those whoretired from the Central Government serviceon or before 31.12.2005 and were alive onthat date, the order does not specificallystate that the qualifying service for pre andpost-1.01.2006 retirees of 10 years will bethe same in case of superannuation or onabsorption in government bodies or

BELGHARIA (WB): Central GovtPensioners’ Welfare Assn. -  CGPWAcelebrated Pensioners’ Day on 19-12-2015chaired by its prez P Chatterjee. After inauguralsong by master Srinjoy Saha, prez welcomingall spoke on the importance of the day & spelled

government undertakings. To this extent,the order needs to be modified.

11. Regarding the objections raised by thelearned counsel for the respondents, we areof the opinion that: i) The main relief soughtin the OAs was parity between pre and post-1.01.2006 retirees. Benefits of 20 years/ 10years clause was the consequence flowingfrom it. Thus, since the main prayer was

(ii) 11 RA 165/2015 with RA 172/2015 allowed,the latter would come under error apparenton the face of the record; ii) Our order in OA1165/2011 was decided on the basis of ourorder in OA 937/2010 along with OA 2101/2010. In the latter order we had consideredin depth respondents arguments based onOA 655/2010 decided on 1.11.2011.Therefore, raising the same issue again isnot admissible;

(iii)The fact of a Writ Petition having been filedin the Hon’ble High Court does not preventus from disposing of these RAs as therespondents have not produced any stayorder of the High Court; and

(iv) Res judicata will not apply in this case asthis is a case of ‘error apparent on the faceof the record’.

12. Thus, we allow the RAs directing that inpara 13, after the words “would apply bothas regards pension and family pension” andbefore the last sentence, the followingsentence shall be added: “For parity ofreasons, the qualifying service for earningpension in case of superannuation andretirement on absorption in governmentbody/ government undertaking will be treatedas 10 years also for those who retire fromthe Central Government service on or before31.12.2005 and 12 RA 165/2015 with RA172/2015 were alive on that date.”

CHHINDWARA (MP): SEC RlyPensioners. -  Observed Pensioners Day on17-12-2015 at Rly Institute in memory of late DS Nakara who took the lead for better deal topensioners. At the request of Secy S S Rajput,members present, 80 in number observed twominutes silence as a mark of respect tomembers departed in 2015. Later secretaryread activity report for 2015 and pointed outdifficulties being faced due to laxity of Rlyauthorities in getting revised PPOs of nearly50 pre-2006 pensioners/family pensionersdespite regular visits undertaken by office-bearers to Divl Office, Nagpur. Later accountsfor 2015 were presented & same passed. PrezG K Chatterjee in his welcome address advisedall to submit life certificates on time. Apprisedhouse of the revision of PPO of Ganpat ex-PMR/CWA resulting in increase of pension of ¹ 3000/- p m and arrears amounting to ¹ 86,000/-. Prezalso referred to progress made in long pendingcase of release of DR due with family pensionto family pensioner Smt Dukini Bai w/o lateChadmi Manik of Nainpur Br. from 18-07-1997to 30-09-2014 and thanked secy(Rlys) BPSBimalendu Chakraborty for his help. Alsoexpressed resentment on unfavourable attitudeexhibited by 7th CPC to the genuine demandsof pensioners projected by BPS. Exhorted allto enroll new members and assured full help toresolve their grievances. Felicitated fourmembers who have completed 15 years ofretired life.

Association, Mangal dai Branch  -  2nd AGMfor 2014-15 held on 06- 12-2015, well attended,was chaired by its prez Amar Sarma. At thebeginning one minute silence was observed inmemory of its members who have left for theirheavenly abode and condolences offered withprayers for eternal peace to the departed souls.Secy N N Medhi read annual report for 2014-15 and same approved. DELHI: I T Retd Persons Welfare Assn.--- Editor Lajpat Rai thru assn's quarterly bulletin'Sun Rise " (Oct-December-2015) informs ofholding of monthly meetings of the MC on 18-11-015, 11-12-015 & 31-12-015. Assn in its pre-budget memorandum to the Hon'ble UnionFinance Minister , has pleaded for benefits topensioners such as incentives for savings,reduction in lock-in-period of saving instrumentscovered under section 80C of the I T Act,pension to be net of income tax,raise inexemption limit of Income Tax , increase inmonetary limit of 80C,exemption from TDS etc.Bulletin also contains analysis ofrecommendations of 7th CPC relating topensioners.

Prez in his addresshighlighted the importance of the day andrecalled the historical judgement delivered byHon'ble Supreme Court in the matter of D SNakara Vs UOI. Chief guest addressing thegathering assured all of cooperation byPersonal Br and desired pensioners / Sr citizensnot to come personally to Raipur for redressalof their grievances and instead communicatethru SMS. GAYA (BIHAR): All India P & T And OtherCentral Govt Pensioners’Assn. - In its bi-monthly meeting held on 07-02-2016, the houseexpressed its anguish on 7th CPC which didnot consider favourably the grievances relatedto old aged pensioners viz better medi-care,increased  FMA, LTC for pilgrimage andincrease/early release of additional pensionfrom 65 years onwards. Expressed hope thatthe E-COS appointed by GOI will give give dueconsideration. Meeting was well attended.

GANDHINAGAR  (GUJRAT): PostalPensioners Assn - AGM held on 16-10-2015elected unanimously A K A Joshi and B P Darjias prez and Secy respectively alongwith  2Wkg prezs. 6 members were felicitated onattaining the ages of 75 years alongwith MsParul Parmar an employee of the departmenton her winning Arjuna Award.

Ex-founder Secy Sant SinghKalsi in his address apprised audience ofrecommendations of 7th CPC. Ex-prez V SSikand and Retd Accounts Ooficer S S Sekhonalso spoke on 7th CPC. Prez thanked all fortheir cooperation and desired members toinvolve themselves in social activities andreferred to NGO - Bharat Jagran Manchengaged in beautification of the city by way ofplanting plants/trees and construction ofbathrooms for benefit of general public.Apprised all of purchase by the assn ofstationery items for distribution to poor childrenof school started by Gurbir Singh Retd HeadMaster in premises owned by him run by FreeEducation Mission.
