Under Victoria’s native vegetation permitted clearing regulations an offset must be secured before native vegetation can be removed. Your permit will include a condition specifying the type and amount of offset that is required. If a permit holder requires a general offset they can generate this offset on their own land. This is known as a first party offset. This kit sets out the process permit holders must follow to secure a first party general offset.

By using this kit the permit holder can: assess their property for first party general offset eligibility determine the amount of gain generated from the offset site prepare an offset management plan without the need for assistance of an ecological expert.

Permit holders will not be able to use this kit for the purpose of: securing a third party offset (i.e. an offset not on the permit holders land) securing a first party specific offset securing an offset to meet the permit holder’s offset condition, as well as selling surplus offsets to other permit holders securing an offset using an agreement with Trust for Nature. securing an offset on Crown land

Further information about offsets is found in the Native vegetation gain scoring manual and Chapter 9 of the Permitted clearing of native vegetation – Biodiversity assessment guidelines (Guidelines).

Note that a compliant offset must be secured prior to any native vegetation being removed. It is recommended permit applicants wishing to secure a first party general offset use this kit before they lodge their application to remove native vegetation to determine the eligibility of their proposed offset site and understand the management commitments required.

Can a first party offset satisfy your permit offset conditions?To assess whether your proposed offset site meets your permit requirements you will need the following: your planning permit conditions or predicted offset requirements (biodiversity assessment report) the exact location of your proposed offset site access to the NVIM system access to the first party general offset gain calculator (DELWP’s website).

Follow the steps below to determine if your proposed offset site is in accordance with the Guidelines.

Step 1 – Determine offset site characteristicsYou must determine if your proposed offset site has the required characteristics of a first party general offset. Please refer to the text below for further explanation of each characteristic.

Creating an offset siteAn offset site can be either: the protection and management of existing remnant patch vegetation, or revegetation of a site that does not contain any native vegetation.

If the vegetation on site meets the definition of a remnant patch (see text box below) you can generate an offset by protecting and managing this existing native vegetation. Assistance in determining whether your site contains native vegetation can be found in the Defining and classifying native vegetation fact sheet on DELWP’s website.

If there is no native vegetation on the site (according to above definition) then the site may be eligible to be a revegetation offset site. Note that a revegetation offset must meet the following minimum size requirements: be at least 1 hectare in size

Remnant patch native vegetation definition A remnant patch of native vegetation is either:

an area of vegetation where at least 25 per cent of the total perennial understorey plant cover is native, or

any area with three or more native canopy trees where the canopy foliage cover is at least 20 per cent of the area.

have an average width of at least 20 metres have a perimeter to area ration of 1:20. Perimeter to area ratio can be calculated by dividing the area (metres2) by the

perimeter (meters).

Woody vegetation First party general offset sites can only be located within woody vegetation types. Areas with grassland and wetland vegetation types cannot use this kit to create a first party general offset. If you wish to generate an offset in grassland or wetland vegetation you must obtain a habitat hectare site assessment report and create a specific management plan. For more information on this process contact the Native vegetation credit register ([email protected]).

All offset sites using this kit must be located within one of the following woody vegetation types: heathland shrubland scrub thicket

woodland swamp (tree canopy cover is naturally present) forest rainforest.

To obtain the vegetation type present on your site, see Appendix E-Navigating the NVIM System.

If your site does not fall into one of the woody vegetation types listed above then it is not eligible to be used as a first party general offset and you cannot use this kit.

STEP 2 – Check the offset site’s eligibilityFor an area to be eligible to be an offset site it must be able to be managed for conservation purposes into perpetuity without the threat of degrading. Check the eligibility of your proposed offset site against the criteria in Table 1. Refer to the text following the table for further explanation of each eligibility criteria.If the proposed offset site does not meet the eligibility criteria, you must find another offset site or obtain your offset from a third party. A response of ‘No’ to any of the questions below may exclude the site from first party general offset eligibility.

Current and future land use compatibilityThere must not be any current or future land use on the site that is incompatible with managing native vegetation for conservation purposes. Incompatible uses may include: activities requiring removal of logs or trimming/clearing of understorey plants or trees horse-riding, cycling or motorised vehicle use off established tracks infrastructure easements cropping earth works ongoing activities that are likely to degrade vegetation condition or restrict improvement in vegetation condition.

If any of these land uses occur, or are planned to occur at the proposed offset site, then it is not eligible to be used and you will need to find an alternative offset site.

Bushfire managementClause 52.47 of the Victoria Planning Provisions require that an offset to compensate for the removal of native vegetation should not increase the bushfire hazard for a dwelling and associated buildings on the subject land and adjoining properties. The impact of an offset and where it is located must be carefully considered to avoid creating further bushfire hazard. For the following locations in Victoria, offsets should be located outside the bushfire management zones. Outside a Bushfire management overlay: A site is not eligible to be an offset if it is within 50 metres of a dwelling. The 50

metres allows for any future modification of vegetation in order to create defendable space around a dwelling. Within a Bushfire management overlay: A site is not eligible to be an offset if it is within 150 metres of a dwelling, unless

confirmation from the Country fire authority or the local government’s Municipal fire prevention officer that the offset site will not increase bushfire risk. 150 metres allows for any future modification of vegetation within the defendable space zone, and avoids increasing the bushfire hazard within the 150 metre assessment area.

Note that you are allowed to carry out fire prevention notices on an existing offset site if one is issued by your council. However, the likelihood of a notice being issued on a proposed offset site should be discussed with council prior to establishment of the offset. If council decides that the fuel load should be reduced, the area would not be suitable for an offset.

Existing offset or agreementAn area of native vegetation can only be eligible as an offset if it has: not already been used to offset the clearance of native vegetation or species habitat required by Victorian and/or

Commonwealth regulations not been subject to a current agreement under an incentive or grant program to undertake actions which are equivalent to

the management commitments for a first party general offset not been designated as an area for native vegetation legislative enforcement purposes.

Current or future threats to the native vegetation conditionAn area of native vegetation is eligible to be an offset site if you are able to control significant threats that would otherwise reduce the condition of the site. Significant threats to the condition of native vegetation impact on a your ability to complete management commitments. The following threats and your ability to control them must be considered: high levels of continued nutrient run off secondary salinity with a high level of the effect increasing continuing significant erosion which is uncontrollable without affecting native vegetation significant invasion from pest animals such as rabbits, deer, goats and pigs extensive die-back or other plant diseases planned disturbance regimes incompatible with native vegetation objectives such as fuel reduction burning, or flooding.

If these threats are present and you are unable to effectively manage them, the site is not eligible to be secured as a first party offset.

Offset site security An area of vegetation is eligible to be a first party general offset if you can enter into a legally binding offset security agreement and commit to the following minimal security agreement standards: contains legally enforceable provisions has no termination date is implemented by DELWP or local government (Trust for nature is a statutory authority able to enter into offset security

agreements, however, not for a first party general offset in accordance with this kit) The following list of statutory agreements can be used as security for a first party general offset for use with this kit: Agreement under Section 69 of the Conservation, Forests and Lands Act 1987 (CFL Act) executed by the Secretary of

the Department of Environment, Land, Water and Planning. The agreement:o is required to be recorded on the property titleo does not require an ecological assessment o uses the attached management plans.

Agreement under Section 173 of the Planning and Environment Act 1987 executed by the relevant local government. The agreement:

Each statutory authority has its own security agreement which will include a set of standard management obligations that the landowner implements at the offset site. Standard management obligations are listed in Appendix A. You should review the management obligations along with the statutory authority’s agreement to ensure that they are acceptable and achievable.

There are costs involved with entering into a security agreement. These include fees for administration and monitoring, and legal costs of establishing the agreement. There will be an additional cost for surveying and recording your offset site on property title. You should consider all costs prior to entering into an agreement.

If you are unable to commit to the required security agreement, then the site will not be eligible to be used as an offset.

Minimum management commitments An area of native vegetation is eligible to be an offset if you agree to the minimum ongoing management commitments included in a ten year management plan. A management plan must be included in the site’s security agreement as Schedule 3.

The following minimum management commitments are required on all first party general offset sites and form the basis of your site’s offset management plan. retain all standing trees (dead and alive) exclude stock and other threats ensure weed cover does not increase beyond the current level (CaLP Act and non CaLP Act weeds combined) monitor for any new and emerging weeds and eliminate to less than one per cent cover retain fallen logs and timber retain organic litter control rabbits revegetation (only if a revegetation offset).

The offset management plan can be developed without the assistance of an ecological consultant. Once a suitable offset site has been identified, you must choose management actions that will achieve the minimum management commitments. A list of

Trust for Nature (TFN) - CovenantsAlthough an offset is able to be secured with a covenant under Section 3A of the Victorian Conservation Trust Act 1972 (TFN Covenant), it is not available for offsets secured in accordance with the first party general offset kit. TFN’s processes and procedures to secure offset sites do not align with this kit. Landowners wishing to secure an offset through TFN must contact them directly at [email protected].

possible actions is given in the standard management plan templates, but if further guidance is required seek assistance from experts in conservation management. Appendix B and Appendix C include ten year management plan templates for remnant patch and revegetation offset sites.

You are required to maintain the condition of the offset site to the level achieved at the conclusion of the ten year management plan in perpetuity. This may require ongoing management actions. If you are unable to implement the required minimum management commitments, then the site is not eligible to be used as an offset.

Additional management commitmentsLandowners may want to implement management actions beyond the minimum commitments required. These are called additional or optional commitments and enable the landowner to generate more gain on the site. Landowners wanting to generate gain from additional commitments are unable to use this kit.

STEP 3 – Calculate offset size and check offset requirements.

Use the table below to confirm if your proposed offset site can meet the offset requirements set out, or expected in the permit conditions. Refer to the text following the table for further explanation. If the proposed offset site does not meet the offset requirements, you must find another offset site or obtain your offset credits via a third party. Refer to Meeting permit conditions – Third party offsets fact sheet on DELWP’s website.

A first party general offset site can either be a patch of remnant vegetation, or a patch of revegetation. The size of the area required to satisfy the offset condition will generally differ between a remnant patch and revegetation offset site.

Remnant patch offsetAs a general rule, if the vegetation condition score and the strategic biodiversity score (SBS) of the clearing and offset site are similar, the size of the offset site should be approximately five times the area (hectares) of the clearing extent.

Revegetation offset sites do not have a condition score and generally have a very low SBS. As a result, native vegetation removed from an area with a high condition score and a high SBS will require a large area for a revegetation offset.

Offset sizeThe exact size of the offset site required can be determined using the following tools available on DELWP’s website. NVIM system - http://nvim.delwp.vic.gov.au/Use the NVIM map to mark the proposed offset site (~5 times the clearing area) and calculate the weighted average condition score and strategic biodiversity score of the proposed offset site.

Refer to Appendix E and follow the prompts to navigate the NVIM map and obtain the scores.

The calculator will determine the available BEUs based on the size, condition and SBS scores from the offset site you nominated on the NVIM map. Complete steps 1 and 2 on the calculator.

Note:An offset with more than one proposed isolated sites can be used as a first party offset site in accordance with this FPO Kit. Each of the isolated sites must meet the minimum strategic biodiversity score and all the sites must add up to meet the offset amount. All sites are included on the same agreement if they are all on the same property.

The BEUs available on the offset site must be sufficient to satisfy the BEUs required on the planning permit. If necessary and the on ground conditions allow, the size of the offset site can be slightly decreased or increased to achieve the required BEUs. A significant size change or relocation of the offset site will require the condition and SBS scores to be re-determined. If there is insufficient native vegetation on site to increase the offset, another offset site must be chosen.

The size of the area determined by the calculator is the exact size of the area to be mapped as the offset site on the property site plan. This offset area will be recorded on the property title.

STEP 4 – Estimate management costs

There are a range of costs involved in delivering a first party general offset, such as the costs associated with the security agreement and ongoing management as well as potential lost income from forgoing the use and development of the land. It is important that you accurately estimate these cost implications prior to committing to delivering a first party offset. Before you calculate gain and draft the offset management plan, contact the statutory authority you plan to secure the offset with to determine their current administrative costs. A breakdown of these costs may include:

Why is the offset site larger than the clearing site?An offset site has to compensate for the permanent clearing of native vegetation elsewhere. This happens through protecting and managing native vegetation so that an improvement occurs in the native vegetation that is over and above what would occur if it was not an offset site. This is known as a ‘gain’ in native vegetation. The gain at the offset site is a measure only of the incremental improvement in the native vegetation above its current condition. To achieve enough gain to fully offset the permanent loss of native vegetation cleared elsewhere an offset site must be larger than the cleared site.

legal and administrative costs involved in establishing the security agreement (legal assistance, surveying, registration) initial set up cost associated with managing the offset site which may include erecting fences, intense weed or pest

control and planting native vegetation yearly ongoing management cost at the offset site, which may include repairing damaged fences, regular weed and pest

control, and replanting dead plants meeting monitoring and reporting requirements any lost income from foregoing the use of the land for other purposes by designating the land for conservation.

Once you have an estimate of the total cost of establishing the offset site and implementing the management plan, you may wish to compare this with the cost of purchasing your offset via a third party.

If the cost of establishing and managing the offset site is prohibitive, you will be unable to use the proposed site as a first party general offset.

STEP 5 – Complete the management plan and enter into the security agreement

Ten year management plan templates have been created for first party general offsets, which enable you to develop a schedule of management actions to meet management commitments. A separate management plan is required for: the protection and management of a remnant patch offset, and the protection and management of a revegetation offset.

The templates for the management plans located in Appendix B and Appendix C are found on DELWP’s website and must be completed in full and included with the security agreement as Schedule 2. The offset management plans must contain the following information:

If you require assistance with developing the management plan or assessing the current condition of a proposed site, consult the statutory authority you will be entering into the security agreement with.

Offset security agreement is legally bindingIt is important to note that the security agreement, including the management actions you enter into is legally binding. Failure to undertake the required management actions is a breach of the security agreement.

The landowner’s security agreement obligation clauses are included in Appendix A and must be included in the agreement you enter into. The security agreement must also include the following: Schedule 1 – Offset site map and property details Schedule 2 – Gain calculator print out Schedule 3 – Management plan.

Once complete, sign and date the agreement and submit it to the relevant statutory authority for approval. A copy will be returned to you for your records. The 10 year management plan commences from the date the statutory authority signs the agreement.

Enquiries for offset security agreements through DELWP should be directed to the native vegetation credit register at [email protected].

Enquires for offset security agreements through local government should be directed to the relevant planning or environment area of your local council.

You are required to submit a yearly offset condition report to the statutory authority you entered into the agreement with, outlining the actions undertaken for the previous year and the site’s year end condition compared to the pre management plan condition of the site. The yearly condition report template is available on DELWP’s website as an editable document.

Appendix A – Security agreement management clauses

The following management and reporting clauses will be inserted into the security agreement as obligations the landowner must adhere to. Please ensure the following clauses are acceptable.

Management of the SiteIn relation to the Site, the Landowner agrees:6.1 To complete the Management Actions specified in the Management Plan to the satisfaction of the Statutory Authority,

for the purposes of achieving the management commitments and where the Landowner has completed the Management Actions specified in the Management Plan to the satisfaction of the Statutory Authority, but a management commitment is not achieved for reasons out of the control of the Landowner.

6.2 To allow the Statutory Authority and its officers, employees, agents, contractors, invitees and licensees access to, and entry onto the Site on reasonable notice being given to the Landowner.

6.3 To be responsible for ensuring that the works required to implement the Management Plan comply with the lawful requirements of any Authority, and with all Acts, regulations and other laws which may be applicable to the Management Plan.

6.4 That at all times from the date of Commencement, except in accordance with the Management Plan, it must not:6.4.1 permit any Native Vegetation (dead or alive) on the Site to be removed, destroyed or lopped; 6.4.2 permit any Native Vegetation (including branches or leaf litter) to be removed from the Site or otherwise

interfered with;6.4.3 apply for a permit under the Planning and Environment Act 1987 (PE Act) to remove destroy or lop Native

Vegetation from the Site;6.4.4 permit livestock to enter any part of the Site;6.4.5 allow any non-indigenous fauna (including any cat, dog or other domestic animals) to be introduced to the Site,

save for up to two dogs which are to be kept under control at all times; or6.4.6 allow indigenous flora or the habitat or potential habitat of any indigenous fauna to be adversely affected.

6.5 That at all times from the date of Commencement, except with the prior written consent of the Statutory Authority, it must:6.5.1 where internal or external threats to the site are identified, whether stock or human, maintain or construct fences

and gates between such area and the site in good working order and condition at all times;6.5.2 prevent the spread of and, as far as possible, eliminate established pest animals in accordance with section 20

of the Catchment and Land Protection Act 1994 (CaLP Act);6.5.3 eradicate Regionally Prohibited Weeds and prevent the growth and spread of Regionally Controlled Weeds as

required by section 20 of the CaLP Act;6.5.4 prevent the growth and spread of all weeds beyond their coverage at time of execution of this agreement6.5.5 prevent the application of fertilizer to any part of the site.

6.6 Except with the prior written consent of the Statutory Authority, the Landowner must not erect, place nor permit any structure or dwelling to be placed on the Site.

6.7 In relation to the Site the Landowner agrees that except with the prior written consent of the Statutory Authority, at all

Reporting6.8 That the Landowner agrees that it must submit a Report to the Statutory Authority within one year after the execution of

this Agreement, and every year thereafter for a period of ten years after the execution of this Agreement, and thereafter at the reasonable request of the Statutory Authority.

6.9 That the Landowner must provide the Statutory Authority with 7 days written notice before removing, destroying, lopping or otherwise damaging any native vegetation in the circumstances referred to in other clauses within this agreement.

Reports are to be submitted prior to the anniversary date of the execution of the agreement..

The yearly site condition report must address progress against each management commitment set out in this agreement.

Landowners must submit photographs which clearly depict management actions undertaken for the previous year.

RevegetationLandowners must record which pre 1750 ecological vegetation class (EVC) is present on site.

Use the relevant EVC benchmark, and the revegetation and supplementary planting standard in Appendix D of the first party general offset kit for planting survival targets.

The plant species selection will be subject to site characteristics, ease of propagation and likely availability from local suppliers. Offset sites vary considerably, so assistance should be sought from your local catchment management authority or regional native plant nurseries as to the appropriateness, method and availability of plant species.

Record your selected species, their density and total numbers planted into Table 3. The understorey needs to be a combination of six species to meet the minimum revegetation standard. EVC benchmarks can be referenced on DELWP’s website.

Appendix D – Revegetation and supplementary planting standard

The standard outlines the minimum requirements for revegetation or supplementary planting to qualify to generate site gain. This includes the appropriate 10 year survival target and the minimum diversity relevant to the vegetation type.

The recommended range of species should be chosen with reference to the appropriate EVC benchmark for the site. In order to develop an appropriate revegetation species list for the site, consideration should also be given to the relevant floristic community, local environmental and site conditions, ease of propagation and likely availability from nurseries.

The planting standard does not require the planting of herbs, prostate shrubs or medium or small grasses.The survival targets are the number of plants required to be surviving at the end of 10 years. To ensure they meet the survival target, landowners may need to establish a greater number of plants than the target survival number. Lower than expected germination rates or attrition of planted species within a habitat component category will require landowners to replant the necessary number within that habitat component to ensure that target survival numbers are met.

Standard for survival targets10 year survival targets are based on the appropriate EVC benchmark.Assessors should select the EVC that formerly occupied the site. This should be by reference to the pre-1750 EVC mapping layer unless on ground evidence suggests otherwise.

The target number of overstorey (trees) plants/ha are as follows: 50 plants/ha for woodlands 100 plants/ha for dry forests 150 plants/ha for riverine/lowland/foothill forests 200 plants/ha for damp/wet forests.

The required target number of understorey plants/ha for each habitat component are calculated according to Table 1 below. The benchmark per cent cover for each understorey habitat component is used.
