The agreement resolves violations by CIAP of Philadelphia Code Section 20-1006(4) resulting from the late filing of campaign finance reports.

A copy of the approved settlement agreement is attached.

The Philadelphia Board of Ethics is a five-member independent board established by ordinance, approved by Philadelphia voters in May 2006, and installed on November 27, 2006. It is charged

with providing ethics training for all City employees and enforcing City campaign finance, financial disclosure and conflict of interest laws. The Ethics Board has authority to render

advice, investigate complaints and issue fines. ###

A. The Board of Ethics of the City of Philadelphia is a five-member, independent board established by ordinance, approved by Philadelphia voters in May 2006, and installed on November 27, 2006. Pursuant to section 4-1100 of the Home Rule Charter, the Board is charged with, among other things, enforcing the City’s campaign finance law.

SETTLEMENT AGREEMENT

This Settlement Agreement (“Agreement”) is made and entered into by the Board of Ethics of the City of Philadelphia, the Executive Director of the Board, the Concerned Irish Americans of Philadelphia PAC, and Robert Gormley, jointly referred to as “the Parties.”

RECITALS

B. The Concerned Irish Americans of Philadelphia PAC is a political committee registered with the Pennsylvania Secretary of State and based in Philadelphia.

C. Robert Gormley is the treasurer of the Concerned Irish Americans of Philadelphia PAC.

D. Pursuant to Philadelphia Code § 20-1006(1)(a) and Regulation No. 1 Paragraph 1.44(a):

Any time a political committee or person is required to file a campaign finance report with the City Commissioners or the Secretary of State, as required by the Pennsylvania Election Code, the committee or person shall file electronically a copy of that report with the Board if the report filed with the City Commissioners or Secretary of State discloses, or should disclose, any expenditures made to influence the outcome of a covered election, including expenditures to a candidate for City elective office.

E. Pursuant to Code § 20-1301(2), the penalty for failure to file a campaign finance report in electronic format as required is civil penalty of $250. Each day the report remains unfiled is a separate offense for which an additional civil penalty of $250 may be imposed, provided that the penalty that may be imposed for failure to file a particular report shall not exceed $2,000 for the first thirty days the report remains unfiled, plus $1,000 for each additional thirty day period (or part thereof) the report remains unfiled.

F. Under the Pennsylvania Election Code, May 10, 2013 was the deadline for political committees to file second Friday pre-primary (cycle 2) campaign finance reports. June 20, 2013 was the deadline for political committees to file 30 day post-primary (cycle 3) reports.

G. In order to ensure that the public has access to information about large independent expenditures made before the primary, but after the close of the pre-primary reporting period, § 1628 of the Pennsylvania Election Code (25 P.S. § 3248) requires that political committees disclose within 24 hours any independent expenditures they make of $500 or more.

H. Therefore, in 2013, if a political committee made independent expenditures of $500 or more on any day from May 7th through May 21st, the committee should have electronically filed an independent expenditure report with the Ethics Board within 24 hours disclosing those expenditures.

I. In June of 2013 while reviewing campaign finance reports, Board enforcement staff discovered that the IBEW Local 98 Committee On Political Education had made the following contributions to the Concerned Irish Americans of Philadelphia PAC in 2013: $20,000 on February 8; $25,000 on April 18; and $28,250 on May 15. Local 98 COPE described the May 15 contribution as being for “5/13 non-fed GOTV poll worker stipends & food.”

J. The contributions disclosed by Local 98 COPE suggested that the Concerned Irish Americans of Philadelphia PAC had made expenditures to influence the 2013 Philadelphia primary election. However, the PAC had not filed campaign finance reports with the City Commissioners, the Department of State, or the Board. Accordingly, Board enforcement staff opened an investigation to determine whether the PAC had violated the City’s campaign finance law by failing to file required campaign finance reports.

K. On July 16, 2013, in furtherance of that investigation, Board enforcement staff served an administrative subpoena on Robert Gormley, the treasurer of Concerned Irish Americans of Philadelphia PAC. The subpoena directed Mr. Gormley to appear at the offices of the Board to produce documents and provide a statement under oath.

L. Shortly after serving the subpoena, Board enforcement staff spoke with an attorney for the PAC and explained to him the concern that the PAC had failed to file required campaign finance reports with the Board.

M. On July 31, 2013, the PAC electronically filed a cycle 2 and a cycle 3 campaign finance report with the Board. The reports disclosed that in 2013, the PAC had spent over $70,000 to influence the May 2013 Philadelphia primary election. Copies of the two reports are attached to the Agreement as Exhibit A.

N. The PAC’s post-primary (cycle 3) report discloses that the PAC purchased more than $6,000 worth of “GOTV” literature. The report further discloses that on each of May 16th, 19th, 20th, and 21st, the PAC made independent expenditures in excess of $500 to distribute that literature or otherwise influence the May 21st municipal primary election.

O. The PAC should have, but did not, file independent expenditure 24 hour reports disclosing all of the independent expenditures it made in excess of $500 to influence the May 21st municipal primary election.

P. The PAC immediately agreed to file its outstanding independent expenditure 24 hour reports upon being informed by Board enforcement staff of its failure to do so. Copies of those reports are attached as Exhibit B.

Q. At all times, Mr. Gormley has fully cooperated with the Board’s investigation. In response to the July 16 subpoena, he produced numerous documents and provided extensive testimony under oath.

R. The Parties desire to enter into this Agreement in order to resolve the issues described herein.

AGREEMENT

The Parties agree that:

1. The Concerned Irish Americans of Philadelphia PAC’s late filing of its 2013 cycle 2 campaign finance report violated § 20-1006(1)(a) of the Philadelphia Code. Pursuant, to Code § 20-1301(2), the monetary penalty for this late filing is $4,000. However, the penalty is reduced to $1,000 to reflect Mr. Gormley’s cooperation and remedial action.

2. The Concerned Irish Americans of Philadelphia PAC’s late filing of its 2013 cycle 3 campaign finance report violated § 20-1006(1)(a) of the Philadelphia Code. Pursuant, to Code § 20-1301(2), the monetary penalty for this late filing is $3,000. However, the penalty is reduced to $1,000 to reflect Mr. Gormley’s cooperation and remedial action.

3. The Concerned Irish Americans of Philadelphia PAC’s late filing of independent expenditure 24 hour reports violated § 20-1006(1)(a) of the Philadelphia Code. However, the penalty for this late filing is waived to reflect Mr. Gormley’s cooperation and remedial action.

4. The Concerned Irish Americans of Philadelphia PAC and Mr. Gormley are jointly and severally liable for the aggregate civil monetary penalty of $2,000 which they shall pay within 14 days of the execution of the Agreement.

5. Payment shall be by check made out to the City of Philadelphia and delivered to the offices of the Board.

6. The Concerned Irish Americans of Philadelphia PAC and Mr. Gormley release and hold harmless the Board and its staff from any potential claims, liabilities, and causes of action arising from the Board’s investigation, enforcement, and settlement of the matters described in the Agreement.

7. In consideration of the above and in exchange for the Concerned Irish Americans of Philadelphia PAC’s and Mr. Gormley’s compliance with all of the terms of the Agreement, the Board waives any further penalties or fines against them for the violations described in the Agreement.

8. The Parties will not make any public statements that are inconsistent with the terms of the Agreement.

9. If the Ethics Board is forced to seek judicial enforcement of the Agreement, and prevails, the Concerned Irish Americans of Philadelphia PAC and Mr. Gormley shall be liable for attorneys’ fees and costs reasonably expended in enforcing compliance with the Agreement. Fees for time spent by Board staff attorneys shall be calculated based upon standard and customary billing rates in Philadelphia for attorneys with similar experience.

10. The Agreement contains the entire agreement between the Parties.
