PHYSICAL THERAPY EXAMINERS BOARD MEETING MINUTES JULY 12, 2012 Item 1- Call to order / roll call to determine the presence of a quorum. Board members in attendance: Kathleen Sidener, PT, Chairman; Lisa Mukavitz, PT, Vice Chairman; Tina Baum, PT; Andrea Menicucci, Public Member; Emilio Puentedura, PT, DPT, Phd, was late due to traffic and missed only Item 10. Non-members in attendance: Richard Dreitzer, legal counsel; Allison Tresca, executive director; Shell Mercer, legal counsel for Board for hearing; court reporter. Item 2 - Pledge of Allegiance. Item 3 – Public comment period. Chairman Sidener called for public comment. There was no public comment. Item 4- Applicant Andrew Reed requests to be licensed. This appearance is necessary due to the applicant’s arrest record. Motion to enter closed session: Mukavitz. Second to motion: Baum. Passes unanimously. After returning to open session: Motion to grant license to the applicant: Puentedura. Second to motion: Baum. Passes unanimously. Item 5 - Licensee Mindy Renfro requests the Board to reconsider the terms of her probationary license. Motion to enter closed: Puentedura. Second to motion: Baum: Passes unanimously. After returning to open session: Motion to change the order to allow Ms. Renfro to have any physical therapist licensed in Nevada co-sign her notes; the physical therapist must have an active license, not on probation, and has never been disciplined: Puentedura. PHYSICAL THERAPY EXAMINERS

BOARD MEETING MINUTES JULY 12, 2012 Item 1- Call to order / roll call to determine the presence of a quorum. Board members

in attendance: Kathleen Sidener, PT, Chairman; Lisa Mukavitz, PT, Vice Chairman; Tina Baum, PT; Andrea Menicucci, Public Member; Emilio Puentedura, PT, DPT, Phd, was late due to traffic and missed only Item 10. Item 2 - Pledge of Allegiance. Item 3 – Public comment period. Chairman Sidener called for public comment. There

was no public comment. Item 4- Applicant Andrew Reed requests to be licensed. This appearance is necessary

Motion to enter closed session: Mukavitz. Second to motion: Baum. Passes unanimously.

After returning to open session: Motion to grant license to the applicant: Puentedura.

Item 7- Applicant Ercel Binalla Basilio requests to be licensed. This appearance is

necessary to review the applicant’s work history. Motion to enter closed session: Mukavitz.

Second to motion: Baum. Passes unanimously.

After returning to open session: Motion to grant licensure: Mukavitz.

Second to motion: Baum. Passes unanimously.

Item 8- Applicant Tina Marie Thornton requests to be licensed under the provisions of

NRS 640.140. Motion to enter closed session: Mukavitz.

Second to motion: Puentedura. Passes unanimously.

After returning to open session: Motion deny request to be licensed under 640.140: Puentedura.

Second to motion: Mukavitz. Passes unanimously.

Item 9- Applicant Valeska Naire Villagran Sosa requests to the take the National

Physical Therapy Examination for physical therapist’s assistant’s a fourth time in accordance with NRS 640.100(4).

Motion to enter into closed session: Mukavitz.

Second to motion: Baum. Passes unanimously.

After returning to open session: Motion allow the applicant to take the test again on October 30, 2012, must

register and pay by the FSBPT deadline of September 23, 2012. The applicant must pass a practice test and submit that score to the Board before the applicant is permitted to sit for the October 30, 2012 test: Mukavitz.

Second to motion: Menicucci. Passes unanimously.

It was suggested that the applicant study with classmates that have passed the test already and therefore could offer more guidance and may have more insight.

Item 10- Applicant Anthony R. Soto requests to the take the National Physical Therapy

Examination for physical therapist’s assistant’s a fourth time in accordance with NRS 640.100(4).

Motion to enter closed session: Mukavitz. Second to motion: Baum. Passes unanimously. After returning to open session: Motion to allow the applicant to take the test again on October 30, 2012, must

Item 11- Applicant Julie L. Ornelas requests to be licensed. This request is necessary to

address the disciplinary action taken by the Colorado Physical Therapy Board. Motion to enter closed session: Baum. Second to motion: Puentedura. Passes unanimously. After returning to open session: Motion to grant license: Puenteurda.

Second to motion: Baum. Passes unanimously.

Item 12- Complaint Hearings or Review and Approval of Consent Decrees. Case #2011-03 – Jeffery Deets. Richard Dreitzer referred the Board to the

consent decree in their packet. He advised that the licensee had accepted the terms of the consent decree. The Board reviewed the consent decree.

Board member Mukavitz recused herself as she was the Investigative Board

member on the case. Motion to accept the Consent Decree as accepted by the licensee: Sidener. Second to motion: Baum. Passes unanimously, with Board member Mukavitz recusing.

Case #2011-08 - Brian K. Werner. This was a hearing in which the case was transcribed by a court reporter. Please contact the Board for more information in this item.

Motion to suspend the license for one year; remedial coursework in ethics, professionalism and boundaries; fine of $5,000 plus all costs: Baum. Second to motion: Menicucci. Passes unanimously, with Board member Puentedura recusing.

Case #2010-24 – Gary C. Amick. Richard Dreitzer stated that the case had

been negotiated and tentatively settled, but not yet completed. He stated that the terms are agreed upon but he did not receive the changes from opposing counsel until the previous evening. He stated that he hoped to have a special meeting once the matter was settled, so that the consent decree could be placed before the Board for decision. Chairman Sidener tabled the case, with Investigating Board member Puentedura, in agreement.

Item 13- Review and approval of minutes for Board meeting of May 8, 2012.

Motion to approve: Mukavitz. Second to motion: Menicucci. Passes unanimously.

Item 14- Review and approval of executive session minutes for Board meeting of May 8,

2012.

Motion to approve with grammatical changes: Puentedura. Second to motion: Baum. Passes unanimously.

Item 15- Review and approval of Treasurer’s Report for period ending April 2012.

Motion to approve: Puentedura. Second to motion: Sidener. Passes unanimously.

Item 16- Review and approval of Profit and Loss Report for period ending April 2012. Motion to approve: Mukavitz.

Second to motion: Baum. Passes unanimously.

Item 22- Review and approval of Executive Director’s Report as of June 29, 2012.

Motion to approve: Mukavitz. Second to motion: Sidener. Passes unanimously.

Item 23- Review and consideration of new policy to allow licensees to use the term

“doctor” if they have earned a doctorate degree in physical therapy. Motion to accept the new policy as written: Puentedura.

Second to motion: Mukavitz. Passes unanimously.

Item 24- Licensee Deborah Dieter, PT, asks if a physical therapist licensed in another

state, not licensed in Nevada, can make an assessment and determination of eligibility for a citizen of Nevada to certify disabled ridership for the paratransit service.

Board member Baum noted that telemedicine was discussed at the FSBPT meeting and there was no consensus on that issue yet. It was discussed that

this was an on-line survey-assessment, and there was nothing hands on done as part of the survey-assessment.

Motion by Puentedura: Yes a person can perform such an assessment as long

as it is solely done by an on-line process and there is no hands-on component. Second to motion: Mukavitz. Passes unanimously. Item 25- Update from Paula Berkley regarding the activities of the Sunset Commission,

which is reviewing all licensing Boards, and consideration of her proposal to represent the Board during the upcoming legislative session.

Motion to retain Ms. Berkley per her submitted contract: Sidener.

Second to motion: Mukavitz. Passes unanimously, with Menicucci no longer present.

Item 26- Discussion and possible recommendation for re-appointment of Lisa Mukavitz

and Emilio Puentedura for their terms expiring on October 30, 2012.

Motion to recommend to the Governor, the reappointment of Puentedura and Mukavitz: Sidener. Second to motion: Baum. Passes unanimously, with Menicucci no longer present.

Item 27- Consideration of courses recommended by the Advisory Committee on

Continuing Education at their meetings of May 11, 2012 and May 29, 2012 for the units listed through July 31, 2013.

Chairman Sidener thanked the Committee for their hard work, noting they were doing a fabulous job.

Item 29- Activities of the Board office.

(a) Update on licensure renewals.

Item 30- Update by inspector Jackie Miklas as to the annual inspections. The director informed the Board that the inspections for 2011 had started late due to the retirement of the previous inspector. The inspections were not yet completed and the director suggested ceasing the inspections due to the fact that the routine annual inspections for 2012 are to begin in September or October. She also advised that the next meeting will include an item for the Board to determine the parameters for those inspections.

Item 31- Request from inspector Jackie Miklas to consider adopting new per diem rates.

Board member Mukavitz noted that the Board reimburses for less than the state rate, and the Board should consider raising to the minimum set by the state. The director noted that the Board’s statutes allow the Board to determine the rates, so that is feasible. Board member Mukavitz noted that the per diem is to be for travel only. The director noted that the state administrative manual does not allow for per diem to be paid unless the person is 50 miles from their home. Board member Mukavitz noted that was appropriate and stated that it must be 50 miles from home, not a total of 50 miles traveled in a day. Richard Dreitzer was directed to create a proposed policy based on the discussion. The item is tabled until the next meeting.

Item 32- Report from legal counsel regarding pending cases. (Attorney-Client Privilege.) Motion to enter closed session: Mukavitz. Second to motion: Baum. Passes with Menicucci no longer present. Item 33- Request from Board member Mukavitz to discontinue the new licensee surveys

due to the low response rate. It was discussed that the new licensee surveys conducted by the Board

members was not successful due to the low response rate. It was discussed that of those contacted, there were no negative comments about the Board staff. It was noted that some of the applicants expressed concern over some of the requirements, but that is not something the Board wants to change at this time.

Motion to discontinue: Mukavitz. Second to motion: Baum. Passes unanimously. Item 34- Update from Board member Baum regarding her attendance at the Federation

of State Boards of Physical Therapy board member training. Board member Baum stated that she appreciated going to the meeting. She noted that they offered some great training and it appears that the digital age issue will be an important factor in healthcare.

The director advised the board that the Occupational Therapy Board’s director had requested that the matter not be discussed until they could have a representative present. The item was tabled for the September meeting.
