Jersey Housing Market UpdateThe last quarter of 2011 ended with a flurry of activity in the Jersey housing market and the first quarter of this year seems to have followed suit. Two busy quarters do not mean that the recession is over for us in the Island, but what this does suggest is that there is now more confidence being shown by both first-time buyers and home movers who, having put their lives on hold for the past four years, now want to move forward.

There is usually a flurry of activity at the beginning of each year in any case and this has been more noticeable in recent months as people wake up to the fact that property prices are negotiable and that interest rates are low - the lowest in fact that they will probably ever see in their lives.

First-time buyers are now much more noticeable again and, despite the recent withdrawal of our 95% mortgage, we still have four lenders offering 90% mortgages and one who can stretch to 100% so long as the borrower can produce a guarantor who is a Jersey property owner. This group of purchasers can also take advantage of huge savings on stamp duty on property below £450,000.

For home movers with a deposit, or equity to take with them from the sale of their property, there is a range of low interest rates from which to choose including a 1.99% discount rate, a 2.39% tracker and, saving the best for the last, a five year fixed rate at 3.49%.

Are you a winner or loser in the property stakes?Price governs property sales. It is not the location. It is not the size. It is not the condition. It is the price. Location, size and condition influence price. But price still governs everything.

So here is a fun game to play with your own home. Estimate three prices. The first figure, a very high amount, beyond even your most rose-tinted view is the figure that your home would never fetch in a month of Sundays. The second figure, a very low sum, is the sort of price at which a frenzied hoard of ruthless cash buyers would bite your arm off on the first day of marketing - and each then be prepared to gazump wildly if they were unsuccessful. This is a price that would be met in a firestorm and with everything that could go wrong, going wrong. The third figure is between the other two. This is the amount your property might fetch if pursued by a couple of ready, willing and able buyers after several weeks of marketing on the internet and in the press. These buyers wouldn’t have been alone in viewing but the others will have decided against proceeding further for whatever reason.

You can play this game with any property and all three figures determine the speed at which the property will – or will not - sell. Clearly human nature demands a preference for a seller to try and achieve the first figure and a strong reluctance to descend to the second. But the clever player will steer the third, middle course. In a property sale one can determine the price one gets and one can determine the time it takes to sell. But it is tricky to determine both together – especially in this market. To achieve a perfectly timed and priced sale the seller has to move the price more towards the realistic than the optimistic, and in some cases, sadly, even nudge the pessimistic. Or they must be lucky. The question every seller has to ask is, am I lucky? Or, do I have time to be lucky?

The good news is that even in a depressed market such as we have now there is a level of movement stimulated by those who must sell and/or buy, usually through reasons of birth, death, health, marriage, divorce, job change, retirement or money concerns. The even better news is that moving home is a game usually played over two legs. There is the home leg, selling, and the away leg, buying. Usually, what one loses on the swings one gains on the roundabouts. So in the end all things pretty much level themselves out.

Remember that first figure, the highly optimistic one? That territory is reserved for a bull market with buyers scrambling to purchase what little there is available, where lenders are throwing money at borrowers, where there is much less unemployment than we have now and far more confidence, where there are no austerity cuts, where the property market is on a charge upwards and panic buying is rife. Can there be any reasonable person in this country who feels we have these conditions right now?

In the current economic climate, it is difficult to know whether it’s a good time to move or whether you should hang on to your existing home a bit longer. If you have chosen to wait and see, there are still plenty of things you can do to, for example, make a bit more space for your family, reduce your home’s reliance on non-renewable energy sources or add some value before you sell.

Since mid-2011, Planning has relaxed its control over some types of work you might want to undertake at home such that planning and/or building permission may not be required.

but beware….. there are a number of legal and other issues you should consider before planning and undertaking any such works. Exceptions and conditions may apply You should always check your proposed plans with Planning before incurring any costs.

your legal title Are there any restrictions on your legal title to your home prohibiting the works you would like to undertake? You should consider taking legal advice.

your boundaries Where are your boundaries? Do you have the right to build up to them? Often you do not. Your neighbour may have a right of access onto a specific part of your property in order to maintain their property which you are not allowed to infringe. You should consider taking legal advice.

Neighbours Will you need access to next door to maintain and repair your new extension, conservatory or gutters established on them? If you will and you don’t already have a right of access, you need to agree a legal right of access with your neighbour. You may think you can agree this informally with your current neighbour but what about the future? Future owners of the neighbouring property may not be so understanding, and a potential purchaser of your property may be put off if there is no established formal right of access for maintenance.

your lender If you have a mortgage, you should check your mortgage documents carefully in case you need the consent of your lender for the proposed works.

Listed buildings Do you live in a Listed Building, a Potential Listed Building, an area of archaeological interest or a Conservation

Area? If so, you will be subject to much tighter rules.

Windows Do you want to put in new windows? You may be required to set them back a certain distance from your boundary. You should consider taking legal advice.

building bye-Laws Even if certain works do not require planning permission, they may still require building bye-laws approval. You should check with Planning and Environment.

In summary, whether you are intending to keep or sell your home, there are ways in which you can add value to it, reduce your household costs or make more space for your family without needing any statutory consents but undertaking works without a consent where it is in fact required will put off potential purchasers of your home AND beware of your legal position. Take professional advice along the way. Don’t make a costly mistake!
