DRAFT PLANNING COMMISSION MEETING

HELD AT THE GOVERNMENT CENTER – 315 BRIDGE ST. TUESDAY, 7:00 P.M. – MARCH 22, 2016

The Meeting was called to order AT 7:00 P.M by CHAIR, WALLY HIBBARD. ROLL CALL: PRESENT: WALLY HIBBARD; PLANNING MEMBERS: COUNCIL REPRESENTATIVE, DOUG BRONKEMA; ROYCE RAGLAND; BECKY LANCASTER; LAUREN DAKE. EXCUSED ABSENCE: RICHARD SMITH; JIM OKONOSKI Also Present: Planning & Zoning Administrator, Steve Ravezzani; Village Manager, Marcia Price, Secretary, Elaine Glowicki MOTION by BRONKEMA second by LANCASTER to approve the Planning Commission Minutes dated February 23, 2016 as presented. All members present voting yes. MOTION CARRIED. CONFLICT OF INTEREST: NONE CITIZEN COMMENTS

• Pastor Gary Gladfelter stated he wanted to share his thoughts with the public regarding the proposed Northern Homes Community Development Corporation who has presented a request to the Planning Commission to build 56 affordable workplace dwelling units of two story townhouse style apartments on his property behind the Elk Rapids Bible Church.

• Pastor Gary Gladfelter showed picture slides of a similar thirteen year old Housing Development built in Petoskey that is well maintained. In talking to the Manager of the Petoskey facility, he was told there have been no problems and the housing has been a safe environment. Gladfelter said he would not be opposed to living behind this type of housing development on his property.

• There were no comments from the planning members.

• Terry Pubanz, Rivershore Resident, addressed the Planning Commission members stating she was representing the Rivershore residents who could not attend tonight’s meeting but had shown a strong turn-out at the Village Council Meeting and February Planning Commission voicing their concerns and submitting written letters against the PUD. Terry said the Housing Development in Petoskey was a larger community built under harmonious conditions. However, remarked the proposed PUD site in Elk Rapids is not harmonious and is located in a different type of neighborhood. Terry said her comments this evening were warranted because she wanted to show the Rivershore resident’s concerns have not changed, they still have their concerns. There were no other public comments.

Zoning administrator, Steve Ravezzani stated that at the request of the developer, further discussion on the PUD request has been postponed until May and he has not received any other details. Developer, Jane McKenzie stated that she has received additional drawings from the engineers but at this time has not had a chance to go over them. Ravezzani said he will ask if it is possible to plan a work session with all parties involved prior to the May regular meeting. OLD BUSINESS: NONE NEW BUSINESS: Preliminary Presentation – Request by Peter Hesse for the re-zoning of his property located at 875 Green St. (old Alden Lumber Supply), from I-1, Industrial to RM-H, Multi-Family High Density to enable development of a proposed multi-family residential condominium. Ravezzani gave the background on Hesse’s request for rezoning, stating his property has been zoned Industrial and now Hesse must have the zoning changed to RM-H before he can proceed with his condominium project. Hesse addressed the planning members and stated that he has been paying taxes on his unoccupied property for the last 15 to 20 years and deserves a chance to develop his 7.1 acres if the zoning code can be amended. This development would increase the Village tax base, increase the water and sewer revenue and be good for the economy of the Village. Ravezzani stated a Public Hearing will have to be held to amend the zoning code changing the classification from I-1 to RM-H. Member Bronkema informed Heese that as a member of the Village Council he could take part in the Planning discussion but could not vote with the Planning Members since he is also a member of the Village Council and would have to vote when the project came before Council for final approval. . MOTION by RAGLAND second by LANDCASTER to hold a Public Hearing at the next Planning Meeting on Tuesday, April 26, 2016 at 7:00 p.m. at the Government Center, to receive public input regarding a Rezoning Request by Peter Hesse for an amendment to the zoning classification from I-1 Industrial to RM-H Multi- Family High Density to enable development of a proposed multi-family residential condominium on property located at 875 Green St. All members present voting yes. MOTION CARRIED. (Ravezzani to provide up-to-date information to the planning members.) CORRESPONDENCE:

• Planning Commission Members - terms expiring for Chairman Wallace Hibbard and Becky Lancaster agreed to be reappointed to the Planning Commission for another term. Their acceptance will be conveyed to Village President Reszka.

• The Commission Annual Reports to Council and reception for all commission members will be held on May 2, 2016 at 6:00 p.m.

Chair Hibbard noted the resignation of Diane Richter, who was present at the meeting, and thanked her for her service. She served on the Park and Recreation Committee. REPORTS: PLANNING & ZONING ADMINISTRATOR, STEVE RAVEZZANI submitted his monthly February 2016 Report. COUNCIL REPRESENTATIVE, DOUG BRONKEMA gave an update of the Council’s recent activities such as employee contracts, negotiating with applicants for the Village Manager position, update of water and sewer improvements. PLANNING REPRESENTATIVE TO ZBA, LAUREN DAKE – THE ZBA Meeting was cancelled due to lack of business. Noted: Green ER Reads will meet April 26, at Siren Hall from 5:00 to 7:00 p.m. to discuss this year’s selection, Richard Louv’s The Nature Principle: Reconnecting with Life in a Virtual Age. Member Ragland discussed available dates to hear Richard Louv’s lecture on watershed protection. (Committee to work on selection of dates.) Also reminder of tickets available for Louv’s speaking engagement at Peterman Hall on May 4th - $10.00 and $40.00 for reception. Tickets available at Corner Druggist. PLANNING AND ZONING ADMINISTRATOR STAFF REPORT

REQUEST FOR REZONING MR. PETER HESSE, 875 GREEN ST. - ZCP #2016-013

GENERAL INFORMATION: Owner: Mr. Peter Hesse 9528 Cherry Ave. Rapid City, MI 49676 Requested Action: Mr. Peter Hesse, Owner, is requesting an amendment to the Official Zoning Map of the Village of Elk Rapids Zoning Code by rezoning Parcel #05-43-028-017-00, and Parcel #05-43-028-019-00, better known as 875 Green St., from I-1, Industrial District to RM-H, Multi-Family Residential High Density. General Location: Parcel #05-43-028-017-00 fronts Green St. parallel to the east right-of-way line of US-31, south of Fourth Street. Parcel #05-43-028-019-00 is immediately adjacent to the east of the first parcel. Existing Land Use: The subject parcels contain vacant buildings and various storage structures that were formerly the Alden Lumber and Supply facility. Since the closing of the lumber company, the structures have been periodically used for antique and other arts and craft sales events. It is currently un-occupied and used by Mr. Hesse for storage. Adjacent Land Use and Zoning: Properties to the North are zoned B-1, Local Business, and R-2, Residential, and consist of Fitzpatrick Insurance Company and residential single-family homes. The property immediately adjacent to the South is zoned I-1, Industrial, however the property is no longer used for its former manufacturing business but is now commercially owned and occupied by K & K Heating and Cooling Company. Property adjacent to and along the East property line of the subject parcel is Zoned R-2 and R-3, Single-Family Residential. Property along the South property line is Zoned P-Public, owned by Elk Rapids Township and is part of the Maple Grove Cemetery property.

Project Description: The owner/applicant is requesting the rezoning of the property to RM-H, Multi-Family Residential, High Density, in order to improve the property for development of a residential condominium community similar in concept to the Meadowview Commons Condominiums near the Elk Rapids Golf Club. The owner believes that this development would present a more inviting welcome for visitors and residents into the village than its current industrial appearance. Zoning History: A review of the history of this parcel indicates that in 1989, the Official Zoning Map was adopted by the Village Council with the subject parcels indicated as being zoned I-1, Industrial. On March 2, 2015, the Village Council adopted the current Village of Elk Rapids Zoning Code and Official Zoning Map that retained the current I-1, Industrial classification. A review of the historic record for the subject parcels by the Planning and Zoning Administrator was unable to verify that the subject parcels were zoned or used for anything other than its current classification prior to 1989. Significant Elements of the Master Plan: A complete review and adoption of the current Village of Elk Rapids and Elk Rapids Township Collaborative Master Plan was completed on August 5, 2013. The subject parcels are located in a portion of the Village that is designated as “General Business” on the Future Land Use Map. It should be noted, the current I-1, Industrial, zoning classification of the subject parcels as well as the adjacent Burnett Foods property to the North are not consistent with the “General Business” future land use designation of the Master Plan. The re-development to commercial business land use has not materialized over the past 30 plus years. A “Mixed Residential” land use category suitable for apartments, condominiums and other residential development is currently designated on parcels directly west of the subject parcels along the west right of way line of US-31. Goal #3, Housing, of the Master Plan Collaborative Goals is to “include housing for the entire spectrum of our community”. The objectives in achieving this goal are specified as 1. “identify impediments to the location of affordable housing and housing to serve elderly residents and develop mechanisms to encourage facilities that allow aging residents to remain in the community in suitable locations” and, “Encourage high-density land uses in and adjacent to the Village, where necessary utilities and services exist….”. Relevant Sections of the Zoning Ordinance: Chapter 300 of the Zoning Code defines the characteristics for the current I-1, Industrial District, the B-3 Commercial Business District described in the Master Plan, and the proposed RM-H, Multi-Family Residential District. This chapter also establishes the permitted uses within each of the zoning districts. Section 470 of the Code describes the Special Use Permit requirements that will need to be completed for the proposed development.

Correspondence Received: The Planning and Zoning Administrator has received no written or other communication, either in favor or opposed, concerning the requested rezoning. ANALYSIS AND FINDINGS: Would rezoning be consistent with other zones and land uses in the area? As described above, adjacent parcels to the North and East are Zoned R-2 and R-3 Residential. Property directly west of the subject parcels along the west right of way line of US-31 are currently zoned RM-H, Multi-family High Density. The proposed rezoning would be consistent with these properties as well as the adjacent B-1, Local Business land use that by definition “shall be compatible with adjacent residential land use.” Would rezoning be consistent with development in the area? New development along the US 31 corridor in this area has not occurred as envisioned in the Master Plan. Changes that have occurred have been mainly in a change in use of existing structures both on the subject parcel and in the vicinity. Are allowable uses in the proposed zone equally or better suited to the area than the uses allowed in the current zone? The number and type of allowable land uses on the subject parcels would be significantly decreased from its current I-1, Industrial classification, specifically, those uses related to manufacturing and commercial business identified in the Table of Permitted Uses, would no longer be permitted within the requested RM-H zoning district. The proposed rezoning would result in a significant change in the character and intensity of land use under the current I-1 classification. Will the rezoning be consistent with the goals, policies and uses proposed for this area in the Master Plan? As noted above, the subject parcels, as well as the adjacent Burnett Foods property to the North, are not consistent with the “General Business” future land use designation of the Master Plan. The anticipated re-development to commercial business land use has not materialized over the past 30 plus years. Since a “Mixed Residential” land use category suitable for apartments, condominiums and other residential development is currently designated on parcels directly west of the subject parcels along the west right of way line of US-31, the proposed rezoning could be considered compatible for this area of the village. Recent discussions and census data supports the need for housing that takes into consideration the demand for senior and “affordable” housing for families in our community. As noted above, the proposed development would be consistent in achieving this goal identified in the Master Plan.

Do current regulations leave the applicant without economically beneficial or productive options? No. Applicant can continue to use the land as it exists or establish any other use that is permitted within the current I-1, Industrial district. COMMENTS: It is important that the requested change in zoning classification and therefore, a change in permitted land use for the subject parcels, be consistent with the Village of Elk Rapids Collaborative Master Plan and the Future Land Use Map. As pointed out above, the current I-1, Industrial classification of the subject parcels, as well as the Burnett Foods parcel adjacent to the north are not consistent with the “General Business” future land use designation of the Master Plan. Since both the current and proposed classifications are not consistent, it is now our difficult task to determine what action we believe will achieve both the best interest of the property owner, as well as that which ultimately results in the best interests of the Village as a whole being met. It is also important to note that, new development consistent with the “General Business” designation envisioned in the Master Plan along the US 31 corridor in this area has not occurred over the past 30 years; that recent discussions and census data indicate a need for affordable housing in the community that takes into consideration the changing demographics of our community including the need for senior and workforce housing; that, understanding the Master Plan is a dynamic document that anticipates the needs and desires of the Elk Rapids community will change over time; and that historically and in the best interest of the Village, changes in zoning classification that have not necessarily been consistent with the Official Zoning Map have been adopted. To that extent, it is the opinion of the Planning and Zoning Administrator that the Planning Commission, after due diligence and consideration, recommend the Village Council amend the Official Zoning Map by rezoning the subject parcel from I-1, Industrial to RM-H, Multi-family High Density. I believe that in doing so, although the request is not consistent with the current Future Land Use Map, the long term interest of the Village of Elk Rapids as a whole will be realized by a decision to move toward meeting the objectives, goals and policies established in the Master Plan. If we are successful in meeting these goals, the possibility of welcoming new families to our community along with the increase in associated economic activity for the local business community and property tax revenue will be realized for the benefit of all.

Zoning Amendment Request Requirements

Applications for a Zoning Amendment Request must be received twenty-five (25) days prior to the date of the Planning Commission meeting to be placed on the agenda. 1. ZCP #2016-012 – Request of Tony’s Mobile and Modular Service for a ZCP to allow for the placement of a new 16’ x 70’ mobile home at the Vacation Village Mobile Home Park at located at 168 Shadywood. Permit Approved.

2. ZCP # 2016-013 – Request of Peter Hesse to amend the Official Zoning Map by rezoning his property located at 875 Green St. from I-1, Industrial to RM-H, Multi-family-High Density. Application under review by the Planning Commission.

3. ZCP #2016-014 – Request of Barbara Enders for a Driveway Permit to allow for the placement of a

3. The Planning Commission heard the preliminary presentation of a request of Peter Hesse to amend the Official Zoning Map by rezoning his property located at 875 Green St. from I-1, Industrial to RM-H, Multi-family, High Density, to allow for the construction of a multi-family condominium development. Application is under review by staff and the Planning Commission. A Public Hearing has been schedule for the April 26, 2016 regular meeting of the Planning Commission.

VILLAGE COUNCIL ACTIVITIES RELATED TO PLANNING AND ZONING:

1. Village Council conducted a First Reading on the recommendation of the Planning Commission to Adopt Ord. #466, the proposed amendment to the Village of Elk Rapids Zoning Code, §528.C.4, Landscape Plant Materials. The Village Council scheduled a Public Hearing for Ordinance #466 at their regular meeting on April 18, 2016.

2. Village Council conducted a First Reading of Ord. #465, Proposed Amendment to the Village of Elk Rapids Code of Ordinances, Chapter 2: Administration, Art. I, Div. 3, Boards and Commissions. Continued discussion is scheduled for the April 18, 2016 regular meeting.
