CITY PLAN COMMISSION MEETING

September 26, 2011

The Plan Commission of the City of De Pere, Wisconsin, met in regular session in the Council

Chambers of City Hall.

Mayor Michael Walsh called the meeting to order at 7:00 p.m. Roll call was taken and the

following members were present: Tom Walsh, Derek Beiderwieden, James Kalny, Elizabeth

Runge, Alderperson Robert Wilmet and Alderperson Kathleen Van Vonderen. Members

excused: Not applicable. Also present: City Planning Director Kenneth Pabich, and members

of the public.

1. Alderperson Wilmet moved, seconded by Derek Beiderwieden, to approve the following

minutes: August 22, 2011 (regular meeting) August 30, 2011 (special meeting), September 6,

2011 (special meeting) September 20, 2011 (special meeting). Upon vote, motion carried

unanimously.

2. Review the proposed detachment from Village of Ashwaubenon and annexation for the City of

De Pere.

Mayor Walsh moved, seconded by James Kalny, to open the meeting to the public. Upon vote,

motion carried unanimously.

Kathy Kocken, 1001 Cedar Street, asked the Commission if there was any intention to force

hookups to the City's water utility.

Mayor Walsh moved, seconded by Alderperson Wilmet, to close the meeting to the public. Upon

vote, motion carried unanimously.

After some discussion, James Kalny moved, seconded by Alderperson Van Vonderen, to support

the Intergovernmental Cooperation Agreement Between the City of De Pere and Village of

Ashwaubenon To Determine A Portion of the Common Boundary Line Through Detachment and

Annexation of Territory, and forward same to the City Council. Upon vote, motion carried

unanimously.

3. Review minor amendment to the Precise Implementation Plan for Nazcr Trac milti-family lot

WD-1171. Agent: Tim Halbrook.

Mayor Walsh moved, seconded by Alderperson Wilmet, to open the meeting to the public. Upon

vote, motion carried unanimously.

Alderperson Wilmet asked if the extra garage space would provide enough parking space for all the

rental units.

Tim Halbrook, 3681 Monroe Road, De Pere. Tim responded that with regard to the additional

garages, there should be less parking onsite because the cars will be in the garages.

Cynthia Simon, 2377 Talladega Speedway. Cynthia asked about the traffic flow, how many rental

units there would be, and whether this development would negatively impact her property values.

Melissa Reinhold, 2392 Lawrence Drive. Melissa questioned the berm, the status of the trees, how

many bedrooms would be in each unit, and who was responsible for the maintenance of the

property in terms of mowing the grass and berm.

Mayor Walsh moved, seconded by Derek Beiderwieden, to close the meeting to the public. Upon

vote, motion carried unanimously.

Mayor Walsh moved to approve the minor amendment to the Precise Implementation Plan with the

conditions that were listed by staff. Mayor Walsh specifically asked that the landscaping and the

berm be reviewed by the City's Forester. Motion was seconded by Alderperson Wilmet. Upon vote,

motion carried unanimously.

4. Review the Conditional Use Application for residential occupancy on the second floor at

301 Main Avenue, Parcel WD-906. Applicant: Tom Gavic.

Moved by Mayor Walsh to approve the Conditional Use Application. Seconded by James Kalny.

Upon vote, motion carried unanimously.

5. Future Agenda Items.

There was no discussion.

6. Adjournment.

Mayor Walsh moved, seconded by Tom Walsh, the Plan Commission adjourned the meeting at

7:40 p.m.

City of De Pere Plan Commission Staff Comments Oct 24, 2011

Item #2: Review the CSM application for a two lot extraterritorial CSM in the Town of

Rockland. Surveyor: Dennis Reim.

Robert E Lee has submitted the CSM that creates two lots located on Old Martin Road in the Town

of Rockland, which are 34.8 and 11.12 acres, respectively. Under our review, the City ensures that

a CSM meets the standards of Chapter 46 which governs our Platting and Division of Land. For

areas within our urban reserve, the code, as written, sets out general requirements, design standards

and use standards.

In June of 2010, the Wisconsin legislature changed how a municipality can review a Plat or CSM

by taking away the ability to look at proposed use of an extraterritorial plat. Specifically 2010

Wisconsin Act 399 states:

“236.45(3) (b) Notwithstanding par. (a) and subs. (1) and (2), a municipality may not deny

approval of a plat or certified survey map under this section or s. 236.10 or 236.13 on the

basis of the proposed use of land within the extraterritorial plat approval jurisdiction of the

municipality, unless the denial is based on a plan or regulations, or amendments thereto,

adopted by the governing body of the municipality under s. 62.23 (7a) (c).”

Based on Act 399, the City cannot consider using the land use standards set out in §46-4(h).

However, the standards set forth in §46-4(g), which do not look at proposed use as a review criteria,

still apply. Under §46-4(g) the proposed CSM does meet the following:

1. Section 46-4 (g) 1.5: Lots within urban reserve area of extraterritorial review jurisdiction.

Every lot within the urban reserve area of the extraterritorial review jurisdiction shall be a

minimum of ten acres in area.

2. Section 46-4 (g) 2.5: Lot dimensions within urban reserve area of extraterritorial review

jurisdiction. Every lot within the urban reserve area of the extraterritorial review jurisdiction

shall have a minimum lot width and frontage of not less than 300 feet.

Based on these provisions, the proposed CSM does meet the 10 acre minimum lot size and both lots

meet the minimum lot frontage.

Recommendation:

Staff would recommend approval of the CSM subject to the following:

1. CSM be forwarded to the City Council for approval.

City of De Pere Plan Commission Staff Comments Oct 24, 2011

Item #3: Review the Street Name Change application for a portion of N. 6th

Street, S. 6th

Street

and Oak Street. Applicant: City of De Pere.

When Fort Howard Avenue was re-constructed, it was extended all the way to Main Avenue.

When the project was done, the change was communicated with the land owners at the time and the

owners do use Fort Howard Avenue as their mailing address. However this change was not

properly recorded with the County. Therefore we need to make two corrections:

1. The portion of Oak Street needs to be renamed to Fort Howard Avenue.

2. The portion of N. 6th

Street needs to be renamed to Fort Howard Avenue.

South of Main Street, there is also a small portion of S. 6th

Street that still remains by the park and

condominium complex (please see map). There are no properties that use S. 6th Street

as an address

in this area. Therefore, staff is recommending that this segment be renamed to Reid Street.

Recommendation:

Staff would recommend approving the street name changes and that they be forwarded to the City

Council.
