Below is the Motion Docket for the Third Circuit Court for Friday, August 7, 2020. The Tennessee Supreme Court has approved the 20 th Judicial District plan to begin in-person hearings but has encouraged the Trial Courts to continue the use of video and telephonic hearings. Third Circuit Court will liberally entertain advanced requests for video-conferencing or telephonic hearings for good cause. Please remember that attorneys and/or litigants who are suffering from the Covid-19 virus, have recently been exposed to the virus, are experiencing symptoms of the virus, or running a temperature will not be allowed in the courthouse. Each individual must submit to a temperature check before they will be allowed to proceed into the building. Further, counsel, litigants and any witnesses are required to bring their own face mask or they will not be allowed to enter the building. While in the building, maintain social distance from other individuals at all times. Please proceed to the 6 th floor. A staff member will meet you at the elevators to be certain your case is being heard that morning. You will be directed to social distance seating in the hall or, if you are early or there are no seats available, you will be directed to another part of the building where there is additional social distance seating available. If you are seated on another floor, you will be invited back to the 6 th floor when seating becomes available or your case is ready to be heard. Both Third and Fourth Circuit Court are experimenting with ways to hopefully expeditiously deal with our Motion Dockets and minimize the number of people in the courthouse at any one time. 1. Motions for default judgments will be taken up first, promptly at 9:00 a.m. The shall be heard in-person. Counsel and

litigants involved in these motions shall remain in the hall until the motion is called. At that time, counsel and litigants shall be invited

into the courtroom, not to exceed 10 people at a time. Please be present and ready to proceed at that time.

2. Those matters which the Court anticipates will be shorter shall be designated and be taken up next. The Court anticipates that

these motions will be heard as in-person hearings unless counsel or a litigant has, for good cause, requested to participate remotely. It is

permissible, however, for one attorney to participate remotely and the other attorney to participate in court or both may participate remotely.

Remember that for remote hearings, exhibits necessary for the hearing shall be filed by counsel, not later than 4:30 p.m. the Wednesday prior

to the Friday motion docket. On the Friday, August 7, 2020 Motion Docket, the Court requests that attorneys be prepared to address

at approximately 9:10 a.m. If you are participating remotely, please contact the Court staff and provide them with a telephone

number where you may be reached so that they may notify you to log in or call in to participate in the hearing.

3. are anticipated to take 10 minutes or less. The Court anticipates that these motions shall be heard as in-person hearings,

unless counsel has, for good cause, requested to participate remotely. For the Friday, August 7, 2020 Motion Docket, the Court anticipates that

shall begin at approximately 9:20 a.m. The Court requests that attorneys and litigants be present and ready to go forward at

that time. Court staff will call your motion in the hall and the attorneys and litigants shall be allowed to enter the courtroom at that time, not to

exceed 10 people at a time. Any witnesses are requested to remain in the hall until they are called to testify.

4. The Court anticipates that shall began at approximately 9:45 a.m. Unless counsel, for good cause, has made prior arrangements

to participate remotely, the Court anticipates that shall be conducted as in-person hearings. The Court requests that litigants

and counsel in arrive at the courthouse 15 to 20 minutes prior and be ready to proceed at that time. The Court’s staff shall

call the motion in the hall and the attorneys and litigants shall be allowed in the courtroom at that time, not to exceed 10 people. The Court

requests that any witnesses remain in the hall until called to testify.

In the event an interpreter is necessary, the use of the State Trial Court interpreter, an interpreter approved by the Administrative Office of the

Court or approved by the AOC guidelines, is required for motion hearings and it is incumbent on the party requiring the interpreter to secure the same.

As always Attorneys and self-represented litigants are encouraged to communicate prior to the motion docket in an effort to reach an agreement

on any pending motion. The Court will continue to accept announcements for agreed orders, continuances and strikes on the morning of the motion

docket.

Both Courts would appreciate your comments and/or suggestions on ways in which we may improve our motion docket procedures. If you have

ideas or have observed procedures in other Courts that you think may benefit us all, please share.
