PROPOSED MOTION
THE TOWN COUNCIL CONSISTENT WITH THE TOWN OF VERNON PERSONNEL RULES AND REGULATIONS, SECTION 4.1 (B) ENTITLED "JOB DESCRIPTIONS", HEREBY ADOPTS THE JOB DESCRIPTION OF THE EMS COORDINATOR AND THE PUBLIC SAFETY TELECOMMUNICATOR, AS PRESENTED.
2. Request the Town Council approve the bid waiver for the services of KIDSAFE, CT for the Birth to Eight services in the amount of $15,000.00. (See memorandum from Alan Slobodien, Director of the Vernon YSB relative to same.)

PROPOSED MOTION
RESOLVE, THE TOWN COUNCIL, CONSISTENT WITH THE TOWN CHARTER, CHAPTER 12, SECTION 9, HEREBY WAIVES THE BID PROCEDURE FOR COSTS INVOLVING THE CONTRACT FOR BIRTH TO EIGHT SERVICES FROM KID SAFE CT IN THE AMOUNT OF $15,000 AND FURTHER AUTHORIZES THE TOWN ADMINISTRATOR, TO EXECUTE ON BEHALF OF THE TOWN OF VERNON ANY INSTRUMENT (S) TO THAT EFFECT.
3. Request the Town Council grant a drainage right of way to the State of Connecticut Department of Transportation - Rt.74 Bridge Replacement at Winds orville Road. (See memorandum dated April 1, 2015 from John D. Ward, Town Administrator to Mayor Daniel A. Champagne and the Vernon Town Council relative to same.)
PROPOSED RESOLUTION
THE TOWN OF VERNON IS THE OWNER OF CERTAIN REAL PROPERTY SITUATED IN THE TOWN OF VERNON, COUNTY OF TOLLAND, AND STATE OF CONNECTICUT, UPON WHICH THE STATE OF CONNECTICUT REQUIRES THE ACQUISITION OF A DRAINAGE RIGHT OF WAY TOTALING 350± SQUARE FEET, A SLOPE EASEMENT TOTALING 523± SQUARE FEET, AND AN EASEMENT TO DRAIN. WHEREAS, THE TOWN OF VERNON HAS BEEN INFORMED OF ITS RIGHTS TO RECEIVE ANY AND ALL JUST COMPENSATION FOR SAID ACQUISITION IN COMPLIANCE WITH THE UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT OF 1970; AND

The term of Tenant Commissioner Mr. Raymond Powers expired in February. Pursuant to a change in the Connecticut General Statutes effective October 1, 2011 Connecticut Housing Authorities are mandated to offer the opportunity for an election to allow tenants and program participants to choose the tenant commissioner. On January 28, 2015 the Vernon Housing Authority mailed a notice to all our tenants and program participants informing them of this opportunity. Tenants and program recipients were required to petition to the Authority by March 3, 2015 if they desired to participate in an election. The Vernon Housing Authority did not receive any interest from our tenants and program recipients to have an election. Therefore, the Statute dictates that the appointment of the tenant commissioner reverts back to the original authority which in this case is the Mayor and the Town Council.
Mr. Raymond Powers has served as the tenant representative on this Commission since 2011 when he was appointed to fill a vacancy just prior to the change in law. During that time he has been a valuable asset to this Commission and he wishes to continue as a member.
I respectfully request Mr. Raymond Power's appointment to the Vernon Housing Authority Board of Commissioners effective February 28, 2015 for a five year term.

Notice to All Vernon Housing Authority Residents and Housing Choice Voucher Participants: The Vernon Housing Authority Board of Commissioners is currently comprised of members who are appointed under the town council including the position of resident commissioner. Pursuant to a change in the Connecticut General Statutes effective October 1, 2011 there has been a change in the manner to which the tenant commissioner is appointed. Any tenant, over the age of 18, who lives in a property· owned or managed by Vernon Housing- Authority or resides in a unit that is receiving housing assistance under a program administered by Vernon Housing Authority may petition for an election for the position of tenant commissioner. If no written requests for petitions are received by March 3, 2015, the appointment will revert to the Vernon Town Council. Should the VHA receive qualified petitions, the Vernon Housing Authority will commence the election process on or about April 3, 2015 for those who have submitted qualified petitions. In order to be part of the ballot, interested individuals must adhere to the petitioning procedures described below:
• Interested tenants/participants over the age of 18 must make a written request to the Vernon Housing Authority by March 3, 2015 requesting petition forms. Only lease holders that are in good standing and have been residents/participants of the Vernon Housing Authority for over a year are eligible to receive petition forms. Upon providing the Vernon Housing Authority with your written request, the housing authority will provide you with a petition form that may be duplicated as needed in order for you to obtain 75 resident/participant signatures that are necessary to be put on the ballot. Each resident/participant must individually sign the form and no other resident may sign for another. Signatures shall be obtained only on the official petition form or duplicate copies. Once the petition form is signed, the signature may not be withdrawn and the signatory cannot sign another petition.
• All completed petition forms must be filed with the Vernon Housing Authority no later than 4:00PM on March 3, 2015 at 21 Court Street, Vernon, CT 06066. After obtaining all the required signatures, a statement of Signature Authenticity, including address and number of signatures obtained, must be completed and signed by the circulator/petitioner in the presence of a representative of the Vernon Housing Authority. The petition pages shall be rejected by the Housing Authority if the statement is not completed and signed as indicated above.
• To be placed on the ballot, each petitioning candidate must provide verified original signatures of at least 75 participants who are eligible to vote. Completed petition forms must be properly and timely submitted in order to be placed on the ballot. A petitioning candidate upon completion of required signatures shall have the petition reviewed for authenticity of signatures and petitioner eligibility. Upon completion of such review. the petitioning candidate's name will be placed on the ballot.

Pursuant to a change in Connecticut General Statutes 8-41 effective October 1,2011 a tenant who lives in a property owned or managed by a housing authority or is residing in a unit that receives housing assistance in a housing program that is administered by such housing authority may, under certain circumstances petition for an election of a tenant commissioner subject to the following prescribed procedures. The appointee as tenant commissioner shall be elected by a fair election of the participants of the Vernon Housing Authority assistance programs and those under management.
The Vernon Housing Authority shall notify all tenants not less than 60 days before the appointment of any tenant commissioner or the expiration of the term of any tenant commissioner of the pending appointment or expiration of term.
Not more than 30 days after the authority notifies such tenants of a pending appointment, or expiration of term, such candidates shall petition pursuant to the petitioning procedures described herein.
The Housing Authority shall provide written notification no later than thirty (30) days before the date of the election, if qualified petitions have been received.
If the tenants of the authority have not petitioned for an election pursuant to the above by the date thirty (30) days after the date the housing authority provides notice of a pending appointment or expiration of term, then the appointing authority shall select the appointee. The current appointing authority is the Mayor with approval by the Town of Vernon Town Council.
Any person requesting a petition form must provide the Vernon Housing Authority with their name and address when obtaining such form. Only leaseholders over the age of eighteen (18), who are in good standing and have been a tenant with the Vernon Housing Authority for over a year will be eligible to receive such forms.
Upon providing the Vernon Housing Authority with the above information, the Housing Authority shall provide the person requesting the petition form one or more petition forms that may be duplicated as needed. If the person requesting the form is indigent the Housing Authority shall provide enough petition forms that would allow room for at least two times the required signatures. The current number of signatures required is seventy-five (75) as per the above statutes.
Each signature on the petition form must be the personal signature of the signer and one individual may not, under any circumstances or degree of relationship, sign for another. Printed names and addresses must accompany each eligible signature. Signatures shall be obtained only on the official petition or duplicate copy signature page distributed by the Housing Authority. Once a petition is signed signatures may not be withdrawn. Only eligible VHA residents and program participants over the age of eighteen (18) who have provide the Housing Authority with a valid Federal/State picture identification and have signatures on file that have been witnessed by Vernon Housing Authority staff may sign petitions.
Any person who is blind may place his/her name on a petition if an third party (not the petitioner or circulator) reads aloud the full text of the petition in the presence of the petitioner or circulator and the blind person consents to have his/her name appear on it. If the blind person is unable to write, a third party may write the name of the blind person followed by the word "by" and his/her own signature.
A statement of Signature Authenticity, including address of the circulator / Petitioner and number of signatures obtained, must be completed and signed by the circulator/petitioner in the presence of a representative of the Vernon Housing Authority. The petition pages must be filed with the Housing Authority office. The petition pages shall be declared invalid by the Housing Authority if the signature authenticity statement is not completed and signed as indicated above.
The completed petition forms must be filed with the Vernon Housing Authority at 21 Court Street, Suite 114, Vernon, CT 06066, no later than 4:00 P.M. on date to be determined at the time of a Tenant Commissioner vacancy Each petitioning candidate, to be placed on the ballot must provide verified signatures of at least 75 participants who are eligible VHA residents or program participants. Completed petition forms must be properly and timely submitted in order to be placed on the ballot. A petitioning candidate, upon completion of required signatures, shall have the petition reviewed for

As Mayor of the Town of Vernon, I recognize the need for Affirmative Action and I pledge my commitment to undertake positive actions to overcome the present effects of past practices or barriers to equal employment opportunity and to achieve the full and fair participation of minorities, women, people with disabilities, older persons, and all other protected groups found to be underutilized in the Town of Vernon's work force or affected by policies having an adverse impact. In the spirit of Executive Order 11, signed by Governor Ella Grasso November 21, 1975, and Executive Order 9, signed by Governor William A. Programs funded and administered by this Town of Vernon must comply with the provisions of Section 46a-64c of the e.G.S., and with related state and federal laws and regulations that prohibit discriminatory housing practices.

This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in employment practices and policies or the provision of services, activities, programs, or benefits by the town of Vernon.
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for persons with disabilities upon request.
The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to:

General Statement of Duties: Highly responsible position involving planning, organizing and managing the staff and volunteers of the Town of Vernon Fire Department, EMS Division.
Supervision Required: Receives general direction from the Mayor, Town Administrator and Fire Chief. Reports directly to the Fire Chief.
Supervision Exercised: Directly supervises all EMS personnel in the EMS Division. Acts as liaison between medical control and all medically trained EMT's in the Town of Vernon Fire Department. This will include record maintenance and coordination with the Training Division for certification and re-certification classes. Essential Job Functions: Oversees the daily operations ofthe Town's Ambulance Department; directly manages recruitment, retention, evaluating,Jrainingand development of employees. The Youth Services Bureau is seeking to execute a contract with KIDSAFE CT for birth to eight services utilizing Office of Early Childhood funding designated for School Readiness expenses. A current contract is in force for $8,500. This request seeks to amend the contract amount from $8,500 to $15,000 and I am requesting an amended bid waiver for this contract based on the following:
~ KIDSAFE CT is the current fiduciary agent for the Vernon Community Plan that includes implementing Birth to Eight strategies articulated in the plan.
~ The proposed $15,000 contract would enhance current services that are within the fiscal purview of KIDSAFE CT.
~ KIDSAFE CT currently provides monthly fiscal reports to the Youth Services Bureau and additional reports on the $15,000 contract would create continuity for the YSB Director.

The Engineering Department has received notice that the Department of Transportation has requested an easement revision to a previously approved CT DOT - Rt. 74 Bridge Replacement at Windsorville Road.
You will recall the original project called for the widening and replacement of Bridge No. 05588 which carries Route 74 traffic over the Hockanum River, in the area of the town's water treatment plant. The project received a positive CGS 8-24 response by the Planning and Zoning Commission (7/17/14), and a Public Hearing was held July 15, 2014. On August 19, 2014, the Council unanimously granted approval for the State to acquire 1,895 sq. ft. of town land for this project, as well as approving a waiver of Compensation and Appraisal as required by the State of Connecticut.
The requested revision expands DOT's former request to include a drainage right of way and right to drain over town land south of Route 74 and westerly of the River. These notations are reflected in a revised map titled "TOWN OF VERNON, MAP SHOWING LAND ACQUIRED FROM TOWN OF VERNON, BY

The attached plan shows a revision to the Department's proposal presented last year to the Town for a small taking and construction easement west of the sewer treatment plant. This revision expands that request to include a drainage right of way and right to drain over Town land south of Route 74 and westerly of the river.
The Department of Transportation has also provided a 'waiver of compensation & appraisals' form similar to the one signed last year by Terry McCarthy. You may recall that the Town Council approved that transfer and authorized the execution of the waiver at their August 19th 2014 meeting. I anticipate that the same process will be required for this supplemental request.

Whereas, the Town of Vernon is the owner of certain real property situated in the Town of Vernon, County of Tolland, and State of Connecticut, upon which the State of Connecticut requires the acquisition of a drainage right of way totaling 350± square feet, a slope easement totaling 523± square feet, and an easement to drain.
Whereas, the Town of Vernon has been informed of its rights to receive any and all just compensation for said acquisition in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970; and
Now therefore, the Town of Vernon does hereby waive its rights to receive any and all just compensation for said acquisition described on the map entitled:

As the Council may be aware, the Vernon Board of Education is proposing to enter into a lease agreement with First Choice Health Center Inc. for rental space at both Rockville High School and the Maple Street Elementary School in order to run school based health centers. First Choice will open the clinic to the Students and Staff.
Pursuant to Conn. Gen. Stat. 7-167, a public hearing must be held. Therefore, I would ask that the Town Council sit this down for a public hearing on April 21.
Prior to the execution of a lease, the matter was referred to the Planning and Zoning Commission for review under e.G.S. § 8-24.

On February 6th at approximately 5:57 PM, several officers were dispatched to a local residence on a report of a domestic disturbance involving a man armed with a knife. A responding officer apprehended the man outside the residence as he was attempting to leave the area. Investigation showed the accused showed up intoxicated at the residence of a neighbor and tried to force his way into the apartment. A physical altercation occurred between the accused and the neighbor as he attempted to keep the accused from entering the apartment. The accused then produced a knife and threatened his neighbor. The accused was charged with Carry a Dangerous Weapon, Threatening, Criminal Trespass, Breach of Peace, and Possession of Marijuana. He was held on a $10,000 bond.
On February 13th at approximately 10:24 AM, officers responded to a local residence on a report of an active domestic where a man from Ashford, CT assaulted his girlfriend by strangling her. The victim was able to fend off her boyfriend and call police. The boyfriend threatened to kill his girlfriend and fled the residence before the arrival of the officers. A description of the accused and his vehicle was given out to area police departments and he was subsequently stopped by state police in Tolland. He was taken into custody and charged with Breach of Peace, Threatening, Assault, and Strangulation.
DETECTIVE DIVISION
The Detective Division completed 3 patrol division assists and made 1 arrest. The Division currently has 41 active cases under investigation. The following is a breakdown of those cases:

Significant Cases
On February 10,2015, the People's Bank at Tri-City Plaza was robbed. A female suspect entered the bank and handed the teller a note demanding money. She fled on foot. No one was injured. Detectives are working together with several area towns on this investigation.
On February 12, 2015, a male entered the First New England Federal Credit Union on Hyde Avenue with a handgun and demanded money. He fled the bank on foot. No one was injured. Detectives have been working with area towns and the FBI on this investigation.
On February 20,2015, Detectives arrested Euclides Landim, of Vernon and charged him with an incident that occurred on January 10, 2015. Landim allegedly caused a potentially serious head injury to his infant daughter while under his care. The baby was hospitalized at CT Children's Medical Center for several days but fortunately has no permanent injury. Detectives conducted a joint investigation with DCF, Tolland State's Attorney and a CCMC Child Abuse Pediatrician. Landim was charged with Risk of Injury to a Minor, Assault 3rd Degree and Cruelty to Persons.

TRAFFIC OFFICER
During the month of February, the traffic officer made 25 traffic stops, issued 15 infraction tickets, and 3 misdemeanor summons. He investigated 12 property damage accidents and 1 serious accident with injuries.

Thank you for bowling in the Nineteenth Annual Fenix Memorial Bowling Tournament on March 7. Alas, it was not to be that the Mayors' Trophy would remain in Vernon. It must have been Manchester's year-the Chiefs Trophy also went back to Manchester. There is always next year!

Due to a clerical error on the part of the Assessorts Office for prorated vehicles a 30 day waiver of interest was granted for three Motor Vehicle tax bills in the name of VW Credit Leasing LTD. I have reviewed this error with Dave Wheelert Tax Assessor, per § 12-145 we have determined that the delinquency was attributable to a clerical error for 2012 Grand List bill numbers 524402, 524377, and 524396.
Written notification of the adjusted tax bills was transmitted electronically to VW Credit Leasing LTD March 6, 2015 along with notification that they have 30 days to pay without interest penalty.
This informational notice is issued to the Members of the Town Council per § 12-145.
