PART 1—PRELIMINARY MATTERS

1. Objectives

The main objectives of these Regulations are—

(a) to define the meaning of plumbing work, and to specify classes of plumbing work and specialised plumbing work, for the purposes of Part 12A of the Building Act 1993; and

(b) to specify the qualifications and experience that are necessary for a person to be eligible to be registered or licensed to carry out plumbing work; and

(c) to provide for the production and return of licence and registration documents; and

(ca) to prescribe standards in relation to plumbing work; and

(d) to specify fees for the purposes of Part 12A of the Building Act 1993.

2. Authorising provisions

These Regulations are made under sections 221ZZZV and 262 of the Building Act 1993.

3. Commencement

Reg. 1(ca) inserted by S.R. No. 66/2001 reg. 5.

These Regulations come into operation on 28 November 1998.

4. Revocation

The Plumbers Gasfitters and Drainers Registration Board Regulations 19881 are revoked.

5. Definitions

In these Regulations—

"Act" means the Building Act 1993;

"apprenticeship" means a training agreement between a person and an employer entered into under Part 5 of the Vocational Education and Training Act 1990;

"AS" or "SAA" followed by a group of numbers or a group of one or more letters and one or more numbers, means the Australian Standard identified by that group of numbers or letters that is published by Standards Australia;

"Board" means the Plumbing Industry Board established under Part 12A of the Act2;

"caravan" includes any form of movable dwelling other than a boat or houseboat;

"cooling tower" means a device for lowering—

(a) the temperature of recirculated water by bringing the water into contact with fan

forced, or fan induced, atmospheric air; or

(b) the temperature of water, a refrigerant or other fluid in a pipe or other container by bringing recirculated water and fan forced, or fan induced, atmospheric air into contact with the pipe or container;

"drain" means a pipe or conduit laid above or below the ground surface, including all associated fittings and equipment, for the conveyance of sewage, trade waste, greywater or stormwater;

"gas" means any gaseous fuel (including petrochemical feed stock) other than a gaseous fuel that is declared under section 4 of the Gas Safety Act 1997 not to be gas for the purposes of that Act or any provision of that Act;

"gas company" has the same meaning as it has under the Gas Safety Act 1997;

"greywater" means treated or untreated domestic waste water (including any discharge from an appliance) that has not come into contact with sewage;

"plumbing course 3212 C.D.A." means the plumbing course 3212 C.D.A. accredited under the Vocational Education and Training Act 1990;

"Plumbing (Backflow Prevention) work" has the meaning set out in regulation 18A;

"Plumbing (Draining) work" has the meaning set out in regulation 9;

"Plumbing (Gasfitting) work" has the meaning set out in regulation 10;

"Plumbing (Mechanical Services) work" has the meaning set out in regulation 11;

"Plumbing (Residential and Domestic Fire Sprinkler Systems) work" has the meaning set out in regulation 16;

"Plumbing (Roofing (Stormwater)) work" has the meaning set out in regulation 12;

"Plumbing (Sanitary) work" has the meaning set out in regulation 13;

"Plumbing (Type A Gas Appliance Conversion) work" has the meaning set out in regulation 17;

"Plumbing (Type B Gasfitting) work" has the meaning set out in regulation 18;

"Plumbing (Water Supply) work" has the meaning set out in regulation 14;

"potable water" means water that is used or intended to be used for human consumption or for personal hygiene;

"sewage" means any human excreta or domestic waterborne waste, whether untreated or partially treated;

"trade waste" means any waterborne waste other than sewage;

"vessel" means any boat or houseboat that has a gas appliance or a sanitary or ablutionary

fixture.

6. Extended meaning of "installation, alteration or repair"

In these Regulations, a reference to the installation, alteration or repair of a thing includes a reference to—

(a) the construction of the thing if the thing is constructed at the premises at which it will remain once it is constructed;

(b) the commissioning, recommissioning or decommissioning of the thing;

(c) the extending, renewal, replacement, relocation, connecting, disconnecting or removal of the thing;

(d) the maintenance of the thing;

(e) any work incidental to, or associated with—

(i) the installation, alteration or repair of the thing; or

(ii) any activity described in paragraphs (a) to (d).

PART 2—PLUMBING WORK

Division 1—Plumbing Work

7. Plumbing work

(1) Part 12A of the Act applies to the following plumbing work—

(aa) Plumbing (Backflow Prevention) work;

(a) Plumbing (Draining) work;

(b) Plumbing (Gasfitting) work;

(c) Plumbing (Mechanical Services) work;

(d) Plumbing (Residential and Domestic Fire Sprinkler Systems) work;

(e) Plumbing (Roofing (Stormwater)) work;

(f) Plumbing (Sanitary) work;

(g) Plumbing (Type A Gas Appliance Conversion) work;

(h) Plumbing (Type B Gasfitting) work;

(i) Plumbing (Water Supply) work.

(2) However, Part 12A of the Act does not apply to—

(a) any work carried out on a supply or discharge reticulation system, a treatment plant, a laboratory or any other works,

equipment or system (other than works, equipment or systems used mainly for administrative purposes) owned by, or exclusively vested in—

(i) a gas company;

(ii) a company that holds a water licence or a water and sewerage licence under the

Water Industry Act 1994;

(iii) an Authority that has a water district or a sewerage district under the Water Act 1989;

(b) the connection for domestic water use of hoses from appliances such as dishwashers and washing machines to taps;

(c) the connection for domestic water use of hoses to taps for the purposes of activities such as cleaning or garden watering.

Division 2—Classes of Plumbing Work

8. Classes of plumbing work

The following classes of plumbing work are specified for the purposes of the definition of "class of plumbing work" in section 221B(1) of the Act—

(a) Plumbing (Draining) work;

(b) Plumbing (Gasfitting) work;

(c) Plumbing (Mechanical Services) work;

(d) Plumbing (Roofing (Stormwater)) work;

(e) Plumbing (Sanitary) work;

(f) Plumbing (Water Supply) work.

9. Plumbing (Draining) work

Plumbing (Draining) work is the installation, alteration or repair of any drain, pipe, fitting, appliance or other item that is involved with the collection, conveyance, disposal or reuse of stormwater or sewage and that is underground.

10. Plumbing (Gasfitting) work

(1) Plumbing (Gasfitting) work is the installation, alteration or repair of any pipe, appliance, flue, fitting, apparatus, control or other item that is involved with the supply or use of gas and that is downstream of the outlet of a gas meter or a consumer's gas storage container.

(2) Plumbing (Gasfitting) work includes the installation, alteration or repair of—

(a) roof sheeting and flashing that is necessary for the purpose of any work involving any flue described in sub-regulation (1); and

(b) any fixture in, or on, a caravan or vessel that is involved with the supply or use of gas.

(3) Plumbing (Gasfitting) work does not include—

(a) Plumbing (Type A Gas Appliance Conversion) work;

(b) Plumbing (Type B Gasfitting) work;

(c) any cleaning, painting or preparation work in relation to gas pipes or gas pipe joints that does not involve the connection, disconnection or alteration of those pipes or joints;

(d) the connection or disconnection of a consumer's gas storage container for the purpose of filling or refilling the container;

(e) any work in relation to any item that is involved with the supply or use of gas and that relates to the propulsion system, or any system that is powered by the propulsion system, of any motor vehicle or vessel.

(4) In this regulation—

"consumer's gas storage container" means a tank, cylinder or similar container owned, leased or hired by a consumer and from which gas is supplied to that consumer;

"gas meter" means a gas company's meter assembly.

11. Plumbing (Mechanical Services) work

(1) Plumbing (Mechanical Services) work is—

(a) the installation, alteration or repair of any valve, regulator, register, pipe, duct, flue, tank, heating or cooling line or surface, boiler, burner, solid fuel heater, coil or other item that is involved in the heating, cooling or ventilation of a building or vessel by mechanical means or by mechanical components;

(b) the installation, alteration or repair, in relation to a cooling tower, of any water pipe, valve, pump, automated dosing device or automated bleeding device or any other

mechanical component that affects the cooling tower's water treatment, flow rate of water for cooling or waste water disposal.

(2) Plumbing (Mechanical Services) work includes the installation, alteration or repair of roof sheeting and flashing that is necessary for the purpose of any work involving any item described in sub-regulation (1).

(3) Plumbing (Mechanical Services) work does not include—

(a) Plumbing (Gasfitting) work;

(ab) any work on a cooling tower drift eliminator;

(b) tapping into a water supply.

12. Plumbing (Roofing (Stormwater)) work

(1) Plumbing (Roofing (Stormwater)) work is the installation, alteration or repair of any roof gutter, flashing, piping, sheeting, roof covering or other above ground item that is involved in the collection, conveyance, disposal, treatment or reuse of storm water.

(2) Plumbing (Roofing (Stormwater)) work also includes the connection of any stormwater piping to a below ground drain.

(3) Plumbing (Roofing (Stormwater)) work does not include—

(a) the installation, alteration or repair of non-metallic tiles or slates or of flat non-metallic

membrane sheeting; or

(b) any cleaning, painting or preparation work in relation to any item associated with stormwater that does not involve the connection, disconnection or alteration of that item.

13. Plumbing (Sanitary) work

(1) Plumbing (Sanitary) work is the installation, alteration or repair of any drain, fitting, pipe, fixture, appliance or other item that is involved in the collection, conveyance, disposal or treatment of sewage, trade waste or greywater.

(2) Plumbing (Sanitary) work includes the installation, alteration or repair of—

(a) an item that is involved in the supply of non-potable water that is not connected directly or indirectly to a potable water supply;

(b) roof sheeting and flashing that is necessary for the purpose of any work involving any item described in sub-regulation (1);

(c) any fixture in, or on, a caravan or vessel that is involved in the collection, conveyance,

disposal or treatment of sewage, trade waste or greywater.

(3) Plumbing (Sanitary) work does not include—

(a) Plumbing (Water Supply) work;

(b) Plumbing (Draining) work.

14. Plumbing (Water Supply) work

(1) Plumbing (Water Supply) work is the installation, alteration or repair of any pipe, fitting, fixture, appliance or other item that is directly or indirectly involved in the supply of potable water.

(2) Plumbing (Water Supply) work includes the installation, alteration or repair of—

(a) a hot or cold water service;

(b) a fire-hydrant service and any component of a fire-sprinkler service up to the main stop valve located immediately upstream of the alarm valve, as defined in AS 2118.1;

(c) an automatic fire sprinkler system.

(3) Plumbing (Water Supply) work does not include Plumbing (Residential and Domestic Fire Sprinkler Systems) work.


"automatic fire sprinkler system" means a water supply system for a residential or domestic building designed to automatically operate to extinguish a fire in the building;

"fire hydrant service" means a system of components designed to convey water for the

purposes of extinguishing a fire in a commercial or industrial building, but does not include an automatic fire sprinkler system.

Division 3—Specialised Plumbing Work

15. Specialised plumbing work

(1) The following plumbing work is specialised plumbing work—


(a) Plumbing (Residential and Domestic Fire Sprinkler Systems) work;

(b) Plumbing (Type A Gas Appliance Conversion) work;

(c) Plumbing (Type B Gasfitting) work.

(2) The following classes of plumbing work are specified for the purposes of the definition of "class of specialised plumbing work" in section 221B(1) of the Act—


(a) Plumbing (Residential and Domestic Fire Sprinkler Systems) work;

(b) Plumbing (Type A Gas Appliance Conversion) work;

(c) Plumbing (Type B Gasfitting) work.

16. Plumbing (Residential and Domestic Fire Sprinkler Systems) work

Plumbing (Residential and Domestic Fire Sprinkler Systems) work is the installation,

alteration or repair of automatic life safety fire sprinkler systems—

(a) in residential buildings of not more than 4 storeys; or

(b) for buildings defined as Class 1 in accordance with the Building Regulations 19943.

Regulation 1.5(2) of the Building Regulations 1994 provides that words and expressions used in those Regulations have the same meanings as they have in the Building Code of Australia. Therefore, Class 1 buildings in those Regulations are buildings defined as Class 1 buildings in the Building Code of Australia.

17. Plumbing (Type A Gas Appliance Conversion) work

(1) Plumbing (Type A Gas Appliance Conversion) work is the adjusting, altering or modifying of a Type A gas appliance to operate on a different kind of gas from the gas the appliance was originally manufactured to use.

(2) In this regulation "Type A gas appliance" has the same meaning as a "Type A appliance" defined in section 3 of the Gas Safety Act 1997.

18. Plumbing (Type B Gasfitting) work

Plumbing (Type B Gasfitting) work is gasfitting work carried out on a Type B appliance within the meaning of the Gas Safety Act 1997.

Plumbing (Backflow Prevention) work is the inspection, maintenance, commissioning, testing, alteration or repair of a registered or testable backflow prevention device listed in column 1 of Table 4.1(a) of AS/NZS 3500.1.2–1998.

PART 3—QUALIFICATION AND EXPERIENCE REQUIREMENTS FOR LICENCE OR REGISTRATION

Division 1—Qualifications and Experience Required for Classes of Plumbing Work

19. Qualifications required for registration

The qualifications required for a person to be able to be registered under section 221O of the Act to carry out—

(a) Plumbing (Gasfitting) work, Plumbing (Mechanical Services) work, Plumbing (Roofing (Stormwater)) work, Plumbing (Sanitary) work and Plumbing (Water Supply) work are—

(i) the completion of, and a pass in, Stages 1 and 2; and

(ii) a pass in the Stage 2 Practical Examination—

of the plumbing course 3212 C.D.A.;

(b) Plumbing (Draining) work is the completion of, and a pass in—

(i) Stages 1 and 2 and in the Stage 2 Practical Examination (Draining) of the plumbing course 3212 C.D.A.; or

(ii) the draining units and in the Stage 2 Practical Examination (Draining) of the plumbing course 3212 C.D.A..

20. Qualifications required for a licence

The qualifications required for a person to be able to be licensed under section 221M of the Act to carry out—

(a) Plumbing (Draining) work are the completion of, and a pass in, the draining units of the plumbing course 3212 C.D.A.;

(b) Plumbing (Gasfitting) work are the

completion of, and a pass in, Stage 3 Stream D of the plumbing course 3212 C.D.A.;

(c) Plumbing (Mechanical Services) work are the completion of, and a pass in, Stage 3 Stream C of the plumbing course 3212 C.D.A.;

(d) Plumbing (Roofing (Stormwater)) work are the completion of, and a pass in, Stage 3 Stream E of the plumbing course 3212 C.D.A.;

(e) Plumbing (Sanitary) work are the completion of, and a pass in, Stage 3 Stream B of the plumbing course 3212 C.D.A.;

(f) Plumbing (Water Supply) work are the completion of, and a pass in, Stage 3 of the plumbing course 3212 C.D.A..

21. Experience required for a licence or registration

(1) The experience required for a person to be able to be licensed or registered under section 221M, 221N or 221O of the Act to carry out a particular class of plumbing work is—

(a) the completion of an apprenticeship of 4 years in plumbing work of that class (except in the class of Plumbing (Draining) work, for which the completion of an

apprenticeship of 2 years is sufficient) under the supervision of a plumber qualified to carry out work of that class; or

(b) employment for 4 years in plumbing work of that class (except in the class of Plumbing (Draining) work, for which employment for 2 years is sufficient) by a plumber qualified to carry out work of that class.

(2) Despite sub-regulation (1), in the case of a person who is qualified to carry out work of a particular class and who seeks to be licensed or registered to carry out another class of plumbing work, employment for not less than 1 year in work of that other class by a plumber qualified to carry out work of that other class is sufficient experience to be able to be licensed or registered to carry out that other class of work.

Division 2—Requirements for Plumbing (Residential and Domestic Fire Sprinkler Systems) Work

22. Qualification required

The qualification required for a person to be able to be licensed under section 221N of the Act to carry out Plumbing (Residential and Domestic Fire Sprinkler Systems) work is a pass in the course in residential/domestic fire sprinkler systems known as 4300 C.D.A. accredited under the Vocational Education and Training Act 1990.

23. Experience required

The experience required for a person to be able to be licensed under section 221N of the Act to carry out Plumbing (Residential and Domestic Fire Sprinkler Systems) work is—

(a) the completion of an apprenticeship of not less than 4 years in Plumbing (Residential and Domestic Fire Sprinkler Systems) work; or

(b) employment of not less than 2 years in Plumbing (Residential and Domestic Fire Sprinkler Systems) work.

Division 3—Requirements for Plumbing (Type A Gas Appliance Conversion) Work

24. Qualifications and experience required

The qualifications and experience required for a person to be able to be licensed under section 221N of the Act to carry out Type A Gas Appliance Conversion work are—

(a) a licence to carry out Plumbing (Gasfitting) work; and

(b) a pass in the Board's Type A Gas Appliance Conversion work examination.

Division 4—Requirements for Plumbing (Type B Gasfitting) Work

25. Qualifications required

The qualifications required for a person to be able to be licensed under section 221N of the Act to carry out Plumbing (Type B Gasfitting) work are—

(a) a pass in—

(i) Stage 3 Stream D of the plumbing course 3212 C.D.A. and the Stage 2 Practical Examination and Plumbing Theory Final Year (3212 C.D.A.)

Gasfitting and Water Supply Part A Examination; and

(ii) a Certificate IV in the Gasfitting Type B Gas Appliances course accredited under the Vocational

Education and Training Act 1990; and

(b) an "S permit" issued under regulation 9 of the State Electricity Commission (Licensing of Electrical Mechanics) Regulations 1992.

26. Experience required

The experience required for a person to be able to be licensed under section 221N of the Act to carry out Plumbing (Type B Gasfitting) work is—

(a) the completion of an apprenticeship of not less than 4 years in Plumbing (Type B Gasfitting) work; or

(b) employment for not less than 2 years in Plumbing (Type B Gasfitting) work; or

(c) in the case of a plumber who is qualified to carry out plumbing work in another class of plumbing work, employment for not less than 1 year in Plumbing (Type B Gasfitting) work.

26A. Qualifications required

For the purposes of these Regulations, any experience required by these Regulations may be obtained over more than one period and with more than one employer.

PART 4—OBLIGATIONS ON REGISTERED AND LICENSED PLUMBERS

28. Licence and registration documents must be returned on demand

(1) A person who holds a licence or certificate of registration must return it to the Registrar as soon

as is practicable after being asked to do so by the Registrar.

(2) The Registrar may only ask for the return of a licence or certificate of registration under this regulation—

(a) for the purpose of altering the details on the document; or

(b) for any purpose permitted by the Act.

29. Licence to be shown on demand

The holder of a licence must produce the licence for inspection if asked to do so by—

(a) any person with whom the holder has entered into a contract to carry out plumbing work or to whom the holder has made a statement indicating that the holder is willing or prepared to carry out plumbing work or to enter into a contract to carry out such work; or

(b) the owner or occupier of any land, building, vehicle, caravan or vessel on or in which the holder is carrying out plumbing work or in respect of which the holder has entered into a contract to carry out plumbing work or to whom the holder has made a statement indicating that the holder is willing or

prepared to carry out plumbing work or to enter into a contract to carry out such work; or

(c) any person authorised in writing for the purpose of this regulation by the Board; or

(d) any person authorised in writing for the purpose of this regulation by any body that is

responsible for the control of plumbing work that the holder is carrying out.

30. Certificate of registration to be shown on demand

The holder of a certificate of registration must produce the certificate for inspection if asked to do so by—

(a) the owner or occupier of any land, building, vehicle, caravan or vessel on or in which the holder is carrying out plumbing work;

(b) any person authorised in writing for the purpose of this regulation by the Board; or

(c) any person authorised in writing for the purpose of this regulation by any body that is responsible for the control of plumbing work that the holder is carrying out.

PART 5—STANDARD OF WORK

Division 1Standard of Work

31. Standard of work

(1) Any registered plumber, licensed plumber or other person authorised to carry out plumbing work under the Building Act 1993—

(a) must carry out his or her plumbing work in a good and workmanlike manner; and

(b) must comply with any code or specification (as applied by these Regulations) listed in the Schedule that relates to work of that kind.

(2) Despite sub-regulation (1)(b), a registered plumber, licensed plumber or other person authorised to carry out plumbing work under the Building Act 1993 is not required to comply with AS 4254–1995: Ductwork for air-handling systems in buildings during the period beginning on the date of commencement of regulation 3 of the Plumbing (Amendment) Regulations 1999 and ending on 18 May 1999.

(3) The Plumbing Industry Commission may exempt a class or sub-class of building from the need to comply with sub-regulation (1).

"11.29 GREASE ARRESTOR APPLIANCES

11.29.1 General All greasy discharges from waste fixtures and floorwaste gullies in the kitchen and food preparation areas of buildings other than Classes 1 and 2 are, unless authorised by the Plumbing Industry Commission and the relevant water authority, to be made to pass through a grease arrestor appliance before entering the sewer.

11.29.2 Location Grease arrestor appliances are to be located as close as practicable to the fixtures served and, whether installed internally or externally, may be above or below ground, except that grease arrestor appliances of the portable type are to be installed above ground.

11.29.3 Design Grease arrestor appliances are to be constructed in accordance with any requirements of the Plumbing Industry

Commission and must generally comply with the following—

(a) grease arrestor appliances are to generally conform with the requirements of Figures 11.2 or 11.3 as appropriate;

(b) grease arrestor appliances are to be

fitted with covers which—

(i) are able to withstand vehicular or pedestrian traffic or other loads likely to be imposed on them;

(ii) may be loose fitting or airtight;

(iii) are readily removable by one person;

(c) the materials of construction of a grease arrestor appliance are to be suitable for the nature of the wastes likely to be discharged through the appliance.

11.29.4 Ventilation

11.29.4.1 If airtight covers fitted Grease arrestor appliances are to be provided with a DN50 vent (see Fig. 11.2 or Fig. 11.3) when airtight covers are fitted.

11.29.4.2 Outlet ventilation Outlet ventilation is to be provided to all grease arrestor appliances as follows—

(a) as a DN100 riser off a disconnector gully outside a building in accordance with Clause 4.6.2;

(b) as a DN50 vent off a disconnector gully inside a building in accordance with Clause 4.6.5;

(c) as a DN50 vent off a DN80 trap riser for a portable grease arrestor appliance inside a building in accordance with Clause 4.6.5.

11.29.4.3 Interconnection Grease arrestor appliance and outlet vents may be interconnected in accordance with Clause 6.7.3.

11.29.5 Connection

11.29.5.1 Greasy discharges Fixtures and floorwaste gullies with greasy discharges are to be connected to the inlet pipe of a grease arrestor appliance in accordance with Clause 3.12.

11.29.5.2 Outlets The outlet from—

(a) a portable grease arrestor appliance receiving a hydraulic loading of up to 5 fixture units is to be a minimum DN50;

(b) a portable grease arrestor appliance receiving a hydraulic loading of more than 5 fixture units is to be a minimum DN80; and

(c) all other grease arrestor appliances are to be a minimum DN100.

11.29.5.3 Trap A separate trap, of the same size as the outlet pipe, is to be installed at the outlet of every grease arrestor appliance.

Division 6Evaporative Coolers

31L. Definitions applying to this Division

In this Division—

"evaporative cooler" means a non refrigerated water filtered air flow ducted cooling system installed above and through a roof;

"surface water drainage system" means any or all surface channels, kerbs and gutters, inlet pits, stormwater drains, stormwater pits, detention tanks or areas, pump installations and rising mains for the collection and conveyance of surface water, from paved and unpaved areas and discharges from

downpipes, but does not include subsoil drains.

31M. Requirements for discharge system of evaporative

coolers

Plumbing work carried out for the installation of, or alterations, additions or repairs to, the discharge system of an evaporative cooler must comply with the requirements of this Division.

31N. Requirements if discharge likely to cause injury or damage

(1) This regulation applies if the discharge from an evaporative cooler is likely—

(a) to fall on a roof from which water is collected for potable or other use or re-use; or

(b) to cause accelerated corrosion of roof surfaces or roof drainage components.

(2) The waste outlet connections from the evaporative cooler must discharge to—

(a) a sanitary drainage system; or

(b) a surface water drainage system; or

(c) a soakage pit, but only if a sanitary or surface water drainage system is not available and the discharge water will not cause damage to buildings or facilities by changing soil moisture conditions.

(3) If water from an evaporative cooler is discharged to a sanitary drainage system—

(a) a tundish must be connected and the provisions of either Clause 4.6.7.8 or Clause 11.22 of AS/NZS 3500.2.2–1996 must be complied with; and

(b) Section 2 of AS/NZS 3500.2.2–1996 must be complied with.

31O. Other requirements

(1) If water from an evaporative cooler is discharged on to a roof then the standards contained in Sections 3 and 4 of AS/NZS 3500.3.2–1998 must be complied with.

(2) A discharge pipe from an evaporative cooler must be a minimum size DN 40 and must have a continuous fall to the termination point.

(3) The bleed-off water pipe of an evaporative cooler must have an internal diameter of no less than the internal diameter of the unit connection.

32. Fees to be paid

The following fees must be paid—

(a) for an application under section 221M, 221O, 221P, 221Q or 221R of the Act $51.50

(b) for an application under section 221N of the Act $21.00

(c) for a licence under section 221M of the Act or a renewal of a licence under section 221ZB of the Act $206.00

(d) for an endorsement under section 221N of the Act or a renewal of an endorsement under section 221ZB of the Act $21.00

PART 7—TRANSITIONAL PROVISIONS

34. Definition

In this Part, "former Regulations" means the Plumbers Gasfitters and Drainers Registration Board Regulations 1988.

35. Conversion of former licences and registrations

For the purposes of any licence or registration, or any eligibility for any licence or registration, under Part 12A of the Act, a class of plumbing work listed in Column 2 of the Table is deemed to be the same class of plumbing work as the class of plumbing work shown next to that class in Column 1 of the Table.

36. Conversion of duct fixing licences and registrations

(1) In this regulation, "duct fixing work" means work in connection with the installation, renewal, replacement, alteration, repair or maintenance of heating, ventilation or cooling ducts.

(2) A person who was licensed, or who was eligible to be licensed, to carry out Plumbing (Duct Fixing) under the former Regulations immediately before the date these Regulations came into operation is deemed to be licensed, or eligible to be licensed, under section 221Q of the Act to carry out duct fixing work.

(3) A person who was registered, or who was eligible to be registered, to carry out Plumbing (Duct Fixing) under the former Regulations immediately before the date these Regulations came into operation is deemed to be registered, or eligible to be registered, under section 221R of the Act to carry out duct fixing work.

(4) A person is deemed to be licensed under sub-regulation (2) until the date the person's licence to carry out Plumbing (Duct Fixing) under the former Regulations would have expired had those Regulations not been repealed.

(5) A person is deemed to be registered under sub-regulation (3) until the date the person's registration to carry out Plumbing (Duct Fixing) under the former Regulations would have expired had those Regulations not been repealed.

(6) Sub-regulations (4) and (5) cease to apply if a person's licence or registration is suspended or cancelled under the Act.

(7) As soon as is practicable after the date these Regulations come into operation, the Registrar must—

(a) seek the return of each licence or certificate of registration issued in respect of Plumbing

(Duct Fixing) under the former Regulations; and

(b) issue a replacement licence or certificate of registration under section 221Q or 221R.

(8) No fee is payable for the issue of a replacement licence or certificate of registration under sub-

regulation (7)(b).

37. Saving of other licences and registrations

Except as otherwise specified in this Part, the repeal of the former Regulations does not affect any licence or registration in force under the former Regulations immediately before the date these Regulations came into operation.
