The Slovak Criminal Acts pecifies only a criminal offence “theft” and defines it as follows: " A person who appropriates other person´ s thing by taking possession of it and thus causes a petty loss” Thefts include burglaries (a so‐called housebreaking). According to our laws, a difference between a major and petty theft consists in the amount of caused loss (over 4,000,000,‐ SKK ‐ particularly serious criminal act of theft). Owing to different definitions, the above statistics include crime offences that comply with the above definition of “theft”.

Participation in organized criminal groups is regulated by the Criminal Act No. 300/2005, i.e.: Article 129 Group of Persons and Organization (6) Supporting of criminal group or terrorist group shall mean wilful pursuance consisting in provision of means, services, collaboration or in creation of other conditions for the purpose of a) establishment or maintenance of such group, or b) commitment, by such group, of criminal offences specified in Paragraph 3 or Paragraph 4. Article 296 Establishment, Formation and Supporting of Criminal Group A person who establishes or forms a criminal group, is a member of such group, acts or supports such group shall be punished by imprisonment of 5 years to ten years. The above statistical data represent a number of criminal offences committed by organized or criminal group. Such groups do not focus only on the territory of the capital. A number of criminal offences committed in the capital is not monitored.

As to Table 4: Additional information on criminal activities recorded in criminal (police) statistics attached to the Questionnaire for the Tenth UN Survey of Crime Trends and Operations of Criminal Justice System, covering the period 2005 – 2006. Question: “When are data collected to be included in the statistics?” Answer: Registration and statistical system of criminality gathers notices of suspicion of commitment of criminal offences, data on criminal offences and known offenders that were identified or reported to the police or prosecutor´ s office. Question: “How the rule of main criminal offence is applied?” Answer: We speak about concurrence of (parallel) criminal offences when the offender committed two or more criminal offences before he was validly sentenced for one of such criminal offences by the court. In the police statistics, pursuance having typical features of one‐act concurrence is registered as a criminal offence. Pursuance having typical features of more‐act concurrence is usually reported in the Criminal Act as separate criminal offences according to the number of violations of individual provisions. Question: “How multiple criminal offences are reported?” Answer: Multiple criminal offences or partial attacks of the same offender that have in common objective connection in terms of time, method of commitment and subject of attack as well as subjective connection, in particular, unifying aim of the offender to commit the relevant criminal offence are reported as one continuing criminal offence. Total number of prisons is 18, thereof: ‐ 6 remand prisons, ‐ 5 prisons, ‐ 4 remand prisons and prisons, ‐ 1 juveniles´ prison (men), ‐ 1 female prison, ‐ 1 prison hospital for pre‐trail detainees and sentenced prisoners. Open and semi‐open units with the mitigated regime have been affiliated to the prisons. In 2005 there were established 8 open or semi‐open units with total capacity 513 places. In 2006 the new Prison Sentence Act dissolved the semi‐open units. As at 31 December 2006 there were established totally 8 open units with total capacity 517 places.

Comments Table 17 17.t3 Data in lines 17. are not to the particular day, but for the whole year 2005 or year 2006. 3 235 sentenced prisoners asked for conditional release in 2005. From the total number of filed applications the court disincarcerated 2 417 (74,7%) sentenced prisoners and 818 (25,3%) applications were dismissed. Sentenced juveniles filed 73 applications for conditional release. From this 66 (90,4 %) juveniles were disincarcerated during 2005. In 2005 there wasan increase in the number of filed applications (about 370 applications) in the 1st correctional group /the least strict regime/. 2 007 sentenced prisoners from the whole number 2 353 were conditionally released in 2007. Apart from the increase in the number of filed applications also the success of the release increased, when 85,3 % (in 2004 76,4%) of applicants for conditional release were disincarcerated in the least strict group in this period. The increase of number of filed applications to 105, in comparison with the previous year was observed also in the middle regime (2nd correctional group). Together 803 sentenced prisoners filed the application, the court granted 344 sentenced prisoners. The success of disincarceration in 2005 is comparable with the previous year, when 42,8 % sentenced prisoners who filed an application were disincarcerated, what creates only 0,8% less than in 2004. Six applications for conditional release were filed in the 3rd correctional group; all were dismissed by the court. 22 sentenced prisoners were conditionally released on the suggestion of the prison director in 2005, thereof 4 juveniles and 18 prisoners placed into the least strict regime /1st correctional group/. 3 123 prisoners asked for conditional release in 2006. From the total number of filed applications the court disincarcerated 2 427 (77,7 %) prisoners and applications of 696 (22,3 %) prisoners were dismissed. In comparison with the previous year 10 prisoners more were conditionally released also in spite of the fact, that the number of filed applications was about 112 lower than in the previous year. From the total number of filed applications for conditional release 85 applications were from juveniles. From this 77 prisoners were disincarcerated, what creates success 90,6 %. Prisoners in the minimum level of guarding filed 2288 applications for conditional release in 2006; the court granted to 2001 prisoners, what creates 87,5%. In comparison to 2005 (85,3%) the success of release increased to 2,2%. Decrease in the number of filed applications about 61 in comparison with the previous year was observed in the middle level of guarding. Totally 742 prisoners filed the application and the court granted to 348 prisoners. The success of disincarceration in 2006 was 46,9%, what creates a moderate increase about 4,1%. in comparison with the previous year. 8 applications for conditional release in the maximum level of guarding were filed, whereas the court granted in one case. 4 prisoners from the minimum level of guarding were conditionally released on the suggestion of the prison director in 2006.

18.t2 In 2005 the number of captures of drug addicts by the entrance searches in prisons was 651, in 2006 646 drug addicts. 379 sentenced prisoners took the protective treatment ordered by court in 2005 on the psychiatric departments and 56 sentenced prisoners took the voluntary anti‐alcohol and anti‐drug treatment. In 2006 the number of prisoners who took the protective treatment increased about 85 persons, 464 prisoners took the protective treatment ordered by court, 60 prisoners took the voluntary anti‐alcohol and anti‐drug treatment in 2006. Nowadays the Corps of Prison and Court Guard has established six drug free zones with total capacity 367 places. On the psychiatric department of Prison hospital Trenčín 389 persons were cured in 2005, what creates the occupancy 71,74 % and in 2006 411 persons, what is the 71,81 % occupancy.
