Slijedeće informacije iz ove točke 1.3. su općenite naravi i ne odnose se na ponuditelje. / The

following information fo this item 1.3. are of general nature and do not concern the Tenderers.

Sukladno Prilogu 4. Poziva na dostavu projektnih prijedloga„Certifikacijom proizvoda do tržišta“

(referentni broj poziva KK.03.2.1.12.)“: „Postupci nabave za osobe koje nisu obveznici Zakona o

javnoj nabavi“, stupanj potrebnog oglašavanja postupka nabava, kao i mjesto i način oglašavanja,

mora biti razmjeran prirodi i opsegu nabave, a uključuje najmanje objavu Obavijesti o nabavi i Poziva

na dostavu ponuda na internetskoj stranici www.strukturnifondovi.hr, odnosno na pripadajućoj

podstranici nabava. / Accorrding to Annex 4. of the Call for Proposals „Access to market by

certification of products“ (reference number of the Call KK.03.2.1.12.): “Procurement procedures for

subjects that are not obliged to Law on Public Procurement“, the level of publication of the

procurement procedure, as well as the place and way of publication, has to be in line to the nature

and extent of the procurement and includes minimally the publication of Procurement Notice and Call

for Tenderes on the Internet web site www.strukturnifondovi.hr, procurement section.

1.6. Pojašnjenja i izmjene Poziva za dostavu ponuda / Additional information and

modification of Call for tenderes

Za vrijeme trajanja roka za dostavu ponuda gospodarski subjekti mogu zahtijevati pojašnjenja vezano

za predmete nabave ili Poziv za dostavu ponuda. / Until the deadline for submission of tenders,

economic operators may request additional information and clarifications related to the subject of

procurement or Call for tenderers.

Zahtjevi za pojašnjenjima se mogu zatražiti isključivo pisanim putem na slijedeću e-mail adresu

kresimir.dulcic@veritasesco.hr, najkasnije tijekom šestog (6) dana prije isteka roka za dostavu

ponuda. / Request for clarifications/additional information can be requested in written form

exclusively at the following email address kresimir.dulcic@veritasesco.hr not later than sixth (6) day

before the deadline for submission of tenders.

Naručitelj se obvezuje odgovoriti na postavljene zahtjeve za pojašnjenjima ili izmjene Poziva za

dostavu ponuda pisanim putem bez navođenja podataka o podnositelju zahtjeva, najkasnije

tijekom trećeg (3) dana prije isteka roka za dostavu ponuda. Sva pojašnjenja ili izmjene

Poziva za dostavu ponuda, bit će objavljeni na www.strukturnifondovi.hr / Contracting Authority

is obliged to provide answers to the requested clarifications/additional information or changes in

Call for Tenderers, in writing withouth specifing information on the submitter, not later

than during third (3) day before the deadline for submission of tenders. All clarifications or

modification of the Call for Tenderers will be published at www.strukturnifondovi.hr

Ukoliko iz bilo kojeg razloga tražena pojašnjenja ili izmjena Poziva za dostavu ponuda nisu

objavljeni na način i u roku kako je gore navedeno, Naručitelj će produžiti rok za dostavu ponuda i

osigurati da gospodarski subjekti imaju najmanje osam (8) dana za dostavu ponuda. Ukoliko bude

potrebno, Naručitelj će izmijeniti ili ispraviti Poziv za dostavu ponude. / If for any reasons, the

requested clarifications/additional information or changes to Call for Tenderers are not supplied in

the manner and timeframe as specified above, the Contracting Authority shall extend the deadline for

submission of tenders and assure that economic operators/potential suppliers have at least eight (8)

days for tender submission. If necessary, the Contracting Authory will change or ammend Call for

Tenderers.

2. PODACI O PREDMETU NABAVE / PROCUREMENT SUBJECT INFORMATION

2.1. Opis predmeta nabave / Procurement subject description

Predmet nabave je nabava usluga testiranja i certificiranja LED svjetiljki. / Subject of procurement is

the serveice of testing and certification of LED lights.

Detaljne specifikacije navedene su u Prilogu 2 – tehničke specifikacije i toškovnik / Detailed

specifications are specified in Annex 2 – Technical Specifications and Bill of Quantities

Predmet nabave nije podijeljen u grupe i ponuditelji su dužni ponuditi cjeloviti predmet nabave.

/Procurement is not divided into lots and Tenderers are obliged to offer complete items subject to

procurement.

Ponuditelj može podnijeti samo jednu ponudu. / Tenderer may submit only one offer.

U ponudi moraju biti ponuđene sve stavke kako je to definirano u Prilogu 1. – Ponubeni list i Prilogu

2. Tehničke specifikacije i troškovnik. /

Offer must include all items as defined within Annex 1. – Bid Sheet and Annex 2. – Technical

Specifcations and Bill of Quantities.

2.2. Tehničke specifikacije i količine / Technical specifications and quantities

Detaljne tehničke specifikacije i količine predmeta nabave sadržane su u Prilogu 2. Poziva za dostavu

ponude. / Detailed technical specifications and quantities of the subject of the procurement are as

per Annex 2 of Call for Tenderers.

Zahtjevi definirani tehničkim specifikacijama predstavljaju karakteristike usluge koje

ponuditelj mora obaviti te se iste ne smiju mijenjati od strane ponuditelja. / Requests defined in

Technical Specifications represent characteristics of the offered services that should be done and

should not be altered by the Tenderer.

Ponuditelj u Prilogu 2 – Tehničke specifikacije i troškovnik obvezatno popunjava stupac „Jedinična

cijena“. Ponuditelj mora ponuditi/popuniti sve stavke troškovnika. / In the Anex 2. Technical

Specification and Bill of Quantities the Tenderer is obliged to fill the column „Price per unit“. Tenderer

is obliged to fill all items of Bill of Quantities

Ponuditelj ne smije mijenjati troškovnik / Tenderer is not allowed to change The Bill of Quantities.

Kako bi se ponuda smatrala valjanom, ponuđeni predmet nabave mora zadovoljiti sve što je

traženo u obrascu Tehničkih specifikacija (Prilog 2). / In order for an offer to be considered compliant, offered services must meet all requirements presented in the Technical Specifications (Annex 2).

2.3. Mjesto izvršenja usluge i isporuke predmeta nabave / Place of performance of services and

place of delivery

Svi predviđeni testovi Veritas LED svjetiljki provodit će se u CB laboratoriju koji je član IEC IECEE CB

sheme međunarodnog priznavanja laboratorija / All tests of Veritas LED lights are to be conducted in

the CB laboratory which is the member oft he IEC IECEE CB scheme of the international recognition of

the laboratories.

Svi certifikati i izvješća o ispitivanju trebaju biti na hrvatskom ili engleskom jeziku i dostavljeni

naručitelju sredstvima elektroničke pošte / All the Certificates and Test Reports are to be in Croatian

or English language and to be delivered to Contacting Authority by e-mail.

2.4. Rok isporuke / Delivery deadline

Krajnji rok isporuke predmeta nabave je kako slijedi / The final dedaline for delivery of procurement

items is

1. rujna 2021. / September 1th 2021.

Odabrani ponuditelj obvezuje se isporučiti predmete nabave u roku koji je naznačen u njegovoj

ponudi u okviru krajnjeg roka isporuke definiranom gore. / Succesfull Tenderer will be obliged to

deliver subject of procurement as specified in his submitted offer in accordance to the final delivery

deadlines specified above.

3. UVJETI I DOKAZI SPOSOBNOSTI PONUDITELJA / SELECTION CRITERIA - CONDITIONS AND

PROOFS OF TENDERERS CAPACITIES

Ponuditelj je dužan u svojoj ponudi priložiti dokumente kojima dokazuje svoju sposobnost za

obavljanje gospodarske djelatnosti. / Tenderer must prove that it has legal capacity for Procurement.

Ponuditelj može dostaviti sve tražene dokumente kojima se dokazuju sposobnosti ponuditelja u

izvorniku, ovjerenoj ili neovjerenoj preslici. /

Tenderer may deliver documents that prove its legal capacity in original, certified or uncertified copy

Dokumenti kojima se dokazuje sposobnost ponuditelja moraju biti na hrvatskom ili engleskom jeziku

ili jeziku države sjedišta ponuditelja i latiničnom pismu. U slučaju da su dokumenti na jeziku različitom

od hrvatskog ili engleskog, ponuditelj u svojoj ponudi mora priložiti prijevod dokumenata na engleski

ili hrvatski jezik. / Documents related to the conditions and proofs of Tenderers' capacities must be

supplied in Croatian or English language, or in the language of the country of Tenderer's registration,

in latine script. In case that these documents are written in languages other than Croatian or English,

Tenderer must enclose a translation to the Croatian or English language.

3.1. Sposobnost za obavljanje profesionalne djelatnosti / Legal and professional capacities

Svaki ponuditelj mora imati sposobnost za obavljanje profesionalne djelatnosti. Sposobnost za

obavaljanje profesionalne djelatnosti ponuditelj će dokazati izvodom iz sudskog, obrtnog,

strukovnog ili drugog odgovarajućeg registra države sjedišta ponuditelja, a ako se oni ne izdaju u

državi sjedišta ponuditelja, ponuditelj može dostaviti izjavu s ovjerom potpisa kod nadležnog tijela.

Navedeni izvod ili izjava ne smije biti starija od tri (3) mjeseca računajući od dana objave ovog

postupka nabave. / Each Tenderer must prove its legal and professional capacity with the following

documentary evidence to be submitted with the tender: extract from the judical, trade or other

relevant register of the country in which the economic operator is established and if such record does

not exist, an equivalent documents issued by the competent judical or administrative authority in the

country in which the economic operator is established. Extracts or documents should not be older

than three (3) months from the date of this Procurement Notice.

Ponuditelj mora biti akreditiran kao Certifikacijsko tijelo za izdavanje svih traženih certifikata i mora

biti članom ENEC asocijacije. / The Tenderer is to be acredited as the Certified Body for all the

requred Certificates as well as to be the Member of the ENEC Association.

Ponuditelj će dokazati naručitelju bilo kojim sredstvom zadovoljavajućim za naručitelja da ispunjava

gornje uvjete sposobnosti koje se odnose na akreditaciju i članstvo u ENEC asocijaciji. Dokazi mogu

biti i u formi slika ekrana s web stranica ponuditelja i ENEC asocijacije. / The Tenderer should prove to

the Contracting Authority by any mean satisfactory to the Contracting Authority the above Capacity

related to accreditation and membership of the ENEC Association. The proves could be also in a form

of screenshot of Tenderer web site and ENEC Association web site in a manner showing the Tenderer

Laboratory.

3.2. Uvjeti sposobnosti zajednice ponuditelja / Capacity conditions related to group of tenderers

Nije primjenjivo. / Not applicable.

4. PONUDA / TENDER

4.1. Sadržaj ponude / Content of Tender:

- Popunjeni potpisani i pečatom ovjereni Ponudbeni list (Prilog 1. Poziva na dostavu ponuda)

dostavljen u izvorniku / Completed, signed and sealed Bid Sheet (Annex 1. of Call for Tenderers)

- Popunjene, potpisane i pečatom ovjerene Tehničke specifikacije i troškovnik (Prilog 2. Poziva na

dostavu ponuda, popunjene sukladno točki 2.2. Poziva na dostavu ponuda) dostavnjene u

izvorniku/ Completed, signed and sealed Technical specifications and Bill of Quantities (Annex 2.

of Call for Tenderers completed in line with point 2.2. of this Call for Tenderers) submitted in

- Dokaze sposobnosti za obavljanje profesionalne djelatnosti, dokaze o akreditaciji i dokaze

članstva u ENEC Asocijaciji u skladu s točkom 3.1 Poziva za dostavu ponuda/Proofs of legal and

professional capacity, proofs of accreditation and proofs of ENEC Association membership in line

with item 3.1 of this Call for Tenderers

Cijena ponude navedena i Prilogu 1 i Ukupna cijena u Prilogu 2 moraju biti jednake / Tender price

listed in Annex 1 must equal Total price in Annex 2.

U slučaju da se, iz bilo kojeg razloga, cijena u Ponudbenom listu (Prilog 1) razlikuje od cijene iz

Troškovnika (Prilog 2), kao ispravna cijena po kojoj će se obaviti rangiranje ponuda smatrat će se

cijena upisan u Troškovniku (Prilog 2). / If for any reasons the price stated in Bid sheet (Annex 1) is

different from the price stated in Bill of Quantities (Annex 2), the price stated in Bill of Quantities

(Annex 2) shall be considered as a correct offered price by which the tenders will be evaluated.

Ponudu i sve njene dijelove (gdje je primijenjivo) potpisuje osoba zakonom ovlaštena za zastupanje

Ponuditelja. / Tender and all its parts (where applicable) is to be signed by the duly authorised

representative of the Tenderer.

Ponuditelji se upućuju na slaganje svoje ponude prema gore navedenom redoslijedu kako bi se

olakšao pregled ponudbene dokumentacije. / Tenderers are instructed to sort out its tender in

order as specified above in order to facilitate the evaluation of tenders.

4.2. Jezik ponude / Language of the tender

Ponude trebaju biti pripremljene na hrvatskom ili engleskom jeziku. / Tender should be prepared in

Croatian or English language.

4.3. Način podnošenja ponuda / Submission of tenders

4.3.1. Broj ponuda / Number of tenders

Ponuditelj može dostaviti samo jednu ponudu. / Tenderer should submit one tender only.

4.3.2. Izrada ponude / Tender preparation

Od dana objave Poziva za dostavu ponuda i Obavijesti o nabavi, Naručitelj osigurava pristup

Pozivu za dostavu ponuda i pratećim dokumentima elektroničkim putem na internetskim

stranicama www.strukturnifondovi.hr / From the date Call for Tenderers and Procurement Notice are

published, Contracting Authority assures access to Call for Tenderers and its documents by

electronical means on the Internet web site www.strukturnifondovi.hr

Ponuda mora biti izrađena i predana u papirnatom obliku, a predaje se u jednom izvorniku. / Tender

should be prepared and submitted in paper form in one original.

Pri izradi ponude ponuditelj se mora pridržavati zahtjeva i uvjeta iz Poziva za dostavu ponude te ne

smije mijenjati i nadopunjavati tekst Poziva za dostavu ponude. / While drafting tender, Tenderer is

instructed to abide to requests and conditions from Call for Tenderers and not to change or

supplement text of Call for Tenderers.

Sve troškove izrade ponude snose ponuditelji. / Tenderer defrays all costs related to tender preparation.

Ponuda se izrađuje na način da čini cjelinu. Ponuda mora biti uvezana u cjelinu na način da se onemogući naknadno vađenje ili umetanje listova ili dijelova ponude. / Tender should be made as one integral pat. Tender should be trussed as a whole in a way to avoid subsequent take out or inserting of sheets or parts of tender.

Ponuda koja je suprotna odredbama ovog Poziva za dostavu ponude i koja sadrži pogreške, nedostatke ili nejasnoće te ako pogreške, nedostaci ili nejasnoće nisu uklonjive, ili u kojoj pojašnjenjem ili upotpunjavanjem ponude nije uklonjena pogreška, nedostatak ili nejasnoća u svakom je pogledu rizik ponuditelja i može rezultirati odbijanjem takve ponude. / The tender which is contrary to the provisions of this Call for Tenderers, or which contains errors, omissions or ambiguities that are not removable or where clarification or completing of offers could not remove error, omission or ambiguity, is in every respect at the risk of the Tenderer and can result with refusal of such tender.

4.3.3. Način i rok dostave ponude / Submission of tender and deadline for submission

Ponuda se u zatvorenoj omotnici dostavlja preporučenom poštom ili osobno do 16. prosinca 2020., do 16:00 sati, na niže navedenu adresu Naručitelja. / Tender is to be submitted in sealed envelope by the registered postal service or hand delivered in person to the address stated below, by 16:00 hours on 16th December 2020. NAPOMENA / NOTE: Ponude trebaju biti zaprimljene do navedenog datuma i vremena, bez obzira na način dostave. / Tenders should be received by the date and time specified above regardless of the means of delivery.

Ako omotnica nije označena u skladu sa zahtjevima ovog Poziva za dostavu ponuda, naručitelj ne

preuzima nikakvu odgovornost u slučaju gubitka ili preranog otvaranja ponude. Ponuditelj

samostalno određuje način dostave ponude i sam snosi rizik eventalnog gubitka odnosno

nepravovremene dostave ponude. / If the envelope is not adressed and labeled in accordance with

instructions in this Call for Tenderers, the Contracting Authority is not held responisible for any loss or

early opening of tenders. Tenderer defines the method of tender submission and bears the risk of loss

or late delivery.

Ponude i ostali dokumenti koji čine sastavni dio ponude ne vraćaju se ponuditeljima. / Tenders and

other documents which are an integral part of tender shall not be returned to the Tenderers.

4.4. Alternativne ponude / Alternative tenders

Alternativne ponude nisu prihvatljive. / Alternative tenders are not acceptable.

4.5. Izmjena i/ili dopuna ponude i odustajanje od ponude / Alteration or withdrawal of tenders

Ponuditelj može do isteka roka za dostavu ponuda dostaviti izmjenu i/ili dopunu ponude. Izmjena i/ili

dopuna ponude dostavlja se na isti način kao i osnovna ponuda s obvezatnom naznakom da se radi o

izmjeni i/ili dopuni ponude. U tom se slučaju ponude otvaraju obrnutim redoslijedom zaprimanja, a

vremenom zaprimanja smatra se dostava posljednje verzije izmjene ponude. / Tenderers may alter

and/or amend their tenders by written notification prior to the deadline for submission of tenders. No

tender may be altered and/or amended after the deadline. Any such notification of alteration and/or

amendment must be prepared and submitted in the same way as the original tender. The outer

envelope must be marked „Alteration/Amendment“. In such case tenders are opened in reverse order

of receipt and time of receipt is considered to be the delivery of last version of altered/amended

tender.

Ponuditelj može do isteka roka za dostavu ponude pisanom izjavom odustati od svoje dostavljene

ponude. Pisana izjava se dostavlja na isti način kao i ponuda s obveznom naznakom da se radi o

odustajanju od ponude. Dostavljena ponuda i prateća dokumentacija se ne vraćaju ponuditelju. /

Tenderer may also withdraw its tender by written notification prior to the deadline for submission of

tenders. Any such notification of withdrawal must be prepared and submitted in the same way as the

original tender. In such case, unopened envelope shall be returned to the Tenderer.

4.6. Cijena ponude i uvjeti isporuke / Tender price and delivery terms

Cijena ponude izražava se u eurima (EUR). / Tender price is established in euros (EUR).

Cijena ponude treba sadržavati sve vezane troškove pružanja usluge i popuste. Cijena ponude je

nepromjenjiva tijekom trajanja ugovora o nabavi. Troškove dostave uzoraka za testiranje i

certificiranje kao i povratak istih nakon testiranja snosi naručitelj / Offered tender price should include

all related costs of the procurement subject and all discounts. Tender price is fixed and may not be

alltered in the period of Contract implementation. Delivery of the luminaires samples for certification

and testing as well as the return of samples to the Contracting Authority shall be borne by the

Contracting Authority

4.7. Rok valjanosti ponude / Tender validity period

Ponuda mora biti valjana minimalno 30 dana od krajnjeg roka za dostavu ponuda. Ponude s kraćim

rokom valjanosti neće biti prihvatljive. / Tender validity period shall be minimum 30 days from the

deadline for submission of tenders. Tender not satisfying mentioned criterion will be refused.

Ako istekne rok valjanosti ponude, Naručitelj može tražiti od ponuditelja produženje roka valjanosti

ponude sukladno tom produženom roku. / If the period of validity expires, the Contracting Authority

reserves the right to require Tenderers extension of the tender validity period in accordance with the

extended deadline.

5. KRITERIJ ODABIRA / AWARD CRITERIA

Kriterij za odabir ponude je najniža cijena. / The award criteria shall be lowest price.

Pri evaluaciji ponuda uspoređuje se cijena bez PDV-a / At the evaluation tender prices without VAT

shall be compared

6. OSTALE ODREDBE / OTHER PROVISIONS

6.1. Odredbe koje se odnose na zajednicu ponuditelja / Provisions concerning groups of

tenderers (consortia)

Nije primjenjivo. / Not applicable.

6.2. Odredbe koje se odnose na podizvoditelje / Subcontracting provisions

Ako ponuditelj namjerava dati dio ugovora o nabavi u podugovor jednom ili više podizvoditelja,

dužan je u ponudi (Prilog 1 – Ponudbeni list) navesti sljedeće podatke / Tenderer that intends to

subcontract a part of the procurement Contract to one or more subcontractors shall specify in their

tender (in Annex 1 – Bid Sheet) the following:

- naziv ili tvrtku, sjedište, OIB, (ili nacionalni identifikacijski broj prema zemlji sjedišta

gospodarskog subjekta, ako je primjenjivo) i adresu podizvoditelja / name or company name,

headquarters, VAT number and the address of the subcontractor

- predmet, količinu, vrijednost podugovora i postotni dio ugovora o nabavi koji se daje u podugovor /

the subject subcontracted, quantity/amount, subcontracted value and percetage share of

procurement subcontracted.

Ako ponuditelj ne dostavi podatke o podizvoditelju, smatra se da će cjelokupni predmet nabave

izvršiti samostalno. / If the Tenderer omits to provide all information required under this article for

the part of the Contract he intends to subocontract, it shall be determined that Tenderer will perform

all the Contract by itself.

Sudjelovanje podizvoditelja ne utječe na odgovornost ponuditelja za izvršenje ugovora. /

Subcontracting does not affect the responsibility of the tenderer for execution of Contract.

Ponuditelj koji je imenovao nekog podizvoditelja da će obaviti dio Ugovora može u bilo kojem

trenutku za vrijeme izvršenja Ugovora odlučiti da će cijeli ugovor obaviti samostalno / The tenderer

who has nominated any Subcontractor to perform a part of Contract can at any time during the

performance of the Contract decide to perform the whole Contract solely by itself.

6.3. Otvaranje i ocjena ponuda / Opening and evaluation of tenders

6.3.1. Mjesto i vrijeme otvaranja ponuda / Place and time of tenders opening

Pregled i ocjenu Ponuda izvršit će Odbor za nabavu kojeg će formirati Naručitelj. / The opening and

evaluation of tenders shall be conducted by Procurement Commitee established ba Contracting

Authority.

Sastanak Odbora za nabavu na kojem će se izvršiti otvaranje i ocjena ponuda održat će se slijedećeg

dana nakon isteka roka za dostavu ponuda u 12 sati, na adresi Naručitelja. /The Procurement

Committee meeting at which tenders shall be opened and evaluated will take place on the next day

after the deadline for tender submission, at 12:00 hours at the Contracting Authority address.

6.3.2. Pregled i ocjena ponuda / Examination and evaluation of tenders

Pregled i ocjena će se obaviti na slijedeći način / Examination and evaluation will be conducted as

follows:

6.3.2.1 Naručitelj u skladu s uvjetima i zahtjevima iz Poziva za dostavu ponuda sljedećim

redoslijedom provjerava: / Contracting Authority shall verify the following in the stated

order, in accordance with the conditions and requirements in the Call for Tenderers:

- oblik, sadržaj i cjelovitost ponude / the format, content and completeness of the tender

- ispunjenje uvjeta sposobnosti / that the selection criteria are met,

- ispunjenje zahtjeva vezanih za opis predmeta nabave i tehničke specifikacije / that

the requirements related to the description of the subject of procurement and

Technical Specifications are fulfilled,

- računsku ispravnost ponude / aritmetical accuracy of calculations in the tender

- ispunjenje ostalih uvjeta iz Poziva za dostavu ponuda / that the other conditions

stated in the Call for Tenderers are met

te odbija ponudu koja nije u skladu s odredbama Poziva za dostavu ponuda / and refuses the

tender that is not in accordance with the provisons of Call for Tenderers.

6.3.2.2 Nakon pregleda i ocjene ponuda iz prethodnih točaka valjane ponude rangiraju se

prema kriteriju za odabir ponude. Ako su dvije ili više valjanih ponuda jednako

rangirane, Naručitelj će odabrati ponudu koja je pristigla ranije. U slučaju izmjene ili dopune

ponude, kao vrijeme zaprimanja ponude uzima se vrijeme zaprimanja njezine izmjene,

odnosno dopune. / After the examination and

evaluation of tenders, valid tenders shall be ranked in accordance with the award

criteria. If two or more valid tenders are equally ranked, the tender submitted earlier will be

considered advantageous. In case of alteration or amendment of the tender, the time of

receipt of alteration/amendment of tender will be considered as the time of recept of the

tender

6.3.2.3 Ponuda koja ispunjava sve uvjete, a najpovoljnija je sukladno kriterijima odabira iz ovog

Poziva za dostavu ponude smatrat će najpovoljnijom ponudom. / Tender

that fulfils all the conditions from the Calls for Tenderes and is the most advantageous

according to the award criteria shall be considered as the most advantageous.

6.3.2.4 Naručitelj će sastaviti Zapisnik sa sastanka Odbora za nabavu te će sve ponuditelje

obavijestiti o konačnom odabiru pružatelja/dobavljača i to slanjem informacije o

odluci o odabiru svim ponuditeljima. /Procurement Committee will draft Minutes from the

evaluation meeting and will inform all entities who submitted the tender on the final results

of the selection, by delivering the award decision.

6.3.2.5 U slučaju da niti jedna ponuda ili niti jedna prihvatljiva ponuda ne bude podnesena,

Naručitelj će poništiti postupak nabave u kojem će slučaju objaviti Obavijest o

poništenju natjačaja na web stanici www.strukturnifondovi.com. / In case no valid

tender or no acceptable tenders have been submitted, the Contracting Authority will

cancel the procurement procedure in which case cancelation notification will be

published on www.strukturnifondovi.com.

6.3.2.6 Zahtjevi za pojašnjenjima

Ukoliko to bude potrebno, Odbor za nabavu može zatražiti dodatna pojašnjenja od

Ponuditelja vezano za tehničke specifikacije i financijsku ponudu (Prilog 1. i Prilog 2.) pristigle

ponude. Zahtjev za pojašnjenjima bit će dostavljen Ponuditelju pisanim putem elektronski, te

u njemu definiran rok za dostavu potrebnog pojašnjenja. / If necessary, the Procurement

Committee may request clarification to technical specification or financial bid (Annex 1 and

Annex 2) of the tender submited. Request for clarification will be sent to Tenderer in writing

and electronically, with the determined deadline for submission of needed clarification.

Ukoliko ponuditelj propusti mogućnost dostave dodatnog pojašnjenja u propisanom roku i na

propisani način, smatrat će se da ponuda nije pravovaljana. / In case the tenderer fails to

submit the clarification requested within the determined deadline and in adequate way,

tender will be considered as not acceptable.

6.4 Rok za donošenje Odluke o odabiru / Period for issuing award decision

Naručitelj će Odluku o odabiru donijeti u roku od 10 dana od isteka roka za podnošenje ponuda. /

Contracting Authority will issue the award decision within the period of 10 days from the date of

deadline for submission of offers.

6.4.1. Dostava i objava Odluke o odabiru / Delivery and publication of award decision

Odluka o odabiru bit će objavljena na stranicama www.strukturnifondovi.hr. Isto tako, Odluka o

odabiru bit će poslana elektroničkim putem odabranom Ponuditelju u roku od tri (3) dana od

donošenja. / Award decision will be announced and made available on www.strukturnifondovi.hr.

Additionally, the award decision will be sent to selected tenderer via e-mail within three (3) days upon

issue.

Odluka o odabiru bit će dostavljena elektroničkim putem i svim ponuditeljima čije

ponude nisu prihvaćene u roku od tri (3) dana od donošenja. / Award decision will be sent via e-mail

also to all Tenderers whose tenders have not been accepted within three (3) days upon issue.

6.4.2. Dostava ugovora i ostale dokumentacije / Submission of Contract and other documentation

Zajedno s dostavom Odluke o prihvaćanju ponude, Ponuditelju će biti dostavljen i Ugovor o nabavi.

/ Along with Award Decision, awarded Tenderer will be delivered a Contract.

Ugovor o nabavi potpisan od strane osobe ovlaštene za zastupanje Ponuditelja, datiran i ovjeren

pečatom Ponuditelja, Ponuditelj treba vratiti naručitelju u roku od 7 dana od zaprimanja . / Tenderer

shall return the Contract, singed by duly authorised person, dated and sealed, to the Contracting

Authority within 7 days upon receival.

6.5. Zadržavanje dokumentacije / Holding of documentation

Ponude i dokumentacija priložena uz ponudu, ne vraćaju se Ponuditelju. / Tenders and

documentation submitted with the tender shall not be returned to Tenderers.

6.6. Rok, način i uvjeti plaćanja / Payment terms

Plaćanje će se obaviti na sljedeći način / Payments shall be made as follows:

- predujam 35% ugovorene cijene usluge u roku 10 dana od potpisa Ugovora i primitka računa

za avans / 35% of the total contracted price in advance within 10 days from the Contract

signature against invoice for advance payment

- ostali dio od 65% od ugovorene cijene platit će se u roku od 10 dana od obavljenog potpunog

posla prema Ugovoru i primitka sve dokumentacije o izvješćima s testiranja, Certifikata i

licenci i primitka konačnog računa./The rest of 65% of the contracted price will be paid within

10 days after complete contracted job is done according Contract and all the Test Reports,

Certificates and Licences are received as well as against of the received final Invoice.

Svim dobavljačima sa sjedištem izvan RH plaćanje će biti obavljeno u eurima. Svim dobavljačima sa

sjedištem u RH plaćanje će biti obavljeno u hrvatskoj valuti (HRK). Za plaćanje u kunskoj

protuvrijednosti bit će mjerodavan srednji tečaj Hrvatske narodne banke na dan plaćanja. / For all

contractor with headquarters registered outside the Republic of Croatia, payments shall be made in

EUR. For all contractors that are registered in the Republic of Croatia, payments shall be made in the

Croatian currency (HRK). For payments in HRK equivalent, median rate of Croatian National Bank at

the payment day shall be valid.

Sva plaćanja obavit će se prema odabranom Ponuditelju bez obzira na eventualno postojanje

podizvoditelja / All payments shall bed one against the awarded Tenderer regardless of eventual

subcontracting of the any part of the contract

6.7. Ostale odredbe / Other provisions

U slučaju eventualnog sudskog spora, sudski proces vodit će se u Splitu, po hrvatskom pravu i na

hrvatskom jeziku / In case of eventual court procedure, the court procedure will be held in Split,

according Croatian Law and on Croatian language.

6.8. Preuzimanje Poziva za dostavu ponuda / Access to Calls for Tenderers

Poziv za dostavu ponude i svi njegovi prilozi se ne naplaćuju te se mogu preuzeti neograničeno i u

cijelosti u elektroničkom obliku na internetskoj stranici www.strukturnifondovi.hr / Contracting

Authority offers unrestricted and full access to the Call for tenderers and any supplementary

documents by electronical means at www.strukturnifondovi.hr free of charge.
