2015 CONFERENCE FUNDAMENTALS
After a successful 2014 conference, AREA returns to Reno for a repeat performance of Silver Legacy-style hospitality during its 2015 Annual Conference, ‘Practice and Polemic: the Art and
Science of Forensic Expertise.’
Practice being the exercise or pursuit of a profession and Polemic being a controversial argument, as one against some opinion or doctrine, this conference will focus on both the technical skills and professional polish required of the successful expert.
Doug Field will guide us through the deposition traps laid by wily attorneys for unsuspecting experts. As Field has remarked, ‘Attorneys rarely
can challenge experts on the technical aspects of their opinion – but they can try to make them look bad, and sometimes succeed in doing so.’
As for the science of our work, along with our popular intermediate and advanced boot camps, we will offer a host of presentations addressing technical aspects of forensic vocational and economic work, including recidivism of former offenders, measures of work-life expectancy, and assessments of earning and functional capacity.
And, encapsulating our theme, we will have a presentation that directly addresses the question posed by many: Is Economics an Art or a Science?

American Rehabilitation Economics Association
Established in 1989, AREA has pursued two missions: bringing recognition to the combined use of vocational rehabilitation and economic loss assessment as a distinct discipline, and providing a peer-exchange forum for vocational, economic and rehabilitation experts who practice within this growing field. Our role is to determine the nature and extent of any loss, from a vocational and/or economic perspective. This, in turn, helps the Court in its assessment of damages. AREA supports professional growth by offering opportunities for continuing education at its Annual Conference. AREA also participates in conference sessions held with other vocational, economic and rehabilitation organizations to encourage the sharing of knowledge among related forensic professionals.

Vocational evaluation is a complex process requiring assessment not only of the individual, but also of the labor market. Within the interaction between the person and the labor market rests the unique vocational potential that each individual possesses. In forensic vocational evaluation, conclusions regarding this interaction must have an adequate foundation that can be testified to within a “reasonable degree of vocational certainty.” This program will link forensic vocational evaluation methodology with essential elements for building a solid foundation to support forensic conclusions. The presentation will provide a brief summary of the evaluation models that have been published for this purpose. The issue of variability in vocational assessment and research conducted to identify key variables for assessment will be discussed. The lecture will round out with a discussion of the Vocational and Rehabilitation Assessment Model (VRAM) which is an empirically derived structural model of vocational assess-ment. Attendees will be provided multiple handouts to include the VRAM model, research bibliography, and research abstract of findings.

In this session, Dr. Cohen will talk about general issues that arise in FELA cases, such as the selection of a proper discount rate, possible differences in methodology by jurisdiction, the computa-tion of net wages, tax issues, projecting future earnings capacity, the relevance of worklife to a loss calculation, the role of an economist is assessing the impact of a railroad disability on earnings capacity, and the treatment of collateral sources, such as disability pensions. Dr. Cohen will then illustrate the application of these issues with a fictitious case.

An injured individual with a history of correctional supervision
creates a dilemma for the economist. If the individual is working at
the time of the injury, how should his or her history of correctional
supervision be incorporated into an analysis of lost earnings, lost
economic support, or lost household services, if at all? For a worker
with a history of correctional supervision, the possibility of possible
future arrest and incarceration is greater than that of the general
population under certain circumstances. Failure to consider the
likelihood of future arrest and incarceration may overestimate lost
earnings, lost economic support, or lost household services for that
worker. However, using a blanket national or state measure of
recidivism may unnecessarily penalize the individual by failing to
consider factors that may mitigate the likelihood of returning to
prison. The questions facing the economist are:
1) What is the likelihood that the individual with a history of
correctional supervision will commit either a technical violation
of parole or probation or a new crime for which he or she is
returned to prison?, and
2) How should the economist incorporate that likelihood into an
analysis of lost earnings, lost economic support, or lost
household services?
The purpose of this presentation is to provide the audience with
some of the latest research, tools, and techniques to answer the two
questions posed above. It will also go over some of the recent
changes in post-release community supervision that may change
the relationships between certain predictors and recidivism behavior
in the future.

writing for professional publication. She will talk about how
to create articles on topics of interest for the readership of
professional journals and about how to package articles so
that journal reviewers will find them of interest to the
readership/membership. She will address how to fit articles
into APA style and about quantitative vs. qualitative
approaches to professional writing. She will advise about
selecting topics for articles and about how to deal with
rejection, when reviews come back. She will involve the
audience in interactive work on the topic of professional
writing.

Dr. Malcolm S. Cohen, President of Employment Research Corporation, received his Ph.D. in Economics from the Massachu-setts Institute of Technology in 1967.
Dr. Cohen has directed numerous labor market research and forecasting studies for the U.S. Department of Labor. Dr. Cohen testifies as an expert witness in various court proceedings on economic loss, discrimination and other employment issues. He has prepared reports in more than 100 FELA cases, and testified in more than 25 FELA cases.
Dr. Cohen joined the Institute of Labor Industrial Relations at the University of Michigan, Ann Arbor in 1972, became the Director in 1980, and retired from the university in 1994. He worked for the Bureau of Labor Statistics (1967-68) and was Assistant to the Vice President of State Relations and Planning at the University of Michigan (1968-70). His teaching assignments since 1969 have been primarily in labor economics. He has also taught Human Resource Management and Statistics at the University of Minnesota.
Research interests include labor market information, labor turnover, employment forecasting and labor shortages. He has directed several major studies to identify national shortage occupations and measure labor turnover using administrative records. His book, Labor Shortages as America Approaches the Twenty-first Century., was published by the University of Michigan Press. His most recent book, Global Skill Shortages written with Professor Mahmood A. Zaidi, is published by Edward Elgar Publishing. He has had articles published in a large number of journals, including: The Earnings Analyst, Journal of Human Resources, Monthly Labor Review, Journal of Political Economy, Review of Economic Statistics, Journal of Economic Theory, and The American Economic Review.

Dr. Patrick Dunn currently serves as Associate Professor in the Department of Educational Psychology and Counseling at the University of Tennessee, Knoxville, Tennessee, and is co-coordinator of the Rehabilitation Counseling program. He has previously taught at Syracuse University and the University of Alabama. In addition to his academic work, Dr. Dunn is also a licensed attorney in the state of Tennessee.

Douglas L. Field attended the Universities of Madrid (Spain) and California (Berkeley), graduating from the latter in 1970. He then completed law school at King Hall (U. C. Davis) in 1973 and immediately entered the practice of civil litigation in Oakland, California.
After working as an associate and later partner at a large Oakland civil defense law firm, in 1980 he formed Taylor & Field, which engaged in all aspects of civil practice for both plaintiffs and defendants, including acting as panel counsel for several large insurance companies.
In 1997, Farmers Insurance Exchange recruited him, where he practiced civil defense litigation, including personal injury defense and construction defect. In 2003, he opened Farmers’ staff counsel office in Stockton, California, and in 2006, he became the managing attorney of the Sacramento Branch Legal Office. There he oversaw 15 to 17 attorneys, averaging nearly 1,150 cases throughout each year. He retired from Farmers at the end of 2011.
During the entirety of his active practice, he has worked closely with expert witnesses in several fields including medicine, architecture, accounting, engineering, biomechanics, and accident reconstruction.
He has tried numerous jury cases to verdict.
After retiring from Farmers, he has dedicated his energies to the presentation of seminars and workshops for expert witnesses, on various topics. He regularly sits as judge pro tempore in the Alameda County Superior Court and is a member of the Consuelo M. Callahan Inn of Court in Stockton, California.
He is the author of the recently released book The Expert Expert – The Path to Prosperity and Prominence as an Expert Witness.
His hobbies include the building and displaying of model ships and maintenance of his Spanish language skills.
Field and his wife, Sandra, have two grown children and four grandchildren. He divides his time between Danville and Woodbridge, California.

Allyn Needham, Ph.D., CEA, is a principal at Shipp, Needham & Durham, LLC (Fort Worth, Texas). For the past 17 years, he has worked in the area of litigation support. Prior to that, he worked more than 20 years in the area of banking, finance and risk management. Dr. Needham has also been an Adjunct Professor of Economics at Texas Christian University and Weatherford College. As an expert, he has testified on various matters relating to commercial damages, personal damages, business bankruptcy and business valuation. He has been retained by attorneys representing plaintiffs and defendants, debtors and creditors. He has given expert testimony in state and federal courts. Dr. Needham is active in several national economic associations. He has served as President of the American Economic Rehabilitation Association and the Southwestern Society of Economics. Judith Parker is a Vocational Rehabilitation Counselor and Case Manager with OSC Vocational Systems, Inc. in Bothell, Washington. She has been practicing in the private sector since 1987 providing vocational assessments in a variety of venues. Ms. Parker has provided consultation, opinion and vocational expert testimony in personal injury, dissolution, Social Security, workers compensation in Washington State and Alaska, employment law and the Veteran's Administration. Her specialties include life care planning, vocational assessment, wage earning capacity evaluation, and economic damage calculations. She holds national certifications from the Commission of Disability Management (CDMS), is a Diplomate
with the American Board of Vocational Experts (ABVE-D), a Certified Life Care Planner (CLCP) and a Forensic Vocational Expert (FVE). She is currently serving as President of the American Rehabilitation Economics Association (AREA) and served for five years as a Commissioner with CDMS. Dr. Rick Robinson has nearly 20 years of experience in vocational, and disability consultation in both litigated and non-litigated settings. He has testified several hundred times as a vocational and life care planning expert in both civil and administrative settings. Dr. Robinson is nationally certified in rehabilitation counseling, vocational evaluation, and life care planning. He is board certified by the National Board for Certified Counselors and as a Diplomate by the American Board of Vocational Experts. He is licensed in Florida as a Mental Health Counselor. He holds a doctoral degree in Rehabilitation Science from the University of Florida, and a masters degree in Business Administration from Regis University. His research interests are focused on forensic rehabilitation analysis, methodologies, and models. He has published over a dozen peer reviewed articles related to forensic vocational rehabilitation services. He is also the editor of the 2014 textbook Foundations of Forensic Vocational Rehabilitation. His leadership roles cross many areas as he is the president elect of the International Association of Rehabilitation Professionals; the president of Robinson Work Rehabilitation Services Co., a private vocational and rehabilitation consulting firm in Jacksonville, FL; and is the lead faculty lecturer for the University of Florida’s postgraduate certificate program in forensic vocational rehabilitation.

Dr. Shipp is a partner at Shipp, Needham & Durham, LLC. He is
also Associate Professor of Marketing at the M.J. Neeley School
of Business at Texas Christian University. Dr. Shipp has been a
consultant and expert witness for over 20 years. During that
time, Dr. Shipp has testified on such subjects as business
valuation, liability, and economic damages including lost profits,
lost earnings, and lost benefits. He has also testified in cases
involving wrongful death, wrongful termination, personal injury,
medical malpractice, divorce, commercial litigation, antitrust,
wrongful termination of distribution agreements, and failure to
exercise best efforts in promoting a new product. Dr. Shipp has
been retained by attorneys for plaintiffs and defendants in both
state and federal courts.
Dr. Shipp actively participates in regional and national
associations that consider matters relating to the calculation of
economic damages. He has also completed continuing
education in business valuation. Dr. Shipp co-authored a
chapter on the calculation of economic damages in Practitioners
Publishing Company's Guide to Litigation Support Services. He
also led a team that developed software sold through
Practitioners Publishing Company that is used to calculate
economic damages arising from personal injury, wrongful death,
and wrongful termination cases.

PACKAGE HANDLING & RECEIVING: All boxes, packages,
overnight mail & faxes (775-325-7474) are received & stored
at the Silver Legacy Exec. Business Center. A nominal charge
is levied for these services. The Business Center can also
arrange for the shipping of individual boxes & material after the
Conference. A detailed price list can be requested at any time.

Taxicabs and Limousines: The Airport is within a 10-minute cab or limo ride of all the major hotels in the area. Taxi and limousine services are provided by these companies and are available to customers on-site. The passenger waiting area for taxis and limousines is located outside of the D Doors located North of Baggage Claim.
Airport Shuttle: Paid Shuttle Service is provided by these companies. The Airport Mini Bus counter can be found inside the A and B Doors located West of Baggage Claim. North Lake Tahoe Express is near Door C and South Tahoe Express is located adjacent to Door D in Baggage Claim. Complimentary Hotel Shuttles run every 15 minutes to the Silver Legacy and stop along the curb, outside the D Doors located North of Baggage Claim, to pick up passengers. When you see your shuttle, please approach the vehicle and board. Be advised the shuttle may not stop in front of you.
City Bus: Service is provided by RTC Ride between the airport and downtown Reno. The city bus pick-up and drop-off location is at the north end of the center curb, outside of Baggage Claim. Please follow the directional signs posted. Bus Route 19, which includes a stop at the Reno-Tahoe International Airport, operates Monday through Friday. The bus schedule to and from the airport, is posted at the bus stop, as well as in baggage claim, adjacent to the Regional Information Booth. Airport guests interested in specific route information can contact RTC Customer Service for assistance at (775) 348-RIDE (7 days a week from 7:00 am to 7:00 pm) or visit their website at www.rtcwashoe.com.
