PRESIDENT’S MESSAGE
Writing my first Virginia Beach Bar Association President’s message I think of how I was so honored to be asked to be in this position. Rather than write this message like an Oscar speech, I remember that words matter. I look back at my journey. First, being a member, I would attend CLEs and social hours afterward. I would wonder how it all came together. Then being a committee member and committee chair, I wondered how the board came up with its ideas and decisions. I remember the president at the time, Jeff Marks, telling me that it is a seven-year commitment - tough at times but always rewarding. Today, being President of the Virginia Beach Bar Association is more than an honor, it is a privilege, a position with deep ties to our local bar, an impact upon our local legal system, and an impact upon our community.
While we do not make laws, we, as a bar association, provide continuing education to lawyers on the latest changes in the law, techniques on being a trial lawyer, and ethics updates - just to name a few areas. However, the VBBA is much more than an education source for attorneys. The VBBA participates in the well-being of the community by feeding those in need and providing swim lessons for students at certain schools, just to name some areas of community involvement. These are all things I never thought of being a part of my profession while in law school. Every day I am reminded of the presidents before me and their tremendous impact upon our local bar and our community.
I then circle back to the beginning of my journey and remind myself that words matter. The words of those coming up as new members of the VBBA matter, committee members’ words matter, the judiciary’s words matter, and the VBBA Board has a voice that matters. Without those new members or learned members our association’s strength would deteriorate. In closing, I want all to know if there is ever an idea, comment (good or bad), constructive criticism, or question as to why the VBBA operates in a certain manner always express such words because as with past presidents, your words matter.
Postscript:My first President’s message was written about two weeks ago, prior
to the Judicial Emergency declared by the Supreme Court of Virginia, and states of emergency declared statewide and nationally. In our
current time, we are seeing a pandemic as we have never seen before. While all citizens are called to do their part in a time of national disaster, I encourage those who are members of the bar and VBBA to think about how they can contribute in this strange time of toilet paper, hand sanitizer and various other shortages.
The VBBA and its members have always been willing to step up and help others in need. But what is the current need? One is explaining to the public that the Courts are still open and working - but only in a limited basis - and what that means. Other needs are being positive and exercising social distancing.
Throughout history the public has looked to the law, lawyers and the judiciary for guidance. Our current national and world emergency will require guidance and understanding. In keeping with my original theme that words matter, it seems quite apropos to say that words matter just as much, if not more, during times of national emergencies. Whether it being words of assurance, words of guidance, or words of comfort. Words matter to many in different ways. Sometimes words of comfort, assurance, and guidance are what matters most. We, as an association, can use our words to positively impact our community during this unprecedented and trying time.

VIRGINIA BEACH BAR FOUNDATION UPDATE
The VBBF board of trustees has approved funding to assist the Virginia Beach Adult Drug Treatment Court.
The Drug Treatment Court was initiated in 2017 through the combined efforts of the judges of the Virginia Beach Circuit Court, the Virginia Beach clerk’s office, and the Virginia Beach Commonwealth’s Attorney. Its goal is to rehabilitate non-violent drug offenders and addicts and provide them with an alternative to prison.
The success rate for similar programs around the country has been impressive, with significant declines seen in the rates of recidivism for Drug Treatment Court participants.
Your contributions through the Virginia Beach Bar Foundation will help sustain and enhance this important program.
In response to the VBBF’s commitment to financially support the program, Maureen H. Barnard, the program’s administrator said, “I cannot tell you how much we appreciate the support of the Foundation.”

The Virginia Beach Sheriffs’ Office asks for your continued patience and understanding with the security screening process at the Virginia Beach Courthouse. The VBSO implemented universal security screening for everyone, including attorneys, entering the Courthouse in August 2019 with the goal of improving safety inside the heavily trafficked public building.
With the exception of public safety officers on official business, everyone entering the Courthouse is searched with a magnetometer and their belongings are screened by an X-ray machine. As always, weapons (including knives and firearms), large liquids (with the exception of baby formula and small items such as hand sanitizers) and electronic devices (including cellphones) are prohibited inside the Courthouse. Attorneys, public safety officers, reporters and employees with the required credentials are still be permitted to bring their cellphones, laptops, etc. into the building. Security personnel retain the right to prohibit any item they deem a potential threat to public safety.
While the transition to universal security screening has gone smoothly, delays are always possible. We ask that you allow sufficient time for the security screening process when conducting business at the Courthouse, especially during busy times of the day, such as first thing in the morning.

he brick main hotel, completed in 1893 by Edward Clarendon Jordan, Jr., grandson of Branch Jordan, still stands today. The west wing of the main hotel is the last remaining section of the first hotel. The second hotel burned circa 1920, and it is unknown what befell the main portion of the first stone hotel, although the foundations of both can still be seen today. In 1947 the Missionary Servants of the Most Holy Trinity purchased the property making it a Catholic Seminary and Monastery. Even today, the property still maintains the calming atmosphere of a resort, with its natural surrounding providing much of its peaceful beauty.
he Historic Jordan Springs Estate is documented to back to 1549 as occupied, when the Catawba Indians discovered the two springs, the White Sulphur Spring and the Calibeate Spring, which flow from the natural grotto at the base of the cliff-like hill called Devil's Backbone. The Native Americans used the area as a meeting place for two centuries, before the springs were discovered by European settlers. The property, a part of the Littler Grant in 1735,later became a resort, centering on the therapeutic and healing powers of the medicinal springs. Since its inception, three hotels have stood on the estate, the first stone structure completed in 1832 by Branch Jordan, and a second wood hotel completed in 1855. The land remained in the Jordan family for many decades. The resort gained in popularity, not only for its healing waters, but also for its proximity to the capitol and the statesmen who loved to vacation here.

uring the Civil War (1861-1865), the resort ceased normal functions and was temporarily converted into a hospital for both the Confederate and Union forces, depending upon which side held the nearby Winchester, Virginia. Many sick and wounded soldiers came to Jordan Springs for medical treatment, especially from the Sharpsburg (Antietam), Gettysburg, and Winchester battlefields. Soldiers who died while at Jordan Springs were buried on the grounds until 1866, when their remains were re-interred at the Stonewall Cemetery in Winchester. Both armies traveled the Jordan Springs Road, and story has it that during the Second Battle of Winchester, Confederate General Edward Johnson stopped at Jordan Springs to ask for directions to Stephenson Depot. After the war, Historic Jordan Springs once again became a popular resort destination for many years. Distinguished visitors, including President Theodore Roosevelt (c.1902), General Robert E. Lee, General Thomas "Stonewall" Jackson, and other statesmen from the Washington, DC area, came to enjoy the Grand Hotel, facilities, and grounds.

VIRGINIA BEACH CIRCUIT COURT NOTICE OF CHANGES TO UNCONTESTED DIVORCE PROCEDURES
Effective March 1, 2020, the Virginia Beach Circuit Court will no longer impose the “Hearing Request” pre-approval process for uncontested divorces that require an in-person hearing before the court. There also will no longer be a special docket for those matters, and the hearings will not be limited to the Duty Judge. Instead, such divorces should simply be noticed for hearing on the regular 9:30 Friday Motions Docket, just like any other motion, and the Duty Judge Judicial Assistant should not be contacted to schedule the hearing. Pre-review and pre-approval of the file and decree will no longer be required or provided. Counsel should submit their proposed decree at the hearing, and it will be reviewed afterward. Other than elimination of the pre-approval process and special docket time, all other requirements for an uncontested divorce hearing still apply, including what types of cases must be set for hearing, notice requirements, evidentiary requirements, etc.

The only exception to the above are Hearing Requests that have already been approved and scheduled for hearing. Those hearings will go forward in compliance with the prior requirements.
NEWPORT NEWS CIRCUIT COURT NOTICE
Our Court has recently made a change to the Local Rule regarding the setting of Civil Trials (please note that we are currently working to have the state website updated accordingly-the local website has been updated). While a Praecipe is still required to be filed, civil trials are no longer being set by Docket Call. The procedure for setting civil trials is explained in the attached Local Rule.

NOTICE REGARDING WEEKENDER PROGRAM AT THE VIRGINIA BEACH CITY JAIL
As the coronavirus pandemic continues to evolve, we are taking every possible precaution to safeguard the health of every person living and working inside the Virginia Beach Correctional Center. To that end, effective Tuesday, March 17, we are canceling all on-site visitation for the foreseeable future. This - along with the other closures and cancellations we have announced - is an effort to reduce possible exposures here at the jail. Friends, family and attorneys still have several options for communicating with their loved ones and clients: mail, telephone, and online video visitation and messaging. For more information on those options, visit https://www.vbso.net/calls-visits. This cancelation applies to all forms of on-site visitation, including media interviews with inmates. If you want to speak with an inmate, I recommend using the online video visitation system, which is available to anyone.

Kimball comes to Virginia Beach from Kaneohe, Hawaii. He earned a law degree from the University of Hawaii, a library degree from the University of Alabama, and a degree in family history–genealogy from Brigham Young University.
His growing family and faith are primary pillars in life and keep him paddling. Kimball hopes to carry on the legacy of Jeannie Tancredi (recently retired); and others who served so well the courthouse community, VBBA, and public over the years, a service which he aptly coins,“ the Wahab way.”
