Lack of adequate funding of our judicial system continues to seriously impact the ability of the entire system to perform the services and functions the people of the State of Alabama have every right to expect. Based on the Governor’s proposed budget for the next fiscal year, consequences in the future are going to be even worse. Locally, our circuit and district judges have taken the lead in trying to find ways to salvage jobs and allow the courts to function even though the funding is inadequate. We as lawyers need to reassess the demands that we place on the support staff at the courthouse to be certain we are helping them work through the problems that have been imposed on them instead of creating additional problems. Please encourage the support staff in your offices to do their best to complete the work you ask of them without having to call or go to the courthouse to ask for assistance. e judges, the clerks, and all of the people in their offices would be the first to tell you to call whenever you need assistance, but these are difficult times and to the extent it is possible to complete your work without involving them now is the time to try and do so. Lack of adequate funding of our judicial system continues to seriously impact the ability of the entire system to perform the services and functions the people of the State of Alabama have every right to expect. Based on the Governor’s proposed budget for the next fiscal year, consequences in the future are going to be even worse. We as lawyers need to reassess the demands that we place on the support staff at the courthouse to be certain we are helping them work through the problems that have been imposed on them instead of creating additional problems. In Cornelius v. Browning, No. 1091378 (Ala., December 2, 2011), the Supreme Court set aside a default judgment as being fundamentally without due process. The defendant had been served and filed

a pro se answer, in which he stated a post office box address. The plaintiff filed a deposition notice electronically but also mailed a copy to the post office box address, which was returned as undeliverable. The defendant did not appear for his deposition. The plaintiff subsequently filed for a default judgment by serving notice at the same post office box address, and the trial court granted it then refused to set it aside. The Court held on appeal that this attempted service of notice failed to comply with the rules or the requirements of due process.

In a case of first impression, the Supreme Court in M.L.H. v. State, No. (Ala., December 2, 2011), concluded that there was no inherent tension or conflict between Ala. Code § 15-25-31, under which a sexual assault victim’s prior inconsistent statements can be admitted as substantive evidence and not just as impeachment, and Rule 801 of the Alabama Rules of Evidence, which generally bars the substantive admission of hearsay. The Court concluded that while the nonhearsay exceptions in Rule 801 were not applicable, Rule 802 provided that hearsay could be substantively admitted if permitted by a statute. Since Section 15-25-31 so permitted, there was no inconsistency.

Overruling Haston v. Transamerica Insurance Services, 662 So. 2d 1138 (Ala. 1995), which it declared aberrational, the Supreme Court in Travelers Indemnity Co. v. Miller, No. 1100619 (Ala., December 2, 2011), held as a matter of law that an insurer could not be sued in a direct action under Ala. Code § 27-23-2 to recover for a default judgment entered against the insured when the first notice that was given to the insurer of the underlying claim was given months after the default judgment was entered.

In Ex parte Limerick, No. 1101201 (Ala., December 9, 2011), a frustrated Supreme Court reversed for the second time a trial court’s order granting a new trial for alleged jury misconduct. On the first appeal, the Court concluded that the 90-day period under Rule 59.1 in the trial court could rule on the post-judgment motion had expired prior to ruling, thus resulting in an automatic denial of the motion. The parties then filed a Rule 60(b) motion seeking to set aside the judgment on the same ground of jury misconduct. The Court held that such a motion was improper and had to be denied.

In Ex parte Jones, No. 1101129, (Ala., December 9, 2001), the Supreme Court denied a petition for mandamus filed in an attempt to require JUDGE GRADDICK to recuse himself from proceedings on a criminal defendant’s post-conviction motion for relief based on jury misconduct. The defendant argued that because Judge Graddick had presided at the trial, he was a material witness as to the alleged juror misconduct and, thus, must recuse. The Court, however, held that Judge Graddick was not privy to anything material about the case that wasn’t readily obtaining from other sources, including the best source - namely the jury members themselves. Consequently, no recusal was required.

In University of South Alabama Medical Center v. Mobile Infirmary Association, No. 1091560 (Ala., December 9, 2011), the Supreme Court ruled that the circuit court lacked subject matter jurisdiction to determine the meaning of Act No. 83-501 pertaining to reimbursement of indigent medical care expenses because the action had been brought as a declaratory judgment action by Mobile County, yet the complaint did not allege the existence of a controversy between the parties but rather simply sought an advisory opinion, which the trial court had no jurisdiction to provide.

In Ex parte City Boy’s Tire and Brake, Inc., No. 1100205 (Ala., December 30, 2011), the Supreme Court reversed a trial court order and held that the trial court lacked personal jurisdiction over a Florida corporation that sold an Alabama resident a tire in Alachua County, Florida, that was subsequently driven back to Alabama by the resident. Another tire on the van later blew out causing an accident. Among other things, the court concluded that the so-called “stream of commerce” argument pertaining to personal jurisdiction had no application here because the tire that the defendant sold was not defective and the claim was instead based on an alleged failure to warn.

VLP ATTORNEY FOR THE DAY CLINICS are helping low-income clients on both sides of the bay. The Mobile clinic takes place the second Monday of the month on the fourth floor of the Mobile County Courthouse. At the April event, attorneys provided seventeen clients with limited legal advice. Clinics also have been held in Foley and Gulf Shores. The Baldwin County Commission has granted SAVLP access to space in the Fairhope, Bay Minette and Foley courthouses, so we look forward to establishing a presence in those locations as well. “NO COURTS, NO JUSTICE, NO FREEDOM”MBA CELEBRATES LAW DAY THROUGHOUT THE MONTH OF MAY!

As we approach May 1st, the day Americans celebrate Law Day, we ask you to consider getting involved in one or more local Bar events that have been organized by local firms, organizations and leaders of the Bar. This year’s theme is “No Courts, No Justice, No Freedom” which underscores the importance of the courts and their role in ensuring access to justice for all Americans despite severe funding cutbacks.

Please note the following dates and sign up to participate, attend or volunteer if you are able!

On May 1st, Cunningham Bounds is sponsoring a benefit cocktail reception and viewing of “To Kill a Mockingbird” at the Saenger Theatre in honor of Law Day. This event will benefit our local Volunteer Lawyers Program (recently changed to South Alabama Volunteer Lawyers Program to reflect its expansion of services into surrounding counties). Tickets are $50 and can be purchased from Cunningham Bounds or the VLP. Thank you Cunningham Bounds for your generous support of this wonderful program as it expands to reach the needs of those throughout southwest Alabama! On May 4th, Everyone is invited to attend the Law Day Naturalization Ceremony which will be held on Friday, May 4, 2012 at 11:00 a.m. in Courtroom 2A of the U.S. District Courthouse for the Southern District of Alabama (113 Saint Joseph Street) in Mobile, Alabama. U.S. DISTRICT JUDGE KRISTI K. DUBOSE will be presiding. At the present time, 16 new citizens will be naturalized. Additionally, CONGRESSMAN JO BONNER will be giving the Remarks to New Citizens, MOBILE BAR ASSOCIATION PRESIDENT WES PIPES will be giving the Closing Remarks, and the COSMOPOLITAN WOMAN’S CLUB OF MOBILE will host a reception for the new citizens immediately following the Ceremony. This is an exciting day for new citizens and a great way to celebrate another way our courts serve the public.

On May 5th at 11 AM, the YOUNG LAWYERS will be holding their second annual KICKBALL TOURNAMENT AT BATTLESHIP PARK ON THE CAUSEWAY. Proceeds of the event will benefit the Mobile Bar Foundation. Several local judges will umpire the games. It is a family event, so kids of all ages are welcome, and non-lawyers are welcome and encouraged to participate in the games. There will be food, beverages, and music, so it promises to be a fun event! Also, it is not too late to be a sponsor (and get your logo on the t-shirt) or put a team together. MARRIED: MBA MEMBER STEVEN SAVARESE WAS MARRIED TO BECKY DAWSON ON APRIL 14, 2012 AT CHRIST THE KING CHURCH IN DAPHNE. FOLLOWING A HONEYMOON IN JAMAICA, THE COUPLE WILL RESIDE IN DAPHNE.

DIED: MBA MEMBER JUDGE JAMES H. LACKEY DIED ON APRIL 13, 2012 IN MOBILE. HE SERVED AS A MOBILE MUNICIPAL JUDGE BEGINNING IN 1982, STARTING THE POSITION IN A PART-TIME CAPACITY AND THEN BECOMING MOBILE’S FIRST FULL-TIME MUNICIPAL JUDGE IN 1990. HE RETIRED FROM THE BENCH IN 2006. HE WAS A GRADUATE OF THE UNIVERSITY OF ALABAMA SCHOOL OF LAW, AND IS SURVIVED BY HIS WIFE, A SON AND TWO GRANDCHILDREN.

DIED: MBA MEMBER EDWARD J. VULEVICH, JR. DIED ON APRIL 15, 2012 AT HIS HOME IN BELLE FONTAINE. HE WAS A GRADUATE OF MCGILL INSTITUTE, THE UNIVERSITY OF ALABAMA AND THE UNIVERSITY OF ALABAMA LAW SCHOOL. HE SERVED IN THE U. S. AIR FORCE IN JAPAN, AND UPON RETURNING TO MOBILE CLERKED FOR JUDGE DANIEL THOMAS. HE JOINED THE U. S. ATTORNEYS OFFICE IN MOBILE IN 1969, AND WORKED THERE UNTIL HIS RETIREMENT IN 2006. HE IS SURVIVED BY HIS WIFE, THREE CHILDREN, THREE GRANDCHILDREN AND MANY OTHER RELATIVES AND FRIENDS.

DIED: MBA FRIEND AND ALABAMA BAR ASSOCIATION EMPLOYEE JEANNE MARIE LESLIE DIED ON APRIL 14, 2012 AT HER HOME IN MONTGOMERY. SHE WAS A GRADUATE OF THE UNIVERSITY OF SOUTH ALABAMA AND RECEIVED A MASTERS DEGREE IN COUNSELING FROM AUBURN UNIVERSITY. IN 1998, SHE ESTABLISHED AND IMPLEMENTED THE LAWYER ASSISTANCE PROGRAM FOR THE ALABAMA STATE BAR AND SERVED AS EXECUTIVE DIRECTOR FOR THE PAST 14 YEARS. SHE HAD AN UNWAVERING PASSION AND COMMITMENT TO HER WORK IN HELPING JUDGES, LAWYERS AND STUDENTS WITH ADDICTION AND OTHER MENTAL HEALTH DISORDERS. SHE IS SURVIVED BY HER HUSBAND OF 25 YEARS, HENRY ARTHUR LESLIE, JR. A SON AND A DAUGHTER, AS WELL AS HER MOTHER, TWO SISTERS AND MANY OTHER RELATIVES AND FRIENDS.

DIED: ROSIE ETTA HERRIN PEARMAN, MOTHER OF MBA MEMBER DON PEARMAN, DIED MARCH 29, 2012 AT THE AGE OF 85. SHE WAS BORN IN LAMAR COUNTY, MISSISSIPPI AND RESIDED IN MOBILE FOR THE PAST 65 YEARS. SHE WAS THE YOUNGEST OF 11 SIBLINGS, ALL OF WHOM PRECEDED HER IN DEATH, AND WAS A DEVOTED MOTHER, GRANDMOTHER AND GREAT-GRANDMOTHER WHO DEDICATED HER LIFE TO HER FAMILY. SHE IS SURVIVED BY FIVE CHILDREN, 16 GRANDCHILDREN, 16 GREAT-GRANDCHILDREN AND TWO GREAT-GREAT-GRANDCHILDREN.
