General terms and conditions These General Conditions apply unless Pahlén AB and the customer has agreed otherwise in writing.
Product Warranty Pahlén AB warrants that all goods supplied are free from defects in material and workmanship, to the original purchaser, for two (2) years from date of delivery. If any defect should occur within this period, it shall be remedied, provided that the said purchaser has fulfilled the payment and other conditions under the purchase agreement, and has within the warranty period notified Pahlén AB of such errors in writing via RMA registration.
The prerequisites for the warranty is that the product has been used on a normal scale to the intended purpose and in accordance with Pahlén AB’s installation instructions and limits on water qualities. Pahlén AB’s liability is limited to the delivery of new goods, repair, or partial reimbursement of the purchase price according Pahlén AB’s choice. In no event will Pahlén AB be liable for direct, indirect, consequential, associated installation costs, or losses for the purchaser.
Excluded products with a limited warranty period of six (6) months from delivery date refers to wear and consumable products / parts that are sold separately or bundled with products. This refers to electrodes, chemicals, pump shaft seals, screen baskets, prefilters, light sources excl. LED, and pool care products.
Price list and export Prices in this list are valid for orders and delivery until the issue of a new price list. The prices quoted do not include Value Added Tax or any other taxes and levies, which may be imposed. In the case of events of a Force Majeure from subcontractors or a significant change of the exchange rate, that may effect the agreed prices and the carrying out of the delivery, the price applicable is that which is valid on the day of delivery. In these circumstances the purchaser will be informed so that he has the possibility to cancel or amend the order. Export orders may be subjected to a surcharge for packing and the prices do not include customs duties, insurance, landing or agent fees, or any other related charges. For orders where the total value of goods is less than €20 excl. VAT an extra fee of €7.50 will be charged.
Terms of delivery and packingAll deliveries are ex works from our factory in Upplands Väsby, Sweden, unless other arrangements have been agreed. In certain cases there can be an extra charge for packing and for the transport of chemicals (hazardous goods). The carrier is responsible for the goods according to his terms of responsibility and until the goods is delivered. The purchaser must note any damage or loss before the goods is accepted and report this to the carrier.
Delivery timesNormal stock items are delivered within two weeks of ordering, subject to prior sales. The delivery time for other goods to special order is subject to agreement. Partial deliveries may be made, if the purchaser does not expressly wish otherwise.
Terms of paymentIf payment in full has not been received on the agreed date of payment, the supplier will be entitled to penalty interest. The goods remain in the ownership of the supplier until payment has been made in full.
ClaimsAll claims with respect to a delivery must be made within 7 days from receipt of the goods. A written claim must be made to the supplier including information regarding order date and invoice or order number. All claims must be agreed in writing by the supplier and all goods is returned at the cost of the purchaser.
ReturnsAll returns must be approved by the supplier. For approved returns there is a charge of 15% of the full value of the goods for control and handling, providing that the goods is returned unused and undamaged. Return carriage charges are the responsibility of the purchaser. Before returning any goods always contact the supplier for a return number for the items involved.
Acceptance delaysIf the purchaser cannot accept the goods at the agreed delivery date, then – on condition that the goods are ready for delivery – the order shall be assumed completed and the purchaser be responsible for payment. The supplier however, is responsible for temporary storage of the undelivered goods if space permits. The supplier may make a reasonable charge for this storage calculated according to the circumstances. During this storage period the supplier will accept no responsibility whatsoever for the goods in question.
DisputesAny dispute between the supplier and the purchaser regarding an order does not release the purchaser from his responsibility for payment according to the agreement. Any dispute between both parties to an agreement shall be decided by an arbitrator or a civil court of law.
ReservationsWe reserve the right to make changes in the construction, dimensions and characteristics of items within this price list without previous notice. We accept no responsibility for printing errors or omissions in the price list.
