Made by the Governor in Executive Council.

Citation

1. These regulations may be cited as the Criminal Code (Authorized Persons) (Videotapes o f Interviews) Regulations 1997.

Members, officers, etc. of Anti-Corruption Commission prescribed as authorized persons (S. 570B)

2. (1) In this regulation -

"the ACC Act" means the Anti-Corruption Commission Act 1988;

"the Commission" means the Anti-Corruption Commission established by section 5 of the ACC Act.

(2) A person to whom this regulation a plies is an authorized person for B the purposes of section 570B of The Crlmina Code.

(3) This regulation applies to -

(a) a person who is a member of the Commission; within the meaning of the ACC Act;

(b) a person who is -

(i) an officer of the Commission;

(ii) a seconded officer; or

(iii) a special investigator,

as defined in section 3 (1) of the ACC Act;

(c) a person who is to be regarded as an officer of the Commission under section 9 (3) of the ACC Act, if the person is authorized for the purposes of these regulations by the Commission; and

(d) a person who is a service provider, as defined in section 3 (1) of the ACC Act, if the person is authorized for the purposes of these regulations by the Commission.

3. (1) A person to whom this regulation applies is an authorized person for the purposes of section 570B of The Criminal Code.

(2) This regulation applies to -

(a) a person appointed as Assessor under the Criminal Injuries Compensation Act 1982; and

Cb) a person appointed as the Chief Assessor, acting Chief Assessor or an Assessor under the Criminal Injuries Compensation Act 1985.

Citation 1. This plan may be cited as the Northern Demersal Scalefish Interim Managed Fishery Management Plan 1997.

Commencement 2. This Plan will commence operation on l January 1998.

"authorised boat" means- (a) a licensed fishing boat, the name, licensed fishing boat number and length of which are

specified in a permit; or (b) a boat spccificd in a writtcn authority under regulation 132 whcrc that boat is to bc used

in place of a boat described in (a); "Commonwealth Fishing Boat Licence" means a licence issued pursuant to section 9 of the Fisher-

ies Act 1952 of the Commonwealth; "Commonwealth Fishing Permit" means a fishing permit issued pursuant to section 32 of the

Fisheries Management Act 1991 of thc Comrnonwcalth; "day" means a period of 24 hours or part thereof; "dcmcrsal linc" mcans a droplinc, longlinc or handlinc; "demersal scalefish" means any fish of the Families-Lutjanidae;

Lethrinidae; Serranidae; Nemiptetidae; Haemulidae; and Labridae;

"dropline" means a fishing line which is weighted at one end and which has not less than 6 hooks and not more than 30 hooks attached;

"exhausted" means the authority to use a fish trap or line which is conferred by a permit and expressed in terms of fish trap units or line units has been exercised in full in respect of the entitlement arising from- (a) the total number of fish trap units specified on the permit; or (b) the total number of line units specified on the permit,

as the case may be; "Fishery" means the Northern Demersal Scalefish Interim Managed Fishery; "fish trap" means-any device used for taking fish other than a hook and line, trawl net, gillnet,

haul net, purse seine net, or rock lobster pot as defined in the Fish Resources Management Regulations 1995;

"fish trap/dayn means one fish trap that may be used for one day; "fishing boat licence" means a licence referred to in regulation 117 of the regulations; "gear" means-

(a) a fish trap; (b) a dropline; or (C) a handline;

"handline" means a fishing line weighted at one end with not more than 6 hooks attached; "KGBMF licence" means a managed fishery licence which authorises the holder to take fish in the

Kimberley Gillnet and Barramundi Managed Fishery as identified in the Kimberley Gillnet and Barramundi Management Plan 1989;

"Kimberley Demersal Line Interim Managed Fishery" means the Fishery identified in the Kim- berley Demersal Line Interim Managed Fishery Management Plan 1995 published in the Ga- zette of 19 December 1995;

"licensed fishing boat number" has the same meaning as defined in the regulations; "licensing period" means the period from 1 January in any year to 31 December in the same year; "line" means a handline or a dropline; "line/dayn means one handline or dropline that may be used for one day; "longline" means a main line anchored to the sea bed at both ends and a t intervals along its

length, to which hooks or branch lines with hooks are attached; "measured length" means the measured length of the authorised boat as defined by and deter-

mined in accordance with the Department of Transport Instruction to Surveyors notice 7/87 (reworked 1994) effective 21 September 1994 as reworked or superseded from time to time;

"nominated fishing day" is a day on which a person intends to exercise the entitlement arising from a fish trap unit or a line unit conferred by a permit;

"nomination to fish" is a notification sent to the Fisheries Department Office in Broome via ALC in accordance with directions for use as specified in the regulations;

"permit" means an interim managed fishery permit which authorises a person to fish in the Fish- ery ;

"port area" means the area within 2 nautical miles of the areas described in Schedule 4; "reel" means a device used to store, carry, set or haul any gear; "regulations" means the Fish Resources Management Regulations 1995; "sacrificial latch" means a device which will unfailingly allow the door of a fish trap to open within

seven days should that fish trap be submerged at sea for longer than seven continuous days; "sct" in rclation to gear mcans to position or rclcasc, lcavc or allow to remain in thc waters of the

Fishcry;

"shark" means the fish of that common name described by scientilic classification opposite that name in column 2 of Schedule 7 of the regulations;

"statutory fishing return" means- (a) a written return made under and in accordance with section 18 of thc Fisheries Act 1905

and furnished to the Western Australian Fisheries Department; (b) a return made under and in accordance with regulation 64 of the regulations; (C) a "Northern and Western Non Trawl Fisheries Catch (Landings) Record" applicable to all

fish species excluding tuna and billfish which was required by the Fisheries Act 1952 (Commonwealth) or the Fisheries Management Act l991 (Commonwealth) as the case may be, to be completed by the holder of a Commonwealth Fishing Boat Licence o r Com- monwealth Fishing permit when fishing off the north coast of Western Australia east of 120" east longitude.

Procedure before amending this Plan 5. For the purposes of section 65 of the Act, the permit holders arc the persons to be consulted before this management plan is amended or revoked.

Identification of the Fishery 6. The Fishery to which this Plan relates is the fishing for any species of demersal scalefish by the use of a fish trap or demersal line in the waters described in Schedule 1.

Zones of the Fishery 7. The Fishery is divided into Zones as described in Schedule 2.

Fishery an interim managed fishery 8. The Fishery is an interim managed fishery.

Persons prohibited from fishing in the Fishery 9. (1) Subject to subclause (2), a person must not fish in the Fishery other than-

(a) in accordance with this Plan; and (b) under the authority of a permit.

(2) A person fishing in accordance with the Act for a non commercial purpose may fish in the waters described in Schedule 1.

Prohibition on fishing activities 10. A person shall not use or attempt to use a fish trap, handline or dropline in the waters described in Schedule 1 other than in accordance with this Plan.

Prohibition on selling, dealing in or purchasing demersal scalefish 11. A person must not sell, deal in or purchase any demersal scalefish taken from the Fishery unless the fish were taken by a person who holds a commercial fishing licence issued pursuant to the regula- tions and the fish were taken under the authority of a permit issued in accordance with this Plan and the Act.

Prohibited means of fishing in the Fishery 12. (1) A person must not fish in the Fishery by any means other than by a fish trap, handline or dropline.

(2) A person must not fish in Zone 1 by any means other than by handline. (3) The master of an authorised boat being used to fish for demersal scalefish-

(a) in Zone 1 must not permit more than five handlines to be used from that boat at any one time; or

(b) in Zonc 2 must not pcrmit- (i) more than five handlines or five droplines to be used from that boat at any one time; or (ii) lines and fish traps to be carried on or used from that boat at any one time.

(4) A person, authorised to use fish traps or lines under the authority of a permit, when using lines to fish in the Fishery-

(a) may leave the fish traps authorised to be used under the authority of that permit in an area of water specified in a notice ("a dump area") in writing given by a fisheries officer to the holder of that permit;

(b) must not leave any trap in any waters other than a dump area specified in a notice in writing gjven by a fisheries officer to the holder of that permit.

(5) A person must not leave fish traps in a dump area specified in a notice made under subclause (4) unless t h o ~ e fish traps are unbaited and the door of the fish trap is secured in the open position.

(6) Thc noticc in writing rofcrrcd to in subclausc (4) may bc rcpcalcd at any timc or amcndcd from time t o time by a further notice in writing from a fisheries officer to the permit holder.

(7) A person fishing from an authorised boat in Zonc 1 must not use a reel other than a manually powered reel to set or haul gear.

(8) A person must not use in the Fishery- (a) more than 5 handlines with more than six hooks attached to any handline; or

(b) more than 5 droplines with more than 30 hooks attached to any dropline. (9) Apcrson must not usc any gcar in thc Fishery othcr than gcar which is spccifjed as authoriscd

gear on the permit under the authority of which the person is fishing. (10) The master of an authoriscd boat must not permit the number of fish traps bcing-

(a) used in the Fishery from; and (b) the number of fish traps being carried on,

the authorised boat at any one time to be more than the number of fish traps which have been nomi- nated in accordance with clause 29 for use on that boat a t that time.

(11) A person must not use fish traps in Zone 1 of the Fishery. (12) A person must not, in the Fishery, use, set or pull, or carry on board an authorised boat any fish

traps or lines if' those fish traps or lines do not have attached a surface float which- (a) has a diameter of not less than 150 millimetres; and (b) is branded or stamped with the initial letter and the licensed fishing boat number for the boat

that is bcing uscd to fish in thc Fishery, and each character of thc brand or stamp must be legible and measure not less than 60 millimetres high and 10 millimetres wide.

(13) Notwithstanding the provisions of subclause (12) a person may fish from an authorised boat by means of a handline or dropline without a surface float attached provided that handline or dropline is attached to the boat.

(14) A person must not use a fish trap in the Fishery unless that fish trap- (a) has an internal volume equal to or less than 2.25 cubic metres; and (b) is fitted with a mesh which satisfies the specifications as described in subclause (16).

(15) Aperson must not use a fish trap in the fishery after 1 January 1999 if that fish trap is not fitted with a sacrificial latch.

(16) Each opening in the mesh of a fish trap shall be square with- (a) each side of the square being not less than 50mm in length; and (b) the measurement between diagonal corners of each square being not less than 70mm.

Use of boats 13. (1) A person shall not use a boat to fish in the Fishery unless the boat is an authorised boat.

(2) The master of an authorised boat must not allow that boat to be in the waters of Zone 2 if the entitlement on the permit on which that boat is specified has been exhausted and there are lines or fish traps on board the boat.

Requirement to install an Automatic Location Communicator 14. (1) The Executive Director may from time to time by notice in writing direct the holder of-

(a) a permit which authorises the holder of that permit t~ fish in Zone 1 of the Fishery where the boat length specified on that permit is greater than 8 metres in measured length; or

(b) a permit which authorises the holder of that permit to fish in Zone 2 of the Fishery, to fit and maintain an approved ALC on the authorised boat specified on that permit.

(2) Where an ALC is fitted in accordance with this clause the authority to fish conferred by a permit shall be of no effect unless that ALC has-

(a) been installed by an authorised installer in accordance with the approved specifications; and (b) is being operated in accordance with the approved directions for use.

(3) A reference to a Zone in the approved directions for use referred to in subclause (1) is a reference to a Zone as specified in Schedule 2.

Permitted and prohibited fishing areas 15. (1) Where the Executive Director is of the opinion that it is in the better interests of the F'ishery to do so, the Executive Director, following consultation with the persons specified in clause 5 , may by notice published in the Gazette-

(a) prohibit fishing in the Fishery or in any part of the Fishery; (b) permit fishing i.n the Fishery or in any part of the Fishery.

(2) A person must not fish in any part of the Fishery at a time when fishing in that part of the Fishcry has bccn prohibited by a noticc made under subclausc (1).

(3) The provisions ol'a notice made in accordance with subclause (1) may be made to apply at all times or at any specified time.

(4) A person must not fish by fish trap or line in the waters described in Schedule 3. (5) A pcrson must not fish undcr thc authority of a pcrmit in Bonc 2 of thc Fishery jf the cntitlcmcnt

conferred by fish trap units or line units which are specified on that permit for that Zone have been exhausted.

Permits 16. ( l ) A permit may be a Class A permit or a Class B permit.

(2) A Class A permit may authorise the holder to fish in Zone 1. (3) A Class R permit may authorise the holder to fish in Zone 2.

Criteria for a pcrmit 17. (1) An applicant for a Class A pcrmit must satisfy thc Executive Director that-

(a) (i) hc or she is thc holdcr of- (A) a current fishing boat licence and in respect of that licence, statutory fishing returns

were furnished to the Department which recorded a catch of demersal scalefish in each of any live months in each calendar year commencing 1 January 1992 and end- ing 31 December 1995 in the waters described as Zone 1 in Schedule 2; and

(B) a current managed fishery licence which authorises the holder t o fish in the Kimber- ley Gillnet and Rarramundi Managed Fishery;

or (ii) he or she is the holder of a current fishing boat licence and in respect of that fishing boat

licence statutory fishing returns were furnished to the Department which recorded a catch of demersal scalefish by line in any five months in each calendar year commencing 1 January 1992 and ending 31 December 1995 in the waters described as Zone 1 in Sched- ule 2;

(b) the fish referred to in (a) were recorded on statutory returns furnished to the Department prior to 31 March 1996; and

(C) the applicant applies for a permit before 31 December 1997. (2) An applicant for a Class B permit must satisfy the Executive Director that-

(a) (i) he or she is the holder of a current fishing boat licence; and (ii) that licence is endorsed to permit the holder to take fish by the use of a fish trap in

Western Australian waters off the north coast east of 120" east longitude. or

(b) (i) he or she is the holder of a current fishing boat licence that does not permit the holder to take fish by the use of fish trap in WA waters off the north coast east of 120°east longi- tude;

(ii) during the 4 year period commencing 1 January 1992 and ending on 31 December 1995 he or she was the holder of a- (A) Commonwealth Fishing Boat Licence; (B) Commonwealth Fishing Permit; (C) fishing boat licence issued under regulation 2 of the Fisheries Regulations 1938; or (D) fishing boat licence,

which, at the appropriate time permitted the holder of that licence or permit to fish by demersal line in the waters off the north coast of Western Australia east of 120" east longitude; and (iii) under the authority of the licence referred to in (i) and the licence or permit referred to in

(ii) fished not less than 3 out of those 4 calendar years and in statutory fishing returns recorded a catch of not less than 5000 kilograms of demersal scalefish by fish trap or demersal line in each of those 3 years;

(C) the statutory fishing returns referred to in (b)(iii) were furnished to the Department, Com- monwealth Australian Fishing Service or the Commonwealth Australian Fishing Manage- ment Authority (as the case may be) prior to 31 March 1996; and

(d) the applicant applies for a permit before 31 December 1997.

Duration of permits 18. A permit expires on 31 December of the year for which it was issued.

Fees for application and issue of permits 19. (1) The fee set out in Part 1 of Schedule 5 opposite a particular type of application is the fee to be paid to make that application.

(2) The fee set out in Part 2 of Schedule 5 is the fee to be paid in respect of the grant or renewal of that permit.

Items that may be specified on a permit 20. A permit granted or renewed in respect of the Fishery may specify the following -

(a) name and business address of the holder of the pcrmit; (b) name of the licensed fishing boat, licensed fishing boat number and length of any licensed

fishing boat which may be used for fishing in the Fishery under the authority of that permit; (C) the permit number; (d) the date of expiry of'the permit; (e) the name of the interim managed fishery to which the permit refers; ( f l the type of gear permitted to be used under the authority of the pcrmit; (g) the number of fish trap units or line units conferred by the permit; (h) any conditions imposed on the permit.

Capacity of the Fishery 21. (1) The capacity of Zone 2 of the Fishery shall be limited to the maximum number of fish trap/ days and lineldays that the Executive Director determines before each licensing period may be used in the Fishery during the following licensing period.

(2) A determination made under subclause (1) in relation to the maximum number of' fish trapldays may only be made after consultation by the Executive Director with the persons specified in clause 5 and advice fi-om the Department's Director Research Services and shall be calculated using the hollow- ing Sormula-

fish trap in Zone 2 of the Fishery; R = the estimated catching efficiency of a fish trap as determined by the Director of Research

Services and expressed as kilograms taken per day per fish trap; C - the capacity expressed as the total number of fish trap/days that may be used in the Fish.ery

during a licensing period. (3) A determination made under subclause (1) in relation to the maximum number of lineldays may

only be made after consultation by the Executive Director with the persons specified in clause 5 and advice from the Department's Director Research Services and shall be calculated using the following formula-

where A = the estimated Total Sustainable Catch, expressed in kilograms, of fish that may be taken by

line in Zone 2 of the Fishery; B = the catching efficiency of a line as determined by the Director of Research Services and ex-

pressed as kilograms taken per day per line; C = the capacity expressed as the total number of line/days that may be used in the Fishery

during a licensing period. (4) A determination made under subclause (1)-

(a) must be published by the Executive Director in the Gazette within 14 days of the making of the determination;

(b) may be made to take effect on gazettal or at a specified future time; and (c) revokes any previous determination.

Entitlement 22. (1) The authority to fish for demersal scalefish conferred by a Class B permit shall be limited by reference to a specified number of fish trapldays or line/days expressed in terms of fish trap units or line units.

(2) A person who satisfies the criteria specified in- (a) clause 17 (2), paragraphs (a), (c) and (d) may be granted a permit which specifies fish trap

units; (b) clause 17 (2), paragraphs (b), (c) and (d) and is not the holder of a current fishing boat licence

which authorises the holder to use fish traps in Western Australian waters off the north coast of Western Australia east of 120" east longitude, may be granted a permit which specifies line units or fish trap units; or

(c) clause 17 (2), paragraphs (a), (c) and (d) and holds an interim managed fishery permit which authorises the holder to fish in the Kimberley Demersal Line Interim Managed Fishery may be granted a licence which specifies fish trap units or line units.

(3) The number of fish trap units that are to be allocated to and conferred by a permit when that permit is first grantcd shall be dctcrmincd in accordancc with the following formula-

where- C = The first determination of the capacity of the Fishery expressed as a number of fish trapldays

determined in accordance with clause 21; D = The number of permits granted as at 1 January 1998 authorising the holder to use fish traps

in the Fishery; and E = Number of fish trap units to be specified on a permit at the commencement of this Plan.

(4) The number of line units that are to be allocated and conferred by a permit when that permit is first issued shall be determined in accordance with the following formula-

where- C = Capacity of the Fishery expressed as a number of line/days determined in accordance with

clause 21; D = The number of permits granted as at 1 January 1998 authorising the holder to use lines in

Zone 2 of the Fishery; and E = Number of line units to be specified on a Class B permit a t the commencement of this Plan.

(5) Any calculation made in accordance with subclause (3) or subclause (4) shall be rounded to the nearest whole number with 0.5 being rounded down.

Exercise of entitlement 23. (1) The entitlement conferred by a fish trap unit shall be exercised in full if the authorised boat specified on a permit that confers an entitlement to use fish traps is travelling in Zone 2 a t less than 4 knots per hour for a period of not less than l 5 consecutive minutes in any day as determined by a Fisheries Officer of the Fisheries Department.

(2) Thc cntitlcmcnt confcrrcd by a lino unit shall bc cxcrciscd in full if thc authorised boat spccificd on a permit is travelling in Zone 2 at less than 4 knots per hour for a period of not less than 15 consccutivc minutcs in any day as dctcrmincd by a Fishcrics Officcr of thc I'ishcrics Ucpartmcnt.

(3) Notwithstanding the provisions of subclause (1) a boat which is travelling at less than 4 knots per hour in a dump area as referred to in clause 12 shall not be taken to be used for fishing during the period i t is in the dump area.

Unit values 24. (1) At the commencement of this Plan the extent of the entitlement arising from a fish trap unit shall be 1 fish traplday which entitles the holder of a permit which specifies fish trap units to use 1 fish trap for one day for each fish traplunit that is specified on the permit.

(2) At the commencement of this Plan the extent of the entitlement arising from a line unit shall be 1 linelday which entitles the holder of a permit which specifies line units to use 1 line for one day for each line unit specified on the permit.

(3) In any licensing period after 31 December 1998 when a Class B permit is renewed, the extent of the entitlement to fish arising from a fish trap unit or a line unit shall be limited by reference to an allocation of fish trapldays or lineldays, as the case may be, as provided for in subclause (4) and subclause (5) respectively.

(4) The extent of the entitlement arising from a fish trap unit for each licensing period commencing on or after the licensing period commencing 1 January 1999 shall be determined using the following formula-

where A = Total number of fish trapldays calculated from clause 21; B = Total number of fish trap units in the Fishery; and C = Value of a fish trap unit expressed as a number of fish trap days.

(5) The extent of the entitlement arising from a line unit for each licensing period commencing on or after the licensing period commencing 1 January 1999 shall be determined using the following for- mula

where A = Total number of lineldays calculated from clause 21; B = Total number of line units in the Fishery; and C = Value of line unit expressed as a number of lineldays.

( 6 ) Any calculation made in accordance with clauses (4) or (5) that does not result in a whole number shall be rounded down to the nearest whole number.

Bycatch of shark 25. (1) The maximum quantity of shark that the master of an authorised boat may be in possession of on that boat is two whole shark or parts of shark that may be determined to be in aggregate no more than 2 wholc shark.

(2) If the fins of a shark have been removed from the shark then the trunk of the shark from which the fins were taken must be on board the boat while the fins from that shark are on that boat.

(3) Aperson must not mutilate, alter or disfigure any shark so that i t will prevent the determination of the number of shark that are on an authorised boat.

(4) A person fishing from an authorised boat which already has two shark on that boat, must, on becoming aware of taking any further shark, take immediate steps to return the shark to its natural habitat with the least possible injury.

(5) For the purposes of subclause ( l ), the master of the authorised boat on which the shark are h.el.d or transported is to be taken to be in possession of'the shark.

( 6 ) For tho purposo of this clauso "trunk" mcans thc body of a shark with cithcr thc h a d , visccra and fins removed or any combination of those three items removed.

Temporary transfer of entitlement 26. Where the holder of a Class U permit applies to transfer specified units for a limited period to the holder of another Class B permit and-

(a) the application is for a whole number of units; and (b) the entitlement conferred by the specified units has not been exercised;

(C) the application refers to units which, at the time the application is received by the Executive nirector, are not the subject of a nomination to fish as specified jn clause 29,

the Executive Director may transfer those units for a specified time.

Grounds for refusal to transfer entitlement 27. The Executive Director may refuse to transfer part of an entitlement from one permit to another permit if the proposed transfer is not for the transfer of a whole number of units.

Grounds to cancel a permit 28. It shall be grounds for the Executive Director to cancel-

(a) a Class A permit if- (i) the permit was granted under the criteria specified in clause 17(l)(a)(i) and the holder of

that permit also ceases to hold a KGNBMF licence; or (ii) the permit was granted under the criteria specified in clause 17(l)(b)(ii) and the holder of

that permit ceases to hold the fishing boat licence that was used to satisfy the criteria specified in that clause; or

(b) a Class B permit if the Executive Director transfers all the entitlement from that permit.

Nomination to fish 29. (1) A person must not allow an authorised boat, which is a boat specified on Class B permit, to be in the waters of Zone 2 unless a nomination to fish has been given and is in effect in accordance with this clause.

(2) A nomination must be made in accordance with any relevant requirement in the approved direc- tions for use referred to in clause 14 and-

(a) must be made before the authorised boat leaves a port area; (b) must be made only in relation to the intended fishing activities to be undertaken during that

trip. (3)Anomination must specify each day during which the holder of the permit intends to fish and the

extent (by reference to the number of fish trap units or line units) to which the permit holder intends to fish during each day specified in the nomination.

(4) Anomination is only of effect where the minimum number of traps to be used is not less than 20. (5) A new nomination is only of effect-

(a) where the master of an authorised boat considers i t appropriate to cease fishing and advises the Broome Regional Department Office-

(i) that he or she is ceasing fishing; (ii) that fishing is ceasing on that nominated fishing day;

(iii) of the current position of the authorised boat in terms of latitude and longitude; (iv) of the estimated weight and composition of fish on board the boat; and (V) the intended destination and time of arrival of the boat; or

(b) where the Executive Director considers that a new nomination is appropriate. (6) For the purpose of determining the exercise of entitlement following a nomination to fish made in

accordance with subclauses (1) and (2), fishing shall be taken to have commenced and the entitlement conferred by a fish trap unit or a line unit exercised in full when the boat-

(a) is in the waters of Zone 2; and (b) is travelling at less than 4 knots per hour for more than 15 consecutive minutes in any day;

and (C) is not in a dump area.

(7) The master of an authorised boat, on any day which is not a nominated fishing day in relation to that boat, must not allow that boat to be used to take fish by line or trap a t any time in the waters of Zone 2 of the Fishery.

(70) For the purposes of this clause "new nomination" means a nomination which is intended to supersede a nomination made in accordance with subclauses (2) to (4) of'this clause.

(11) If a new nomination refers to units that were the subject of a previous notification, the nomina- tion is only of effect if the new nomination is made while the authorised boat specified on the relevant nomination is still in port.

Offences and major provisions 30. A person who contravenes a provision of clause 9, 10, 11, 12, 13, 14, 15,25,29(1), 29(2) or 29(7) commits an offence and for the purposes of section 75 of the Act these are major provisions.

Revocation 31. Tho Kimberley Uemersal Line Interim Managed Fishery Management Plan 1995 published in tho Gazette of 19 December 1995 is revoked.

City of South Perth Local Law Relating to Dogs

No. 2 of 1997 In pursuance of the powers conferred upon it by the Local Government Act, 1995 and of all other powers enabling it, the Council of the City of South Perth hereby records having resolved on 26 November, 1997 to make the following Local Law :-

Short Title 1. This Local Law may be cited as the Dog Local Law 1997.

Commencement 2. This Local Law comes into operation fourteen days after the date of its publication in the Government Gazette.

Content and Intent 3. The purpose and intent of this Local Law is to provide for the control, registration, ownership and keeping of dogs within the district.

Repeal 4. The Local Law Relating to Dogs as published by Council in the Government Gazette on 29 August, 1980 as amended, and all of the Council's other Dog Local Laws are hereby repealed.

Definitions 5. In this Local Law, unless the context requires otherwise-

"Council" means the Council of the City of South Perth; "district" means an area of the State that has been declared to be a district under the

Local Government Act 1995, and includes for certain purposes provided for i n this Act other areas which although not bcing within the boundaries of a district arc regarded for those purposes as being part of the district;

"Dog Act" means the Dog Act 1976, as amended; "person liable for the control of the dog" means each of the following-

(a) the registered owner of the dog; (b) the owner of the dog;

(c) the occupier of any premises where the dog is ordinarily kept or ordinarily permitted to live; or

(d) a person who has the dog in his possession or under his control; but does not include- (e) a registered veterinary surgeon, or a person acting on his behalf, in the course

of his professional practice; or ( f ) a police officer or other person acting under a statutory duty or in the admin-

istration of the Dog Act; "public place" means any place to which the public has access; and "authorised person" means a person who is appointed by a Council, to exercise powers

on behalf of the Council, under section 29(1) of the Dog Act.

Pound 6. The Council may establish and maintain a pound or pounds for the impounding of dogs pursuant to the provisions of the Dog Act. The pound established by the Council on Re- serve No. 26917 being part of Lot 3816 of Swan Location 40 within the district of the City of South Perth has been established as a pound.

Fees Chargeable 7. The fees to be charged to the owner of a dog when that dog is, pursuant to section 29 of the Dog Act-

(a) seized and returned to the owner of the dog; (b) detained in the pound; andfor (C) destroyed

are those specified in the First Schedule hereto. Those fees shall be paid upon the return of the dog to the owner, upon release of the dog, or upon destruction of the dog, as the case may be.

Number of Dogs 8. An occupier of premises within the district shall not keep or permit to be kept on those premises more than two dogs over the age of three months and the young of those dogs under that age.

Prohibited Areas 9. A person liable for the control of a dog shall not permit that dog to enter or remain in any part of those portions of the district as set out in the Second Schedule hereto.

Dog Exercise Areas 10. The lands specified in the Fourth Schedule are designated as Dog Exercise Areas.

Dog Excreta 11. Any person liable for the control of a dog within the district shall remove the excreta of that dog from any street, public place or any land, unless otherwise permitted by the occupier of the land.

Penalties 12. (1) Any person who commits a breach of any provision of this Local Law commits an offence and shall upon conviction be liable to a penalty not exceeding $2,000.00. (2) The offences described in the Third Schedule are prescribed pursuant to section 51(b) and 5l(c) of the Dog Act as oKences in relation to which a modified penalty applies and the amount appearing directly opposite each such offence is the prescribed modified penalty payable in respect of that offence. (3) (a) Where an authorised person has reason to believe that a person has committed an offence against this Local Law as prescribed in clause 13, he may serve on that person an infringement notice and the infringement notices issued under this Local Law shall be substantially in the form depicted in Form 7 of the First Schedule of the Dog Act Regula- tions, 1976. (b) An infringcmcnt notice may be scrvcd on an allcgcd offcndcr pcrsonally or by posting it to his address as ascertained from him, at the time of or immediately following the occur- rence giving rise to the allegation of the offence, or as rccordcd by Council pursuant to the Dog Act. (C) Where a person who receives an infringement notice fails to pay the prescribed penalty within the time specified in the notice, or within such further time as may in any particu- lar case be allowed, he is deemed to have declined to have the allegation dealt with by way of a modified penalty. (d) An alleged offender on whom an infringement notice has been served may, within the time specified in that notice or such further time as may in any particular case be allowed, send or deliver to the Council the amount ofthe prescribed penalty, with or without a reply as to the circumstances giving rise to the allegation, and the Council may thereupon-

(i) appropriate that amount in satisfaction of the penalty and issue an acknowledg- ment; or

(ii) withdraw the infringement notice and refund the amount so paid.

(e) An infringement notice may, whether or not the prescribed penalty has been paid, be withdrawn by the Council by sending a notice in the prescribed form to the alleged of- fender at the address specified in the notice or his last known place of' residence or busi- ness. (f) The prescribed form of Withdrawal of Infringement Notice issued under this Local Law shall be substantially in the Ibrm depicted in Form 8 ol'the Firs.t Schedule of the Dog Act Regulations, 1976.
