Baer,Assistant United States Attorney for the Southern Districtof West Virginia, recommending that a Presidential Warrantbe issued for the' apprehension of the above-named subject.The reconmendation was stated to be based upon a FederalBureau of Investigation report identified as follows:

CURTIS s t e.t ed t ha t they had carefullys tud.ied the instructions issued to United. Sta.tes Attorneys bythe Attorney-General, and in addition thereto r~d carefullystudied the statutes relating to the is~uance of search ~~rrants,

which statutes ar-e conte.ined in Section 612, Ti t Le 18, USCA.They had also studied carefully Sections 21, 22, 23, and 24 ofTi t l,e 50 upcn which statutory authori ty the Pre s i.dcn t.La.L ProcLama­tion was issued by the P~esident.

After a careful study of this ~'1.tter they reached theconclusion that it was not pos sible to issue a search ...,rarr8.nt ininstant matter. They of course pointed out the necessity of havingto ob tafn a. search war-rant f ro n the Uni ted States Commissioner uponprobable cause being sho~m that a particular article or articles

.... had been used in connection ~ri th the commission of a felony offense.

It was ~ointed out tr~t the aforementioned sections ofTitle 50 give no indication that the possession of any~of the pro­hibi ted. articles under the Presidential Pro cLama t Lcn consti tutesa felony offense, but as a matter of fact, the procedure institutedis to intern the alien enemy. Both Hr. HILLER and Hr. CURTIS felt

. that there 'Has no stetutory author! t~.. for the issuance of judici~vl

-:'-' sear-ch warrants on a matter of this nature, and therefore declinedthe authorization for the issuance of such a warrant. They both

., indicated that they were anxious to cooperate with this Bureau in.every possible way but felt that they wero "'rithout statutory auth­ority to au.tho r i ze the Ls suance of the requested jud.icial searchwarrant , They of course pointed out the fact tb.at the use ofPresidential search warrant s has not t hus far been authorized in theState of Ohio.

Under the above conclusion reacheo. by the United StatesAttorney it ,·,rill obviously be impossible for this office to engagein multiple spot searches of premises of alien enemies, even wher-es-pecific complaints have been received to the effect that alienenemies have in thei r possession any of the enume re.t ed articlesprohibited under the Proclam8.tion.
