Rev. 6/9/20 Page 1 of 7 Private Cart Use Regulations Authority The Operating Agreement for Hartness and the Residential Declaration promulgated pursuant to the Operating Agreement vest in the Hartness Neighborhood Association (“the Neighborhood Association”) and its designees the authority to make and enforce rules and regulations regarding the use of privately- owned electric carts by property owners within Hartness (the “Community”) on roads or other designated areas within the Community. Electric Cart Specifications To receive approval for a Private Cart Decal to operate a privately-owned electric cart, an Owner’s electric cart must be equipped with and meet the specifications set forth in the attached Exhibit A. Insurance An Owner shall maintain a liability insurance policy that ensures the Owner or designee and any other users of a privately-owned electric cart while the electric cart is being operated in the Community. The policy shall have limits of liability of at least $100,000 for bodily injury and property damage per occurrence. South Carolina Golf Cart Permit Registration An Owner shall maintain a SCDMV golf cart permit, renewable every five years and posted on the cart. Approved Roads, Paths and Trails A Private Cart Decal will entitle the Owner of an electric cart to utilize the roads within the Community and certain paths located in the Hartness Preserve (“Preserve”) designated with a golf cart symbol on the marker of the pathway entry point. Privileges Upon approval of the Application and placement of the Private Cart Decal on the electric cart, an Owner and any other person who has a valid automobile driver’s license may operate the electric cart. Violation of the Rules & Regulations Violation of any rules and regulations regarding electric cart use in the Community may result in the revocation of an Owner’s Private Cart Decal. Surrendering of the decal must be made within 14-days to the Neighborhood Association Manager. Failure to do so will result in a $100 fine and a lien may be placed on the property until fine is paid and decal surrendered. Re-application for a Private Cart Decal may be made after six months. Damage Any damage caused by an Owner or anyone utilizing such Owner’s electric cart will be promptly repaired by the Owner at Owner’s sole cost and expense. Failing to do so, the Neighborhood Association may make the repairs and bill the Owner for the costs of the same. If Owner fails to reimburse the Neighborhood Association for such repairs within thirty (30) days of the Neighborhood Association providing the Owner with a statement thereof, such amounts shall be deemed as a “Specific Assessment” under the Charter and shall be an automatic lien on the Owner’s property.

Safe Operation and Driving Policy

• Carts are to be operated with the utmost courtesy, care and consideration for the safety of theoperator, passengers, pedestrians and Hartness property.

• Pedestrians shall be given the right-of-way at all times.

• Number of passengers per vehicle shall not exceed the seating designation or capacity.• No one under the age of sixteen (16) is allowed to operate a cart.

• A valid driver’s license is required to drive a cart.

• Carts will be driven in compliance with the common “rules of the road,” adhering to all traffic lawsand regulations, regardless of whether they are being operated on alleyways, roadways or Preservecart paths.

• Cart operators must reduce speed on roadways and Preserve cart paths when pedestrians arepresent, maintain safe distance between golf cart and pedestrian, follow street driving rules anddrive on right side of roads/paths.

• Carts may not be driven on sidewalks, grand lawn, green streets, courtyards, event lawn or greenspaces of community parks.

• All occupants in the golf cart shall keep hands, arms, legs and feet within the confines of the golfcart at all times when the cart is in motion.

• Never back up without first making sure there is no person or obstructions behind the cart.

• Reduce speed to compensate for inclines, corners, bumps/rough terrain, pedestrians, and especiallyon wet/icy conditions.

• Avoid abrupt stops (skidding), high speed turns and any form of horseplay.

• Avoid driving over sprinkler heads, drain covers and avoid turf (grass) during wet conditions.

• Do not jump curbs or other obstacles.

• Be certain to set the brake whenever stopping and leaving the cart.

• Drivers and passengers must remain seated whenever the vehicle is moving. Do not stand on orride on the bumpers, fenders or rear storage area.

• Any time a cart is unattended the ignition shall be turned off and the key removed from theignition.

• Drivers of carts that are not equipped with turn indicators shall use appropriate hand signals.

• Items being transported must be placed in the rear box and/or properly secured. Neither cargo norpassengers shall be placed on the roof of the cart.

• Carts shall only be parked in designated parking spaces.

• Carts shall not be parked in fire lanes. Carts parked in handicap parking spaces must have the properpermit. Carts shall not be parked in any manner that blocks the normal flow of pedestrian trafficor building entrance and exits, or on sidewalks or ramps that would impede pedestrian or handicapaccessibility.

Private Cart Use Regulations Exhibit “A”

All privately-owned electric carts operated in Hartness must meet the following specifications in order to be approved for a Private Cart Decal:

1. Electrically powered. No gas operated carts are permitted.

2. Maximum Speed of 25 mph

3. Four (4) wheels; 4-ply tires, maximum 13-inches

4. Mechanical drum-type brakes with hill brake

5. Automotive-type steering

6. Forward and reverse gears

7. Hub caps

8. Plastic or fiberglass body

9. While there exists no mandate on preferred body colors, custom accents (e.g. slogans, emblemsor logos, etc.) found to be profane, obscene, racist, sexual, defamatory, or otherwise offensivewill not be allowed.

10. No Passes other than Hartness Private Cart Passes are allowed

11. Headlight and taillights are required

OPERATING RESTRICTIONS

The Permit Registration must be carried when the golf cart is operated. To be operated during daylight hours only. Operator must have a valid driver’s license and must be at least sixteen years of age.

The driver’s license must be in the operator’s possession.

May be driven on a secondary highway or street for which the posted speed limit is thirty-five miles an hour or less, within 4 miles ofresidential or additional address noted above.

May cross a highway or street at an intersection where the highway has a posted speed limit of more than thirty-five miles an hour. Upon sale of the golf cart, immediately notify the Department of Motor Vehicles in writing giving the name and address of the new

owner, with date of sale. Remove the assigned permit decal from the golf cart upon sale.
