issue auth orization if it is conv inced that thep ro ject wi ll no t cause negat ive impacts ;

(b ) app rove th e p ro je ct a nd is su e authoriz ation w ithconditions that m ust be fulfilled in order toe lim in ate o r r educ e adver se limpac ts or re duceadver se impacts to in sign if icance if i t i s conv in -ced that the negat ive impact s can be e ff ec tivelycountered , or

(c) refuse implementation of the project if it isconv inced that the negative im pact cann ot b estasifactoriey avoided

10. Validity of Approved Environm ental Im pact StudyReport1 ) The Auth oriza tio n o f a n en viro nmen ta l impac t stu dy

report shall expire if the project has not beenimp lemen ted a ccor ding to th e time fr ame s et dur ingits authorization.

2) Any proponent who w ishes to challenge the ap-p ro priaten ess o f th e p ro visio n o f S ub A rtic le (1 ) o fth is Ar ti cl e, t o h is p ro ject , may submit an app licat ionto tha t e ff ec t t o the Autho ri ty o r the rel evan t r eg ionalenv ironmen ta l agency, a s may be approp ria te .

3) W ithin 30 days from the receipt of an applicationpursuant to Sub Article (2) of this Article, theAuth ority o r th e re le va nt re gio na l e nv iro nmen talagel}cyshall ,unless specia l c ircumstance so dic ta te ,d ec id e wheth er to extend th e valid ity o f th e repo rt o rto order th e revisio n o r the red oin g of the env iron -menta l impact assessment .

mon itoring o r an y d ecision of th e A utho rity o r therelevant r eg ional env ironmental agency regardingthe project m ay subm it a grievance notice to thehead of the Authority or the relevant regionalenv ironmental agency, a s may be appropr ia te .

2 ) T he d ec isio n o f th e h ead o f th e Auth ority o r relev an tre gio na l en viro nmen ta l a ge ncy sh all, as p ro vid edunder Sub A rticle (1) above, be issued w ithin 30days fol lowing the receipt o f the g ri evance .

PART SIX18. Offences and Penal ties

1) W ithout prejudice to the provisions of the PenalCod e, a ny p erso n who v io la te s th e p ro visio n o f th isP ro clamatio n o r o f an y o th er relev an t law o r d irec -ti ve commi ts an o ff ence and sha ll be l iabl e accordin -gly.

2) A ny person w ho, w ithout obtaining authorizationfrom the Au thor ity o r th e re le vant re giona l env iron-m ental agen cy, or m ak es false p resentation s in anenv ironmental impact a sses smen t s tudy report com-m its an offence an d sh all be liable to a in of not lessthan fifty thousand birr and not more than onehundred thousand Bir r.

3) Any person commits an offence if he fails to keeprecords or to fulfill conditions of authorizationissu ed p ursuant to this P ro clam ation and shall b elia ble to a fin e o f n ot le ss th an ten th ou sa nd B irr an dnbt mo re th an twenty thou sand B irr.
