RESOLUTION NO. 1 : Considered and approved the monthly accounts for the period for August, 2019.

2. MUNICIPAL CORPORATION PRATAPGARH V/S. SHRI PRADEEP PATIDAR AND SH. MUKESH MOHIL AGAINST G.S.T.

Reference letter No. AAR/14/MCP/2018-19/91-94 Dated 15.03.2019 received from Rajasthan authority for advance ruling Goods and Services Tax, Kar Bhawan, Ambedkar Circle, Near Rajasthan High Court, Jaipur (Rajasthan) Advance ruling No. RAJ/AAR/2018-19/37 Dated 14.03.2019.

As per para 5 (i) of said order, pure services provided by the vendor (Municipal Services) shall attract NIL rate of tax and provisions of GST. TDS will not be applicable. However, before taking any action on GST deduction/payment, legal opinion from CGSC may be taken.

Relevant file is placed on the table to decibel further action in the matter.

RESOLUTION 2 : Considered and resolved that legal opinion from CGSC may be taken on applicability of, order of ruling dated 14.03.2019 and making payment of fee for opinion, as per rule. Further action be taken after receipt of opinion.

3. NOTING AND CONFIRMATION OF CIRCULATION AGENDA NO. 01 DATED 16.09.2019 :

To note and confirm the Circulation Agenda No. 01 dated 16.09.2019 Cantonment Board, Ajmer regarding Preparation of ordinary election to Cantonment Boards and requirement of delimitation of ward is not required in Ajmer Cantonment.

RESOLUTION 3 : Noted and approved.

4. LEVYING OF USER CHARGES FOR DOOR TO DOOR GARBAGE COLLECTION IN CANTONMENT AREA :

Reference Cantonment Board Res. No. 14 dated 29.08.2019. The following rates collection of user charges are proposed, on the basis of user charges received from office Ajmer Municipal Corporation:-

RESOLUTION 4 : Issue again discussed at length. The elected members are not in favour of imposition of user charges for Door to Door collection of garbage. The member secretary again emphasized the need to impose user charges as board already making payment to vendor for door to door collection of garbage and on account of which, the Paltan Bazar looks very clean. However President Cantonment Board, instructed all members to intimate, a reasonable amount to be charged, from users and the same shall be intimated to members Secretary (Chief Executive Officer) by 30th Sept. 2019. But none of members did the same. May be reviewed in next meeting.

5. STICHING OF SUMER & WAINTER UNIFORM OF CANTONMENT BOARD EMPLOYEES. To consider the matter for stitching of summer & winter uniform for 11 Men and 2 female

employees of Cantonment Board, Ajmer who are entitled for uniform during the year 2019-20. In this connection, there are 3 quotations were received. The rates are as below:-

RESOLUTION 5 : Considered and approved.

6. ESTABLISHMENT: ENGAGEMENT OF CHARTERED ACCOUTANT (EXTENSION): Reference Cantonment Board Res. No. 02 dated 29.08.2019.

The time period of Smt. Khushboo Jindal, Charted Accountant (on contract basis) is expiring on 18.10.2019. However, as per directions of higher authorities the ABAS is still in progress. The contract need to be extended for 03 months w.e.f. 19.10.2019

The relevant file are placed on the table to decide further action in the matter.

RESOLUTION 6: Considered and approved.

7. ESTABLISHMENT: DATA ENTRY OPERATOR FOR ABAS WORK: Reference Cantonment Board Res. No. 03 dated 29.08.2019.

The time period of Shri Mayank Goyal, Data entry operator (on contract basis) for ABAS work is expiring on 24.10.2019. However, as per directions of higher authorities the ABAS is still in progress. The contract need to be extended for 03 months w.e.f. 24.10.2019

The relevant file are placed on the table to decide further action in the matter.

8. ENGAGEMENT OF DATA ENTRY OPERATOR CUM CLERK IN OFFICE OF CANTONMENT BOARD AJMER :

As there was urgent need for a Data Entry Operator in office, as a number of clerical posts lying vacant, a data entry operator was engaged w.e.f. 08.08.2019 on prescribed rate from vendor Mis Ram Kanwari, Bhunabai, Jaipur Road, Ajmer. The engagement of Data Entry Operator is inheritable in view of number of activities I agenda's assigned by DGDE I PDDE viz. S.H.S., 150th year celebration of birth anniversary of Mahatma Gandhi, Jal Shakti Abhiyan etc in addition to routine correspondence and office work.

The relevant file is placed on table to decide further action in the matter.

RESOLUTION 8 : Considered and approved.

9. SUPPLY OF MAN POWER IN CANTONMENT BOARD, AJMER:

Reference this office letter No. I/42/CA-AJ/2018-19/335, dated 05th November, 2018.

To consider extension of the time period for supply of Manpower of Mis Ram Kanwari, Shiv Mandir Ki Gali, Bhunabai, Jaipur Road, Ajmer, as the same is expiring on 30.09.2019, till the new tenders are floated and finalised for manpower supply by the Board.

A minimum period of 03 months, on same terms and conditions is proposed.

RESOLUTION 9 : Considered and approved. The manpower supplier contract be extended for 03 months w.e.f. 01.10.2019 but within this period the new tender process shall be completed. Tt was emphasized by President Cantonment Board that since. "No Lineman" for electric works/maintenance is available in Ajmer Cantonment Board and also "No lineman/plumber/valve man" is there, in next tender these two additional manpower be hired through contractor, to ensure effic ient and prompt service related to electricity and water supply, being essential services.

10. INSTALLATION OF IRON RAILING AROUND CHABUTRA:

The Vice President and elected members have requested for promising ofrailing around Old Pipal Tree (chabutra) so that people can perform rituals safely. They also requested for development of surrounding area.

To consider and approve the matter for installation of iron railing opposite to House No. 75, Paltan Bazar, Ajmer, and lying of stones around chabutra.

RESOLUTION 10 : Considered and approved that for improvement of general area around Pipal tree and for fixing iron railing on chabutara, Chief Executive Officer is authorized to take action · and make payments as per procedure/rule position.

11. INSTALLATION OF SUBMERSIBLE PUMP IN BORE WELL OF HAND PUMP & FIXING OF WATER TANK (SINTEX TYPE):

To consider the request of Vice President and other elected members of Board, the matter for purchase following material for installation of submersible pump and the water tanks (plastic) near hand pumps, etc is proposed -1. Texmo make borewell submersible motor single phase 1 H.P. - 02 Nos. 2. l" P.V.C. appr. 400 ft. - 400 ft . 3. Submercible cable 2.5 sqm.X3 core - 400 ft. 4. TufRassa - 400 ft. 5. Panel L&T single phase/3 phase - 02 Nos.

Labour charges extra. The quantity of above items may increased or decrease as per actual requirement.

RESOLUTION 11 : Almost all elected members raised this issue and desired that a submersibl~ pump with over head syntax or like tank be fitted at, minimum 03 locations in Paltan Bazar. The President Cantonment Board directed in view of above to do needful, but cost of each setup (pump + tank etc.) shall not exceed Rs. 35 ,000/- Chief Executive Officer is authorised to get work done and payment be made as per policy and rule position.

12. UNAUTHORISED CONSTRUCTION IN HOUSE NO. 73, PALTAN BAZAR, AJMER

Reference this office letter No. ~ ~ 73/580 dated 01.03.2019, notice under sub section 248(1) letter No. ~ ~ 73/77 dated 27.08.2019 and C. B. RES. No. 14 dated 19.02.201 9, the notices was issued to Shri Kailash Chand Vijay H.No. 73 , Paltan Bazar, Ajmer under section of Cantonments Act, 2006 for un-authorised construction.

As per C.B. Res. No. 14 dated 19.02.2019 for re-erection of House No. 73 under section 235 of Cantonment Act 2006, building application was rejected and returned to the applicant for first getting the land position regularized, as advised by the Defence Estate Officer, Jodhpur. Submitted plan was not Sanctioned. However it is reported that despite rejection of building plan the applicant has constructed house.

Multiple notices were issued to stop the work, but construction work is almost completed. Relevant fi le/notices kept on table, the Board has to take decision on unauthorised construction.

RESOLUTION 12 : It is brought out by member Secretary that the board earlier vide Cantonment Board Resolution No. 14 dated 19.02.2019 rejected the building application submitted by Shri Kailash Chand Vijay but despite that, the applicant has constructed the house which is a serious violation of existing land policy. It is further emphasized by member Se~retary that the unauthorised constructions shall not be tolerated and strict action be taken on this, to set an example. The Pres ident Cantonment Board supported the stand taken by member Secretary, but the elected members some-how said, that the occupants/applicants are residing in this area for the last 25-30 years and on old house was these. The applicant/Mr. Kailash Chand Vijay has only re­constructed the house on same plinth area. No encroachment has been done by him. The members Secretary not accepted the same.

There was a long heated arguments, between elected members, and member Secretary. The President Cantonment Board supported views of member Secretary and apprised the board that un­authorised constructions and encroachment on land, shall not be tolerated at any cost.

Since due to paucity of time, no final decision could be taken, it was decided to review this issue in next meeting with complete file of property, GLR Survey No. 20-73 on table.

13 . UNAUTHORISED CONSTRUCTION IN HOUSE NO. 74, PALTAN BAZAR,AJMER

19.02.2019, the notices was issued to Smt. Sarla Vijay, H.No. 74, Paltan Bazar, Ajmer under section of Cantonments Act, 2006 for un-authorised construction.

As per C.B. Res. 14. UNAUTHORISED CONSTRUCTION IN HOUSE NO. 42, PAL TAN BAZAR, AJMER

Reference this office letter No. ABC/Engg./Building/H.No.42/58 dated 07.08.2019, notice under Sub Section (1) of Section 248 of Cantonment Act, 2006 letter No. ABC/Engg./Building/H.No.42/86 dated 22.08.2019 and letter No. H.No.42/ID-56/82 dated 28.08.2019, the notices was issued to Shri Vijay Kumar Vijay s/o Shri Ramgopal Vijay H.No. 42, Pal tan Bazar, Ajmer under section of Cantonments Act, 2006 for un-authorised construction.

Shri Vijay Kumar Vijay asked for repairing work of house dated 20.05.2019, instead of repairing the whole structure is demolished and newly constructed from plinth level. Multiple

notices were issued to stop the work and notice for demolition of encroachment area on date 29.08.2019 result of which applicant give written letter to remove his previous encroached area but he doesn't and the work is in progress.

RESOLUTION 14 : The Member-Secretary again taken a serious view and informed the board, if despite notice Under Section 248(1), the applicant do not stop work and do not demolish the same at his/her own, the Chief Executive Officer may go ahead with demolition of construction being carried out, without sanction. All elected members requested not to proceed with demolition and assured that work will be stopped by Shri Vijay Kumar Vijay S/o Shri Ramgopal Vijay immediately and he will apply for regularization of un-authorissed construction. The President Cantonment Board also instructed that this case shall be reviewed in next board meeting as there was paucity of time. After assurance by Vice President and other elected members, the progress be reviewed in next board meeting.

15. ENCROACHMENT BY SH. TARARCHAND AHIR S/O LATE SH. GOPILAL AHIR NEAR GROUP LATRINE OPP. HOUSE NO. 77 P ALT AN BAZAR, AJMER

Reference office of CEO Ajmer letter No. ~/3lff1CJ51i 01/589 dated 12.03.2019, the notice was issued to Shri Tarachand Ahir s/o Late Shri Gopilal Ahir under relevant section of Cantonments Act, 2006, for un-authorised construction on government land near group latrine, Paltan Bazar, Ajmer Cantt.

The said un-authorised construction was earlier removed by the Cantonment Board Ajmer but he again constructed the whole structure. The construction work is almost completed and finishing work is in progress.

The board has to take decision to protect interest of Govt.

RESOLUTION 15 : The Member-Secretary again taken a serious view and inform~d the board, if despite notice Under Section 248(1), the applicant do not stop work and do not demolish the same at his/her own, the Chief Executive Officer may go ahead with demolition of un­authorised construction being carried out without sanction. All elected members requested not to proceed with demolition and assured that work will be stopped by Shri Tarachand Ahir S/o Late Shri Gopilal Ahir immediately. The defaulter shall submit application/building plan for its regularisation as per procedure. The President Cantonment Board also instructed that this case shall be reviewed in next board meeting as there was paucity of time.

16. ENCROACHMENT BY SH. MAHESH KUMAR S/O SH. GYARSHI LAL OPP. TO HOUSE NO. 77 PALTAN BAZAR, AJMER

Reference this office letter No. ACB/Engg./Building/Ench/15/68 dated 22.08.2019 and office letter No. ACB/Engg./Building/Ench/15/80 dated 28.08.2019, the notices. were issued to Shri Mahesh Kumar s/o Shri Gyarshi Lal under section of Cantonments Act, 2006 for un­authorised construction on government land opposite to H. No. 77, Paltan Bazar, Ajmer Cantt.

Shri Mahesh Kumar lives on Encroached area of Government Land, and now he is constructing first floor on it. Multiple notices were issued by the CB Office to stop the work but the work still in progress.

Gyarashi Lal immediately. The President Cantonment Board also instructed that this case shall be reviewed in next board meeting as there was paucity of time.

17. ORIENTATION PROGRAMME FOR ELECTED MEMBERS: NON SUBMISSION OF CLAIM AGAINST ADVANCE

Reference Cantonment Board, Ajmer Circulation Agenda No. 01dated03 June, 2015.

2. The elected members of Cantonment Board, Ajmer were paid advance of TA/DA Rs. 7000/- each, for attending Orientation programme which was held at Pune for two days i.e. on 08th & 9th June, 2015. The Hon'ble RM was Chief Guest of the said programme.

3. All 6 elected members were reminded vide following letters for submitting their TA/DA claims against the advance given :-

(i) letter No. l/5/ca.aj/226, dated 01.09.2015 (ii) letter No. l /5/ca.aj/328, dated 16.03.2016 (iii) letter No. l /5/ca.aj/34, dated 09.06.2016 (iv) letter No. 1/5/ca.aj/72, dated 03.08.2016 (v) letter No. 1/5/ca.aj/553, dated 08.02.2019

4. Local Audit Officer (A), Nasirabad vide their letter No. LN/290/10/2015 TO 3/2016 DATED 29.04.2016 objected for non submission of claim by members which is still outstanding against Cantonment Board, Ajmer.

5. Further PD,DE, SC, Pune vide letter No. 20940/ADM/OP/DE, dated 15th June, 2015 intimated that following four elected members did not pay their room rent while vacating the rooms and the same was therefore paid by this office through RTGS on 18.06.2015 (Rs. 17,556.00) :-

RESOLUTION 17 : All elected members assured that they will submit their T AIDA claims before next board meeting, duly attaching the tickets etc. However the same need to be reviewed in next board meeting.
