QUESTION: DOES THE HIPAA PRIVACY RULE PERMIT A COVERED ENTITY (TMMC) TO CONSULT, DISCLOSE OR RELEASE PROTECTED HEALTH INFORMATION (PHI) ABOUT A PATIENT, TO ANOTHER HEALTHCARE PROVIDER (HOSPITAL, NURSING HOME, PHYSICIAN, ETC) FOR TREATMENT, PAYMENT and/or HEALTHCARE OPERATIONS (TPO) WITHOUT THE PATIENT’S AUTHORIZATION? ANSWER: Yes, The Privacy Rule permits a covered entity to disclose or release Protected Health Information (PHI) about a patient, without the patient’s authorization, to another health care provider when the request for PHI is for Treatment, Payment or Health Care Operations (TPO). Healthcare facilities may ask the other healthcare facility to provide verification the request for PHI is for TPO reasons. The patient must sign a HIPAA Authorization for Use or Disclosure of PHI, when the disclosure of PHI is NOT for TPO such as a personal reason. PHI = PROTECTED HEALTH INFORMATION = Patient name, room number, address, phone number, SS#, diagnosis, procedures, medications, insurance, photographs, email address, etc. TPO = Treatment, Payment or HealthCare Operations.
