HIPAA Tip

QUESTION: IS IT A HIPAA VIOLATION/ PRIVACY BREACH OF UNAUTHORIZED USE OR DISCLSOURE OF PHI IF: 1. A patient, family member or visitor overhears hospital staff members discussing patient PHI in public areas such as the cafeteria, hallways, elevators, parking areas? Yes, this is considered a HIPAA violation / patient privacy breach. 2. A staff member obtains patient PHI from another staff member or from viewing or

accessing the patient record for personal reasons and then discloses the patient PHI to others.

Yes, this is a HIPAA violation / patient privacy breach.

3. A patient, family member or visitor overhears a conversation between hospital staff members and the patient and/ or family member, in which patient PHI is being discussed?

No, this is not considered a HIPAA violation IF staff has adhered to reasonable safeguards in protecting the privacy and confidentiality of the patient.

4. A patient, family member or visitor overhears hospital staff members discussing patient

information during unit rounds or shift change?

No, this is not considered a HIPAA violation. If unit rounds or shift change is taking place in the patient room; be sure to ask visitors (family members, etc.) to step out prior to discussing patient PHI. 5. The Nursing Unit electronic “white” boards display a partial patient name?

No, the electronic white boards on the units are used for health care operations only (TPO). Our staff utilizes the tracking (white) boards to communicate

important information relating to patient care. To protect patient PHI, the boards do not display the full name of patients and only display partial names of patients requesting to be aconfidential. The boards do not display the patient age, medical information, procedures or the diagnosis of the patient. Also, Icons are used to communicate specific needs of the patient for staff use only and will not be communicated to patients, family members or visitors.

Some reasonable safeguards include, but not limited to, are: Provide patients with the option to have family members or visitors step out of the room prior to

discussing PHI, treatment or administering procedures. Provide patients and / or family members a private location when discussing patient PHI. Avoid discussions about your patient in public areas or areas where you could be overheard by other

patients, family members or visitors. Be aware of your surroundings and speak quietly when others are around.
